How Obama's amnesty will give non-citizen law-breakers access to a “wide array” of programs -- and an advantage in the job market.

Apparently President Obama’s unilateral decision to grant de facto amnesty to five million illegal aliens was insufficiently outrageous. On Tuesday, a White House official told the Washington Post that many illegals now protected from deportation will be eligible to receive a “wide array” of government benefits, including Social Security and Medicare.

The admission verifies that, once again, Americans are forced to endure another lie perpetrated by the president. When he announced his executive action last Thursday, Obama was adamant. “It does not grant citizenship, or the right to stay here permanently, or offer the same benefits that citizens receive—only Congress can do that. All we’re saying is we’re not going to deport you,” he insisted.

Not exactly. The status conferred by the president activates the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, which states that the government “will pay monthly title II and title XVIII benefits to a claimant/beneficiary who is present in the U.S. and who is a U.S. citizen, U.S. national, or lawfully present alien as determined by the Attorney General” (italics mine). It further states that payment provisions “apply to retirement, survivors or disability benefits. This rule also applies to payments made for Medicare services rendered.”

Illegals would be required to pay a Federal Insurance Contributions Act (FICA) tax, which includes separate payments made to Medicare and Social Security. Once they do that, benefits await. “If they pay in, they can draw,” White House spokesman Shawn Turner told the Post by e-mail.

Turner further noted that such eligibility does not extend to benefits such as student financial aid, food stamps, housing subsidies or ObamaCare. Yet as critics of the president’s plan rightly explain, this administration’s “flexible” approach to the rule of law and the Constitution leaves the door wide open for additional “adjustments” to the program.

“Deferred action and parole-in-place don’t fit neatly into statutory definitions that prohibit access to benefits, mostly because deferred action and parole-in-place have no statutory basis themselves,” Federation of American Immigration Reform (FAIR) communications director Bob Dane told Breitbart News. “Congress has never imagined a rogue president pulling rabbits out of a hat to justify a broad, transformational makeover of the country by way of amnesty. There will always be thousands of loopholes in the law and backdoor methods to achieve a desired agenda, but ultimately the intent of Congress is preeminent. It may be that the courts will have to review that.”

If a recent ruling by a three-judge panel at the 9th Circuit Court of Appeals is any indication, there may be little relief in sight. On Monday, they rejected Arizona Gov. Jan Brewer’s request to rehear a case related to her 2012 executive order denying about 20,000 illegals access to drivers’ licenses. The Court determined that the Obama administration’s Deferred Action for Childhood Arrivals (DACA), allowing illegals brought here as children before June 15, 2007, and born after 1981 to be protected from deportation, included the right to obtain those licenses.

In other words, we already have exactly the kind of court-sanctioned “extrapolation” of a constitutionally-dubious executive order that completely belies Turner’s assertion. Thus it is more than likely a president interested in a “fundamental transformation” of the nation—one that includes the transparent attempt to make the Democrat Party an unassailable power—would be more than OK with pulling a few more “rabbits out of a hat” to realize that agenda.

According to the Heritage Foundation’s Robert Rector, the current level of benefit access imposes a staggering cost on the nation. “The net cost–which is total benefits minus total benefits paid in–of the amnesty recipients I estimate will be around $2 trillion over the course of their lifetime,” Rector told Breitbart News Monday. “What [Obama] is doing is he is putting these 4 million people– who on average have a 10th grade education–into the Social Security and Medicare programs. Given their expected earnings, from someone that has a 10th grade education, they will draw about three dollars worth of benefits out of those programs over their lifetimes for every dollar they put into them. But the overall cost in outlays will be around a trillion dollars for those programs alone,” he added.

Rector’s calculations were based on a figure of 4 million illegals living an average of 50 years each. The additional trillion dollars of his estimate is based on an assumption that is the mother’s milk of the American left: incrementalism. Rector assumes that additional legislation—or another executive order—will eventually grant amnestied illegals unrestricted access to America’s welfare state. He further envisions that once the citizen children of the amnestied illegals turn 21, they could petition the government for green cards to be granted to their parents, without those parents having to leave the country to get them. “After 5 years with a green card status they are eligible for all the welfare programs,” he explained.

Ironically—or perhaps more accurately, inevitably—the push to expand amnestied illegals access to benefits will be driven by ObamaCare. As the Washington Times explains, the current executive order gives up to 5 million illegal immigrants three years of legal presence in the country that includes the ability to obtain work permits—but not ObamaCare. As a result businesses that hire amnestied illegals will not have to pay the $3000 ObamaCare penalty for denying them healthcare coverage. Since that penalty would apply to native-born workers, ObamaCare has established a perverse incentive to favor illegal employees over American employees

Rep. Lamar Smith lamented that reality. “If it is true that the president’s actions give employers a $3,000 incentive to hire those who came here illegally, he has added insult to injury,” he contended. “The president’s actions would have just moved those who came here illegally to the front of the line, ahead of unemployed and underemployed Americans.”

Or as mentioned earlier, it would provide the administration with a springboard to expand ObamaCare coverage to include amnestied illegals. It doesn’t take much of an imagination to envision the administration pursuing mainstream media-assisted sales pitch that such a scenario is a “win-win” for illegals who get healthcare coverage, and American workers who no longer have to worry about that perverse incentive.

Republicans were ostensibly surprised that amnestied illegals would be eligible for Social Security and Medicare. “First with Obamacare we were told we should pass it and then read it to find out what was in it,” noted Republican National Committee (RNC) spokeswoman Kirsten Kukowski. “Now Obama overreached and acted unilaterally on immigration, which should have been vetted and authorized by Congress, and we’re finding out there’s more to the story than Obama and the Democrats originally told Americans.”

All well and good, but one suspects Americans have little sympathy for a reactive GOP, one “finding out” that the same president and party who lie on a regular basis would once again engage in subterfuge to further their agenda. Credit the normally clueless Sen. John McCain (R-AZ) for having a clue this time around. McCain spokesman Brian Rogers said the best way to get rid of the loophole is to get rid of the employer mandate itself, adding that next year’s GOP majority should hold a vote on such a proposal.

That would theoretically put the president between a rock and a hard place—unless he unilaterally decided to grant temporary access to ObamaCare to amnestied illegals. There is little doubt a president who makes it up as he goes along would dismiss such an idea out of hand. Another solution would be to once again postpone the business mandate. Again, in the age of the Imperial President, all things are possible.

In the meantime, Obama reminded the nation why he remains one of the most divisive individuals to ever occupy the Oval Office. “There have been periods where the folks who were already here suddenly say, ‘Well, I don’t want those folks,’ even though the only people who have the right to say that are some Native Americans,” he told a Chicago audience Monday, completely dismissing the concerns of millions of Americans, including 62 percent of likely voters who opposed his unilateral efforts. He further insisted migrants “will boost wages for American-born workers.”

There are conflicting reports with regard to that statement, depending on whose ideology is being served. Yet the most basic rule of supply and demand cannot be ignored: when you have more of something, as in a larger pool of foreign and native-born workers competing for jobs, each unit of that something, in this case wage levels, are worth less. Yet as far as this president and his party are concerned, the well-being of Americans and illegals are now inseparable agendas. One is left to wonder how long American citizens will put up with that.

The catastrophic impact Obama's immigration power grab will have on America.

That we live in a perilous era is hardly a headline — this is a well established fact. America and Americans face an existential threat posed by terrorist organizations. Additionally, huge quantities of heroin and cocaine have flooded across our borders, smuggled by pernicious drug trafficking organizations that have set up shop in communities across the United States. There is a strong nexus between narcotics trafficking and narcotics use and crime, especially violent crime.

The tens of billions of dollars, the annual proceeds from the drug trade, flow into the coffers of transnational drug trafficking organizations and international terrorist organizations.

Finally, our nation’s economy continues to falter and struggle as do tens of millions of American workers and their families find that their incomes shrink as their expenses rise as more foreign workers enter the United States each month than the number of new jobs that are being created.

All of the above-noted issues have a clear nexus to failures of our nation to secure its borders and enforce the immigration laws effectively. In point of fact our immigration laws were enacted with two primary goals, protect American lives and the jobs of American workers.

In point of fact, our borders and our immigration laws are supposed to shield America and Americans. Given all of the threats and challenges confronting America and Americans those shields should never be more important. However, you would never know it to listen to the President and, frankly, to all too many of our nation’s politicians from both sides of the political aisle in Washington and on the state and local levels.

On November 20, 2014 President Obama went before the cameras at the White House and laid out his plans to unilaterally “fix” the broken immigration system. That there are millions of illegal aliens present in the United States indicates that our immigration system is failing. That terrorists have been able to enter the United States and embed themselves in the United States provides further evidence of failures of the immigration system. Consider, if you will, that the Tsarnaev brothers were able to gain lawful entry into the United States and apparently game the political asylum program. This provides a graphic example of a failure of that component of the immigration system.

“The Social Contract” published my article in its Summer 2013 edition, on how fraud in the political asylum program currently enables our enemies to see in America’s compassion, weakness. The title of my article was “Political Asylum: Where Compassion and National Security Intersect.”

What has never been explained, by President Obama or others who claim that the immigration system is broken, is how their proposals will greatly reduce the number of illegal aliens present in the United States. What has never been explained is how the proposed “fixes” will create integrity to the processes by which aliens are granted visas or immigration benefits such as gaining lawful immigrant status or United States citizenship. These are critical issues that were identified by the 9/11 Commission.

