Obama’s New Imperial Decree

okFor purely partisan reasons, the Obama administration cynically unveiled extra-legal plans on the eve of Thanksgiving to unilaterally delay the launch of a website for small businesses to select plans through federal health care insurance exchanges.

It’s just the latest sleazy political move by the Community-Organizer-in-Chief to salvage his party’s fading electoral prospects by delaying at least some of the approaching tens of millions of health insurance policy cancellations until after the national vote next November.

It is also a sign of the Obama White House’s growing desperation over the political ramifications surrounding the grotesque failings of Obamacare. The administration said Wednesday it will unilaterally delay the upcoming launch of the online portal for small businesses. The website, which would allow small businesses to window-shop plans through the federal health insurance exchanges, won’t be ready for another year.

President Obama, whose political stature seems to shrink almost hourly, is feverishly trying to keep congressional Democrats aboard his sinking political ship. On Capitol Hill, Democratic lawmakers are now openly panicking at the damage the growing public backlash over Obamacare is going to inflict on their standings in the next Congress. Recent developments suggest that an electoral tsunami is developing that threatens to drown Democrats and give Republicans a healthy majority in the Senate.

The new one-year small business signup delay is just the latest in a series of unilaterally imposed deadline changes. One allows consumers to enroll until Dec. 23 — instead of Dec. 15 — to get coverage in time for the new year. The president also announced plans to push back the beginning of individual enrollment next year from Oct. 15 to Nov. 15, or after the 2014 midterm congressional elections. Obama has no legal authority to do this but he doesn’t care.

As Obama, a one-time part-time constitutional law lecturer ought to know, obstructing the implementation of a duly enacted federal law by refusing to enforce it in order to secure partisan political advantage almost certainly rises to the level of “high crimes and misdemeanors,” as the Framers of the Constitution recognized when they wrote the presidential impeachment provision in Article 2, Section 4 of the Constitution. Of course, hardly a day goes by in Obama’s increasingly imperial presidency without the Chief Executive creating new grounds for his own impeachment, and so this latest outrage is, unfortunately, barely newsworthy.

The Small Business Health Options Program (SHOP) that is being delayed was supposed to help small businesses by providing tax credits that could be used to defray the cost of premiums, according to the Washington Times.

“In the case of SHOP, the administration said that online tool won’t be ready until November 2014. Department of Health and Human Services officials said they are still allowing enrollment through agents, brokers and insurers in the federal marketplace.

Businesses with fewer than 50 employees, which are not required to offer coverage under the Affordable Care Act, can compare plans online starting Dec. 1, even if they have to rely on non-Internet applications to qualify for tax credits and gain coverage for employees, officials said.”

Republicans say this is the latest indication that Obamacare should be repealed outright.

“The president bit off more than he can chew with this health care law, and small businesses are now forced to bear the consequences,” said Speaker of the House John Boehner (R-Ohio).

House Small Business Committee chairman Sam Graves (R-Mo.) said that “another last-minute delay is just more proof that the law is unworkable and beyond the capabilities of the administration.” He added, “if small firms failed to provide services this frequently, they would be fired.”

Although Obamacare critics may be enjoying some well-deserved schadenfreude at the expense of the Obama administration as the bureaucratically bungled HealthCare.gov enrollment website launched Oct. 1 continues to malfunction, the president’s law is still helping to wreak havoc among health care consumers and cause upheaval in the health care industry, just as it was designed to do. No websites have to be functioning properly in order for Obamacare to collapse the system.

Government officials are still trying to fix the federal website, which is used in the 36 states that chose not to create their own health insurance exchanges. They say the website should be working for the “vast majority” of users in the individual market this weekend, but they’re probably guilty of wishful thinking at best, or of lying, at worst.

Health insurers have already dropped –or in Obama-speak, “transitioned”– at least five million Americans from their health plans despite President Obama’s oft-repeated promise that under Obamacare all Americans would be allowed to keep their current policies. And tens of millions more –perhaps more than 1 in 2 of all persons insured through their employers– will be pushed over the cliff next year as various provisions of the Affordable Care Act come into force.

