The Lawless Bergdahl Swap

306586629Virtually no one in the nation’s capital now doubts that President Obama violated the law when he approved an unconscionable prisoner swap that repatriates an American deserter while freeing five Islamofascist terrorist field commanders.

Just throw it on the growing pile of impeachable offenses committed almost daily now by President Obama.

In yet another new historical first that paints a bulls-eye on the backs of U.S. citizens and military service members around the globe, Americans learned this week not only that Obama negotiates with Islamofascist terrorists — but that he does so with all the skill an 18-year-old boy who just won the lottery employs when dealing with a Porsche salesman.

Perhaps Obama thought that the release of Army Sergeant Bowe Bergdahl who was held for five years by the Taliban in Afghanistan would be a sure-fire good news story to distract from the Veterans Affairs hospital waiting list scandal. If so, he guessed wrong.

Bergdahl, it turns out, expressed dismay about the war and walked off his base overseas in search of terrorists to whom he could surrender. There are conflicting reports, but it appears Bergdahl became an active collaborator with America’s enemies and fed them valuable information that helped them strike U.S. military targets in Afghanistan with enhanced efficiency.

Bergdahl, whom one of his former military colleagues described on TV as at best a deserter, and at worst, a traitor, was traded for five high-value Guantanamo Bay inmates in a clandestine transaction that might be the modern-day equivalent of swapping the high command of Nazi Germany’s armed forces for a wartime saboteur like Ernest Peter Burger or Herbert Hans Haupt.

Thanks to Obama and the same people who brought you HealthCare.gov and a growing list of governmental monstrosities, bearded unlawful combatants are now at liberty in Qatar where supposedly somebody is keeping an eye on them. They will, no doubt, return to plotting against the United States and orchestrating plans to kill Americans.

In carrying out the deal President Obama bypassed most of the congressional leadership and violated a statute he recently signed into law. Senate Majority Leader Harry Reid (D-Nev.), ever the Obama water carrier, took time out from his ambitious hate speech campaign against the Koch brothers to claim the administration let him know of the operation in advance. Apart from Reid, just about nobody else on Capitol Hill makes the same claim.

House Speaker John Boehner (R-Ohio) said he was not notified of the unseemly transaction until it had already happened. Boehner said the administration gave congressional leadership a heads-up about a prospective prisoner swap over two years ago but did not revisit the issue with lawmakers.

“Unfortunately, the questions and concerns we had were never satisfactorily answered and they remain today,” Boehner said. “At the time, the administration deferred further engagement because the prospects of the exchange had diminished.”

As recently as June 21, 2013, White House spokesman Jay Carney said “we would not make any decision about transfer of any detainees without consulting with Congress.”

“There was every expectation that the administration would re-engage with Congress, as it did before, and the only reason it did not is because the administration knew it faced serious and sober bipartisan concern and opposition,” Boehner said in a statement. His office was reportedly notified of the swap, by that time a fait accompli, on Saturday at 11:52 in the morning.

Sen. Dianne Feinstein (D-Calif.) corroborated Boehner’s version of events, explaining that a prisoner exchange was discussed with congressional intelligence panels and met with more or less unanimous opposition.

Lawmakers reportedly worried such a deal would provide terrorist groups with an incentive to hold more U.S. soldiers and that the administration would be powerless to stop the released detainees from returning to the battlefield.

House Armed Services Committee Chairman Buck McKeon (R-Calif.), and Sen. James Inhofe (R-Okla.), who is ranking member on the Senate Armed Services Committee, said in a joint statement that the president “clearly violated laws which require him to notify Congress thirty days before any transfer of terrorists from Guantanamo Bay and to explain how the threat posed by such terrorists has been substantially mitigated.”

The 2014 National Defense Authorization Act mandates that the defense secretary advise the relevant congressional committees 30 days before freeing any prisoners from Guantanamo Bay. Obama signed the measure into law and griped in an accompanying signing statement that such a requirement was unconstitutional.

