If we could reclassify the EPA as pig flatulence, we could get the EPA to fund its own elimination.

A report released by Arizona Republican Sen. Jeff Flake found numerous examples of EPA mismanagement and excess, including employees illegitimately spending $15 million on agency credit cards and $9 million the agency lost track of funding projects in California.

Happens to everyone. One time I lost track of $12 million in Arizona and couldn’t find it for a week.

$1,500,000 annually to store out-of-date and unwanted publications at an Ohio warehouse” and another “$700,000 to attempt to reduce methane emitted from pig flatulence in Thailand.”

They attempted to do it. If you’re going to spend $700K on pig flatulence, then can’t you at least succeed at whatever you were trying to do?

Forget Green Energy. The real money is in Green Taxes.

The Environmental Protection Agency has begun the process of determining whether to regulate greenhouse gas emissions from airline flights, which could result in higher costs for airline travelers.

The agency has no timeline set for when the rule will be released, but anticipates a proposed endangerment finding by late April 2015 and a final determination by spring of 2016. A positive endangerment finding would mean the EPA would declare greenhouse gas emissions “endanger public health or welfare.”

“If a positive endangerment and cause or contribute findings are made, U.S./EPA is obligated under the Clean Air Act (CAA) to set [greenhouse gas] emission standards for aircraft,” the EPA said in its notification to the United Nations.

Note the United Nations part of that.

We’ve long left the territory of anything involving the Clean Air Act which is being used to push unscientific claims about the Warming scam under the guise that anything that contributes to a non-existent problem which has already been disproven can be regulated under the CAA.

But the endgame, as always, is money. It’s about forcing Americans to get rid of their dishwashers and washing machines or pay more. It’s about forcing them not to fly or pay more.

It’s about lefty feudalism which turns the lifestyle that Americans used to enjoy into a privilege reserved for wealthy liberal climate consultants.

Green? Think red.

This little gesture by the UMWA might be slightly more impressive if the union leadership hadn’t already shown that it had learned nothing from the past… by endorsing Alison Grimes… despite her association with billionaire ecomaniac Tom Steyer.

It’s unlikely that United Mine Workers of America president Cecil Roberts thought he would be arrested protesting the energy policies of the very politician his union supported in 2008. But things have come full circle for coal miners, who now see President Obama’s climate agenda threatening their livelihoods.

Roberts and other UMWA members were arrested Thursday marching through Pittsburgh, Pennsylvania, towards the federal building where the Environmental Protection Agency was holding field hearings for a new rule that could very well force more coal mines and plants to shut down.

Roberts was leading about 5,000 coal miners, their families and supporters to show the EPA that coal miners, boilermakers, electric workers and other unions did not support the Obama administration’s new regulations limiting carbon dioxide emissions from coal-fired power plants.

“This was an expression by the leadership of the union and the solidarity for our members when our jobs are on the line … it’s what it’s all about,” Roberts said while being arrested.

UMWA District 31 vice president Mike Caputo said the Pittsburgh rally was only “the first shot of the battle” against the Obama’s administration’s regulatory agenda.

“We were willing to go to jail to show the government that this is a serious issue within our union and the jobs that it affects,” Caputo told the Register-Herald. “We painted a vivid picture of who this rule is going to affect.”

Willing to go to jail, yes. Willing to stand up to the Democratic Party, no.

Under Obama, in 2012, the agency took in $252 million in fines, up from just $96 million in 2009.

Courts? Who needs courts anyway. Obama doesn’t need them and the rest of the Deep State liberal bureaucracy doesn’t either. That includes the EPA, an agency that has become the enforcement arm of the Big Green lobby pushing its religious doctrine of Gaia worship on Americans.

The Environmental Protection Agency has quietly claimed that it has the authority to unilaterally garnish the wages of individuals who have been accused of violating its rules.

According to The Washington Times, the agency announced the plan to enhance its purview last week in a notice in the Federal Register. The notice claimed that federal law allows the EPA to “garnish non-Federal wages to collect delinquent non-tax debts owed the United States without first obtaining a court order.”

