		<description><![CDATA[No disagreement here... this is just a guess but Nifong made it impossible to ignore his misconduct while Fitzgerald picked a mostly unsympathetic target in a highly technical case where no one was outraged at Fitzgerald&#039;s behavior.  Without outrage from the traditional media no one seemed to care what Fitzgerald did.  Same with what they (Democrat prosecutor in Austin TX) did to DeLay.  Major outlets helped convict DeLay for something that wasn&#039;t against the law when he was doing it.  The DA kept getting told by grand juries there was no case and he shopped until he came back with an indictment.  This was a Democrat criminalizing political behavior.  I&#039;m glad that was finally overturned.]]></description>

		<description><![CDATA[Ultimately, Nifong was charged with and convicted of criminal contempt of court, but he could have been charged with felonies either under state laws pertaining to official misconduct or under federal law pertaining to civil rights violations. The NC Attorney General&#039;s office apparently declined to pursue state charges, and the AG of the U.S. also decided not to charge Mr. Nifong. Prosecutorial discretion was their prerogative, but the point is that Nifong could have been charged with several far more serious crimes. 

In my view, Mr. Fitzgerald, notwithstanding his reputation for unbiased enforcement of the law, abused the criminal process in a way that did indeed &quot;rise to the level&quot; of criminal misconduct in the Valerie Plame case. In my view, he should have been charged under federal laws with official misconduct because his actions, in charging Mr. Libby, were entirely intentional and malicious. Fitzgerald, not finding any crime had been committed, simply created one and entrapped Libby. In accepting the role as Special Prosecutor, Fitzgerald went political in the last years of the Bush administration, and he remained so with the election of Barack Obama in 2008. Apparently Fitzgerald decided not to charge the Obamas with income tax violations when Barack Obama was President-elect.]]></description>

		<description><![CDATA[My memory is a little fuzzy but Nifong  was disbarred for prosecutorial misconduct and convicted of criminal contempt where he did a day in jail.  Nifong went way beyond what Fitzgerald did.  Sadly... Fitzgerald can use the &quot;I&#039;ll go where the investigation leads me&quot; meme.  The investigation may have been a set up but proving it was a set up is the legal challenge.  Nifong just plain ignored facts, withheld evidence from defense attorneys, and ran the trial like a campaign. 		<content:encoded><![CDATA[<p>My memory is a little fuzzy but Nifong  was disbarred for prosecutorial misconduct and convicted of criminal contempt where he did a day in jail.  Nifong went way beyond what Fitzgerald did.  Sadly&#8230; Fitzgerald can use the &#8220;I&#8217;ll go where the investigation leads me&#8221; meme.  The investigation may have been a set up but proving it was a set up is the legal challenge.  Nifong just plain ignored facts, withheld evidence from defense attorneys, and ran the trial like a campaign.  I&#8217;m guessing Fitzgerald is smarter than Nifong and knows how package his corruption to pass legal muster even if is unethical. He may not have been involved in the leak of the itself, but he was involved in the cover up of the leak; and when push comes to shove, it is often the cover up which generates the charges in the political arena. You only have to think back to Nixon and the Watergate affair and the Clinton administration and the Monica Lewisky affair. In both cases, it was the cover up which ultimately got both presidents in big trouble. Bigger trouble, in fact, than if they had allowed the original issues to come out into the public arena, a break-in in one instance and a sex scandal in the other.

You will remember that Bush did NOT give a pardon to Libby, implying that even Bush believed Libby was far from innocent and in at least some way connected with the scandal.