“Trading five senior Taliban leaders from detention in Guantanamo Bay for Bergdahl’s release may have consequences for the rest of our forces and all Americans,” the two lawmakers said. “Our terrorist adversaries now have a strong incentive to capture Americans. That incentive will put our forces in Afghanistan and around the world at even greater risk.”

Two prominent left-wing legal commentators who are otherwise sympathetic to Obama’s policy agenda accused the president of breaking the law by executing the prisoner exchange.

“I think he clearly broke the law,” said CNN legal analyst Jeffrey Toobin. “The law says 30-days’ notice. He didn’t give 30-days’ notice.”

“The law is on the books, and he didn’t follow it,” he added.

When asked if the Obama White House violated federal law, George Washington University law professor Jonathan Turley replied, “they did.”

“I don’t think that the White House is seriously arguing that they’re not violating federal law. And to make matters worse, this is a long series of violations of federal law that the president’s been accused of. … This is going to add to that pile. I don’t think there’s much debate that they’re in violation of the law.”

President Obama “is essentially arguing the very same principle as George Bush, that when it comes to Gitmo, he has almost absolute power, that it’s his prerogative, his inherent authority, to be able to make these decisions as he sees fit.”

Strangely, the normally docile Speaker Boehner wants to do something about the Bergdahl swap, which he said “invited serious questions into how this exchange went down.” He said he supports calls for congressional hearings on the issue.

Because of Obama’s action, U.S. personnel abroad now face an elevated risk of being kidnapped by terrorists.

“One of their greatest protections — knowing that the United States does not negotiate with terrorists — have been compromised,” Boehner said.

Obama unleashed the White House propaganda machine over the weekend to spread false information about this stinker of a deal. Naturally, he used White House National Security Adviser Susan Rice as his TV talking head. Rice also served as reelection candidate Obama’s emergency first-prevaricator on the Benghazi coverup in fall 2012.

Rice went on TV to spread the administration’s bogus cover story. She said with a straight face that Bergdahl “served the United States with honor and distinction.”

“Sergeant Bergdahl wasn’t simply a hostage; he was an American prisoner of war captured on the battlefield.”

No doubt Rice won’t have any difficulty landing a job in public relations or academia after Obama leaves office in 2017.

        Exactly. Democracy in the end is just a set of tools for solving problems, especially those dealing with abuse of power. If you don’t use them, the problems won’t go away, and in fact, they may eventually overwhelm you. (And what’s even worse, there are never any guarantees.)

      It’s not the first prisoner swap. The problems are that it was done illegally, without notifying congress. And also that it doesn’t seem fair to get back one low-ranking kid in exchange for 5 senior officers.

          It was definitely in violation of the 30 days notification law. You could argue that law is unconstitutional because Obama is commander in chief according to the constitution. But in that case, he shouldn’t have signed it.

      Why the 30 day notice? I’m guessing so we can place assets to follow them to their fellow terrorists! DUH! They surely won’t be planning a trip to Disneyland. Once in Qatar, they will just mix in and eventually make their way to Pakistan where all of them look the same too.

      In a way, I’m hoping they do go back to the battlefield and if they kill an American and post it on a website, then it SHOULD mean the end of Obama and his fellow Communists. If they kidnap an American in any country and they demand a trade, especially a Gitmo trade, then that too should be grounds for impeachment.

      ALL depends on the 2014 election and if the Republicans don’t take the Senate, America will fall and Obama will be a hero to billions.

      Why is everyone conveniently forgetting these Taliban were released into Qatari custody? They may or may not escape Qatari custody in order to return to the Taliban. We don’t have a clue what American intelligence has decided to do to handle these men in Qatar nor do we have a clue what plans American intelligence has for them should they attempt to rejoin the Taliban.

