Obama Threatens Florida over Purging Non-Citizen ‘Voters’

Last Thursday, the United States Department of Justice (DOJ) reached a new low in its efforts to prevent individual states from combating vote fraud. The state of Florida was ordered to halt its efforts to identify and purge its voter rolls of non-citizens. “Our records do not reflect that these changes affecting voting have been submitted to the United States District Court for the District of Columbia for judicial review or to the Attorney General for administrative review as required by Section 5 of the Voting Rights Act,” wrote T. Christian Herren Jr., the DOJ’s lead civil rights lawyer. “Accordingly, it is necessary that they either be brought before that court or submitted to the Attorney General for a determination that they neither have the purpose nor will have the effect of discriminating on account of race, color, or membership in a language minority group under Section 5.”

Florida is not backing down. Despite being given until Wednesday to decide whether or not to comply with the DOJ’s order, it took state officials only one day to reach a decision. “We have an obligation to make sure the voter rolls are accurate and we are going to continue forward and do everything that we can legally do to make sure than ineligible voters cannot vote,” said Chris Cate, a spokesman for Florida Secretary of State Ken Detzner on Friday. “We are firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot. We are not going to give up our efforts to make sure the voter rolls are accurate.”

Section 5 of the Voting Rights Act requires the DOJ or or a three-judge panel of the United States District Court for the District of Columbia to “preclear” changes in “any voting qualification or prerequisite to voting, or standard, practice, or procedure with respect to voting different from that in force or effect on November 1, 1964,” in order to prevent “denying or abridging the right to vote on account of race or color.” Florida is one of a handful of states, predominantly in the South, covered by Section 5, due to its historical efforts to suppress minority voting. Critics contend Section 5 continues to stigmatize states that have long abandoned tactics such as requiring non-white voters to pay a poll tax or pass a literacy test. The Act contains a bailout provision for states that can demonstrate a record of good behavior, yet many counties within those states consider the cost of doing so prohibitive.

Earlier this year Secretary Detzner worked with the Florida’s Department of Motor Vehicles to identify more than 2,600 people who were registered to vote despite being non-citizens at the time they applied for a driver’s license. Critics of the effort claim that many of those drivers become citizens between scheduled license renewals. They further contend that many of the warning letters sent out by state notifying these individuals that they would be purged from voter rolls unless they provided proof of citizenship within 30 days, were sent to people who were citizens.

Detzner, who contended that earlier efforts by his agency had identified 182,000 voters who were non-citizens by comparing voter rolls and driver’s license databases, revealed that he and his staff were refused access by the Department of Homeland Security (DHS) to the federal database containing more up-to-date immigration and citizenship information. Thus, it would appear that the federal government is working at cross-purposes with itself: the DHS won’t assist Florida in its effort to be as non-discriminatory as possible, even as the DOJ insists that Florida is engaging in discrimination. And not just with respect to Section 5. The DOJ also contends Florida is violating the 1993 National Voter Registration Act that requires states to maintain “accurate and current” voter registration lists “in a uniform and non-discriminatory manner.”

Yet if testimony by former DOJ Voting Section attorney J. Christian Adams before a House Judiciary Subcommittee is accurate, the DOJ’s efforts in Florida are as hypocritical as it gets. “One of the most unfortunate circumstances relating to the 2012 elections is the absence of DOJ enforcement of Section 8 of the National Voter Registration Act,” Adams told the Subcommittee. “Voter rolls nationwide are filled with ineligible and dead voters. Yet the Department of Justice is deliberately refusing to enforce Section 8 and require states to purge rolls because of philosophical disagreement with the purging statute. Failure to enforce Section 8 to require states and localities to clean up voter rolls presents a troubling circumstance prior to the November 2012 elections.”

    Support VALID PHOTO ID voter legislation….it is the only way to make sure voting is fair, honest, legal etc
    I needed to show a photo ID to rent a rug shampoo machine….surely, I should have to show a valid ID to vote!!!

      But you can get a valid photo ID and still be in the country illegally. That is one of the biggest problems. This should be handled in a two step measure in my opinion. First, if you are not a legal US citizen (here legally but not a citizen) it should be printed across your ID just like most states do if you are below the legal drinking age. THEN require a photo ID in order to vote. IMHO, illegals shouldn't be given an ID of any kind, especially a DL, but if they are (as most states do anyway) it should also have the Non-Citizen water mark.

    Photo ID's are not difficult to get.Most states have programs that assist people in getting an ID.Since you need 1 to do everything from file for welfare to buy cold medicine ,Holder's voter fraud program is blatantly obvious .

    Btw determining a persons race by reading their last name is presumptive,prejudicial and extremely racist.The government consider race as self determined .There is no measurement to grade racial content.Governments and media have no right to determine race by a name.Just ask George Zimmerman who was labeled a white Jew before his personal info was known.