Calculating left-wingers counted on being able to blame the insurance companies for the wave of policy cancellations, but so far the public isn’t buying it. Americans know President Obama lied over and over again about how Obamacare would work and his already-abysmal public approval ratings continue to fall. Too many people are experiencing real hardship as the Affordable Care Act causes their insurance to be canceled — and they know who to blame for their pain and suffering.

Stung by public anger and his rapidly plunging approval ratings, President Obama cried crocodile tears earlier this month as he tendered his now-infamous non-apology apology for lying about Americans being able to keep their plans.

Around that time he also proposed delaying the cancellation of existing health care insurance policies for one year. The House of Representatives responded quickly, approving Congressman Fred Upton’s (R-Mich.) quixotic legislation that would supposedly allow Americans to keep their insurance plans. No one knows how the statute would actually work in the real world.

The legal infrastructure of the health care insurance market has been changed. Policies were canceled because they don’t subsidize all the new services that Obamacare mandates. Those policies no longer exist for a reason. Insurers can’t just push a button and bring them back into existence.

Obama’s bizarre pronouncements reflect leftists’ disdain and ignorance of market processes, and the president’s determination to proceed in defiance of those processes. A locomotive going 60 miles per hour can’t stop instantly when brakes are activated. Nor can the Obamacare juggernaut which has so many moving parts spread out over such a wide area that locking up one part of the beast won’t stop it from continuing to barrel forward.

But Obama wants to have a Communist Chinese-style rubber-stamp Congress for the final two years of his presidency.

As Obama sees it, in order to accomplish this almost unprecedented feat he has to distance himself from the most visible damage that is being inflicted on society by his signature legislative achievement. He has to pretend to try to mitigate the damage done by Obamacare.

Obama will do whatever he feels he has to do, including lying and demonizing Republicans, in order to gain total control over Congress.

    I think this review of the latest incarnation of Obamacare falls short. I think that the Small Business REQUIREMENT to implement Obamacare remains; it is, I think, ONLY the opportunity to shop on-line and compare options on-line that is being postponed! Small Businesses will have to find methods OTHER THAN on-line in order to implement Obamacare, I think! Can someone clarify this, please?

      Every time the Republican House sends a bill to the Democrat Senate, it is either defeated or shelved by Harry Reid and his Democrat majority.

    Correct me if I’m wrong, but if the president signs a law and the date rolls around for that law to be enacted, isn’t it the legislative body, Congress, that would need to amend the law and not the Executive Branch? In other words, if necessary changes to the law need to be made, wouldn’t it be the Executive Branch that would submit those changes to the House of Representatives for a debate, vote and then sent to the Senate for debate, markup, vote and final version sent back to the House of Representatives for a final vote? How can the president of the United States unilaterally change a law at whim simply because it’s become politically inconvenient to hide from the effects of the disastrous legislation that they’ve signed into law? Am I missing something? Wouldn’t it be an impeachable offense for the president to usurp the powers of Congress to simply change the law without going through the legislative process?

      You are correct. But while Obama has certainly committed impeachable offenses, the Senate will never convict him unless their own worthless (Democratic) hides are at stake if they support him. Therefore, there is no reason for the House to impeach unless Obama is tied to something even worse, like the IRS scandal. In that case, the House would have to impeach, even though the Senate still wouldn’t convict.

    If anyone thinks Obama can or would make his destruction of our
    health industry any less onerous it is a delusional thought. Obama
    is and has been making life for Americans unlivable since he has
    had the power to do so. Bringing down America in every aspect of
    our existence is his obvious intent looking at his actions and those
    who do not yet see this, they will never be able to do so until they
    are eating out of garbage cans and living in the rubble of abandoned
    buildings and for many this is not far off. The only possible avenue
    of relief that can be possible is the removal of Democrats from
    the Senate and as many from all parts of Government as is possible.
    We are on a collision course with total collapse or civil war, the
    people are motivated to action and it will not take to much more,
    as Americans see the past, present and future ruined it will not

They base this on Rome mainly (Will and Ariel Durant’s book) but we are not like Rome in so many ways!! mainly in our basic belief in one God. The Romans worshiped many deities and did not know God. Therefore, no comparison.

