Obama's favorite conspiracy theory returns.

Birtherism was almost in the grave, but only three weeks into his term, Hawaii’s newly elected Democrat governor Neil Abercrombie is scheming to resurrect it. Birthers, who claim Barack Obama was not born in the US and is therefore ineligible to be president, work entirely to President Obama’s benefit, diverting his opponents into dead-end conspiracy mongering. While publicly distancing himself from Abercrombie’s efforts, President Obama can only be thrilled at the opportunity to portray his opponents as tin foil hat-wearing lunatics.

As Obama’s hero Saul Alinsky once wrote: “The enemy properly goaded and guided in his reaction will be your major strength.” And Abercrombie’s Alinskyite maneuver is already working: popular Internet site Mediaite cheers, “When Hawaiian governor Neil Abercrombie rekindled the dying embers of the birther fire today, the media leapt up like starved piranhas to nip at the scrap.”

Governor Abercrombie was part of the same early 1960s University of Hawaii Marxist student clique as Obama’s parents, Barack Obama Sr. and Stanley Ann Dunham. As he likes to say, “I was here when that baby was born.” Abercrombie’s wife, UH Prof. Nancie Caraway, was a member of the Democratic Socialists of America National Feminist Commission in the mid-1980s. Caraway’s 1991 book, Segregated Sisterhood, is dedicated to Abercrombie and to former Communist Party member Bettina Aptheker, among others. Abercrombie denies ever having been a member of the DSA, but several editions of the DSA organ, the Democratic Left, describe Abercrombie as a “DSAer Democrat.” Former Abercrombie aide George “Skip” Roberts is the long-time DSA representative to the Socialist International. In Congress, Abercrombie was for 20 years an ineffectual backbench member of the DSA-allied Congressional Progressive Caucus. For much of his career, he co-chaired the House Gym Committee. Now he is the Governor of Hawaii.

Perhaps hoping, Abercrombie implies Birtherism could be the end of America, telling one reporter: “More than demonization — this is self-evisceration of politics. Empires fall and countries fall when that takes the place of discourse.”

But contrary to appearances, Abercrombie is a birther’s dream come true. With Hawaii governed by Abercrombie–someone who is cast in a key role in their conspiracy theory–birthers no longer have to explain how it is the previous Republican Lingle/Aiona administration insists that Obama’s birth certificate is accurate. The loop is closed and now Abercrombie is portrayed as covering up his UH-Manoa comrades’ 50-year conspiracy to hide Obama’s “true origins.”

The Burlington, Vermont School District does not give students a day off to commemorate the September 11 attacks, but on Friday, September 10, 2010 Burlington schools will close early for the weekend to celebrate an Islamic Feast.

Chaired by once-disbarred lawyer and admitted embezzler Fredrick Lane, the Burlington School Board on March 9 voted 8-1 to add Eid al-Fitr and Yom Kippur to the school calendar starting this Fall.

School officials claim it is all about maximizing attendance. The Burlington Free Press reports:

School Superintendent Jeanne Collins said Burlington High School Principal Amy Mellencamp told her and School Board members that about 75 of the high school’s roughly 1,100 students were absent on Eid last year. About 50 students are absent on a typical day, she said….

But, in 2009, Eid al-Fitr was on a weekend–running from sunset on Saturday, September 19 through sunset Sunday, September 20. In 2008, most of Eid al-Fitr fell on Tuesday, September 30–the same day as Rosh Hashanah. According to the Burlington daily,

(Board Chair Fred) Lane said the Burlington school system has long had a sizable Jewish population and now has an increasing number of Muslims. Jewish and Muslim students often take days off on their respective holidays. If the schools close the on those holidays, some of the attendance problems go away, Lane said.