      My son's mother is from Spain which the Moor's invaded centuries ago so I'm not sure what classification he falls under. What I do know he is an American citizen and a human being. Other than that, his attitude towards others is what counts the most.

    The Administration and the DoJ are doing this because accurate voting roles make it much, much more difficult to find a box of 3,000 ballots that are uniformly Democrat.

    Right now the real threat of voter fraud does not come from non-citizen voters. For the real voter fraud, look to the RNC and the delegate vote count. Romney is going to LOSE the delegate vote. Paul is going to WIN the delegate vote. Already the RNC has:

    rejected the straw poll results
    rejected the previously cherished Iowa results
    rigged the Iowa election
    eliminated entire districts' voting tallies
    stolen ballot boxes
    closed down primary rallies where Romney was losing
    tried to force delegates to agree beforehand to vote Romney
    dislocated the hip and broke the fingers of the duly elected chairman of the Louisiana Republican Convention

    Now finally, they are losing the delegate vote as Al Gore did, but they will arbitrarily appoint Romney as the winner and discredit the DELEGATE vote whereas previously, they discredited the POPULAR vote.

    Therefore, the real voter fraud will be coming from the Republican Party Leadership. If Mr. Ahlert ignores that, then he really SUPPORTS voting fraud.

    Photo IDs alone are not good enough as shown by the article. Many people with drivers licenses and other State Issued IDs are illegal aliens and are not eligable to vote. So in my opinion these voter roll purges are necessary to insure the integrity of our elections. Holder is conspiring to commit voter fraud and should be charged with felonies when the next Attorney General takes office. Not just for enabeling blatant voter fraud by Illegal Aliens.but also for the Fast and Furious debacle and failure to prosecute Balck Panther voter intimidators.

    My 12-year old son was registered as a Democrat in 2008. He, or I, received five calls from the Democrats which I recorded. On the third call I informed the worker and still received two more calls. IN 2010, I, or my son, started getting calls in September so I informed a State election official at our local State Fair. He took my name, and my son's, phone number and I never received a call for SS# or any info. I got five calls total on that series with the last one being an hour before the polls closed. NOW I CALL LOCAL AND STATE OFFICIALS and they seemed concerned BUT I SUSPECTED THEY WERE DEMOCRATS TOO due to their type of questioning.

    NOW IN 2012, HE is still getting calls for the primaries and one from Obama. NOW IT'S THREE DIFFERENT FIRST NAMES AND STILL CHAVEZ FOR THE LAST NAME. One yesterday was for a female. WTF!!!!!!!!!!!!!!! I've called the media for years, no story. DEMOCRATS?

    The Voting Rights Act, on the face of it, is Unconstitutional. Any Federal Law which applies to a selected few of the States or subdivisions of States violates equal protection of the Law. That statement is True, regardless of what any Court says otherwise. The Sates should take back some of their 10th Amendments Rights. That also includes State Land Stolen by Federal Fiat. Nowhere in the Constitution does it say the Fed Government can steal State Lands. States, take back our Lands.

    No doubt there's some law somewhere that requires states to help fund and administer federal elections held on their territory, but just in case there isn't, is there some reason why, if the United States government is going to the trouble of suing states (who generally have the power to regulate elections) over voter identification, the states have to contribute money, time, people, and space to federal elections?

    I mean, it could be "sue us and run your OWN damn elections, feds."

    1. Buy firearms. Lots of them – short ones, long ones, etc. The battle between the good and evil is coming. Maybe not in our lifetime, but it is definitely coming.

    2. Vote. The more of us vote, the better chances we have of tipping the scale in our favor, despite the long democrat tradition of voter fraud.

    3. Talk to people around you. Some will refuse to hear you, so move on to the next person. There is a large number of Americans who would be willing to pause and think about your ideas. All it takes is a good storyteller. Ben Shapiro, who is a frequent contributor to the Front Page Magazine and an unbelievably intelligent and articulate writer, once correctly noted that an emotionally charged and personal story will travel right to the hearts of people. All that needs to happen is for your story to spark a thought in the mind of a person.

    It is VERY disturbing that the DOJ works in such unlawful ways of denying states their right to uphold both state and federal election laws…what a bunch of hypocrates. Even more disturbing is what I've heard- the vote counts for the 2012 election will be conducted overseas by a Spainish auditing group, not even counted on US soil…WTF??

    The voter rights Act is Unconstitutional on the face of it. Equal Protection of the Law is violated by requiring only a few states to obey this law. And then even subdivisions of those states. The States should tell the Federal Government to Stick it where the sun doesn't shine. Make them deploy troops if they think it is so important to violate the Constitution. Then secede from the Union on justifiable grounds.