Traditionally when laws are violated our leaders call for enhanced enforcement efforts to combat and deter the crimes. Because of concerns about those who have trespassed on New York City landmarks, Senator Chuck Schumer has proposed that a law be enacted that would subject those trespassers to a period of imprisonment of five years rather than the maximum of one year currently on the books. He stated in part:

“While individuals like this (trespassers) may have meant no harm, their acts put commuters and first responders at risk,” Schumer said. “They also inspire copycats who may have much more evil plans in mind.”

Critical infrastructure is defined by the Patriot Act as systems and assets so vital to the U.S., that the incapacity or destruction to them would have a debilitating effect.

“That would be a bridge, a power plant, the air vents to one of our tunnels,” Miller said.

Miller and Schumer said the new legislation will help serve as a deterrent.

“When stunts like this occur, the New York City trespassing law has a maximum of one year and it’s often three months,” Schumer said. “That’s not enough punishment to deter this behavior. It’s time to change that.”

Schumer said this legislation is based on another federal law protecting railroads.

His statements were reported upon in an October 14, 2014 CBS News report, “Mayor De Blasio Heads To D.C. For Meetings On NYC Security And Counter-Terrorism.”

However, Senator Chuck Schumer has been the staunchest advocate for providing a pathway to United States citizenship to illegal aliens who have trespassed on America by running our nation’s borders and evading the crucial screening process conducted by CBP (Customs and Border Protection) inspectors at ports of entry. This serves to encourage, not deter, aliens to run our nation’s borders.

Where our broken immigration system is concerned, the obvious questions not being asked or answered is, “Where is the deterrent?” “How is the lack of integrity in the immigration adjudications program being addressed?”

President Obama’s tone has been defiant, claiming that if members of Congress wanted to stop him from taking his actions that they should pass an immigration bill that he agreed with. It was a stunning statement especially considering that Obama was a constitutional law instructor. On numerous previous public appearances he made it clear that he did not have the authority to act alone to take the actions that he is now taking to deal with immigration. Yet, for reasons never articulated, he has now made it clear that he will now do what he had previous claimed he lacked the legal authority to do.

He has also never explained how his actions would curtail future illegal immigration or address the recommendations and findings of the 9/11 Commission. But then, these are critical questions that virtually no journalists have ever asked or members of the Republican Party have ever addressed, either.

Obama is attempting to extort immigration legislation by using the sort of “strong arm” technique of Tony Soprano rather than the conciliatory and constitutionally mandated technique befitting the President of the United States, who leads the most powerful democratic republic on the planet.

While the media has fixated on the procedural issues of whether or not what Obama is promising (threatening?) to do is within the bounds of his legal authority as the President of the United States, what has never been discussed to any great degree is the other procedural question — how would USCIS (United States Citizenship and Immigration Services) implement this massive amnesty program involving millions of illegal aliens with even a sliver of integrity?

On November 30, 2013 Californians for Population Stabilization (CAPS) posted my commentary, “Political Asylum Fraud: Where America’s Compassion Becomes Vulnerability”that was predicated on a hard-hitting report posted by ABC News on November 20, 2013, “Exclusive: US May Have Let ‘Dozens’ of Terrorists Into Country As Refugees.”

The number one priority of the government of the United States is national security and, with it, public safety. How on earth could the administration successfully administer that program in a manner that would not undermine national security and public safety? Let us remember that America’s borders and immigration laws are its shields, its first line of defense and last line of defense against international terrorists, transnational criminals and other foreign nationals whose presence in the United States would undermine national security, public safety, public health or otherwise compromise the well-being of America and Americans.

On September 10, 2014 the New York Post published a disturbing report, “Homeland Security: We can’t stop ISIS from coming into US.”

Here is an important quote from this report:

‘Terrorists could be just one visa-free flight away from arriving in the United States.’

-Rep. Candice Miller

Members of Congress cited estimates that 12,000 foreigners have traveled to Syria to engage in the civil war, including more than 1,000 Europeans and more than 100 Americans, with a dozen Americans believed to be fighting alongside ISIS.

“ISIS is a threat to the United States and to the people of the United States,” said Rep. Sheila Jackson Lee (D-Texas).

“We may be reminded on 9/11 the count was approximately 19 who created the most heinous terrorist attack, killing more than 3,000.”

One Frenchman who trained with ISIS went to Brussels to murder four people at a Jewish museum in May, authorities say.

State Department and Homeland Security leaders said they’ve been working diligently with the tools at their disposal, including constantly upgrading border security procedures, reviewing the terror watch list and vetting visas.

“Though we currently have no credible information to indicate that ISIL is planning to attack the homeland, we remain concerned in the long term that their access to Westerners … will allow them to plan and coordinate attacks in the US,” Lasley said.

On November 10, 2014 Newsweek published a report about how the CIA is unable to effectively vet just 5,000 Syrians who claim to be moderates who want to help fight ISIS. Realize that these are people who are in their country of citizenship and the CIA is able to conduct in-person interviews and are able to conduct investigations in the towns and villages where these people live, yet the vetting process is a disaster. If it is virtually impossible to effectively screen 5,000 Syrians within their own country, how on earth could USCIS properly vet 5 million or, likely, many more aliens in the United States without an interview or field investigation?

The Newsweek article, “Inside the CIA’s Syrian Rebels Vetting Machine,” begins with this passage:

Nothing has come in for more mockery during the Obama administration’s halting steps into the Syrian civil war than its employment of “moderate” to describe the kind of rebels it is willing to back. In one of the more widely cited japes, The New Yorker’s resident humorist, Andy Borowitz, presented a “Moderate Syrian Application Form,” in which applicants were asked to describe themselves as either “A) Moderate, B) Very moderate, C) Crazy moderate or D) Other.”

After Senator John McCain allegedly posed with Syrians “on our side” who turned out to be kidnappers—a report later called into question—Jon Stewart cracked, “Not everyone is going to be wearing their ‘HELLO I’M A TERRORIST’ name badge.”

Behind the jokes, however, is the deadly serious responsibility of the CIA and Defense Department to vet Syrians before they receive covert American training, aid and arms. But according to U.S. counterterrorism veterans, a system that worked pretty well during four decades of the Cold War has been no match for the linguistic, cultural, tribal and political complexities of the Middle East, especially now in Syria. “We’re completely out of our league,” one former CIA vetting expert declared on condition of anonymity, reflecting the consensus of intelligence professionals with firsthand knowledge of the Syrian situation. “To be really honest, very few people know how to vet well. It’s a very specialized skill. It’s extremely difficult to do well” in the best of circumstances, the former operative said. And in Syria it has proved impossible.

The 9/11 Commission Staff Report on Terrorist Travelwas prepared by the staff that assisted the 9/11 Commission. The preface of that document began with this paragraph:

“It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United States if they are unable to enter the country. Yet prior to September 11, while there were efforts to enhance border security, no agency of the U.S. government thought of border security as a tool in the counterterrorism arsenal. Indeed, even after 19 hijackers demonstrated the relative ease of obtaining a U.S. visa and gaining admission into the United States, border security still is not considered a cornerstone of national security policy. We believe, for reasons we discuss in the following pages, that it must be made one.”

That report also detailed numerous examples of instances where terrorists not only made use of visa and immigration benefit fraud to enter the United States, but to also embed themselves in the United States. Page 47 of this report noted:

“Once terrorists had entered the United States, their next challenge was to find a way to remain here. Their primary method was immigration fraud. For example, Yousef and Ajaj concocted bogus political asylum stories when they arrived in the United States. Mahmoud Abouhalima, involved in both the World Trade Center and landmarks plots, received temporary residence under the Seasonal Agricultural Workers (SAW) program, after falsely claiming that he picked beans in Florida.”

It is significant to note that the Seasonal Agricultural Program, also known as the Special Agricultural Program (SAW), were major components of the 1986 amnesty and that New York’s then-Congressman Chuck Schumer was one of that program’s major architects even though there were absolutely no farms in his congressional district when he concocted it.

This paragraph is found on page 98 of the report, under the title “Immigration Benefits”:

Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.

The program that the administration is about to create violates the findings and recommendations of the 9/11 Commission yet, incredibly, this issue is never raised in the mainstream media or members of either political party in either the House of Representatives or the Senate.

While Obama and others have stated that the program being by the administration would involve five million illegal aliens, there is no assurance that humongous as that number is might not quickly swell to double or triple that number. In 1986 the Reagan administration predicted that roughly one million illegal aliens would participate in the amnesty program that was a part of the Immigration Reform and Control Act. By the time that the bureaucratic dust had settled between 3.5 and 4 million aliens had gained lawful status.

While the majority of these illegal aliens are not likely to have serious criminal histories or affiliations with terrorist organizations, the sheer magnitude of this program would create a monstrous haystack in which some truly deadly needles will easily be able to conceal themselves. Because of the huge number of applications that will likely be filed, there would be no capacity to conduct routine face-to-face interviews with the applicants. There would be no capacity to conduct routine field investigations to seek to verify information contained in the applications.