Of course the “progressives” never saw fit to honor a Jewish holiday until it was needed as a smokescreen for the Islamic holiday. Neither of the last two years attendance figures could give any actual reflection of any possible Muslim students skipping school. The ability to slip by with lame excuses like “attendance” is a key motivation to incubate such counter-cultural Gramscian initiatives in “progressive” colonies where they are likely to go unquestioned before being cloned to deploy against the rest of the US and the world.

In recent months, Islamists and their “progressive” appeasers have been working overtime to add Islamic holidays to the calendar in other liberal jurisdictions.

In Hawaii, the State Legislature last year voted to celebrate Islam Day on September 24, 2009–a day which signifies nothing in the Islamic calendar, but just so happens to coincide with September 11 in the old Julian calendar favored by the Eastern Orthodox Christians conquered by Islam.

In New York City, a coalition of community organizers, unions and Muslims won a non-binding City Council vote to celebrate Eid a-Fitr and Eid al-Adha.

Because Burlington schools have a long summer vacation, and Islam uses a lunar calendar, the Eid al-Fitr Islamic Feast day will not actually appear on the school calendar again for eight or nine years — until either June 15, 2018 or June 4, 2019. So Burlington “progressives” were running against the clock. If they had not acted this year, they would have lost their chance to use Eid al-Fitr in an effort to further the break down America’s formerly dominant cultural paradigm. Yom Kippur falls on Saturdays in 2010 and 2011.

The culture war has been an interest of Lane’s since at least 2000. He has been a sporadic DailyKos diarist since 2005. In 2006, he authored, “The Decency Wars: The Campaign to Cleanse American Culture.” In 2008 Lane published “The Court and the Cross: The Religious Right’s Crusade to Reshape the Supreme Court.” He promotes himself as a nationwide speaker on his own website.

In his Amazon.com biography, Lane proudly lists his engagements:

On August 23, 2006, I had the honor of appearing on “The Daily Show with Jon Stewart” to discuss The Decency Wars. I have also appeared as a guest on a variety of other national television programs, including ABC’s “Good Morning America Weekend,” NBC’s “Weekend Today,” ABC’s “Nightline,” CBS’s “60 Minutes,” and assorted BBC documentaries. In addition to those televised appearances, I have been interviewed by numerous radio shows, magazines, and newspapers around the world on topics relating to my books.

Over the last fifteen years, I have frequently been invited to lecture before college, university, and professional audiences to lecture on Internet technology, workplace and personal privacy, computer forensics, and censorship issues.

With Lane having done so much to smash the dominant paradigm, on April 18, 2008 the Vermont Professional Responsibility Board found him to have been “rehabilitated”, and recommended readmission to the Bar. As evidence of rehabilitation, the report explains: “Amy Werbel, his domestic partner, testified at some length about his success in putting his personal life back together. He is now divorced, as is Werbel.”

Regarding “…the risk to client money if Lane should resume law office practice”, the 2008 report states:

“(Lane) acknowledged to the Panel that this might be a concern, but he had no present intention of returning to practice, and if he did so, it would not be as a solo practitioner, but rather in association with other lawyers. While this is no guarantee, it is additional assurance to the Panel that client monies would not be at risk.”

For “progressive” culture manipulators, the clock is ticking on two other Islamic holidays. Eid al-Adha will fall on September 11 in the year 2016. Islamic New Year–1 Muharram–will fall on September 11, 2018. After that it will be decades before the next opportunity. For this reason, Gramscian strategy dictates that some “progressives” will become eager to celebrate these holidays over the next six to eight years with interest peaking in early 2016 and early 2018, respectively.

Date symbolism is not just a “progressive” fetish. It is very important to al-Qaeda as well.

September 11, 2001 marked the 318th anniversary of the defeat of the Turkish Ottoman army as it laid siege to Vienna September 11 and 12, 1683. After 1,059 years of Islamic conquest of the Persian Sassanids and then the Byzantine Romans, Christian victory at Vienna marked the beginning of an Islamic decline which would continue unabated until Christian Europe had colonized nearly all Islamic countries. The climax came at the end of World War One with the collapse of the Ottoman Empire and the abolition of the final Islamic Caliphate by Turkish secularist rebels led by Kemal Ataturk.

