For a time, it seemed like the Obama administration might have dodged a bullet in the New Black Panther Party (NBPP) voter intimidation scandal. The case mostly faded from public view after former Department of Justice official J. Christopher Adams testified before the U.S. Commission on Civil Rights in July. Adams claimed the DOJ routinely ignores civil rights cases involving white victims, with its decision to drop most of the charges in the NBPP case providing the most egregious example of this disturbing trend. Administration officials dismissed Adams’ allegations and leftists sought to portray him as a disgruntled ex-staffer with an ax to grind. What was a burgeoning scandal then seemed to burn itself out. The smoldering flames roared back to life on Friday, when Christopher Coates, the former voting chief in the Civil Rights Division, testified under oath before the commission.

The DOJ spent the better part of a year trying to prevent Coates from testifying and even ordered him to ignore a subpoena. It’s now clear why the administration would try to stop Coates from telling his story, for his is a damning tale indeed. Not only did the ex-ACLU attorney back up Adams’ claims that charges were dropped in the NBPP case for political (rather than legal) reasons, he outlined a disturbing pattern of behavior within Attorney General Eric Holder’s Department of Justice. Rather than representing an anomaly, Coates laid out a convincing case that the DOJ’s questionable behavior in the NBPP case is consistent with racially-motivated departmental policy.

In order to put the NBPP controversy in context, Coates went back to a case he got involved in back in 2003: United States vs. Ike Brown et al. That landmark case, involving an election in Mississippi, was the first time that the Voting Rights Act was invoked to protect the rights of white voters who were subjected to racial discrimination by African Americans and other minorities. Despite the objections of some long-time DOJ staffers, Coates and others pressed forward with the case and the courts ultimately found Brown and his co-defendants guilty.

According to Coates, Ike Brown and his allies engaged in “…some of the most outrageous and blatantly discriminatory behavior at the polls…” that he had witnessed in over thirty years as a voting rights litigator. Nonetheless, Coates testified that some career attorneys in the voting rights section didn’t want to take the case, believing that the Voting Rights Act should only be invoked if a minority was the aggrieved party. He added that one African American attorney who volunteered to help out in the Brown case was subject to harassment from some DOJ employees.

    What on earth is happening in America? Has it reached the stage where there are two laws, one for whites and the other for 'minorities'? If that is the mindset of the DOJ then America under the Obama administration is in real trouble. For not only are the laws of the United States being applied to accomodate a far left ideology but they are also being subverted to favour one group of people over another. The dangers of that doctrine are self evident and were apparently removed during the civil rights movement in the 60's. Unless Obama immediately fires Holder, Loretta King and the other misfits in the DOJ who permitted this travesty to happen, the US clearly faces far more pressing problems than merely those related to the economy.

      This is like a propaganda hangover….

      When the newly purged Justice Department under Bush had free reign to file whatever they wanted, they still couldn't bring intimidation or voter fraud charges on the scale the Bush White House wanted. I don't see how it matters. If the people on FPM disagree with an election or fear it's outcome they are already predisposed to question its legitimacy.

      As for the Black Panther case, the guy with the weapon was charged with having a weapon…what kind of earth shattering case do these people want brought? Voter intimidation is very hard to prove until someone comes forward and says they were intimidated into not voting.

        Bush didn't purge the DOJ, and in fact the dp pitched a fit when he fired just eight of them. Perhaps you're thinking of clinton, one of his first acts as President was to fire all DOJ lawyers without reason or explanation and replace them with his appointees.         There are people that will come forward when this marxist government is forced into court on the voter intimidation case, in Philly, make no mistake about that.
        president Soetoro and Holder-the MSM have quashed letting these victims come forth, and the Breitbarts on the right want to delay their exposure until this whole issue moves further along, for their own protection.

        I think the point you are missing is that the case had already been adjudicated and the guy with the club had been found guilty. The DOJ decided to drop the charges AFTER the man was found guilty. I think that even YOU can see something very wrong here, no?

