The DOJ’s Curious Foray into the ‘Knockout Game’ Fray

2D9769936-today-rossen-knockout-131125-01.blocks_desktop_mediumTwenty-seven-year-old Conrad Barrett of Katy, Texas has been charged with a hate crime by the U.S. Department of Justice (DOJ) for allegedly targeting a 79-year-old black man as his “knockout game” victim. The victim suffered two jaw fractures in the November 24 assault. “Suspected crimes of this nature will simply not be tolerated,” said Kenneth Magidson, the U.S. attorney for the southern district of Texas. “Evidence of hate crimes will be vigorously investigated and prosecuted with the assistance of all our partners to the fullest extent of the law.”

According to the complaint filed by the DOJ, Barrett recorded a cell phone video of the attack in which he remarked, “the plan is to see if I were to hit a black person, would this be nationally televised.” The complaint also states that Barrett allegedly showed the video to other people and that other videos contained on the cell phone confiscated by police included Barrett using the n-word and insisting that black Americans “haven’t fully experienced the blessing of evolution.”

As a result, Barrett has been charged with one count of violating the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act. If convicted, he will be facing a maximum of 10 years in prison and a $250,000 fine. “It is unimaginable in this day and age that one could be drawn to violently attack another based on the color of their skin,” said Special Agent in Charge Stephen Morris of the FBI’s Houston office. “We remind all citizens that we are protected under the law from such racially motivated attacks, and encourage everyone to report such crimes to the FBI.”

There is no question that the assault attributed to Barrett was heinous and likely motivated by racial animus, but the Washington Times addresses the other issue that is undoubtedly on the minds of many Americans. “The ‘game’ has spawned a fierce debate since many of the reported victims have been white and their assailants have been black, but hate crimes charges have been all but non-existent,” the Post states.

Although there have been several incidents in which it would seem apparent that racial hate was a motivating factor — especially when one considers that other nicknames used to the describe the knockout game are “polar bearing” or “Get the Jew” — an extensive Internet search by this writer failed to turn up a single other incident where the U.S. Department of Justice pursued hate crime charges against anyone allegedly involved in the knockout game.

Not that it would have been impossible to do so. As New York City Police have noted, there have been eight knockout game attacks in Brooklyn, some of which are being investigated as hate crimes by city authorities. All of the suspects are black teens. Twenty-eight-year-old Amrit Marajh was actually charged with harassment as a hate crime by New York authorities for punching a 24-year-old Orthodox Jew.

And those are just recent incidents. According to the DOJ complaint filed against Barrett, there have been knockout game incidents going back as far as 1992. A study conducted by the Department of Justice’s Bureau of Justice Statistics asserted that more than 250,000 Americans over the age of 12 are victims of hate crimes every year, of which one third are reported. That means there are 83,000 reported hate crimes per year. If one ten-thousandth of one percent of those hate crimes involved some version of the knockout game, the Eric Holder-led DOJ would have had at least 41 other opportunities to pursue federal hate crime charges during the five years the Obama administration has been in charge.

“The ‘knockout game’ — and the media underreporting of it — combines the breakdown of the family with the media’s condescending determination to serve as a public relations bureau for blacks,” contends black American columnist Larry Elder. Elder points out that both National Public Radio and the New York Times have labeled such incidents as overblown. He further notes that, following an incident where 30-40 black youths and adults attacked three white girls in Long Beach, CA — with eyewitnesses reporting the mob yelling, “We hate white people, f*** whites!” as it occurred — NPR didn’t report the incident for a month. When they did, it was used to question “whether blacks, given America’s history of racism, can even commit a ‘hate crime,” Elder explained.

Americans would be disturbed to learn how those in charge of the DOJ would answer the above question.