Furthermore, because of the huge number of applications and relatively sparse numbers of USCIS adjudications officers, applications will need to be processed quickly. This raises yet another area of concern. It takes just minutes for an adjudications officer to approve an application but may take hours, days or even weeks for those adjudicators to deny an application. Adjudications Officers will be required to process a minimum number of applications per day or week to satisfy the standards established in their evaluations which are prepared periodically. This will force these dedicated employees to be pressured to approve the great majority of the applications that they are given to adjudicate.

On November 1, 2013 CAPS (Californians for Population Stabilization posted my commentary: “Speed Kills at USCIS”

USCIS (United States Citizenship and Immigration Services) is the woebegone division of the DHS that would be tasked with administering this program. As it is, this beleaguered and inept agency cannot keep up with its workload without “rubber-stamping” approvals on many applications where this slipshod approach enables fraud to often go undetected. It only takes minutes for an Adjudications Officer to approve an application for a benefit such as lawful status or citizenship, but it may require hours or days to deny an application.

The adjudications officers will be pressured to “get to yes” as was reported by the media about instructions given to these USCIS officials. Furthermore, their evaluations contain productivity requirements (quotas). A diligent adjudicator will find his/her career imperiled for not meeting quotas that all but preclude denying more than a very few applications.

I wrote an article about the plight of these officials in my article for CAPS, “The Immigration Bon Bon Factory.” In my piece I noted that a hilarious episode of “I Love Lucy” found the hapless Lucy and her comedic side-kick Ethel working in a candy factory and were assigned to wrap morsels of bon bons. They were unable to keep up with the pace of candy hurtling at them on a conveyor belt that started slowly but quickly accelerated to warp speed. They were warned that if they failed to keep pace with the candy they would be fired. To keep from losing their jobs they began stuffing the candy down their clothing and eating them, but to no avail.

While the situation Lucy and Ethel found themselves in were designed to entertain their audience, there is nothing amusing about the plight of the employees of USCIS or what it means for national security.

This is not just speculation on my part but is, in fact, based on the current reality in terms of how the hundreds of thousands of applications for DREAMERS are being adjudicated now. Indeed, the approval rate for the DREAMERS under the DACA (Deferred Action- Childhood Arrivals) Program now exceeds 95%.

Because of this illegal aliens, who, for reasons only known to them, evaded the inspections process that is supposed to prevent the entry of aliens whose presence would be problematic for America and Americans, will see an opportunity to secure lawful status and official identity documents by committing fraud that is most likely to go undetected. Aliens will be able to succeed in lying about their identities, including potentially their true countries of citizenship. They will also likely be able to successfully make false claims concerning their dates and methods of entry into the United States.

That these aliens evaded the inspections process is all but ignored in the media and in the statements made by our supposed political leaders. Aliens who run our borders entered the United States by evading the inspections process conducted at ports of entry by CBP (Customs and Border Protection) inspectors that is supposed to prevent the entry of aliens into the United States whose presence would be dangerous to the safety and well-being of America and Americans.

Title 8, United States Code, Section 1182 enumerates the categories of aliens who are to be excluded. Among these classes are aliens who suffer from dangerous communicable diseases or extreme mental illness. Additionally convicted felons, human rights violators, war criminals, terrorists and spies are to be excluded, as well as aliens who would seek unlawful employment thus displacing American workers or driving down the wages of American workers who are similarly employed and aliens who would become public charges.

It should be obvious that aliens who evade that inspections process do so because they know that they belong to one or more categories of aliens who are to be prevented from entering the United States. What is not obvious about these aliens is any information as to what would prevent them from being lawfully admitted. There is no way to readily determine their true identities or backgrounds. This means that they may successfully lie about their countries of citizenship as well as their names and dates of birth. Their is no way to even know when or how they actually entered the United States.

The National Review Online posted an article that coincided with the New York Post Post article, “ISIS Fighters Getting Caught Coming Across the U.S.-Mexican Border?”

Here is the text of this relatively short and disconcerting report:

From the midweek edition of the Morning Jolt:

Say What? ‘At Least Ten ISIS Fighters Have Been Caught Coming Across the Border’

Rep. Duncan Hunter, Republican of California, does not seem like a nut job or prone to wild exaggerations. But last night he said something that should make jaws drop:

Van Susteren: Hold on. Stop for one second.

Hunter: They are going to be bombing American cities coming across from Mexico.

Van Susteren: Let me ask a question. You say that they are coming in the southern border, which changes all the dynamics Do you have any information that they are coming in through the southern border now?

Hunter: Yes.

Van Susteren: Tell me what you know.

Hunter: At least ten ISIS fighters have been caught coming across the border in Texas.

Van Susteren: How do you know that?

Hunter: Because I’ve asked the border patrol, Greta.

Van Susteren: And the border patrol just let’s ISIS members come across the border?

Hunter: No. They caught them at the border. Therefore, we know that ISIS is coming across the border. If they catch five or ten of them, you know that there are going to be dozens more that did not get caught by the border patrol. That’s how you know. That’s where we are at risk here, is from ISIS and radical Islamists coming across the border. Once again, they don’t have a navy, air force, nuclear weapons. The only way that Americans are going to be harmed by radical Islam — Chairman Dempsey said the same thing. He said that’s where the major threat is here, that’s how these guys are going to infiltrate through America and harm Americans.

Providing millions of illegal aliens with lawful status and official identity documents would not provide a deterrence to millions of aspiring illegal aliens from around the world and with the abject lack of integrity to the process, could potentially wind up with the additional consequences of providing terrorists with official identity documents in false names.

Mr. Obama’s plans could be the ultimate bad news.

Given the foregoing, Star Trek’s Captain James T. Kirk would likely command, “Shields up!”

Incomprehensibly, Mr. Obama is ordering just the opposite and the focus of attention of the media and politicians from both parties is solely on whether or not the President’s executive orders are constitutional, certainly a major issue. However, what is being ignored is the impact this will have on our nation and our citizens in this particularly perilous era.

Under the program Mexican gangsters were provided with guns by the U.S. in the hope that they would go on a killing spree that would whip up public hysteria that might have led to a crackdown on gun ownership.

The ongoing assault on the Border Patrol is completely preventable. Evidence strongly suggests it is part of President Obama’s plan to cause chaos on the border as part of his larger assault on the nation’s free institutions. Obama’s policies encourage illegal aliens, including gang members and other violent criminals that are part of the Democratic Party’s natural constituency, to invade the United States in record numbers.

It is a kind of Mariela boatlift in reverse in which the U.S. president is aggressively recruiting and importing the dregs of Latin American society into the U.S.

It is taking a grave toll on the people of the United States.

As Breitbart News reports, a new report from the U.S. Department of Justice states that roughly half of all federal criminal cases in 2013 were filed in regions close to the southern border.

To no one’s surprise, the news report states:

During [Fiscal Year] 2013, U.S. Attorney’s offices filed a total of 61,529 criminal cases against defendants, according to the DOJ. Regions along the border each had more convictions than in any other district. 6,341 cases were filed in Western Texas, suggesting it is home to the country’s most severe crime patterns. 6,130 cases were filed in Southern Texas; 4,848 were filed in Southern California; 3,889 were filed in New Mexico; and 3,538 were filed in Arizona.

The lawlessness will continue and undoubtedly escalate in the remaining two and a half years of Obama’s term of office.

More Border Patrol deaths are inevitable thanks to the dangerous policies of this malevolent administration.

How many bases across the country are redistributing illegal immigrants?

A source tipped me off last week to a curious occurrence: It seems that two planeloads of illegal aliens were recently shipped to Massachusetts. The first reportedly landed at Hanscom Air Force Base in Bedford. According to my tipster, approximately 160 illegal immigrants arrived on that flight and stayed nearly a week before being transferred to a Department of Homeland Security site and then released.

The second flight reportedly was diverted from Hanscom to Boston’s Logan Airport this past weekend. I am told that both Massachusetts and New Hampshire officials were on hand. I reached out to Hanscom AFB for confirmation, but did not receive a call back by my deadline.

Question: How many other military bases are stealthily being used to redistribute, house, process and release illegal border crossers?

What we do know for sure is that the Obama administration already has converted several other military bases across the country into outposts for tens of thousands of illegal aliens from Central and South America.

San Antonio’s Lackland Air Force Base opened its doors as an illegal immigrant camp last month. Port Hueneme Naval Base in Ventura County, Calif., will shelter nearly 600 illegal border-crossing children and teens. The Fort Sill Army post in Lawton, Okla., was ordered on Friday to take in 1,200 illegal aliens despite the objections of GOP Gov. Mary Fallin, who blasted the White House, saying, “The Obama administration continues to fail in its duty to protect our borders and continues to promote policies that encourage, rather than discourage, illegal immigration.”

A makeshift detention center in Nogales, Ariz., is being used as the central clearing station for the latest illegal alien surge. The deluge is a threat to national security, public safety and public health — not to mention a slap in the face to the law-abiding men and women in uniform on those bases and a kick in the teeth to law-abiding people around the world patiently waiting for approval of their visas.

Meanwhile, a law enforcement source in Texas tells me this week that countless illegal aliens are being released into the general public despite testing positive for tuberculosis.

“The feds are putting them on public transportation to God knows where,” he said.