The Muslim Brotherhood, the world’s key Islamist movement, was founded in 1928 to re-create this lost Caliphate. Muslim Brotherhood agents lead most US Islamist organizations. Ayman al-Zawahiri, an Egyptian Muslim Brotherhood operative, became the number two person in al-Qaeda after leading his Egyptian Islamic jihad group to merge with Osama bin-Laden’s “base” in 1998.

By attacking the “New Rome” on September 11, al-Qaeda makes the claim that Allah intends for Muslims to re-ignite the old wars of Islamic conquest.

Oh, and Fred Lane? What was he doing around the time of September 11, 2001? According to his 2002 disbarment report, Lane had been Treasurer of the Chittenden County, Vermont Democratic Party. The report explains:

“Without having permission to do so, the Respondent wrote checks to cash and used the money for personal reasons. Between July of 2001 and March of 2002, the Respondent removed between $1,500 and $2,000 from the Party’s account and used it for personal expenses.

“As a result of the fact that the Respondent was using the Party’s money for personal reasons, the account was often overdrawn. The bank charged a daily fee to the overdrawn account. The fee eventually rose to slightly more than $300.”

In resigning from the Vermont Bar, Lane in 2002 agreed that “The material facts upon which these allegations are based are true.”

At the time, Lane has just published his first book, “Obscene Profits: The Entrepreneurs of Pornography in the Cyber Age.” His removal from the Bar came shortly after he was elected to the Burlington School Board.

In Lane’s last post on DailyKos, he complains that:

“Senator John McCain employed the services of former ‘American Idol’ make-up artist Tifanie White to get the Senator camera-ready at televised events earlier this year.

“The cost? According to reports filed with the Federal Election Commission, $5,583.43 during the last reporting period. That certainly blows away the $400 that John Edwards spent on his notorious haircut.”

According to the signature line on the post, Lane is beginning work on a new book, titled “People in Glass Houses….”

The media manipulates the "cunning plan" to cover up global cooling.

Geoff Jenkins is the self-described “front man explaining climate change.” The UK Guardian in 2004 called him, “the man Tony Blair turns to for the facts about climate change.” And as the mid-1990s global warming hype was being cranked up to full volume, Jenkins in 1996 formed a “cunning plan”, “inventing” temperature readings, and releasing fake “estimates” of temperature data for the year even before the year is over.

In a November 22, 1996 email to other top global warming scientists, Jenkins writes:

“Remember all the fun we had last year over 1995 global temperatures, with early release of information (via Oz), “inventing” the December monthly value, letters to Nature etc etc? I think we should have a cunning plan about what to do this year….”

According to Jenkins, the fake temperature information would be fed “selectively to Nick Nuttall (who has had this in the past and seems now to expect special treatment) so that he can write an article for the silly season.”

Nuttall is the Spokesperson and “Head of Media” for the United Nations Environment program. Global warming is not Nuttall’s only media manipulation enterprise. In October, 2008 his claims that Somalia had been used as a dumping ground for European toxic waste were immediately picked up by Islamists to justify Somali pirate attacks.

Another source seemingly preferred for the execution of Jenkins’ “cunning plan” is Neville Nicholls, the Senior Principal Research Scientist and Leader, Climate Forecasting Group at the Bureau of Meteorology Research Centre, Melbourne Australia. Does this explain Jenkins’ “via Oz” remark? According to his online CV, Nicholls is, “an editor of the Journal of Climate, and was a Convening Lead Author of the IPCC Second Assessment Report on Climate Change.”

Jenkins’ chosen mouthpieces would create a media frenzy “for the silly season.” Then when the real temperature data comes out: “We relesae (sic) the final estimate on 20 Jan, with a joint UEA/MetO press release. It may not evoke any interest by then.”

