		<description><![CDATA[I don&#039;t know everything, Val, but I have handled well over 2,000 criminal cases as an attorney and do know a little about how criminal cases work. I&#039;ve never handled one in Mexico but have handled many involving foreign nationals. I know how courts work and what powers the executive branch has in countries like the US and Mexico where we have independent judicial branches. I know that Tahmooressi&#039;s lawyer says that no phone call from anyone, not a mayor or a president, is going to  change things in this case. Because, as he said, an executive cannot order a judge to drop this case.  I know that if the prosecutors in this case really do have evidence that Tahmooressi was in Mexico earlier on the day that he was arrested and really rented a room in Tijuana for the night that that evidence makes his claim that he just accidentally crossed the border and wasn&#039;t going in to stay in the room he&#039;d already much harder to believe.  


It&#039;s not like they have absolutely no evidence and are holding this man for no reason at all but to be mean. I&#039;m not surprised that this case is being prosecuted and that the judge has not dropped the charges yet. I think we need to let the court case finish up and hope for the best. If he gets convicted and is given a long sentence, then our executive branch can talk to their executive branch about clemency and pardons, which is something they do actually have control over.  


I hope this young man gets to come home soon.  He&#039;s going to be okay. People are donating all kinds of money into funds for him now and when he gets out he&#039;s going to clean up on paid interviews and that sort of thing. I seriously doubt he&#039;s locked up much longer, even if he&#039;s convicted.  He has a good lawyer making some good arguments that might very well result in him getting off on a technicality. The judge seems to be bending over backwards to give him due process. That seven hour evidentiary hearing they had just recently, in a typical case it would likely have lasted a few minutes. Everything is going to be okay.]]></description>

He crossed the border with three weapons, at least two of which are illegal for anyone in Mexico to possess except military personnel. He drove through the &quot;nothing to declare&quot; lane.  They stopped him and only then did he admit to having the weapons. It is a serious crime to bring a single bullet into Mexico, let alone these three loaded weapons and 456 rounds. 

It is also, by the way, a serious felony for people who are not citizens of this country and not here on immigrant visas to have any firearms unless they have special permission, and people are charged under these statutes all the time and many have gone to prison for it. I remember reading a case from 2008 I think of a Morrocan guy here on student visa who was charged and convicted and sent to prison because they had a picture of him holding a rifle at a firing range with a big grin on his face. There was no evidence of any other criminal conduct.  

Anyway what happened at the border in Tahmorressi&#039;s case is disputed.  He apparently told them some lies about whether he&#039;d been to Mexico before and so on. Mexican prosecutors say they have proof that he had been in Tijuana on the morning of his arrest and had rented a room for the night there in Tijuana. That&#039;s not good for Tahmooressi, at all. That does tend to make it harder to believe that he just accidentally crossed the border, that he wasn&#039;t on his way back into Mexico to stay in the room he had rented.  I suppose he could argue he rented the room just to use it to meet with a woman or something and was already don&#039;e with it. I have nothing against Tahmooressi. I hope he gets to come home soon. What bugs me about this case is the way people are being manipulated into making it much more than it really is, which is a pretty run of the mill criminal case. This is being done for political gain and to keep people watching certain news stations and reading certain websites and so on to keep ratings up. The people doing the manipulating know the score in this case, they know there is nothing Obama can do but love any opportunity to attack the guy.  I never voted for him, don&#039;t like him, but see the media coverage and political attacks in this case as just sleazy as can be, and it never seizes to amaze me to see how easily manipulated people can be, how stupid they can be.  And as crazy as people are getting about this case, I&#039;m just waiting for bodies of brown people who happen to look Mexican showing up because we have a lot of people ready to go to war on this, take matters into their own hands and engage in all sorts of vigilante justice. 

I just wish people would calm down and let the court process finish up.  I think this judge will likely bend over backwards to give Tahmooressi a fair trial given all the media attention and pressure he&#039;s getting from people and both of our governments.  Hopefully he gets off or they work something out where he can get a &quot;time served&quot; sentence and come home soon. If not, that&#039;s when the real political pressure starts because the executive branch does have authority to grant clemency and pardons.  

Right now all they&#039;d be doing is interfering with the judicial process. We charge an awful lot of their people and send a lot to prison, and they don&#039;t interfere with that. They let our judicial process work in criminal cases. We expect them to respect our sovereignty and our judicial system. They have a right to expect the same from us.  They work with us on extraditions and our law enforcement agencies cooperate some and it really wouldn&#039;t be right for our government to demand that they release this guy that they&#039;ve charged with a crime when they do have at least some evidence of his guilt and are giving him due process of law and allowing him to fight these charges.

Our government is talking to them and no doubt applying lots of pressure, but there is only so much they can do.  This guy will have his day in court, hopefully soon. He&#039;d have already been to court if he didn&#039;t keep firing his lawyers. Criminal cases take time, usually several months in the US and sometimes a lot longer. Three months is not a long time in the system here and probably not in Mexico either. Tamoohressi has not helped himself out at all, with the things he&#039;s said, trying to escape and putting off his court. He will likely walk though, and that will be mostly because of political pressure.]]></description>