Another source, working in the border patrol in south Texas, tells me: “Our station, along with every other station, is flooded with women and small children. One lady yesterday had a baby as young as 8 months. And they’re coming over with pink eye and scabies. So getting them medically cleared becomes a priority. They’ll be here for almost a week, so we provide them with formula and diapers. We have a catering service contracted to feed them because it’s too many for us to feed on our own. And of course, they end up being released because every family housing facility is full. They’re supposed to show up for immigration court at a later date, but they don’t.”

Same old, same old. I’ve reported for years on the feds’ catch-and-release games and deportation Kabuki. The “notice to appear” letters — known as “run letters” — are a notorious joke in open-borders circles.

The latest “crisis” is a wholly manufactured byproduct of White House administrative amnesties, which are supported by a toxic alliance of ethnic-vote-seeking Democrats and cheap-labor-hungry Big Business Republicans. The flood comes just as Obama’s DHS announced a two-year extension for beneficiaries of the “Deferred Action for Childhood Arrivals” (DACA) program. A whopping 560,000 illegal aliens have been granted amnesty under DACA and also have received employment authorization.

As I’ve said for two decades, illegal alien amnesties guarantee two things: more illegal immigration and more Democratic voters. Now we have a White House forcing U.S. military bases to provide interminable benefits and services to illegal aliens for political gain, while said White House evades responsibility for allowing military veterans to die waiting for the most basic of medical services.

And where’s the GOP “leadership” in this country? Doing the bidding of the amnesty-loving U.S. Chamber of Commerce and demonizing Republican candidates at every level who are sick and tired of giving away the store and the country.

God save us from bipartisanship.

A grim example of the law of unintended consequences.

Last week, the lawlessness of Obama’s non-deportation policy came home to roost when Homeland Security (DHS) estimated 60,000 “unaccompanied alien children” were expected to enter the country illegally this year. The figures have since gone up to 90,000, which is more than a ten-fold increase from 2011. Unsurprisingly, according to interviews with those caught, the news waves are directly related to Obama’s rolling orders to DHS to ramp up amnesty efforts wherever possible. Yesterday, Senator Cornyn of Texas called Obama’s continued amnesty push an “extremely dangerous incentive for children” and “a painful example of the law of unintended consequences.”

Stories have been ongoing of illegal alien children, teens and adults being flown around the Border States in search of any government facility that may have available space. After it was reported last week that Greyhound stations in Phoenix were becoming drop-off points for detained-illegals flown in from border-checkpoints in Texas, Arizona’s Governor Brewer fired off a letter to the President asking him to end his “unconscionable policy.”

Considering the depth and scale of Obama’s subversion of our immigration laws, the prospect of thousands more children and teens illegally entering the country won’t likely change his approach to border security any time soon. After all, as it was revealed last December, DHS has actually been directly and proactively facilitating human-trafficking for quite some time.

In the case of U.S. v. Nava-Martinez, border agents busted a repeat-felon attempting to smuggle a 10-year old El Salvadorian girl across a checkpoint in Texas later discovering that the operation was organized by the girl’s mother, an illegal alien living in Virginia. But when the agents contacted DHS officials they refused to arrange for her arrest. Instead, according to Judge Andrew Hanen of the Southern District Court of Texas, DHS “successfully complet(ed) the mission of the criminal conspiracy” by flying the child to her mother in Virginia at taxpayer expense.

The order issued by Judge Hanen is a crushing rebuke of Obama’s DHS. In it he warns that such immoral and illegal policies would dramatically increase the number of minors attempting to make the dangerous trip across the border. With DHS’s new estimates and the huge problems hitting the Border States, we can now see how right the good judge was.

In just the previous month alone, Judge Hanen had seen four cases of “DHS completing [a] criminal conspiracy… by delivering [minors caught at the border] to the custody of parents illegally living in the United States.” In none of the cases were the children detained or the illegal alien parent deported.

Besides the concerns that DHS’s facilitation of illegal activities works to decrease border agents’ morale and helps fund drug cartels (the chief operators of human smuggling rings), the remarkably prescient judge had noted that such a policy “undermines the deterrent effect the laws may have and inspires others to commit further violations.” The consequences of this undermining effect we’re now seeing and hopefully it’s becoming clear to the elite and media classes just how dangerous it is to play politics with immigration enforcement.

Since the first amnesty in 1986, the illegal alien population has ballooned from 3 million to 12 million with most of that increase coming in the last decade. Obama’s first administrative amnesty in 2012, the “Deferred Action for Children Arrivals” program, applied specifically to children and young adults, which, along with further mini-amnesties since, has acted as an announcement to the people of Mexico and Central America that the US is not at all serious about its border security.

Who knows what the next round of figures from DHS will be, but it’s possible they’ll be double or even triple the recent estimates. The same goes for deaths at the border, which have already been on the increase since Obama started his amnesty-push. As Judge Hanen devastatingly wrote at the close of his order, if DHS persists with such a policy, “more children are going to be harmed, and DHS will be partly responsible because it encourages this kind of Russian roulette.” It’s now time for Obama and Democrats to finally consider the consequences of their policies, which harm citizens on both sides of the border, and turn off the amnesty magnet.

Another change in prosecutorial "priorities" in the offing?

Recently installed Homeland Security Secretary Jeh Johnson is proving to be just as adept as his predecessor was at blindingly carrying out the destructive, lawless policies of the Obama administration.

This week the AP reported that Secretary Johnson’s been considering changing the “priority list” at DHS’s immigration enforcement branch by giving amnesty to illegal aliens who have not committed “serious crimes.” It wasn’t specified what qualifies as “serious,” but those given a pass apparently would include illegal aliens who have re-entered the US after being deported before (currently a felony under federal law) as well as fugitives from immigration proceedings – A report also out this week from the Center for Immigration Studies says this latter group alone could number in the hundreds of thousands.

This proposal to unilaterally change how immigration law is enforced comes after the Schumer-Rubio bill stalled in the House and mirrors the original Congress-defying amnesty Obama implemented in the lead up to the 2012 elections. It also shows that the new era of lawlessness we find ourselves in is apparently here to stay.

As the AP writes, “adjusting the department’s priorities for deportation” has become a new approach for this Administration. This is a reference to DHS’s newfound use of “prosecutorial discretion”, a tool manipulated by the Obama Administration to “adjust” our immigration laws in order to expand the number of future Democratic constituents. As Stanford law professor John Yoo writes, “using ‘prosecutorial discretion’ not to enforce statutes with which the President disagrees” has become his “preferred tool for domestic policy.”

In the immigration context, “prosecutorial discretion” has been used as weapon to weaken border and interior enforcement. For this, in part, we can thank the Republican leadership’s almost total lack of opposition to Obama’s amnesty plans.

Notwithstanding that a judge recently called Obama’s 2012 administrative amnesty unconstitutional and illegal, anyone willing to look up the history of “prosecutorial discretion” will see just how cynical this administration is when it says it’s in the clear to retroactively “adjust” our immigration laws.

“Prosecutorial discretion,” or “deferred action” as it’s also known, is the general ability of any law enforcement agency to decline to arrest someone for minor infractions, such as jaywalking in the case of the police. Importantly, it’s not a policy entrenched in law; it’s an administrative directive or tool that’s meant to be applied, not broadly, but in minor and highly particular cases. For instance, in 1972, it was applied for the first time to John Lennon after his long struggle against deportation ordered by the Nixon administration. Later in the early eighties, the INS would grant deferred action to a select-few US citizen widows and widowers who were facing deportation.

In 2011, Jessica Vaughn from the Center for Immigration Studies in D.C., gave testimony before the House Judiciary Subcommittee on Immigration Policy and Enforcement, where she called “prosecutorial discretion” an “extraordinary tool” that due to its “lack of statutory guidelines makes it especially susceptible to abuse.”

One year after Ms. Vaughn’s testimony and soon after the DREAM Act was rejected by Congress for the 24th time, Obama placated the open-borders lobby by telling DHS to apply “prosecutorial discretion” on a mass scale. In June 2012, he issued an Executive Order telling enforcement officials to stop arrests of illegal aliens under 30 and those who had arrived before they were adults, a group estimated to number around 800,000 and later adjusted upwards to 1.4 million.

We know for a fact that our ex-law professor president understood that “prosecutorial discretion” had never before been applied on such a mass scale and that his Executive Order was way out-of-bounds legally. Immediately after the DREAM Act failed in 2011, Obama told a group of “immigration rights” activists that “[w]ith respect to the notion that I can just suspend deportations through executive order, that’s just not the case… there are laws on the books that Congress has passed.” Of course, considering he’s done everything possible to weaken border enforcement, attacks state and local governments when they try to enforce federal law on their own, and lets holier-than-thou “sanctuary” cities ignore federal mandates to detain illegals, this really shouldn’t surprise.

In another critical law journal article about Obama’s illegal amnesty, Professor Yoo asked, “[I]f a president can refuse to enforce a federal law against a class of 800,000 to 1.76 million, what discernible limits are there to prosecutorial discretion?” As we’ve seen with Secretary Johnson’s latest proposal, if our representatives fail to check the president, the limits to such lawlessness are unbound.

Criminal record? Repeat offenses? "Welcome to America," says the president.

The Obama administration is barely enforcing immigration laws against illegal immigrants now and intends to do even less in the future, according to Sen. Jeff Sessions (R-Alabama).

“The evidence reveals that the Administration has carried out a dramatic nullification of federal law,” Sessions told Breitbart News.