Jenkins is not exactly a household name. But he has been at the center of the global warming movement since the beginning. The UK Guardian explains:

Jenkins began in the climate prediction business in 1988 when, in response to scientific concerns, the Intergovernmental Panel on Climate Change was set up with Sir John Houghton, then head of the Met Office, as chair of the first scientific group.. Jenkins’s job was to pull together the science from round the world and put together 1990′s groundbreaking Group One report. “It was huge fun. It was not political in those days, it was scientists pooling their best knowledge to produce the best report. They were great days.”

Margaret Thatcher’s enthusiasm for science led to the establishment of the Hadley Centre, programmed to begin to find out how the climate would change over the next century or so with more carbon dioxide being pumped into the atmosphere.

Jenkins was among the 25 original staff in May 1990 – now the staff has tripled. “At first we were entirely in the business of predicting what would happen in the future. It was all very academic, with universities and research institutions. We were the sort of people whose outlets for information were papers in Nature.”

Once the first Earth Summit in Rio had taken place in 1992, the Hadley Centre began to move into the policy area and how to mitigate greenhouse gas emissions. This eventually led to the Kyoto Agreement of 1997, which was to be the first step to reducing emissions from industrialised countries.

But by 2000 the mission had changed again – particularly with the floods of that year. The environment department had set up the UK Climate Impacts Programme in Oxford to start dealing with adaptation – something that had not even been considered when the Hadley Centre opened.

The hacked global warming emails are now posted online in a searchable database. Jenkins’ addressees are led by Phil Jones. Jones, along with now-discredited tree-ring fraudster Keith Briffa, led the CRU’s defense of the so-called “Hockey Stick Graph” which relied heavily on Briffa’s bogus tree-ring data to falsely show a relatively stable temperature pattern followed by steady temperature increases which coincide with the beginning of the industrial revolution. The fraudulent chart was included several times in an IPCC report even though its faked data neglected to include neither the well-established “little ice age” nor the equally well-documented “mediaeval warming period”.

Searches for the names of Mann, Jones, and Briffa each bring up about 500 emails.

Mann is a leading author on the global warming blog “real climate”. Scientific American in 2005 tagged Real Climate, “A refreshing antidote to the political and economic slants that commonly color and distort news coverage of topics like the greenhouse effect, air quality, natural disasters and global warming.”

The scientists do not work alone. As RealClimate explained in 2005: “…our domain is being hosted by Environmental Media Services, and our initial press release was organised for us by Fenton Communications….”

Activist Cash explains what EMS and Fenton are:

If you’ve ever been advised to steer clear of a food, beverage, or other consumer product based on the claims of a nonprofit organization, you’ve likely been “spun” by Fenton’s multi-million-dollar message machine — and Environmental Media Services (EMS) has probably been the messenger.

EMS is the communications arm of leftist public relations firm Fenton Communications. Based in Washington, in the same office suite as Fenton, EMS claims to be “providing journalists with the most current information on environmental issues..” A more accurate assessment might be that it spoon-feeds the news media sensationalized stories, based on questionable science, and featuring activist “experts,” all designed to promote and enrich David Fenton’s paying clients, and build credibility for the nonprofit ones. It’s a clever racket, and EMS & Fenton have been running it since 1994….

It’s called “black marketing,” and Environmental Media Services has become the principal reason Fenton Communications is so good at it. EMS lends an air of legitimacy to what might otherwise be dismissed (and rightly so) as fear-mongering from the lunatic fringe. In addition to pre-packaged “story ideas” for the mass media, EMS provides commentaries, briefing papers, and even a stable of experts, all carefully calculated to win points for paying clients. These “experts,” though, are also part of the ruse. Over 70% of them earn their paychecks from current or past Fenton clients, all of which have a financial stake in seeing to it that the scare tactics prevail. It’s a clever deception perpetrated on journalists who generally don’t consider do-gooder environmentalists to be capable of such blatant and duplicitous “spin.”

