The NAACP Sics the UN on Our Sovereign States

The National Association for the Advancement of Colored People (NAACP) is petitioning the United Nations to investigate alleged disenfranchisement of black and Latino voters in anticipation of next year’s presidential election. According to the NAACP, which issued a report on December 5, 2011 titled Defending Democracy: Confronting Modern Barriers to Voting Rights in America, more than a dozen states have passed laws aimed at unfairly restricting the constitutionally protected right of black and Hispanic voters to vote.

With the NAACP’s customary race-baiting hyperbole, NAACP President and CEO Benjamin Todd Jealous charged:

It’s been more than a century since we’ve seen such a tidal wave of assaults on the right to vote. Historically, when voting rights are attacked, it’s done to facilitate attacks on other rights. It is no mistake that the groups who are behind this are simultaneously attacking very basic women’s rights, environmental protections, labor rights, and educational access for working people and minorities.

William Barber, a member of the NAACP’s national board, said the new state voting laws constituted the “most vicious, coordinated and sinister attack to narrow participation in our democracy since the early 20th century.”

The NAACP is sending its report to the United Nations. This Saturday it will be conducting a “Stand 4 Freedom” rally across from the UN’s New York headquarters. Supporters are being asked to sign an online pledge which asks the United Nations to “investigate and condemn voter suppression tactics in the United States.” The NAACP is also said to be planning to send a delegation to Geneva, Switzerland to present its case before the UN Human Rights Council. What better forum for the NAACP to use to berate and try to embarrass the United States than the dysfunctional United Nations Human Rights Council, where  57.45% of the members are rated “Not Free” or only “Partly Free” by Freedom House?

We don’t have to imagine what this travesty of an international “human rights” organization will do with the report. Members with such stellar human rights records as Russia, Saudi Arabia, Qatar, Cuba and China will have a field day trying to deflect attention from their own blatant denials of fundamental freedoms to their peoples by turning the United States into a racist oppressor.

Recall that in 2008 Dr. Doudou Diène, who was then the UN’s Special Rapporteur on Racism, went on a UN-paid junket across America to investigate charges of racism in the United States. His information-gathering meetings included officials of the Council on American-Islamic Relations and the far-Left New York Civil Liberties Union and the Center for Constitutional Rights. He also met with Supreme Court Justice Stephen Breyer, who is the leading advocate on the Supreme Court for using international norms and foreign law to interpret the United States Constitution.

It’s no surprise that the UN’s Special Rapporteur on Racism concluded in his final report that “racism and racial discrimination have profoundly and lastingly marked and structured American society.” He went on to say that the “historical, cultural and human depth of racism still permeates all dimensions of life of American society.”

The United Nations has no jurisdiction whatsoever to investigate how the sovereign governments of our nation’s fifty states choose to conduct elections in their states, least of all the UN Human Rights Council. Legitimate recourse for any alleged illegal voter restrictions should be through our own courts and political process, not an unaccountable dysfunctional United Nations body.

However, instead of pushing back at UN interference in our nation’s internal matters, the Obama administration has made things worse. It has conferred legitimacy on the Human Rights Council by deciding to submit its own self-examination of the U.S. human rights record to the scrutiny of the other Council members, including its core group of human rights abusers. Who did Hillary Clinton’s State Department consult when preparing the report? Groups such as the NAACP, the American Civil Liberties Union and the American Arab Anti-Discrimination Committee.

Indeed, the Obama administration provided the NAACP with a convenient passage way to approach the UN body with charges of racism by our nation’s various states when the State Department did its own mea culpa over state immigration laws which the Obama administration vigorously opposes.

Yet when one looks at what the NAACP is actually complaining about, there is more smoke than fire. What we see are mostly good faith efforts of elected officials to foster an honest electoral process in their states, with requirements that are race-neutral.

The following is a table of alleged restrictive voting measures that is included in the NAACP’s report.


Let’s look beyond the NAACP’s loaded characterizations of the restrictions and take a look at some of its specific examples.

