The Traitor Class – by David Horowitz

On Monday night Bill O’Reilly had a representative of the traitor class in his cross-hairs, an episode he re-visited Tuesday night. The traitor class is easily defined as people who can’t identify a self-declared enemy of the United States even after he has killed 3,000 innocent people in an act of self-described holy war and is prepared to provide his talents and services gratis to help the enemy combatant attack this own country.

Scott Fenstermaker is an attorney for Covington Burling, a white shoe law firm which has provided millions of dollars in pro bono legal work to Gitmo terrorists. A Covington partner is the brother of Weather terrorist Kathy Boudin, and the lawyer organizing the Gitmo pro bono defense team is family friend and political comrade Michael Ratner, head of the terrorist-supporting Center for Constitutional Rights, who has spent his life defending America’s enemies and serving anti-American causes.

If you can’t describe the 3000 innocent victims of Khalid Shaikh Mohammed as “murdered” and your first move is to describe your own government’s case as propaganda, and you are devising a case to “justify” the evil deed your client has committed and won’t say that you would be upset if your country were to lose the case, and also if you’re a Jew and don’t have any problem defending an Islamic Nazi who beheaded Daniel Pearl after forcing him to say “I’m a Jew, I’m a Jew” — there can be only one explanation. You believe in the justification defense you are preparing, you think America and the Jews are guilty and deserve what they get, and you are a traitor.

And much worse — only words are inadequate to describe just how low on the human scale you have sunk.

    First let me state my position. The public trail of these war criminals is an insult to the US legal system and Americans as a whole. It is totally politically motivated by Holder and the Obamatible administration he represents. I am confident this president will go down as the biggest liar and the worst president in US history.

    That being said, Fenstermaker made a serious mistake coming on to O'Reilly's program in the first place. Bill will ask the tough questions and really should not ask a defense consul his feelings on his clients charges. Fenstermaker walked a thin line in the interview avoiding any speach that could be interpreted as a pre-judgement of his client. Any public comments he makes that reflect on the guilt or innocents of a client could be a point of appeal or misstrial if a conviction is handed down. Since another attorney could site a defense consuls prejudice against the client. Even one who did not directly participate in the litigation itself.

    While I have no love for Fenstermaker and nothing but contempt for his ignorant, barbarian clients, I regret I must respect his cautious replies to Bill's prodding questions. His evasiveness, while it was “weasally” as Bill put it, it did not give much evidence for prejudice in fact it was the opposite.

    I am an ardent fan of Bill O'Reilly and David Horiwitz and agree almost completely with their philosophies. But because of the radical loopholes the liberal left have driven into our criminal justice system, extreme care has to be used in discussion of criminal cases. Mr. Fenstermaker may well be a “weasal” but you can't fault his behavior on “The Factor”

Mr. Fenstermaker is ashamed of his culture, Judaism. These people always seek to justify their self hatred by bowing to the enemy. However, this is clearly an open and public stage for the perverts to expose themselves on. This Fenstermaker is the typical insidious and pervasive display of mental illness. This is a pattern of self-sabotage, motivated by deep feelings of unworthiness. Psychologically, this man is so easily analyzed in that he falls so simply and snugly into the classic categories of depression, substance abuse, and general anxiety. In short, when a show off rises to announce that he wants to defend mass murderers, he has exposed himself with knowledge aforethought. As a self appointed male cheerleader boy, his self-hatred represents one of the negative consequences of the socialization process itself. Undoubtedly, he is strongly representative of the Cluster B classification of personality disorders; histrionic, narcissistic, borderline, antisocial, and soaked in denial.

    The Obama Legal Crusade where every terrorist, illegal and anyone else will get two attorneys provided by the US taxpayer. All politicians are attorneys and they will create there own job security for future fees. What a great system.

    The problem is that even a patriotic attorney would be compelled to defend zealously these monsters. This is one of the reasons the criminal trial in civilian court is a truly bad idea. There is no good reason in the current circumstances to expose America to the additional threats that will of necessity be brought about by a civilian trial. Even assuming the best case scenario, namely that 1)no jurors or judges are terrorised or murdered by KSM's confederates, 2)that there is no terrorist attack on NYC, and 3)that the jihadists are duly convicted and executed, the trial will be an intelligence bonanza for the terrorists. Copies of documents provided to the attorneys of the terrorists who bombed the WTC and actively planned the destruction of various NYC landmarksin 1993, were found–a decade later–in a terrorist lair in Afghanistan. Chances are we will end up exposing intelligence methods, foreign and domestic intelligence agents, and numerous classified documents. This could set back our efforts to fight terrorists a decade.
    The military tribunal has a long and respected pedigree, and is the proper forum for trying these jihadists. In light of the fact that they have all admitted guilt, and asked to be martyred, we should have granted their desire. Instead, this radical jackass Holder, who has some experience in building a case for granting terrorists reprieve (see the release of the FALN terrorists around 1999), who could have salvaged some decency by resigning when his boss ordered him to carry out so irresponsible a process, has decided to be the point man for a decision that will hurt our national security. But what the hell, the European elite will approve.

Although I essentially agree with Horowitz today about this fuzzy-minded attorney, I recognize that he does not rise to the status of a traitor just because he openly espouses left-wing POVs. He does so fully within the boundaries (which are wide in this Republic) of The Bill of Rights and the light of day. These values, by the way, are the main reason I put my life on the line as an enlistee back in 1965 without hesitation. You can't have it both ways–you can't live in a big-hearted country and advocate small-minded ideas.     Sorry, but this is nuts. The most homicidal scum on earth is entitled to the best defense a good lawyer can mount. (Think OJ Simpson). I say this as an American outraged by the decision to give Mr. Mohammed a criminal trial, a Jew, and a lawyer.

    The good lawyer is an advocate at all times, and in all places, from the moment of retention until it ends. You can't seriously expect Mr. Fenstermaker to make public statements regarding the government's case, or his client, that are less than vigorously supportive of the defense he intends to offer,

    Fenstermaker's opening sallies may or may not presage a good defense, but nothing I've heard attributed to him thus far is outside the ethical limits of a lawyer defending someone charged with a crime in an American court. Those limits don't vary with the gravity of the offenses charged, or with the propriety of the state's choice of venue.

    I don't see why Fenstermaker is the problem. Once Holder decided that KSM was entitled to a criminal rather than military trial, then someone was going to represent him.
    FrontPage regularly features editorials by Alan Dershowitz, who volunteered to defend OJ. OJ murdered Nicole Brown Simpson and Ron Goldman.
    Neither Fenstermaker nor Dershowitz seem to care who their clients murdered.

Our judicial system is not a ” deathcult, ” Islamic terrorists and those who defend or aid them are. Our soldiers on the battlefield are not evidence gathering forensic experts who tip-toe through through cross-fire looking for ways to build a court case in the event they have to fight or capture the enemy. To give foreign fighters all the protections of an American citizen is ludicris. Our Constitution protections are provided for Americans. You cannot cite a case in our history where a foreign ememy was taken from a war theater and given a civilian trial in America. Again, your arguments are either incredibly naive or you survive on Obama's Kool-Aid. There is no good which can come out of the pending trial. Financial burden on taxpayers, propaganda, exposing state secrets are all part and parcel to this sham. Why don't you look up the disgusting conflicts of interest Atty. Gen.Benedict Arnold, Washington's favorite fighting general, gave the British the ground plans for West Point so they could more effectively attack the fort. You would for sure have something to whine about if apple got there grubby hands on the unlock before the release of 4.2.