The first rule of this game is that it’s strictly pay-for-play. For a price, you too can promote your product by maligning the competition with junk-science smear tactics. To Fenton Communications, you’ll be a “client”; down the hall at EMS, though, you’ll join the ranks of its “project partners.” And nobody will be the wiser.

Environmental Media Services was founded in 1994 by Arlie Schardt, who would later serve as communications director for Al Gore‘s 2000 Presidential campaign. Schardt in the 1970s left his position as a Sports Illustrated writer to head the Environmental Defense Fund. He was also a project director for Teresa Heinz Kerry’s and George Soros’ Tides Center, then chaired by ACORN founder Wade Rathke. In 2005, shortly after the RealClimate admission, Schardt retired and EMS was renamed the Science Communication Network. Their website carries a running feed of articles they have planted in the media on behalf of “organic” food processing and marketing clients of Fenton Communications.

Why would Jenkins want to cover up the real data? Well, even with the faked data, he did not look forward to having to explain that 1996 was in fact cooler than 1995. So he suggested:

“We explain why the globe is 0.23k (or whatever the final figure is) cooler than 95 (NAO reversal, slight La Nina). Also that global annual avg is only accuirate (sic) to a few hundredths of a degree (we said this last year – can we be more exact, eg PS/MS 0.05K or is this to big??)”

In spite of this, their scam was noticed at the time–but not by Fenton’s spoon-fed media outlets. For instance, on March 18, 1996 Michael Fumento of the Washington Times wrote:

In early January, the Climatic Research Unit at England’s University of East Anglia made headlines, including the New York Times, with a preliminary report saying 1995 was the hottest year on record. But their data were for only 11 months. Rather than risk December’s temperatures spoiling everything, they jumped the gun and sent out their press releases.

Their fears were fulfilled when December’s average temperature came in at the lowest in 17 years. “It was a pretty ordinary year,” said NASA scientist John Christy, who has been analyzing satellite data on temperature since 1979. And James Hansen of NASA’s Goddard Institute for Space Studies, who pretty much started the whole global-warming scare, admits his study of land areas – where the effects of global warming would be most severe – revealed that 1995 was about 0.02 degrees celsius cooler than 1990.

In Jenkins’ email, “NAO reversal” refers to an inconvenient cooling of ocean temperatures labeled: “North Atlantic Oscillation.” “Slight La Nina” refers to an equally inconvenient cooling of the Pacific called the the South Pacific Decadal Oscillation. The same excuses for global cooling are still being used 13 years later. For instance, consider this item from an October 9, 2009 BBC article titled, “What happened to global warming?”:

But those scientists who are equally passionate about man’s influence on global warming argue that their science is solid.

The UK Met Office’s Hadley Centre, responsible for future climate predictions, says it incorporates solar variation and ocean cycles into its climate models, and that they are nothing new.

In fact, the centre says they are just two of the whole host of known factors that influence global temperatures – all of which are accounted for by its models.

In addition, say Met Office scientists, temperatures have never increased in a straight line, and there will always be periods of slower warming, or even temporary cooling.

What is crucial, they say, is the long-term trend in global temperatures. And that, according to the Met office data, is clearly up.

Tom Wigley is a fellow of the American Association for the Advancement of Science described as “one of the world’s foremost experts on climate change and one of the most highly cited scientists in the discipline..” He has argued that the global warming alarmists are not alarming enough asserting: “the human-induced changes that are expected over the next 100 years are much, much greater than any changes that societies experienced in the past.” In an October 14, 2009 email, Wigley discusses similar methods for making cooling look like warming by manipulating the data:

…here are some notes of mine on the recent lack of warming. I look at this in two ways. The first is to look at the difference between the observed and expected anthropogenic trend relative to the pdf for unforced variability. The second is to remove ENSO, volcanoes and TSI variations from the observed data. Both methods show that what we are seeing is not unusual. The second method leaves a significant warming over the past decade.