“Under the guise of setting ‘priorities,’ the Administration has determined that almost anyone in the world who can enter the United States is free to illegally live, work and claim benefits here as long as they are not caught committing a felony or other serious crime.”

Sessions’s comments came after his office released a three-page “Critical Alert” prepared by the senator’s staffers. The report asserts that the Obama administration is currently blocking the enforcement of immigration laws in the overwhelming majority of violations and is planning to turn down the heat on illegals even more by further expanding the various de facto presidential amnesties now in effect.

President Obama has taken three separate, legally and constitutionally dubious actions that when considered collectively guarantee that almost no individuals illegally present in the country will be deported if their sole act of lawbreaking consists of being in the country.

Obama has provided executive amnesty and work permits for illegal immigrants covered by the proposed “DREAM Act” that Congress has repeatedly rejected. That legislation, if enacted, would cover individuals who claim to have entered the U.S. as minors under their parents’ guidance.

The Department of Homeland Security (DHS) also issued a directive in August 2013 expanding that amnesty to illegal immigrant relatives of “DREAM Act” beneficiaries. DHS issued another directive in December 2012 reinforcing the existing policy under which almost all immigration offenses were deemed unenforceable absent a separate criminal conviction.

The Sessions report undermines the claim by some left-wing pressure groups that President Obama is tough on illegal immigrants and is deporting them in record numbers. Some radical activists have mocked Obama, labeling him the “Deporter in Chief,” in what now appears to have been contrived criticism calculated to give the president political cover to move even further to the left on immigration policy.

Left-wing lawmakers are calling on Obama to scale back deportations. After Latino Democrats met with the president at the White House recently, DHS announced it was considering how to deport illegal immigrants in a more “humane” way.

Except for the occasional convicted criminal, hardly any illegal aliens at all are being deported under Obama, Sessions discovered.

According to official Immigration and Customs Enforcement (ICE) statistics on 2013 removals, 98 percent of all removals met one of the agency’s “enforcement priorities.” Those priorities consist of: individuals convicted of a serious criminal offense; those apprehended in the act of crossing the border; those who have been previously deported; and fugitives from the law.

The first two categories —235,000 border apprehensions (which are not deportations as commonly understood) and 110,000 removals of convicted criminals— taken together account for 94 percent of the 368,000 removals last year.

Under 0.2 percent, or under two tenths of 1 percent, of the approximately 12 million illegal immigrants and visa overstayers in the U.S. were placed into removal proceedings who did not have serious criminal convictions on their record.

Under 0.08 percent –that’s less than eight one-hundredths of 1 percent– of the 12 million were placed into removal proceedings who were neither convicted of a serious crime nor a repeat immigration violator.

This means that at least 99.92 percent of illegal immigrants and visa overstayers without known crimes on their records did not face removal.

Illegals are routinely taken into custody and released back into the community soon afterward. Those garden-variety illegal economic migrants not targeted for removal “are free to illegally work in the United States and to receive taxpayer benefits, regardless of whether or not they come into contact with immigration enforcement,” the report notes.

In a particularly disturbing incident described in the report, ICE management cautioned an ICE officer in 2011 that he would be subject to disciplinary action if he followed through and enforced the law by issuing a Notice to Appear in court to an illegal immigrant “driving the vehicle of a known fugitive without a license.”

“The suspect, who had multiple misdemeanor offenses on his record, was released while the ICE officer was threatened with suspension,” the report stated.

Amnesty opponents in the House of Representatives reacted strongly to the Sessions report.

“The Obama administration’s subversion of the Constitution and the rule of law make enforcement of our immigration laws virtually impossible,” Rep. Michele Bachmann (R-Minn.) said. “The law-abiding and taxpaying Americans who oppose this executive amnesty policy are paying the price with lower wages and fewer job opportunities.”

Rep. Mo Brooks (R-Alabama) thundered that while “President Obama hypocritically tells people he is for income equality, [at the same time] he violates federal immigration law, floods the labor market with wage-suppressing illegal aliens, and destroys the chance millions of hard-working Americans have of attaining self-sufficiency and the American dream.”

“It is clear that President Obama believes it is more important to pander to voters based on race than it is to enforce immigration laws that protect American workers’ ability to earn a living wage.”

Rep. John Fleming (R-La.) said, “This is another clear warning to anyone who thinks immigration reform is possible under President Obama. He has repeatedly shown a willingness to enforce the law selectively, while looking the other way when it doesn’t fit his agenda.”

Obama and generations of leftist politicians before him have been using immigration to subvert the American system. In the 1960s the late Sen. Ted Kennedy (D-Mass.) shepherded reform of that era’s immigration laws through Congress. The concept is simple: Flood America with people who don’t share Americans’ traditional philosophical commitment to the rule of law, limited government, and markets, in order to force changes in society.

So far the plan is working.

Why conservatives are on the right side of the immigration debate.

With Republicans tying themselves in knots over the Democrats’ destructive, but superficially appealing, demand that unemployment benefits be extended to two and a half years, I return to my suggestion that Republicans stop playing defense and go on offense. For every issue that MSNBC loves to prattle on about, gloating that it will cost Republicans this or that demographic, there’s an equivalent issue to use against the Democrats. (The difference is: Our proposals would actually be good for the country.)

In addition to my repeated suggestion that Republicans introduce bills to institutionalize the dangerous mentally ill and force the Democrats to defend the right of psychos to crap in libraries and shoot up schools, Republicans should take the public’s side on immigration.

Democrats love to pretend their sucking up to illegals is all upside for them, but that’s because they lie even when taking polls.

Liberals will claim that 99 percent of Americans favor national health care after taking a poll that asks: “Do you support Americans being nice to one another?”

WAIT! THAT’S NOT A POLL ABOUT NATIONAL HEALTH CARE!

It’s the same thing. The government providing free health care to everyone is just being nice.

They’ll claim “90 percent of Americans favor banning most guns” based on a poll that asks, “Are you for common sense gun safety or are you against it?”

Similarly, the immigration polls triumphantly brandished by the media ask about positions no one holds, no politician has proposed and no bills would require. Polls are irrelevant if you lie to the people being polled.

Most immigration polls are variations on the one taken by the liberal Brookings Institution last March. Although it has been endlessly cited for allegedly showing that a majority of Americans support amnesty, the poll never asked about amnesty, or any real policy.

Rather, the poll gave respondents only two options, neither of which have been proposed by either political party or are up for a vote anywhere in America.

The options were:

“The best way to solve the country’s illegal immigration problem is to secure our borders and arrest and deport all those who are here illegally”;

Or:

“The best way to solve the country’s illegal immigration problem is to both secure our borders and provide an earned path to citizenship for illegal immigrants already in the U.S.”

Neither of those choices describes the position of anyone on either side of the immigration debate. Amnesty proponents have no intention of either securing the border or making illegals do anything to “earn” citizenship. Meanwhile, not a single amnesty opponent has proposed any program to “arrest and deport” illegals.

But amnesty proponents turn around and cite this fraudulent poll as proof that a majority of Americans support “a path to legalization.”

This is how the left uses polls to manipulate public opinion, rather than find out what it is. They provide the ingredients for today’s political discussion and we’re not allowed to pick any items off the menu.

But can’t I be against amnesty without voting for rounding up illegals at gunpoint?

No substitutions! Look at the menu.

All the “path to legalization” polls play the same trick. Either armed men round up millions of women and children at midnight, put them in leg irons and immediately deport them on stinky buses; or we offer them a “path to legalization” after meeting all sorts of onerous requirements (none of which will ever materialize).

There were loads of promises surrounding Ronald Reagan’s 1986 amnesty, too — such as securing the border, punishing employers who hire illegals and forcing illegals to pay back taxes. Sen. Teddy Kennedy vowed: “We will secure the borders henceforth. We will never again bring forward another amnesty bill like this.” (Those were the good old days when they were willing to call it “amnesty.”)

Obviously, that promise ended up in the same place Mary Jo Kopechne did — underwater and unmentioned.

After the bill passed, then-Rep. Chuck Schumer (Gov. Chris Christie’s current immigration adviser) immediately introduced a bill excusing illegal aliens from having to pay any back taxes at all.

Now, instead of 3 million illegal aliens living here, we have 11 million, salsa is the best-selling condiment in America, and I have to press “one” for English.

We already tried this the nice way. The country gets one mulligan, not two.

An honest poll question would ask:

Do you think people who have knowingly broken our laws to come here illegally with their families since the last amnesty should be rewarded with citizenship, or should they voluntarily go back the same way they came?

An even more honest immigration poll question would ask:

At a time of massive unemployment, do you think people who have knowingly broken our laws and come here illegally with their families since the last amnesty should be rewarded with citizenship, or should they voluntarily go back the same way they came?

Even a poll question that simply omits the lies about the theoretical hurdles illegals will have to clear (which will never happen) produces a poll in which a majority of Americans support “deportation.”

Last year, the TechCrunch website polled this question: “Do you support or oppose deporting the 11 million undocumented immigrants currently living in the U.S.?”

Again: NO ONE IS TALKING ABOUT DEPORTATION. We didn’t round up 11 million foreigners to get them here, and we’re not going to round them up to send them home. They’ll leave the same way they came.