    It's very possible that AG Holder will be forced to step down over this issue because he and others testified under oath that the decision to defer in the prosecution of the Black Panthers was made by lower level DoJ lawyers…and that there was absolutely no political pressure from above. The facts coming out now directly refute such testimony.

    Incidentally, has anybody bother to read PAT BUCHANAN's open letter to OBAMA about us, the SILENT MAJORITY ??? Not that BUCHANAN is a saint of my devotion but at least he dared to call matters for itsright name and I think it is time for the REPUBLICAN Congress, IF THEY ARE WORTH THEIR SALT, to raise enough hell in order to PURGE the DOJ from the scum entrenched there

    Unfortunately, our side doesn't give a damn about institutionalized, codified racism against white working and middle class people.

    If we made an issue of this travesty we would peel off enough white votes so that we would never lose another national election. All we need is to increase our take of the white vote by about 5 percentage points to make this a reality. White union voters are the low hanging fruit needed in this drive.

It seems to me the more egregious injury is the fact that the DOJ has CHOSEN to ignore FOIA requests…and gets away with it. Hugo Chavez has nothing on this administration.

    As a retired DEA agent, I served proudly in the Justice Dept for almost 25 years across Democrat and Republican administrations. This case shows the divide between career prosecutors and political appointees. "Bull" Connor must be laughing in his grave now, but I am ashamed.

    The video of the Coates testimoney is online and it's fascinating (but 3 hours and 40 minutes long). It's time for the US Congress to insist that the DOJ Voting Rights Division enforce the laws even-handedly against both white and black defendents.

    At least one of the DOJ Attorneys testifying before Congress blatently "lied" or misrepresented at the very least his actions or inactions to correct the problem/s.

    The double standard in race relations, particularly in the law, has existed for a long time. When the Bakke case was decided, Justice Marshall told his fellow Supreme Court justices, "You guys have been discriminating for years. Now it's our turn."

    President Reagan extended his hand to Marshall as a de facto spokesman for black people, and Marshall responded by saying that he wouldn't serve as a dogcatcher under Ronald Reagan (although he did continue as a Supreme Court justice, saying when Reagan died that "you shouldn't say anything bad about the dead. Well, I consider him dead.").

    Another think that Mr. Coates testified to was that the Voting Rights Division is refusing to enforce federal law in heavily Democrat and minority areas that requires states to purge their voter lists of dead and moved away people. This obviously has the effect of maintaining a pool of names that aren't going to be voting in local jurisdictions in whose names they can have their activists cast votes. It is beyond belief that this country has an administration that is so blantently disregarding the law and, in spite of credible evidence backing this up, that the "news media" is not even looking into it.

    It is quite one thing to refuse to take a case. It is quite another to say you are not going to take cases, based on the race of the vicitm, especially in civil rights prosecutions. That is an internal problem with DOJ. The bigger problem is some portions of the voting rights act, itself. The most glaring of these is the "preclearance" requirement. Now, voting is a matter that is governed by the state. The voting rights act provides that a state may no discriminate in voting requirements. However, it also requires that state to get "preclearance" from the DOJ, before changes to voting law are made. This goes far beyond any protection against discrimination, and interjects the federal government into an area of state regulation, before the fact. While there are reasonable arguments about the constitutionality of the voting rights act, to the extent it prohibits discrimination, there is no constitutionally delegated authority for the federal government to "preclear" any state action.

This is what happens when black people and minorities are given special treatment all these years. White people are just slowly taking away their own rights by trying to be sensitive to minorities.     Unfortunately there have been times when the DOJ power has been abused for political purposes. If these allegations are true then this clearly is the case here.

    I watched this whole testimony and what a shocker it truly was. There will be no hiding from the facts of this situation and no matter what the so-called what's his name, the illegal worker obamas Bin Ly'n says, he and holder must be brought up on charges. These were political appointee's who made the decision to shovel this under for a good reason. The attorney's who refused to do their job because of the direction of holder and abamas Bin Ly'n should be in prison. Nothing or anyone is above the law in this country, not even the president and the AG. These are the worst of the worse, they set about proving it daily. Judgement day will soon be upon them.
