Supreme Decision: The Best Possible Result for 2012

David Horowitz was one of the founders of the New Left in the 1960s and an editor of its largest magazine, Ramparts. He is the author, with Peter Collier, of three best selling dynastic biographies: The Rockefellers: An American Dynasty (1976); The Kennedys: An American Dream (1984); and The Fords: An American Epic (1987). Looking back in anger at their days in the New Left, he and Collier wrote Destructive Generation (1989), a chronicle of their second thoughts about the 60s that has been compared to Whittaker Chambers’ Witness and other classic works documenting a break from totalitarianism. Horowitz examined this subject more closely in Radical Son (1996), a memoir tracing his odyssey from “red-diaper baby” to conservative activist that George Gilder described as “the first great autobiography of his generation.” He is author of the newly published book The Great Betrayal (Regnery 2014), which is a chronicle of the Democrats treachery in the war on terror before 9/11 to the death of Osama bin Laden.


Politically speaking there couldn’t have been a better Supreme Court decision. If Obamacare had been declared unconstitutional, the Democrats’ campaign in November would have been those horrible Republicans have politicized the Supreme Court and denied affordable healthcare to everyone. The focus would be on the court’s “unfairness.” The Democrats would have a plausible if unfair case (and in politics lack of fairness is a given). Advantage Democrats. Advantage because the last things they want to talk about are Obamacare and taxes. And that’s the second big plus from this decision. The focus – thanks to Justice Roberts – is going to be on the biggest tax increase in human history on everyone, not just the rich. And on the lies of Obama which dwarf those of Clinton. Obama promised no tax hikes on the middle class and then defended Obamacare before the Supreme Court as …. a tax.

As for the constitutionalists. Roberts’ argument makes sense to me. Yes the power to tax is the power to destroy, but it’s in the Constitution. So this decision doesn’t really change anything constitutionally. If you don’t like Obamacare, the remedy is to repeal it. Let the elections begin.

        Anyway, I think a lot of conservatives are trying to spin this to rally the troops, or they are trying to wish away reality, but this ruling is not good for conservatives, much less the best possible result. Now the Dems can say that even "reasonable" Republicans like Roberts are OK with ObamaTax, and only "radical" Tea Party conservatives are against it. And Romney can't really argue against this coherently, because he is a "reasonable" Republican who came up with a health care plan much like it. All he can say is "ObamaTax BAD!!!", and continue to dodge why ObamaTax is bad while RomneyCare isn't.

      I disagree. To spin this as a win for Repubs is not reality. It gives Obama the leash to say that Obamacare has been ruled constitutional, and we have been knifed in the back by Chief Justice Roberts who instead of applying the law, decided to rule on what would make his court look better for his legacy. When even Justice Kennedy, the least partisan of any of the justices proclaims the whole law unconstitutional, it is clear that with Roberts vote if would have been. It may temporarily stir up the base, but unless you like this hodge podge of regulations, it is a solid defeat for Repubs who wanted the Court to strike it down.

      Romney’s plan did not take $500 billion away from Medicare funding for today’s seniors. First of all, while it does tax people, in the same way Obama's mandate is a tax. A recent report shows that we as a State spent over $400 Million last year for emergency romm visits as those listed as "Out of Staters" aka Illegals. Also, my premium has gone up over 300%, 4 times faster than the National average. It is also scheduled to go up again this year by 40%.

        Heere's the deal. Romney needs to start telling it like it was. Our Legislature is 92% Democrat, this was their bill. And the Speaker of the House at that time is now serving 8-10 in Federal pen for taking bribes. Romney however gladly signed it while sitting beside the late Edward "Teddy" Kennedy. When Deval Patrick took over, he made changes and it got worse. That is the true story of Romneycare. He should apologize to Mass residents for it.

      Actually, Romney himself can say, the voters wanted it so we did it on a state level. Now we know that costs are way beyond the projections and that Mass. residents pay more than any state, whereas most states are already being crushed by the costs of Medicare. He can definitively say, that if it has been a disaster for one state, it should have been a clue that it would not work for 50 states under the governance and bureaucratic prowess of the Federal Government. Many in the the medical industry will choose to refuse government plan recipients because the work vs. costs to treat, isn't worth it. Many doctor's will not take Medicare patients now. You will have to find hospitals, like public welfare hospitals who have agreements with the government, to treat you. You will no doubt face shorter lines, better care and the very best in technology to treat your illness in a timely fashion. I will not be a SLAVE!

      Actually, the Republicans put forth common-sense health insurance legislation in HB 3400, led by Tom Price (R-GA 6). It was light-years ahead of the PPACA, or "ObamaCare" – rather "ObamaSnare," which is designed to slowly collapse into an inefficient and corrupt single-payer system. Why did HB 3400 not go further? Well, it was a free-market approach which gave people choices, and so Democrats did not like it.

      Remember, a truly free market is but the economic side of free expression.

    Perhaps Congress can pass the Lawyer Tax next year. Every year lawyers will be required the Federalist papers or pay the Tax. Judges will also be required to take a test on the Federalist papers or pay an additional Tax. We can throw in the Gun Tax – buy one for safety and healthcare spending reduction or pay the tax. Tax or No Tax there is still a MANDATE. We are now owned by the government.