One example is Florida’s new requirements regarding third-party registration. The NAACP alleges that such requirements would “place restrictions on nonpartisan, nonprofit organizations that conduct voter registration drives.” What they actually do is to simply require that third-party voter registration organizations register with the Division of Elections and provide the Division with certain information. The Division or Supervisor of Elections then makes voter registration forms available to third-party voter registration organizations and requires that such forms contain certain information identifying that organization. What the NAACP neglects to mention is that the prior law in Florida also required a third-party voter registration organization to name a registered agent in the state and submit certain required information to the Division of Elections. The new law provides for third party organizations to submit their information in electronic format and to turn over applications they collect to the Division or the Supervisor of Elections within 48 hours after the applicant completes the form or the next business day if the office is closed for that 48-hour period.

To demand photo ID is understandable, but to limited existing voting time frames, ie time to resgister, mail in votes etc. WHY , because the more people who vote the less your chances of winning.       You are uninformed and also stupid. The time to register cannot be open ended. You have to register as a voter to get on put the voting list at the poll and that has to be done early. No convicted felons should ever be allowed to vote nor should they ever be allowed to hold a public office of any kind. Democrats want people (even the dead) to vote early and often and illegally because they are outcome driven and not honest process driven. Racism is the dispensing of and/or witholding of privilleges and/or punishments based an a persons race. Examples of racism are affirmative action, the moratorium on the execution of blacks in Maryland, job quotas, admisions quotas, and minority contractor set asides, and the fact there is even such a thing as the "Black Caucus" in the Congress of the United States.

          Here's the facts: EARLY VOTING CAUSES FRAUD. The longer the voting period is, the longer it can be attacked, and the more often it is attacked. That's the way fraud works. The voting period is being shortened TO PREVENT FRAUD. Shortening the voting period IS RACE-NEUTRAL. To claim that shortening the voting period is racist means that you think that blacks and minorities are committing fraud, or are lazy — something you implied, not me.

          Quick quiz for you: which party led the way in granting blacks the right to vote? Which party led the way in protecting blacks' right to vote? For whom did blacks vote for en masse in the 1980 election? Which party opposes telling blacks and other minorities "You can't do it with the gubmit's help"? Which party opposes the self-destructive ghetto culture that celebrates gang violence, drug use, fatherlessness, and crime? Time's up.

Republicans believe that blacks and Latinos are equal to whites and should be treated exactly the same as whites. Dems, on the other hand, believe that blacks and latinos are inferior and unable to compete in this world unless given special privileges, and they certainly do their best to keep blacks on the welfare plantation because they do not want prosperous, educated blacks who would vote republican.       States establish the qualifications for voting. I don't know or care about "should", but if the respective state decides that someone is disenfranchised, because of a felony conviction, that is up to that particular state. They are free to get the law changed, but ramifications of a felony conviction are a state issue.

    This is such a joke. What is it the NAACP not getting enough air time on TV these days? The states should continue to do what is right by their people. Picture ID's can be had and you don't have to be a driver to get one. Make it clear the ID must reflect your current address and be kept up with just like a driver’s license.
    I look forward to the day that non-tax payers aren't allowed to vote. IF you don't pay, you should have no say. This doesn't make you a criminal. It just means you should have no right to determine how tax dollars are spent if you don't contribute to it. Just like I can't tell you how to spend the money in your household neither should you have any say over how our money is spent. Can you imagine how even those that placate this sector would change their ways. For many of them, their entire voter base would dry up.

    Thousands of people including women and children are being held illegally and tortured by rebels who helped oust Colonel Gaddafi, according to a UN report.

    Around 7,000, many of them foreigners, are behind bars in private prisons and makeshift detention centres, beyond the control of the new Libyan government and without access to any legal redress.

    The report by UN Secretary General Ban Ki-moon will be embarrassing for Britain and other governments which supported the overthrow of the Gaddafi regime despite concerns about who would take power in their place.