But even answering a stacked poll question asking about something no one has proposed — deportation — a majority of respondents, 53.4 percent, supported deportation, compared to 42 percent opposed. Among Republicans, 74.1 percent favored deportation, with only 22.3 percent opposed.

Not only that, but a Fox News poll last year showed that a majority of Americans would like to curtail legal immigration, with 55 percent supporting a decrease in legal immigrants and only 28 percent supporting an increase.

My thought is: Republicans should push policies that are popular.

But instead of proposing immigration reforms that are runaway hits with a majority of Americans — without anyone even having made the argument! — Republicans have been hoodwinked by Democrats into trying to outbid Democrats for the Hispanic vote. They still won’t win the Hispanic vote, but now the rest of the country will hate Republicans, too.

Cocaine kingpins beware. If you’re going to deal in millions of dollars worth of drugs, better take your kid to an amusement park first. Kids, like British judges, are surprisingly easy to impress.

A convicted drug kingpin cannot be deported after immigration officials ruled he is a good father who once took his family to a Peppa Pig theme park.

Princewill Oluoha, 37, from Nigeria, was sentenced to seven years for an attempted plot to smuggle £1m of cocaine to Britain in 2010.

Although the Home Office are desperately trying to deport him, he has been allowed to remain in the UK because he claims he plays a key role in the life of his British daughter.

Oluoha, who came to Britain in 2007, has two children and has been pictured enjoying himself with his family at Peppa Pig World, an amusement park in the New Forest based on the children’s cartoon.

At hearing in April last year, a Home Office bid to return Oluoha to Nigeria failed after a judge heard evidence from his partner about how he helps bring up his daughter.

Oluoha, who is thought to be on licence and immigration bail, told The Sun: “I want to concentrate on being the best dad.”

It comes months after a violent foreign criminal who held a knife to the throat of a victim overturned a government attempt to deport him due to his “right to family life”.

Lee Corbin, 50, has been allowed to stay in Britain because of what a court described as his “amazing” relationship with seven children he has fathered by three different women.

Corbin has 75 criminal convictions to his name and has been handed jail sentences totalling more than 16 years since he came to this country in 1978.

But you don’t have to be the best dad to be allowed to stay in the UK. The UK is fairly lenient on that score. You can even stab your daughter.

A Bangladeshi immigrant who stabbed her baby with a kitchen knife has won the right to stay in Britain so that she can have contact with the child.

The Nigerian cocaine kingpin could have skipped the amusement park. He could have even stabbed her. British judges are lenient that way.

This isn’t an alien issue in the United States either. The drumbeat of amnesty is based around not separating parents from children. Essentially the right to a family life.

The newest “prosecutorial discretion” directive for deportation cases.

A new directive by US Immigration and Customs Enforcement (ICE) will allow even more criminal illegal aliens to avoid being deported.

The new directive, titled Facilitating Parental Interests in the Course of Civil Immigration Enforcement Activities, was issued by ICE’s new director, John Sandweg, to all ICE agents on August 23, 2013, and it referred to the euphemistic moniker of “prosecutorial discretion,” which has been used repeatedly to administratively direct ICE agents in the field to no longer apply immigration laws if individuals fit into the definition of the directive.

In this case, Sandweg directed all ICE agents to use “prosecutorial discretion” regarding individuals ICE detainees who are parents or caregivers to children living in the USA.

The directive identified three specific categories: 1) primary caretakers of minor children without regard to the dependent’s citizenship; 2) parents and legal guardians who have a direct interest in a family court proceeding involving child welfare proceedings in the United States; and 3) parents or legal guardians whose minor children are U.S. citizens (USCs) or lawful permanent residents (LPRs).

This latest prosecutorial discretion memo follows in a long line of similar memos authored by a variety of high-level Department of Homeland Security (DHS) officials, each of which has reduced the scope of illegal aliens who are to be prioritized for removal.

The so-called “Morton Memo,” authored in 2011 by then-ICE Director John Morton, instructed ICE agents to treat any illegal alien not convicted of a crime as a low priority. Then, in December 2012, another ICE memo instructed ICE agents to treat anyone with two or fewer misdemeanors as a low priority. (ICE still considers even one felony conviction as a high priority). With this new directive, all illegal aliens considered primary caregivers for children, here legally or illegally, will also be treated as a low priority.

Recently, Congress has gotten into the act. Earlier in September, liberal California Senator Diane Feinstein sent a letter to outgoing DHS Director Janet Napolitano urging DHS to consider applying prosecutorial discretion to farm workers.

Jessica Vaughan is a policy analyst with the Center for Immigration Studies, and in a blog post, she likened the new directive to the parental version of the DREAM Act. In that same blog post, Vaughan singled out a criminal illegal alien previously featured in Front Page Magazine.

Amado Espinoza-Ramirez is a suspected serial child molester, who’s accused of acts that include incest. After making bond in a criminal court in Chicago, Illinois in early September 2011, ICE took custody of Espinoza-Ramirez. ICE decided to release rather than hold him in an ICE facility because there wasn’t enough bed space in ICE facilities and he no longer fit their definition of dangerous. He was released with a tracking monitor. He subsequently maneuvered out of that tracking monitor, missed all subsequent court appearances, and is considered a fugitive, while being charged in criminal and immigration court in absentia.

The two reasons identified by ICE at the time for releasing rather detaining Espinoza-Ramirez were that Espinoza-Ramirez was only suspected but not convicted of criminal acts and that he had a legal citizen child.

Espinoza-Ramirez is still a fugitive and likely back in his home country of Mexico. However, were he to be apprehended, the same principles would still be in place, and arguably, Espinoza-Ramirez would be eligible for release under the new directive.

This new directive did not escape the ire of Congress. The Chairman the House Judiciary Committee, Bob Goodlatte, immediately issued a statement linking this policy to a tough-on-criminal-illegal-alien bill passed out of his committee called the SAFE Act.

The primary reason why our immigration system is broken today is because our immigration laws have largely been ignored by past and present administrations. It’s imperative that we prevent this from happening again by taking away the enforcement on/off’ switch from the President. That’s why the House Judiciary Committee approved the SAFE Act, which prevents the Executive Branch from unilaterally turning off immigration enforcement by granting states and local governments the authority to enforce federal immigration laws.

Not everyone was attacking the directive. The American Immigration Council (AIC) defended the directive, stating in a blog post that this was nothing more than a sensible first step toward immigration policy which places priority in not breaking up families.

The directive, signed by Acting ICE Director Jon Sandweg, reminds ICE officers that they must continue to review all cases individually and “continue to weigh whether an exercise of prosecutorial discretion may be warranted” while considering such factors such as whether the immigrant is a parent, guardian, or primary caretaker of a U.S. citizen or a minor.

Tough deportation policies against criminal illegal aliens was one of the main promises of all those who have been proponents of comprehensive immigration reform. The public has been promised repeatedly that criminal illegal aliens will be pursued with vigor and all dangerous illegal aliens would face deportation. A series of memos (including this last one) prove that President Obama has no intention of getting tough on dangerous illegal aliens.

Glenn Beck unveils new disturbing information indicating an Obama administration cover-up.

Questions remain about whether there is a Saudi connection to the Boston Marathon bombing last week and if the Obama administration has been interfering in the investigation of the Islamic terrorist attack.

These questions take on greater urgency as Islamic terrorist organizations continue preparing attacks. Canadian authorities yesterday upended an ambitious terrorist plot that could have killed hundreds of Americans and Canadians.

In the spotlight is Saudi visa student Abdul Rahman Ali Alharbi (also spelled al-Harbi) who was injured in the marathon bombing blast and was initially considered a suspect in the deadly terrorist attack that killed three bystanders and hospitalized close to 200 others. There is a prominent Alharbi clan in Saudi Arabia. Many individuals with the surname Alharbi are reportedly active in al-Qaeda.

Glenn Beck’s news website, The Blaze, reported yesterday that Alharbi was placed on the “no-fly” list as a potential terrorist after he was detained by federal authorities last week. A Department of Homeland Security source said the U.S. Customs and Border Protection’s National Targeting Center (NTC) created an “event” file on Alharbi under section 212 (3b) of the Immigration and Nationality Act, the part of the federal statute that deals with aliens involved in terrorism. The file is important enough that it has reportedly been read by members of Congress.

“The burden of proof required to file a 3B [report] is significant, according to sources familiar with law enforcement protocols,” the article indicated. Media reports last week indicated that the U.S. was planning to deport Alharbi.

But it is not at all clear what caused officials to flag the young Saudi as a possible terrorist in the first place. Media reports indicated that when Alharbi was hospitalized after being injured in the blast eight days ago, the government called him a “suspect,” but soon watered down that description, calling him a “person of interest,” and eventually a mere “witness.”

Beck said the FBI began backtracking on Alharbi’s status after Secretary of State John Kerry met with Saudi foreign minister Saud al-Faisal last Tuesday. The next day President Obama met with the foreign minister and Saudi Arabia’s ambassador to the U.S., Adel al-Jubeir.

“Wednesday at 5:35 p.m. the file is altered,” Beck said. “This is unheard of, this is impossible in the timeline due to the severity of the charge … You don’t one day put a 212 (3b) charge against somebody with deportation, and then the next day take it off.” He continued:

There are only two people that could revoke the deportation order — the director of the NTC could do it after speaking with each department … which is impossible to do in such a short period of time — or somebody at the very highest levels of the State Department could do it. We don’t have any evidence to tell you which one did it.