    I have not listened to a single speech Obama has made since he announced his candidacy in 2007 and I will not listen to any speeches he will make until his sorry butt is out of the Oval Office where it NEVER belonged. But those who can’t get enough of his bluster and propaganda will, as Matthew points out, get their daily fix once or more than once a day for the next 11 months. The rest of us still have the freedom to ignore him and refuse to listen to him, but this freedom may also disappear one day when Big Brother arrives on the scene.

    I’m still trying to understand how 39% of the voters still approve of his job performance. There’s something suspicious about these poll numbers or a large number of Americans are still in a fog or dream walking. Hopefully they will wake up fully by Nov 4, 2014 so this nightmare can end.

      I can kind of understand it. I used to defend Obama, too. I actually voted for him the first time around. (Didn’t vote in the last presidential election.)

      Ah, back in those days, I really felt like I had to protect poor Obama- he meant well! Why couldn’t they see that! These mean, low-brow
      unsophisticated (usually white) people mocking him were just being cruel and unfair!

      Now I realize I was a dumb kid and I had no freaking clue what
      I was talking about. Obama doesn’t need me to defend him, he’s a grown freaking man. Also, they were right, he is a bad president.

      Also, I was too young to vote in the Bush years, but I still respect that man for the abuse he put up with. If there was ever a more hated
      man than Bush, I would really be shocked. I remember watching him respond to a roasting with equanimity, and even though I was a dumb lefty kid, even then some slight pang of human feeling reached my heart enough to think, “Who is really the bigger fool here? The guy who puts everything on the line and accepts criticism with grace? Or the shrieking left?”

      Bush wasn’t a hero but he wasn’t evil, either. See, the difference is that Bush actually had good intentions. He was elected- people forget this- on a non-interventionist, classically conservative platform. And then 9/11 happened. He had to rise to the occasion very quickly, and he may not have been the best guy for the job, but all things considered at least he did rise to the occasion. Obama had nothing like that, he merely ran on opposition to hatred of Bush. There’s no comparison, Obama got cut way more slack for way too long.

Even if he were somehow removed it would do no good as the whole administration is just as corrupt as he is. Our founding fathers left us instructions on how to deal with just this sort of problem. For those of you who have never felt the need to exercise your 2nd Amendment rights, you may want to rethink your position………………before its too late.

    The most effective way of overturning a law is simply for the governed people to ignore it.

    Obama has ignored the law in the past; perhaps it’s time for Congress to ignore HIM.

    There’s at least some precedent for ignoring rulings: President Jackson ignored the U.S. Supreme Court in Cherokee Tribe v. Georgia (I think that’s the name of the case).

    Obama took an oath to see to it that the laws are observed. Not to live up to that oath is something approaching a “high crime and misdemeanor.” But Obama will NEVER be impeached, not even in the increasingly likely event that Congress becomes dominated by Republicans. To impeach our first black President is to set foot on a politico-cultural third rail, or so our political leaders seem to think.

    I laugh when I read about Dims trying to “escape the blame” for Obamacare. HOW CAN THEY?!?!? Regardless of what vote they cast now, what statement they make attempting to “distance themselves” (love that phrase, don’t you?) from the Anointed One’s “signature legislation”, the fact is they ALONE wrote it, they ALONE passed it, and a Dim signed it. If there is blame (and there is), where else can it go but on Dims? If the voters send this same bunch back to Congress next year, all complaining should cease – we get what we deserve. The notion that Obama will ever be impeached, let alone removed from office, is laughable. Dims NEVER turn on their own, no matter what.

    no natural path to destruction, it is based in violating
    God’s laws, rejecting His Son and falling into damnable
    conduct. American Christian heritage allowed the Nation
    to gain in value from the efforts of each generation.
    Rome grew in power from law and the sword with a
    hardness we would be shocked to see today. America
    has Law and righteousness in our Constitution which
    I see as divinely inspired and that may be the reason the
    left wants to destroy the Constitution and destroy our basis