For instance, upon taking office, former head of the DOJ’s Civil Rights Division, Thomas Perez, declared that the department’s mission would be to focus on legal activism on behalf of minority groups, including illegal immigrants, “people of color” and Muslims, among others.  As Byron York wrote of Perez’s appointment at the time:

He is promising a huge increase in prosecution of alleged hate crimes. He vows to use “disparate impact theory” to pursue discrimination cases where there is no intent to discriminate but a difference in results, such as in test scores or mortgage lending, that Perez wants to change. He is even considering a crackdown on Web sites on the theory that the Internet is a “public accommodation” as defined by the Americans with Disabilities Act.

DOJ whistleblower J. Christian Adams has extensively documented the level of poisonous ideology that has infected the department under the direction of Eric Holder, who has turned the agency into a lawless tool of racial politics.

Take, for example, the gang of 30 rampaging individuals who terrorized the Iowa State Fair in 2010. Eyewitnesses reported that they were yelling it was “beat whitey night,” while they roamed the grounds looking for people to attack. A similar incident occurred at the 2011 Wisconsin State Fair in Milwaukee, where eyewitnesses also identified a mob that injured several people as “young African American teens.” The DOJ didn’t even investigate either incident, much less pursue hate crime indictments. Contrast this with the DOJ’s role in helping to organize the racial lynch-mob calling for George Zimmerman’s head in 2012 over false charges of law enforcement racism. According to Holder, the DOJ is still considering ways to charge the acquitted Zimmerman.

If the Barrett case were the beginning of a trend of the DOJ equitably prosecuting these brutal and senseless crimes as hate crimes, then that would be all well and good. However, the notion that the DOJ’s newfound interest in prosecuting this particular type of violence is colorblind remains doubtful. A Department led by a man who dismissed America as a “nation of cowards” because we wouldn’t have a “national conversation on race,” even as his efforts to pursue selective, race-based justice has been chronicled by a former insider, no longer gets the benefit of the doubt.

    Yes Black people are capable and have actually committed many hate crimes, yet they don’t get charge as hate crimes. The Media are the real cowards for not letting the axe swing both ways on race related violence. Of course their is a right way and wrong way to balance the scales. Clearly, our country isn’t brave enough to take a shot at striking a meaningful and recognizable balance on handling minorities and whites with the same level of seriousness on hate crimes. Black people or any other race group does not need special treatment when they commit the same crimes as white people. All races need to be held accountable and should have nothing to do with their color. It should be about criminal intent and having evidence to support any claims made about said intent, when filing charge in accordance with the nature of the crime committed.

    I’m black and I have come so close to knocking out another black person for being racist towards white people. So many times I’ve heard young black men claim they hate white people because they believe white people are racist towards black people. I hate reverse racism and race related ignorance. I would love to play the knockout game to knockout every black, white, hispanic or other race of person that reveal themselves to be racists. Racism has no limits to who can be racists, ignorance comes in a flavors, and they all can kiss butt of America the Beautiful Melting Pot of racial and cultural diversity.

      Well said! Justice is supposed to be blind and all Americans are supposed to receive equal treatment before the law. When the DOJ fails to enforce laws equally then it has violated its mandate. Holder should be impeached and, if found guilty, disbarred. He should lose his government pension along with any other government perks he may have received. Criminal charges, if any are applicable, should be brought against him as well. All the attorneys in the DOJ should be vetted and fired if they did not uphold all the laws of the land equally. We need to demonstrate that in this country everyone is subject to the rule of law no matter who or what they are or believe.

        Note that Attorney General Eric Holder dropped the case against the New Black Panthers who were intimidating voters at a poll booth in Philadelphia – even caught on video doing so. The case had been brought by the Bush administration. J. Christian Adams writes about this in his book INJUSTICE.
        Attorney General Holder is a dishonest, black racist.

    I grew up in the military, I can remember my farther and his comrad in arms complaining when Harry Truman opened the doors for blacks to be integrated into military units. When I entered military service, I found no racism, some of my best friends were not of my race. The Civil Rights movment set the military on edge. Then came EEO, and the government started promoting unqualified non-white people into jobs they were not suited for, even the blacks in uniform were complaining about the inequality of civilian support jobs on military post. Even here there did not seem to be discrimination between the races. Watts, Cleveland, Rodney King…did not seem to make a difference; in Vietnam, the balcks tended to isolate themselves from the non-black ranks, still there was no conflict. And now, we have a president and DOJ who are actively promoting racism. Our Harvard professor, Zimmerman, and now the knockouters. It is not the people, it is the government. I would encourage everyone to stand against this senseless practice and demand non-racism of our government.

