Each state has an Insurance Commissioner. That Commissioner determines the rules - it is their job to decide what the Federal Governments says what the States can and cannot do. They in turn tell the insurance companies what their minimum policies MUST include.

That&#039;s just people getting thrown off their old plans, there are many more that are looking at the new rates on the exchanges and saying &quot;Screw this! I&#039;m paying the fine&quot;. The Feds could start by invoking the Commerce Clause as it was intended, ban states from disallowing interstate sales of health insurance.
 Also allow people to buy whatever level of coverage they want, starting at catastrophic coverage and moving out from there. Why should an adult male be required to be covered for pregnancy? Why should health insurance cover sex changes and birth control? This is like requiring car insurance companies to cover new tires and mechanical repairs for everyone&#039;s plan. 

 Another thing that could be done is by shutting down frivolous malpractice suits, and putting a cap on damages. Some states like Texas have already done this, and before the ACA came along their rates were actually going down.]]></description>