The notice went on to say that the EPA had fast-tracked the new rule, enabling it to take effect September 2 unless the agency receives enough adverse public comments by August 1. The EPA said the rule was not subject to review because it was not a “significant regulatory action.”

The EPA claims that fast tracking a rule to seize money without a court order is not significant. Except to the people it targets.

The EPA, like a lot of terrorist groups, is notorious for trying to intimidate its targets into settling without going into court. The EPA doesn’t like courts and this rule provides extra leverage for doing that.

The plan has drawn protests from conservatives, including Sen. John Barrasso, R-Wyo., who told The Washington Times, “The EPA has a history of overreaching its authority. It seems like once again the EPA is trying to take power it doesn’t have away from American citizens.”

The conservative Heritage Foundation claimed that the rule gives the EPA “unbridled discretion” over the process of challenging fines. David Addington, group vice president for research at Heritage, told the Times that the rule not only puts the burden of proof on the debtor, rather than the agency, but also allows the EPA to decide whether a debtor even gets a chance to present a defense before picking whomever it chooses to serve as a hearing officer.

The amount of money the EPA has collected in fines has increased steadily since President Obama took office. In 2012, the agency took in $252 million in fines, up from just $96 million in 2009.

Terrorists gotta terrorize and the only difference between the EPA and officially environmental terrorist groups like ELF is that it has the law on its side. Or rather it doesn’t, since it avoids courts, but like Obama, it does have power.

The EPA is starting to act like a James Bond villain. From raiding a guitar maker to trying to save the world from carbon to demanding control over all the water in the country, its antics are as ridiculous as they are creepy.

And now the Fourth of July, the very celebration of freedom, is being endangered by the EPA, the enemy of freedom.

While Americans get ready for the thousands of fireworks shows that will be occurring across the country this weekend, Republicans are warning that pending federal water regulations could ruin fireworks displays next year.

“If the proposed ‘waters of the United States’ rule becomes final and serves as the eventual basis for future citizen suits against those who organize fireworks shows, we fear fewer homeowners, communities, or local organizations will be able to conduct fireworks displays as they have for decades or longer,” wrote Republican Senators, including David Vitter of Louisiana and John Barrasso of Wyoming, in a letter to the EPA.

This isn’t just a theory. It’s already been taking place.

Environmentalists have already been using litigation to stop fireworks shows from happening near or over federally protected waters. In Lake Tahoe, California environmentalists sued the city, alleging their fireworks show violated the Clean Water Act.

Environmentalists said the fireworks show would result in the unpermitted discharge of pollutants into the lake. The lawsuit demanded that Lake Tahoe pay $37,500 per day in penalties for each violation of the Clean Water Act. Lake Tahoe officials nearly cancelled the show, but luckily for residents the city settled with environmentalists in April.

Like the race-baiters, the environmentalists sue and profit. This isn’t about the environment. It’s Green Banditry.

“Commemorative fireworks displays have been a part of our nation’s history since its founding. However, there are individuals and groups who would like to significantly limit this tradition through heavy-handed citizen suit litigation under the Clean Water Act and other laws,” Republicans added.

The environmentalists are part of the left and the left hates this nation, its freedom and its history.

Every time Congress issues a subpoena, hard drives begin crashing in the bureaucratic deep state of the liberal regulators.

The Internal Revenue Service isn’t the only government agency dealing with missing emails or faulty hard drives.

Environmental Protection Agency administrator Gina McCarthy on Wednesday cited a similar cyber snafu during a House Oversight Committee hearing.

Lawmakers at the hearing wanted McCarthy to address lost emails from a hard-drive crash at the agency that wiped out some emails from former employee Philip North to his bosses at the EPA over the controversial Alaska mine project.

Complicating matters, North has gone off the proverbial grid, making it difficult for lawmakers to issue a subpoena for him to testify.

When he was still reachable, North was asked multiple times to come in and talk to lawmakers about the project. He offered up a list of complications that prevented him from meeting with the government, including a pre-planned, one-year boat ride around the world with his school-aged children.