    Eric Holder’s DOJ has 3 years left to show if they are going to prosecute all Hate Crimes. As the author points out they will get 41 chances a year to show they can equitably prosecute the Hate Crimes involving the Knockout Game.

    A mere 1 or 2 prosecutions a year will show a definite trend of omission not equal justice.

    This is the culmination of fifteen years of efforts led initially by Elena Kagan and Eric Holder under Clinton to destroy the concept of equality before the law and to shift public attention from crimes committed by minorities to largely minor or misrepresented incidents.

    Hate crimes laws were and are the engine of this destruction. Also to blame, prominently, are the original members of the hate crimes coalition that was empowered to “define” these laws for prosecutors and police, and who have been training these groups ever since to enforce the law inequitably: Abe Foxman’s ADL, the HRC (gay group), the NAACP (which played a smaller role, because they could), the SPLC, the Simon Weisenthal Center, and an alphabet soup of smaller ethnic lobbies — MALDEF and La Raza have taken on bigger roles of late. These are the organizations who should be blamed for creating and imposing the toxic regime in which whites and women are counted as lesser in the eyes of the law.

    But we feed this system by accepting the entirely manufactured statistics labelled “hate crime” by the DOJ. Before the word went out not to speak to me, state administrators responsible for collecting the material for the DOJ were quite upfront about their view that these numbers are utterly manipulated. To accept the stats is endorsing the fraud.

The James Byrd case in point, Mr Byrd did NOT deserve to die, regardless of his color. His killers deserved to have the book thrown at them, regardless of their color. They got the death penalty. What more could they have been given with “hate crime” laws? There’s nothing higher than death but it never stops them from dragging him out (no pun intended) when the subject comes up.

      It seems odd, but white Americans are apt to weigh their legal position ahead of their safety. When “Beat Whitey Night” was held at the Wisconsin State Fair people were in a state of shock that it was happening because for the most part they are pro-diversity, multiculturalism-worshipping leftists. So why on earth would blacks attack them? They’re the good guys!

      Yea, but they weren’t black. And that’s the key to black racism; it is TOTAL.

      The only families who escaped without injuries were able to conceal themselves. I can admit that even if I had a gun, I would be more inclined to hide my family than go into the conflict. Might be different if I was at the fair alone or with a group of other armed men.

      The guerilla tactics will lead this to some sort of conclusion. The numbers might make it seem obvious. But the law really is looking the other way. So most white Americans are well aware that the courts are a crap shoot. It will take a substantially hideous set of events to finally break this situation open. Though I wonder how bad it has to be when I consider the hideous events in Knoxville.

      Also remember that any pro-white organization of any kind, even a garden club, will be labeled as racist and set upon y press, slimy lawyers and lots of in your ace diversity. And just try to form a “secret” club of any size if you are white.

    The DOJ doubled down when they brought in the Matthew Shepard and James Byrd Jr Hate Crimes Prevention Act when we know clearly know that two men who murdered Shepard were both gay and drug addicts.
    Gay journalist Aaron Hicklin, writing in The Advocate asks, “How do people sold on one version of history react to being told that the facts are slippery — that thinking of Shepard’s murder as a hate crime does not mean it was a hate crime? And how does it color our understanding of such a crime if the perpetrator and victim not only knew each other but also had sex together, bought drugs from one another, and partied together?”

    The idea of a “hate crime” is ludicrous in that it makes the motive the crime. Hate is a motive and, like lust for money is the motive for robbery, we do not prosecute robbers for lust but we have now decided to prosecute assailants for motive.

    If anything, the motive of hate should be used to further re-enforce the prosecution of an assault and not become the crime itself.