      The President is not anti-American. Why attempt to produce this kind of hysteria in the populace? Because there are those who’d like to sell the concept that these are not sensible policies. But the fact is, they are policies which are the confluence of the thinking of a GREAT MANY AMERICANS of all sorts of political leanings. No policy is ever solely produced by the mindset of an American President. They may fall under his tenure as President, but they are the fruits of the labors and the beliefs of many more Americans than the President alone.

      Bergdahl wanted out of his role in the Afghanistan conflict. We don’t know what influenced that decision. How many drone strikes did his unit witness? How many mistaken targets did his unit attack? How many personal mistakes did Bergdahl make as far as killing Afghan civilians? Some of the very same influences that undermined Bergdahl’s belief in his mission are shared by those soldiers who are manning the drone consoles who are firing the missiles in these drone strikes. They’re certainly not in the identical position as Bergdahl but they share some of the same doubts.

    Valerie Jarret said exactly what she meant back in 2008 when she boldly proclaimed that Obama would be ready to “rule” from day one. That was not a typo or a misspoken word. Obama needs to be impeached. Obama needs to be tried for treason. Obama needs to spend the rest of his days in Leavenworth. Regrettably, no one who is in a position to make these things happen appears to have the cajones to take the first step. Perhaps the Bergdahl debacle will be the tipping point to get people to grow a pair.

      Impeaching Obama would lead to civil war and Obama would be martyred. “Racist America” would be blamed for impeaching the “First Black President.”

      I truly detest the term “First Black President.” The man is as white as he is black so the term has absolutely no meaning except as a marketing tool and political shield.

      At any rate, actions taken against this criminal can and probably will result in literally ripping this country apart. I’m sure that both parties in congress take this into consideration.

          A generation of children have been taught that being born with white skin automatically makes one both Privileged and Racist. This is every bit as sick and powerful as hatred toward those born of color.

          With the help of educators (and the very loud and powerful voices you mentioned) the minority of racists in this country becomes a majority. Instead of racism being based on actions taken by a person or a group it is based on what color your skin is at birth. Essentially, a generation of students have been taught that racism is an inherited trait.

          When there is resistance to Obama’s policies or criticism about the way he addresses or handles incidents and crisis those who scrutinize, question or oppose him are marginalized as racist. We’ve witnessed this countless times over the past six years.

          “Racist America” doesn’t necessarily have a white face. Everyone who disagrees with the POTUS, regardless of color, is racist and/or a race traitor. If the POTUS is impeached the country will divide itself along the lines of those who agree and disagree with his right to rule rather than to lead. Racism exists and may well be the catalyst for an initial divide and a civil war would have overtones of racism but on one side of the line in the sand will stand those who support our Constitution and on the other will stand those who believe that the document is outdated and does not apply.

          I read this morning that ‘…if he does it again…’ (releases terrorists without regard for the law) congress will take action. The POTUS swapped a terrorist dream team for an American traitor with zero regard for the laws that govern this nation. But Clinton faced impeachment hearings for being a philanderer?

They won’t simply keep hammering away at lesser issues as if they’re addressing the most pressing issues facing the country.

            Clinton was impeached for lying under oath in the Paula Jones sexual harassment trial. The judge suspended his law license and fined him $50,000 in that suit. Irony of all ironies, it was a judge that he appointed and, it was he that signed the sexual harassment law when both houses of congress passed it. Delicious!

They wanted their five top guys back on the field and now they’ve got them. The Five are going to rest up in Quatar for a year, make their plans and then back to battle. The Dems agree, but say that Americans will be out of Afghanistan by the time that happens.
      Meanwhile the Berg will be convicted of treason and sent to jail.

    The issue are the owners of the central banks. The Bank of Israel is a continuance of the Anglo Palestine bank ” founded” in 1902 in London. This tells me that the owner is Rothchild.

    Most likely by this time a major owner of the US Federal Reserve ( a reserve of ink, cotton and printing machines) is Rockefeller.