Rep. Kerry Bentivolio, R-Mich., asked McCarthy if she knew where North was.

“No sir, I don’t know that,” she responded.

Bentivolio pressed McCarthy about claims North’s hard drive crashed, making some of his emails unavailable.

McCarthy said the EPA has submitted all the documents it has been able to find and will “continue the search.”

Isn’t it funny how this happens. North just “vanishes” and his hard drive crashes. That means if Republicans subpoena enough of the Federal government, it will just vanish in a mass of hard drive crashes.

We’re just capping off and trading American jobs to any country that wants them.

Labor unions criticized the Environmental Protection Agency’s new regulations on carbon emissions from power plants on Monday, highlighting growing tensions between the environmentalist and working class arms of the Democratic Party.

United Mine Workers of America (UMWA) president Cecil Roberts blasted the proposal, saying it would leave tens of thousands of the union’s members unemployed.

“The proposed rule … will lead to long-term and irreversible job losses for thousands of coal miners, electrical workers, utility workers, boilermakers, railroad workers and others without achieving any significant reduction of global greenhouse gas emissions,” Roberts said in a statement.

According to a UMWA analysis, Roberts said, the rule will cause 75,000 job losses in the coal sector by 2020, rising to 152,000 by 2035.

“When a U.S. government economic multiplier used to calculate the impact of job losses is applied to the entire economy, we estimate that the total impact will be about 485,000 permanent jobs lost,” Roberts said.

The left has gone from treating miners like heroes to turning them into enemies of the state. The wealthy special interests of Big Green have made billions from Obama Inc. and they won’t stop until they destroy what’s left of the working class they hate.

“It’s clear the administration needs to grow a set of antlers, or perhaps take a lesson from Popeye and eat some spinach,” the president of the Laborers International Union of North America said at the time.

Apparently the reality that America’s economic output declined by 1 percent in the first quarter, retail and home sales are plummeting, and a record-setting 1 in 8 (or 10 million) American men in their prime working years between ages 25–54 aren’t working or looking for work will be no impediment for a president determined to impose a radical environmentalist agenda on the nation. On Monday, the Obama administration announced the first-of-their-kind national limits on carbon emissions from the nation’s more than 600 coal-fired power plants. The proposed regulation, implemented by the Environmental Protection Agency (EPA), will demand a 30 percent cut in emissions by 2030.

At a Feb. 11, 2014 hearing of the Subcommittee on Oversight and Investigations related to the status of clean coal programs, Rep. Tim Murphy (R-PA) spelled out the real-world consequences of such a plan, explaining that Americans could expect an increase in electricity costs ranging from 40 percent at a coal gasification facility, to as much as 80 percent at a pulverized coal power plant, according to the Department of Energy’s own documentation. The reliably leftist New York Times illuminates the implications, noting that the regulations could lead to the closing of “hundreds” of such facilities.

Unsurprisingly, the effort completely bypasses Congress, undoubtedly because it would be as DOA as it was when the Democratically-controlled legislative branch failed to pass such cap-and-trade legislation in 2010. Thus our constitutionally-comtemptuous president has rendered members of Congress superfluous, even as the EPA becomes their de facto replacement.

The administration offers a degree of flexibility in achieving these goals. They include allowing states to reduce emissions by installing solar, wind or other energy-efficiency technology, and by creating or joining cap-and-trade programs at the state or regional level that allow such entities to cap emissions, and then buy and sell permits that allow plants to continue to emit greenhouse gases—as long as they pay a suitable fee for doing so. That fee that will inevitably be passed down to consumers. Yet in keeping with the administration’s imperialist impulses, if such state- or regionally-imposed rules do not satisfy the EPA’s guidelines the agency will act unilaterally to force such entities into compliance.