The Blaze’s source said Alharbi is not currently a suspect in the Boston bombings and is not subject to a deportation order but another Saudi visa student in the Boston area may be deported. That student, who was intercepted when picking up a package at a Boston port, is now accused of violating the terms of his student visa by failing to enroll in school. He has been ordered to appear in immigration court.

At a congressional hearing last week Homeland Security Secretary Janet Napolitano stoutly denied Alharbi was in the process of being deported. “If I might, I am unaware of anyone who is being deported for national security concerns at all related to Boston,” Napolitano said responding to Congressman Jeff Duncan (R-S.C.).

Duncan followed up by asking if it would constitute “negligence” to deport someone who just days earlier was a person of interest to investigators.

“I’m not going to answer that question,” Napolitano said. “That question is so full with misstatements and misapprehensions that it is not worthy of an answer … there’s been so much reported on this that’s been wrong I can’t even begin to tell you, congressman.”

Lawmakers were not impressed. The House Homeland Security Committee has asked Napolitano to provide a classified briefing on Alharbi to committee members. The letter, dated April 19, states,

We request the Department provide a detailed overview of the records associated with this individual to include his law enforcement and immigration records prior to April 15, 2013, as well as his current status. We request briefers from the Office of Intelligence and Analysis, Immigration and Customs Enforcement, and Customs and Border Protection.

Meanwhile, the Royal Canadian Mounted Police foiled a major terrorist attack in Ontario, the most populous province in Canada. Two suspects, Chiheb Esseghaier, 30, of Montreal, and Raed Jaser, 35, of Toronto were charged with terrorist conspiracy yesterday after allegedly planning to attack a passenger train. The two men are not Canadian citizens but two media outlets reported Esseghaier is Tunisian. Officials said the plot was not connected to the recent events in Boston.

The thwarted attack in Canada and the Boston Marathon bombing are sobering reminders that Muslim terrorist networks remain as significant a threat as ever to Western civilization. Al-Qaeda, in particular, is far from extinction, despite President Obama’s claims to the contrary.

RCMP Assistant Commissioner James Malizia said the two suspects received “direction and guidance” from “al-Qaeda elements” in Iran but they did not appear to be “state-sponsored.”

The Toronto Sun reports that the terrorists were considering bombing a train as it crossed a bridge over the mighty Niagara River from Niagara Falls, Ontario, to Niagara Falls, New York.

“The plan was to take out a train with passengers on board and the crossing trestle,” a police source said. “It was meant to be spectacular and there would have been a lot of carnage.”

Canada is no stranger to Islamic terrorism.

The RCMP said last week it was investigating whether Canadian national Mahad Dhore had died while participating in a suicide attack on the courts in Somali capital Mogadishu. The student left Toronto in 2009 and allegedly became a member of the Islamist group al-Shabab.

The Mounties are also looking into two young classmates from London, Ontario, who died in Algeria earlier this year as they apparently took part in a terrorist attack at a gas facility. A colleague of the two is being held in Mauritania, accused of joining al-Qaeda in Mali.

Citing two anonymous U.S. officials, a wire service reported yesterday that preliminary evidence suggests that the two young Tsarnaev brothers, accused in the Boston Marathon bombings, were motivated by Islamic extremism but did not appear to be linked to Islamist terrorist groups. This would appear to mean that the brothers somehow acquired bomb-making skills on their own or reached out to someone with bomb-making experience.

The article indicated that the surviving brother, Dzhokhar, who is in the hospital recovering from a gunshot wound to the neck and other injuries, was interrogated but failed to explain how the officials gained personal knowledge of the investigation, leaving readers to wonder if this information was just the latest foul-up in an ongoing story that has been brutally bungled by the mainstream media.

That the Tsarnaev brothers had no connection to terrorist organizations is difficult to believe especially because Russia’s Federal Security Service (FSB) considered the elder brother, Tamerlan, to be a potential extremist. (Tamerlan was killed Friday in a dramatic shootout with police.) According to Time magazine, the FSB warned the FBI two years ago about Tamerlan after he frequented a radical mosque in Makhachkala, the capital of Dagestan, during extended visits to that country. The mosque is reportedly a terrorist hangout.

Dagestan, a member of the Russian Federation, is a small, politically unstable country of 3 million inhabitants that borders Chechnya and Georgia in the west, Azerbaijan in the south, the Caspian Sea in the east, and Russia in the north. It is a hotbed of Islamic terrorist activities. The terrorist group Shari’ah Jamaat, active in Dagestan, is “one of the more potent groups in the region,” according to the National Consortium for the Study of Terrorism and Responses to Terrorism.

The Obama administration’s foremost designated Islamist appeaser was also in the news.

Always anxious to place his foot in his terrorist-sympathizing mouth, Secretary of State John Kerry compared those innocent bystanders who were murdered in Boston to Turkish-backed armed belligerents killed three years ago trying to violently break Israel’s blockade of the terrorist-infested Gaza Strip.

On April 21 Kerry said the Boston Marathon bombings reminded him of Turks who died during “the 2010 IDF raid on the Marmara.” He was alluding to Israeli commandos’ boarding of the Mavi Marmara, a ship carrying Muslim militants in the blockade-running “Gaza Freedom Flotilla.”

Without referencing the terrorists participating in the flotilla, Kerry said the Boston Marathon bombing made him “acutely aware of the emotions felt by the families of the nine Turks who died” during the raid.

“It affects the community, it affects the country,” Kerry said. “But going forward, you know, we have to find the best way to bring these people together and undo these tensions and undo these stereotypes and try to make peace.”

No doubt Muslim terrorists are quaking in their boots.

Evidence mounts that the release of thousands of illegal aliens was a sop to the open borders lobby.

The Office of the Public Advocate for the US Immigration Customs Enforcement (ICE) held a series of “community roundtables” with numerous left-wing groups that have been lobbying the Obama administration for years to reduce the detainee population in ICE facilities because those groups believe that the Obama has been arresting, holding, and deporting far too many illegal aliens. These roundtables were held regularly for three months prior to the release of several thousand suspected illegal aliens from a number of ICE facilities in February 2013.

According to a newsletter published in February 2013 by Andrew Lorenzen-Strait, the Public Advocate for US Immigration and Customs Enforcement, the Public Advocate team organized a series of appearances in a number of “community roundtables” sponsored by groups like the Massachusetts Immigrant and Refugee Advocacy Coalition (MIRA), El Centro Hispano, the International Institute of Connecticut, and the International House in Charlotte, North Carolina.

Lorenzen-Strait has been the Public Advocate at ICE since that position was created by the Obama administration in February 2012. Ostensibly, he’s supposed to represent the public, but in reality, no less than the Huffington Post acknowledged that the post was created specifically to address the complaints of left-wing groups that were complaining that the Obama administration was being heavy-handed in its deportation and incarceration immigration policy.

In a story titled “Immigrant Advocates Skeptical On New DHS Public Advocate Position” by Huffington Post writer Elise Foley on February 7, 2012, that’s the exact impression given regarding the new position of the ICE Public Advocate:

The agency tasked with finding and deporting undocumented immigrants announced on Tuesday the creation of a new position that will work with non-governmental organizations, advocacy groups and immigrants to make sure their voices are heard.

Immigration advocates said they are hopeful, but will believe it when they see it.

In December 2012, the Public Advocate team says it met with community activists in Durham and Charlotte, North Carolina in a “community roundtable” with one roundtable sponsored by a group called “El Centro Hispano in Durham.”

In December 2012, the Public Advocate Team held community roundtables in Durham and Charlotte, North Carolina. We are grateful to El Centro Hispano in Durham and International House in Charlotte for allowing us to hold these events at their facilities. ERO field office leadership were present at both meetings to ensure stakeholders were able to connect with them directly and to respond to questions pertinent to the field. ICE Homeland Security Investigations (HSI) also sent representatives to the meetings. Participants at both meetings indicated that they were pleased with the content and format of the events. While in the region, the PA Team also toured the York County Detention Center in South Carolina to talk to detainees and assess the overall conditions of the facility.

According to the website of El Centro Hispano, one of the activities it sponsors is “community organizing.” The group is primarily funded by the left-wing Z Smith Reynolds Foundation.

The Capital Research Center is a 501©3 that is dedicated to being a watchdog group to left-wing charities and philanthropies.

According to Scott Walter, the Executive Director of CRC, Z Smith Reynolds is the largest foundation in North Carolina and the leading funder of left-wing groups in that state. Its money comes largely from the family of tobacco company RJ Reynolds.

Another 501©3 Z Smith Reynolds funded in North Carolina, Blue Print North Carolina, was involved in coordinated political efforts with the state’s Democratic apparatus. That is entirely inappropriate for such a non-profit because they receive favorable tax treatment precisely because they don’t get involved in partisan matters.

While Z Smith Reynolds claimed to not be aware of Blue Print North Carolina’s activities, the philanthropy supplied $400,000 of Blue Print’s $1 million budget.

In January 2013, the roundtable roadshow was moved to New England, with a meeting in Boston, Massachusetts and one in Hartford, Connecticut hosted by the Massachusetts Immigrant and Refugee Advocacy Coalition (MIRA).