While trying to figure out what degree of inaccuracy they could get away with asserting, and dithering over how to play with numbers to make cooling into warming, Jenkins had no problem peddling the wildest global warming claims. For instance the September 28, 1996 London Evening Standard reports:

An alarming picture of how London would be affected by global warming was painted by the Government’s top climate change adviser today.

Dr Geoff Jenkins fears that summer temperatures could hit 45C (113F), raising the spectre of thousands dying through heat-related illnesses; the number of days of extreme heat will rise 20-fold and rainfall will be down by a fifth making droughts a common occurrence.

What rain we get will be in heavier bursts and, as it hits parched ground, will increase the threat of floods threefold. Rising sea levels will see the Thames rise by 3ft, requiring billions to be spent on flood defences …

That was the propaganda required to peddle global warming in the mid-1990s. But in the next decade, global warmers sought to look past their wild claims and pretend that a “consensus’ exists. Jenkins, in lockstep, provided the “scientific” veneer for these claims telling the BBC July 27, 2004:

“We’ve reached the point where it’s only by including human activity that we can explain what’s happening.”

Doing their part to make up the story, the emailing global warming scientists are just cogs in this machine. But if the cogs seize up, the machine breaks down.

How the radical arm of the legal Left has undermined American security since 9/11.

Earlier this month, the Obama administration moved to transfer alleged 9/11 mastermind Khalid Sheikh Mohammed from the military justice system at Guantanamo Bay to the jurisdiction of the US District Court for the Southern District of New York. Behind this move away from the military tribunal system, which delivered justice so effectively at Nuremburg, is an $8.5 million lobbying effort by the so-called “John Adams Project” launched in April, 2008 by the American Civil Liberties Union.

With the endorsement of Clinton Attorney General Janice Reno, former boss of Obama’s Attorney General Eric Holder, as well as former President Jimmy Carter, FBI and CIA chief William Webster, and others from both Republican and Democratic administrations, the ACLU‘s victory on behalf of the man sometimes described as “al Qaeda’s CEO” is also a defeat in the U.S.-led war on terror. Thanks to the ACLU, a terrorist like KSM will now enjoy the constitutional rights reserved for American citizens.

The civilian trial of a leading terrorist is the culmination of a years-long campaign by the ACLU to handicap U.S. efforts in the war on terror. The ACLU responded to the 9/11 attacks with the formation of its so-called National Security Project. Under the leadership of the ACLU and its ideological affiliate, the so-called Center for Constitutional Rights, hundreds of lawyers from top law firms have worked without pay to “serve the caged prisoners,” as they call the terrorist detainees in American custody. Their assault on the courts, combined with Democratic electoral gains in 2006 and 2008, has seriously undermined the military commission system.

With the ACLU and CCR lawyers having long claimed that the failure to provide constitutional rights to terrorist captives is a crisis for the United States, the Obama administration has stepped in to “solve” it by transferring Mohammed and the four others to civilian courts. But, to the ALCU and its liberal allies, the al-Qaeda defendants are merely pawns in a larger game aimed at shackling the American and international forces who have been fighting al-Qaeda since 9/11.

Many of the ACLU’s campaigns have taken place under the “National Security Project.” Led by its CAIR-affiliated director, Jameel Jaffer, it reveals a broader picture of ACLU’s ongoing sabotage of American national security.

In AAR v. Chertoff and ASA v. Chertoff, the ACLU is fighting US denial of a visa application to Muslim Brotherhood propagandist Oxford professor Tariq Ramadan and South African Professor Adam Habib, accused of “engaging in terrorist activities.”

On behalf of three al Qaeda operatives, the ACLU is suing Jeppesen Dataplan, a Boeing airplane leasing subsidiary, based on allegations that its planes were used to transport illegal enemy combatants. The target is a single company, but in conjunction with the other facets of the ACLU plan, the objective is to use the threat of civil liability and the broad-brush accusation of “torture” to deny the US Department of Defense the use of private contractors upon which it depends for many essential functions.