      Yes, and at one time the U.S Supreme court ruled that slavery was legal, several decades later they also ruled that segregation was legal, as were police wire taps without warrant, all have been overturned by later courts and or the legislative process.       Most of the people involved; media, patriots, etc., know enough about the Constitution, that they were positive the Court would overturn the Mandate. Who of them could guess the convoluted workings of Chief Justice Robert's mind. He said yes the mandate is unconstitutional using the commerce clause and penalty…but says he…I have searched and it can be made constitutional by calling (rewriting it as) it a TAX and the government's constitutional authority to tax. Roberts is one of three things: 1) has some mental or medical problems that affect clear thinking; 2) was in fear of his and/or is family's lives; or 3) he's another David Souter in patriot's clothing (the Bushes seem to pick those)

And no, the pure free market by itself does not work, because the health care businesses lose $$$ everytime someone uses a medical service..Right?….The free market only works when a business makes $$$ when the service is used…therefore the free market model of healthcase needs some additional aspects baked into it to take these unique factors into account….So, what is the GOP/Romney plan?

    David is good at focusing on the Marxist within the system, but like so many others, he only sees the outside of the nut, the shell and not the inter workings or the root cause. David for years has struggled in himself for his belief. Brainwashed by the communists, he still finds it difficult to accept or even discover the inner truth. Glenn Beck has the same issue as David. Both are great men for standing against the communist propaganda machine, however there is on chink in the armor of the Marxists that they both have missed, There is one thread which makes all the actions of the Marxists unconstitutional as it relates to the 1st amendment. If they would simply wake up to this truth then they would be truly guiding America down the right pathway.

    What is that common thread? The Apostle Paul warned of it in two places in the new testament. First was his engagement of the believers in a specific doctrine which occurred in Athens and is documented in the 17th book of Acts, the companion to that engagement in Athens as well as observations elsewhere is Colossians chapter 2. The word philosophia is only used in those two specific biblical texts, never again in all the written word. The doctrine of Athenian philosophia, especially the use of the dialectic stands as the basis for the beliefs of Hegel and his students which include Marx & Engels as well as Feuerbach, The Bauer Brothers and Sterner. This is the thread which is common among progressives, Marxists, Leninists, socialists, communists, progressives, Darwinists and a whole host of others which include believers in Liberation Theology. Bring this fact into focus and you will have accomplished something which could very well save this nation. People simply do not understand that the Federal Government is being used to assimilate the people under one doctrine. Congress is making law in respect of a religion and that religion is Athenian philosophia doctrine.

    There is a logic to what you have stated, and I hope the logic works out as you stated. That logic does not excuse the chief Justice for jumping from the creation of Obamacare under commerce to its constitutional acceptance as a tax. Obamacare is unconstitutional under any circumstances. It is clearly beyond the pale.
    Roberts and the socialist crew who signed it into law need to be impeached and convicted of Bad conduct for that piece of work. Congress must repeal it whle the Roberts, our own Vicar of Bray, and his socialist asssociates are being led out.

    "Those horrible Repooblicans" ought not to pass the decision to the Supreme Court at all. They ought to aggressively vote down the unconstitutional health care bill in the Congress in their time, which they did not do. Therefore yes, the Repoobs ARE horrible, without any sarcasm.

    How can a tax increase follow from the US Constitution which explicitly enumerated just a few particular things which the Federal Government can control, and Health care is not among them?

    And how can any tax increase follow from the Constitution if the taxes then were not imposed on the US citizens at all, but were collected as tariffs of foreign trade instead?

    You argue as a yes man and lackey of the party rather than a conservative, and definitely not as a constitutionalist (which you have never been).

    I wish I could share the optimism, but since Obamacare and Obamamnesty, his polling numbers have increased. Most importantly
    with the complicity of the MSM, the public is being fed Obama’s
    campaign talking points. The health care bill is Constitutional, the
    penalty is not a tax, millions will benefit, amnesty was the right thing to do, the attack on Holder is racist, and Fast and Furious an unfounded election year ploy. The praise Obama’s gets for ignoring the Constitution is more frightening than terrorists.

    Government has failed on just about any domestic social problem it has undertaken. Take for example its failure in the “Great Society” which created two massive programs that have failed miserable — the “War on Poverty” and Federal Aid to Education! I am not aware of the amount of money spent on education but I do know that we are 25th in the world in science and math!     Man oh man, David. I have admired you for many years but this is absolute nonsense. Robert's argument makes sense to you? You've got to be kidding! He did exactly what conservatives have been railing against the liberal members of the court for doing. He legislated from the court. He HAS NO CONSTITUTIONAL AUTHORITY to change a law that was duly passed by the Congress and signed by the president into law.

    Obama said it wasn't a tax. The democrat members of Congress said it wasn't a tax. They were lobbied by their constituents on the basis that it wasn't a tax. And now Roberts comes along and says it is a tax and it's OK. I think you need to read the dissent.

    Also, Roberts said that Congress can only pass laws that fall under the enumerated powers of the Constitution. Perhaps he should be reading what the judiciary is allowed to do. Roberts is a hypocrite, and his ruling is nothing less than tyranny. When he took his oath of office he perjured himself through his teeth. Just another dishonorable judge who threw his reputation in the sewer.

    Great post, David. Conservatives would do well to be patient. The term "crazy like a fox" comes to mind regarding the decision.

    Then there's the whole other issue with this new "tax" called Obamacare law (which, by the way, WILL raise TAXES)…it originated in the Senate. Tax laws are to originate in the House, according to the Constitution. It remains to be seen if this will become the issue that makes Obamacare UNconstitutional. Someone needs to challenge it now on those grounds. Let the lawsuits begin.