    All wars have benefitted those families and their associates. All countries have 2 things in common ( aside from Cuba, North Korea and Iran):

    1) a central bank
    2) right and left wing parties where each party takes turns playing the war monger ( LBJ (D) – Vietnam and Bush (R) – Iraq ).

    Until we resolve this nothing will change. Instead of a million march on the Lincoln Memorial, there must be a million man march on the Federal Reserve to begin to reverse this deadly paradigm..

      There is no point in the House bringing impeachment proceedings when the Senate is controlled by the Democrats who will not vote to impeach.
      The Democrats win because they promise entitlements at other peoples’ expense and the LIVs eat it up.
      The current Repub leadership are all RINO POS. They are not conservatives. Perhaps if we had some real conservatives you would see more action.

      Not that simple. If there is anything the Republicans learned from the Clinton impeachment, is to not even try to impeach if there is no chance to get a conviction verdict by 2/3 of the Senate. And, as long as Dingy Harry has that place under his thumb, it’s not going to happen. Most Senators will vote politics over law and reason and the media will side with Obama and feed their spin to the great unwashed, just as they did with Clinton.

    Yes, in 1948 it was a totally different situation. The war was over, Germany was flattened and no threat to anyone so Truman obeyed the international rule of law that says all POW’s must be sent home unless they can be charged with a crime.
    What I wonder is why none of the remaining Gitmo-ites has been charged with a crime. Apparently prosecutors tried to twice but their case was struck down by the judge. They’ve had 13 years to make a case against these terrorists! They must have enough evidence to try Khalid Sheik Mohammed so I wonder why he hasn’t been been tried, convicted and executed. I know that terrorists don’t have the right to a speedy trial but 13 years should be enough time to prepare cases against them.

    The worst part of this is not the breaking of law. It is equating unlawful enemy combatants with POWs, which by custom and the Geneva Convention, they can never be. Obama has placed an equivalence between high-value terrorist masterminds drenched in blood and American soldiers. Worse still, the American soldier was a deserter whose desertion cost eight American lives in futile recovery efforts. If Bergdahl was to be returned, it should only have been with the stipulation that he would receive a general court martial for desertion in war time. Absent that, he should have been left to rot with the Taliban, for whom he and his Ron Kuby look-alike father, were in sympathy.     As he has done in almost every area, Obama alone decides what laws he will follow and what laws he will not. Congress does nothing in response to the utter lawlessness emanating from the WH. The collective response is: “So what?” The next time I hear ANY politician say “we are a nation of laws”, at least it will be something to laugh at.

    Yes, there needs to be an investigation. Who did Obama meet with in Afghanistan the week prior to this “prisoner swap? Did Obama meet with Taliban leaders at that time, in order to aid and abet our enemies? Did Obama give $$$ money to the Taliban to as part of this sweet deal? Did obama oust our top spy in Afghanistan as part of this “deal”? DId Obama personally meet with Bergdahl while he was in Afghanistan? Did Obama make even more promises to the Taliban while bragging to them about ending our war with them? Is this out and out fraudster also an out and out Traitor who is personally making trips at our expense to broker deals with our enemies?

    I believe every rational human being knows without doubt that 0bama and his regime have committed criminal acts from treason, to murder, to fraud and embezzlement but so what? The Repubikans haven’t done anything about it except to whine and cry foul.

    That Obama’s staff could be so completely uninformed about Bergdahl’s real status as a deserter, traitor and collaborator with the enemy is difficult to comprehend. Either they knew or they didn’t. If they knew then the elementary common sense of a 5-year old would have been enough to nix the deal. If they didn’t know then there is some serious and dangerous dysfunctionality in the WH which hopefully our enemies are not aware of. And if they are aware of it then Bergdahl is the least of our problems.

    Rice’s willingness to tell, not small, but very BIG lies, on Obama’s behalf, seems a bit surreal to me.