In Kind Hearts for Charitable Humanitarian Development, Inc. v. Paulson et al. the ACLU seeks to protect an Islamist “charity” shut down in 2006 by the US Treasury Department for funneling money to Hamas. “Kind Hearts” is the successor to the shuttered Hamas fundraiser “Holy Land Foundation”. The objective is to prevent the US Treasury Department from halting suspected terrorist financiers and freezing their assets—even though ordinary drug dealers are subject to seizure and forfeiture on a daily basis.

ACLU v. DOD –the ACLU seeks to force exposure of WOT-related US government documents which may be used by US and foreign prosecutors to go after individual US and international military and intelligence personnel — and after defense contractors if the right kind of precedent is created in Mohamed et al. v. Jeppesen Dataplan, Inc . John Adams Project operatives are also photographing CIA agents and giving the photos to Guantanamo detainees in order to generate torture allegations.

In Amnesty v. McConnell, the ACLU seeks to eliminate the right of the US government to spy without warrant on international telecommunication traffic. This is a right exercised by Carter, Reagan, Clinton, Bush and now by Obama–as well as many Presidents before them. An ACLU victory in this case could subject numerous US military and intelligence personnel telephone companies and military contractors to criminal or civil prosecution by or on behalf of jihadists in US or foreign courts.

ACLU attorneys worked to defend Lynne Stewart, convicted in 2005 after being videotaped helping the “blind sheikh” Omar Abdel Rahman communicate from prison with his Egyptian terrorist comrades of Al-Gama’a al-Islamiyya, responsible for the 1997 Luxor massacre of 58 Japanese and European tourists.

In each of these cases the ACLU is seeking to extend constitutional rights to hostile foreign nationals living outside the US and to protect armed activities conducted partly or wholly outside the US. As the KSM trials suggest, it also has a sympathetic ear in the Obama administration.

For instance, Obama’s Attorney General Eric Holder was a senior partner in the Covington & Burling law firm, which currently represents 16 Guantanamo detainees. Holder’s C&B law partner David Remes stripped to his underwear at a July 14, 2008 Yemeni news conference to demonstrate the strip-searches he claims are the most serious “torture” inflicted on detainees. Strip searches are a daily standard procedure in US and international prisons housing common criminals. But in the eyes of Holder’s former partner, this procedure is too debasing to be applied to jihadists. Remes soon left the firm to work on so-called “human rights” cases full time.

Another of Holder’s former C&B law partners, Marc Falkoff, edited “Poems from Guantanamo: The Detainees Speak.” Falkoff described the detainee-poets—among them Abdullah Salih al Ajmi—as “gentle, thoughtful young men” in a 2006 nationally broadcast college teach-in. After the “gentle, thoughtful” al Ajmi was released from Guantanamo, he travelled to Mosul, Iraq. On Easter Sunday, March 23, 2008, after making an al-Qaeda suicide video, al-Ajmi drove a 5,000 to 10,000 lb truck bomb into an Iraqi army barracks and detonated himself, killing 13 Iraqi soldiers and wounding 31 more.

To be sure, the administration is not entirely in agreement with the ACLU. As Attorney General, Holder now takes pains to portray KSM as a special case and emphasizes that other Guantanamo detainees will still face military tribunals, not civilian courts.

But the ACLU has other ideas. It wants to see all the Guantanamo detainees given civilian trials. The ACLU strategy has the potential to create a web of interlocking decisions and precedents that would serve to establish a basis for criminal prosecutions and more civil lawsuits by al Qaeda members against the US military personnel, contractors, Bush administration officials, and intelligence officers who have pursued them since 9/11.

If the ACLU is even partially successful, Americans and foreign allies who have risked their lives to pursue al Qaeda may find themselves in court answering to charges brought by the jihadists. With the civilian trial of Khalid Sheikh Mohammed, the ACLU is one step closer to that destructive goal.