      No, and the reason why is because the top charge is murder – a top-class felony in every state, DC, and the federal level. Hate crime laws are designed to enhance the punishment for a crime by a felony count, but you cannot enhance a charge of murder, as there is no higher class of felony to which to enhance it (that is, there is no such thing as a Class A+ felony).

    Matthew Shepard was not the victim of the media and left created, “homophobia.” He was a meth dealer, and those that killed him were clients, and also his gay sex partner. They were homosexual and drugs were involved.
    A book just came out about it recently, and the left is trying very hard to cover it up. He was not the saint they made him out to be.
    There was no internet to get the truth out then, but there is now.

    Everything is fake in this country right now, from this president, to a black Santa at Macys, and they want everyone to believe only whites are racist and everyone’s homosexual.     Holder’s a crazy with a chip on his shoulder, and I hope in time, it’s knocked off. He should be charged with treason for trying to frame Americans in Fast and Furious, killing hundreds, including two federal agents. He should hang from the tallest tree. Do you think that’s why the left is trying to introduce a bill to end the death penalty for treason? Because there may come a day, when the tables turn on them, and they’re finally punished?

        Historically, these kinds of crimes have never been the original jurisdiction of the feds, however. They almost always start out as a state investigation. The feds may get the case later on, but vis a vis these instances, unless there is an additional federal matter involved, nothing will be enough for an original federal evidence.

        As such, I see no problem with the lack of a DOJ investigation—so long as the state did an investigation.

You can be sure that if it was Caucasians doing this to blacks or other people of color, it would be an “epidemic” of racial hatred.         That – video – is essentially the level of evidence you would need to win a conviction on a crime as a hate crime…self-incrimination and itent to carry out the act on someone of a different race, creed, ethnicity, national origin, or on the elderly. By contrast, a nickname on social media wouldn’t be admissible unless the suspect owns up to it.

        As for cases where the feds didn’t pursue charges—if the state gets to the suspects first, the feds are barred by double jeopardy from then entering the situation…even if the hate-crime prosecution is unsuccessful at the state level or there is a plea to lesser charges. A proper argument that demonstrates DOJ bias on this issue would center around cases in which the feds, and not state authorities, had original jurisdiction.

No one is arguing that blacks shouldn’t be punished for assault.

    We need new hate crime prevention legislation in order to prevent atrocities like the “knockout game” from happening again. But we need real hate crime prevention legislation, not the so-called “hate crime prevention” legislation promoted by the left that focuses on only certain categories of people. In all cases, we need effective legislation to address this massive problem. Behold the Jesse Dirkhising and Ken Tillery Hate Crimes Prevention Act. This proposed legislation would not only combat all hate crimes, regardless of who commits them,bt will also require a watchdog to keep an eye on the left/MSM/academia for any biases regarding hate crimes. This proposed legislation is named after Jesse Dirkhising and Ken Tillery, two people whose stories were buried by the left/MSM/academia because of the extreme level of political correctness that is predominant in this country today. Jesse Dirkhising was a straight teenager who was killed by two homosexual men in 1999, while Ken Tillery was a white Texas man who was killed in 2002 by three black men in a similar fashion to how James Byrd, Jr. died (dragging death from a car. Coincidentally, the crime happened in the same town, Jasper, as the original dragging incident). Yet, the Dirkhising and Tillery events didn’t get the same national attention as the Shepard and Byrd events because of political correctness. Since the left dominates the MSM and academia, Jesse’s and Tillery’s stories got snubbed in order for the left to continue its oppressor-oppressed narrative about American society. It is time to overcome political correctness and combat hate crimes of all kinds.

    Recently we had about 99 teenagers thrown out of Florida State Fair for rampaging. Of course the new media would not comment on the fact they were black. The problem is in the family structure and the lack of a strong father that teaches discipline and respect for others in the black community. Our govt is an enabler of the single mother “family”. The poor mother who has to work and raise her kids without the help of a father, that is the problem.