    The UN said Tawergas are ‘reported to have been targeted in revenge killings, or taken by armed men from their homes, checkpoints and hospitals and some allegedly later abused or executed in detention’.

    The UN also warned that a vast arsenal of surface-to-air missiles, known as Manpads, had been accumulated in Libya, further worsening the security situation there.

      It is a mystery to me, why any black person would choose to be a muslim or would defend muslims in any way. Have they never read the things said of them in the koran? They can start with the word "raisin" in a search engine for the koran (for the ones who have never done so – be prepared to be shocked).

    The NAACP also tried to save the Hi-Fi murderers from death row a number of years back by playing the race on the fact that all the perps were black.

    When they were in prison, all the other inmates, including the other african-american inmates treated them with contempt and they were even taunted by another condemned murderer as they were led to their fates.

This is why colleges all across America are now teaching courses on this huge "racism scam" that has been going on now for eons. Yes, you are right, most of these colleges have named their course "The Great Racism Scam 101", while a few other colleges have named their course "The Big Bad White Man 101". In the end, it doesn't matter the name of the course, all that matters is that a whole bunch of young people have signed-up to take the course and are learning a lot from the course.         I would like to clarify that the one American I admire more than any other on the planet at this time in history is African – American Congressman Allen West and although I think little of the NAACP, I did want anyone to think my views were a wholesale put down on African Americans.

        Sadly organizations like Acorn & the NAACP have only enhanced the "division" of this nation and a "house divided will not stand."

        Like you I am a great believer that the Judeo-Christian heritage was the bedrock that made America great and think you might find the following You Tube documentary fascinating

And on that card is verification of WHO you are WHERE your legal residence is .and Party affiliation .     Having said that , IT ELIMINATES THE POSSIBILITY of voting more than ONE TIME , since your name is checked and you SIGN the voting roll . And since your particular polling place is predesignated according to address and district , you CAN NOT go nto another and vote again, since your name appears only on the roll at your designated polling location . Without a crd , lost or otherwise , you must provide acceptable forms of ID , either a drivers licence or that States Official ID card for non-drivers or those too old to be drivers -AGAIN this is fair , reasonable and Constitutional . YOU NEED EITHER OF THOSE TWO FORMS OF ID TO CASH A CHECK !

      Listen and learn! RACISM is the dispensing and/or withholding of privileges and/or punishments based on a person;'s race. Examples of racism are affirmative action, the moratorium on the execution of blacks convicted and sentenced in Maryland, job quotas, admissions quotas, and minority contractor set asides, and the fact there is even such a thing as the "Black Caucus" in the Congress of the United States.     It's probably just a coincidence that most if not all of these proposed measures negatively impact low income and minority voters. There is simply no other explanation that a most stunning coincidence, though perhaps some of the sharp minds here have some insight that i am missing. I'm very eager to hear.

    And I'm sure the fact that voter fraud is actually a non-issue in terms of its prevalence is really just a Democratic Party conspiracy to keep the white man in his place.

As a state party to the International Covenant on Civil and Political Rights, the United States must report to the Human Rights Committee every five years on its compliance with the ICCPR, which among other things, sets basic standards for democratic elections. Your article here is not factually accurate.

    You are not addressing the issue raised in the article with regard to UN jurisdiction.

    Article 40 of the ICCPR provides for the submission to the Human Rights Committee (now the Council) by the treaty State Parties of "reports on the measures they have adopted which give effect to the rights recognized herein and on the progress made in the enjoyment of those rights: (a) Within one year of the entry into force of the present Covenant for the States Parties concerned;
    (b) Thereafter whenever the Committee so requests."

    As my article noted, the Obama administration submitted such a report. The issue here is whether the Human Rights Council or any other UN body has jurisdiction to act upon a complaint from a non-governmental organization and investigate how any of our fifty sovereign states determine to conduct elections within their own borders, particularly when our domestic courts have not been given an opportunity to first hear and decide the matter. Neither the Human Rights Council or any other UN body has such jurisdiction.