According to data provided by CRC, among the funders for MIRA include the National Council of La Raza, George Soros’s Open Society Institute, and James Knight Foundation, a well-known left-wing foundation.

The exact locations for the February roundtables hadn’t been set when the newsletter went out, but Lorenzen-Strait said that his office wanted to travel to California, Oregon, and Arizona, and he wanted to visit the facility in Florence, Arizona specifically.

Looking ahead to February 2013, members of the Public Advocate Team will travel to Arizona, California, Oregon, and Washington. We will hold community roundtables in Phoenix, Orange County, and Portland and will meet one-on-one with several immigrant advocacy organizations in Seattle. We also intend to tour multiple detention facilities throughout the trip, including the Florence Service Processing Center and Pinal County Jail in Arizona, Adelanto County Jail and Santa Ana City Jail in California, and the Northwest Detention Center in Washington State.

The Florence facility is important because an especially large amount of suspected illegal aliens were released from that facility starting in md-February. Last week, Front Page Magazine reported exclusively that Sheriff Paul Babeu, the Sheriff of Pinal County where the Florence facility is located, was denied information about of those released by ICE.

The Florence facility is also important because groups like those with whom the Public Advocate meets regularly have also been complaining about the heavy-handed methods of Sheriff Babeu.

“This announcement and releasing people in this way for me is a confirmation of how many people we are holding in custody that don’t need to be there,” said Lindsey Marshall, executive director of the Florence Immigrant Rights and Refugee Project, for a story on the web site Frontera’s Desk on February 27, 2013.

Speaking with Arizona Star Net, Marshall also echoed this idea that there were plenty of non-violent offenders that could be released from the Florence facility. “The overwhelming majority of the people we work with have ties to the U.S.; they have children here, they have homes here, they have jobs here, and they will show up at court,” she said.

Much of the pressure from groups like Marshall’s stems from the fact that, for years, the Obama administration has boasted that they’ve been able to increase deportation numbers by ten percent over the Bush administration. In fact, for years, groups headed by the likes of La Raza have complained that heavy-handed enforcement of an ICE program called Secure Communities has been the primary cause for these numbers and this has led to too many apprehensions, incarcerations and deportations of what these groups believe are otherwise law abiding citizens.

Secure Communities was first created in 2008, but its use has exploded under the Obama administration. Secure Communities is supposed to be a data sharing program. As soon as someone is arrested in any participating county, that person’s information is immediately shared with ICE and others. This can trigger an investigation by ICE.

Left-wing groups have complained that overzealous county sheriffs like Sheriff Babeu have abused Secure Communities by arresting people they suspect, but have no proof, are in the country illegally for minor traffic violations in order to get them into the system to trigger an immigration investigation.

In fact, in 2011, Sheriff Joe Arpaio accounted for some of the best numbers in the country for triggering successful Secure Communities investigations.

Meanwhile, tough new anti-illegal immigration laws like those in Arizona (making the Florence facility important for yet another reason), South Carolina, and Alabama have given these same groups an extra layer of complaint on the issue, especially in those localities. For instance, the ACLU complained in the Hill in 2011 that Alabama’s law would be used to racially profile when it was combined with Secure Communities.

Neither the ICE Public Advocate nor any of the groups that hosted any of the “roundtables” would answer FrontPage Magazine directly whether or not they advocated in these meetings to the Obama administration the mass release of thousands held in ICE facilities as is currently being implemented. While it’s not entirely clear what, if any, influence these meetings had on public policy, there is more than enough evidence to demand full disclosure.

Why we shouldn't assume that those given quasi-amnesty will have any loyalty to America.

America’s ward-heeler-in-chief just bought some votes with the policy equivalent of a keg of beer and a slab of bacon. Obama’s memorandum to Homeland Security head Napolitano to stop the deportation of illegal aliens brought here as children and granting them work permits bypassed Congress, that branch of government our quaint Constitution makes responsible for such policy. Obama said so himself last year when he reminded people that he couldn’t “change the law unilaterally” and “We have to pass bills through the legislature and then I can sign it.” But the need to stanch the bleeding from a week of economic bad news for his reelection campaign has given the president Constitutional amnesia. If Obama had been sincerely interested in crafting a legal, bipartisan, permanent solution to this problem, he could have negotiated with Florida Republican Senator Marco Rubio, who has crafted a more sensible solution than last year’s Dream Act, and worked through Congress. But the need to throw some goodies to Latino voters in several swing states critical for his own reelection was more important than actually governing according to the Constitution.

Obama’s accompanying rationale for this decision, moreover, was full of unexamined assumptions and sentiments. “These are young people who study in our schools, they play in our neighborhoods, they’re friends with our kids, they pledge allegiance to our flag. They are Americans in their heart, in their minds, in every single way but one: on paper,” Obama said. They “face the threat of deportation to a country that [they] know nothing about, with a language that [they] may not even speak.” They “for all intents and purposes, are Americans. They’ve been raised as Americans, understand themselves to be part of this country.” All those statements are loaded with begged questions that point to the bigger problem we have with immigration both legal and illegal––the question of national identity and national loyalty.

No doubt, many of these young immigrants match Obama’s description. I’d bet that those who have served in the military do. But many do not, particularly the university students usually showcased by their champions. From my years of experience as a teacher in a university about half Hispanic, hundreds of them illegal immigrants mostly from Mexico, I know that many see themselves as Mexican or Chicano first, and Americans second, if at all. They travel to Mexico and speak Spanish, and have imbibed an anti-Americanism that casts them as victims of American imperialism and racism who deserve reparations for those historical crimes.

These attitudes are institutionalized in the courses they take from ethnic studies departments and in the organizations they join. Many universities, for example, have chapters of a group called MEChA, the “National Chicano Student Movement of Aztlán,” the mythical land allegedly stolen by Americans in the Mexican War. This fantasy history claims that the whole Southwest was once Aztlán, the homeland of La Raza, the “bronze” race, who are “the Chicano inhabitants and civilizers of the northern land of Aztlán from whence came our forefathers,” as the “Plan of Aztlán” puts it. This homeland was lost to the “brutal ‘gringo’ invasion,” and the goal of the “Plan” is the “reconquest” of that lost homeland, and restitution for that historical crime. The racist drift of all this is apparent in the motto of MEChA: “For the Race everything, outside the Race, nothing.”

Obviously, MEChA scorns assimilation to American culture and identity, promoting instead a Mexican identity called “Chicanismo,” which “involves a personal decision to reject assimilation and work towards the preservation of our cultural heritage” and the recovery of a “bronze culture for a bronze people.” Thus MEChA “is committed to ending the cultural tyranny suffered at the hands of institutional and systematic discrimination that holds our Gente [people] captive.” If you need further evidence that this ideology is hostile to American culture and identity, consider a poem published at California State University Fresno in La Voz de Aztlán, a state-subsidized campus newspaper that functions as MEChA’s house organ: “America the land robbed by the white savage / the land of the biggest genocide / the home of intolerance / the place where dreams come to die / the place of greed and slavery,” and so on for another two dozen lines.

The declining illegal immigration rate comes to an abrupt halt -- just in time for the election.

Mitt Romney was ridiculed recently for proposing “self-deportation” as a way to reduce illegal immigration, but at least he was trying to address the problem. The same cannot be said for the Obama administration, which has seen a Bush-era trend toward declining illegal immigration come to an abrupt halt on its watch.

In a new set of findings, the Center for Immigration Studies estimates that the U.S. illegal immigrant population stands at 10.9 million, plus or minus 200,000. If accurate, that would mean that illegal immigration stopped declining under Obama after falling by over 1 million in the final two years of the Bush administration. It’s not so much immigration reform as immigration reversal.

There are several reasons for the negative change. In a bid to court Hispanic voters, Obama has repeatedly signaled that he will accommodate rather than crack down on illegal immigration. This January, for instance, the administration moved, over Republican objections, to reduce the amount of time that illegal immigrants separated from family members in the U.S. will have to spend out of the country before reapplying for legal status. Under current law, illegal immigrants are barred from returning for a minimum of three years. But under the revised rules, they can claim that their absence would pose a hardship for their family and ask the Department of Homeland Security to waive the re-entry restrictions. However well-intentioned, the revised policy sends the message that the administration is not serious about reducing illegal immigration.

Reinforcing that message is the administration’s policy of “prosecutorial discretion,” which allows most illegal immigrants without a criminal record to remain in the country. The administration announced last summer that it would indefinitely delay deporting illegal immigrants without criminal records and give them a chance to apply for a work permit. As critics were quick to note, this amounted to a de facto amnesty for illegal immigrants. In drawing the distinction between illegal immigrants with and without criminal records, the administration obscured the fact that being in the country illegally was itself a crime, and thus thwarted the enforcement of immigration laws.

When the administration has paid lip service to enforcement, its actions have not matched its rhetoric. Obama has maintained that his administration has done its part to curb illegal immigration by providing federal funding for border fencing and security. Yet the evidence suggests that the administration has not really delivered. The Government Accountability Office noted in 2011 that Border Patrol had full control over only 15 percent of the border with Mexico. Of the nearly 2,000 miles separating the U.S. and Mexico, 873 – or 44 percent – are under only under the “operational control” rather than the full control of the Border Patrol. The broad majority of the border remains unsecured.