Those affected are planning to sue. “Clearly, it is designed to materially damage the ability of conventional energy sources to provide reliable and affordable power, which in turn can inflict serious damage on everything from household budgets to industrial jobs,” said Scott Segal, a lawyer with Bracewell & Giuliani, a firm representing coal companies in anticipated litigation. Oklahoma Attorney General Scott Pruitt also plans to challenge the regulations in court. “The Clean Air Act clearly sets out a role for EPA to suggest guidelines, while granting states authority to develop and implement specific proposals to achieve the goals of the Clean Air Act,” he told The Daily Caller News Foundation. “Should the EPA’s proposed regulation force states to adopt a ‘cap and trade’ scheme or any other specific proposal, it would violate the law and likely be challenged in court.”

Such challenges, as well as litigation anticipated by other industry groups and other states such as West Virginia, North Dakota, Alaska and Texas revolve around the EPA’s use of a little-used section of the Clean Air Act to create its new regulations. The implementation of section 111 (d) of the Act is necessitated by the reality that carbon dioxide isn’t regulated under major Clean Air Act programs that address air pollutants. The EPA claims it has used that section to previously regulate five sources of air pollutants, but none of those approach the magnitude of their attempt to regulate carbon dioxide.

As the Wall Street Journal explains, the relatively rare instances in which section 111 (d) has been invoked, creates the “unusual circumstance in which potential challengers to the carbon rules would be litigating largely on a blank slate against the EPA,” thus testing “how far a president can go in using the long-standing air-pollution law to try to address climate change.” The paper further notes that such a blank slate accrues to the EPA’s advantage, because courts generally give deference to administrative agencies, provided they are not imposing regulations in an “arbitrary and capricious manner.”

Moreover, the courts have an already-established track record of siding with the EPA. Recent decisions include the Supreme Court’s ruling last month that allowed the EPA to curb power-plant emissions blowing across state lines, while appeals courts have upheld the right of the EPA to regulate mercury emissions from power plants, rules on auto emissions, and the agency’s 2009 contention that CO2 and other greenhouse gases posed a threat to public health. Washington environmental lawyer Sean Donahue spelled out the implications. “There’s more room to make legal arguments because the courts haven’t specified what the statute means and doesn’t mean, but it also leaves more room for the agency’s judgment,” he explained.

It is a judgement completely aligned with global warming alarmism, irrespective of two realities. First, even if one buys the notion of global warming, the key word is “global.” According to the International Energy Agency, by 2012 the United States had cut CO2 emissions more than any nation on earth since 2006, due in large part to the already occurring shift from coal to gas in the nation’s power sector. The world’s leading polluter is now China, which emitted 9.0 billion tons in 2012, compared to only 5.3 billion metric tons released by the U.S. By 2020 that total is expected to top 11.5 billion metric tons, while we remain flat, according to the U.S. Department of Energy.

Moreover, China and India will be constructing three-quarters of the 1,200 coal-fired plants being proposed globally, according to the World Resources Institute in Washington. As Robert Stavins, director of Harvard University’s Environmental Economics Program explained to Bloomberg News, even if America reduced its carbon emissions to zero, “global emissions would continue to increase. So, the direct impacts of the new power plant rules on atmospheric greenhouse-gas concentrations will be small.”

The reasons for the increases are blindingly obvious: underdeveloped nations wish to raise their standard of living, and no amount of hectoring by the nation with one of the highest standard of living on the planet is likely to alter those ambitions in any substantial way. Nonetheless the administration remains tethered to the notion that cutting emissions will give American climate change negotiators a stronger hand at the United Nations General Assembly next fall, when governments engage in the attempt to hammer out a worldwide treaty by 2015. “I fully expect action by the United States to spur others in taking concrete action,” said Christiana Figueres, executive secretary of the United Nations Framework on Climate Change.

In the meantime, such “concrete action” by the United States will do serious damage to an already damaged economy. “The administration has set out to kill coal and its 800,000 jobs,” Sen. Mike Enzi (R-WY) said in the GOP weekly address Saturday. “If it succeeds in death by regulation, we’ll all be paying a lot more money for electricity — if we can get it.” The Chamber of Commerce contends the new regulations will cost the economy $50 billion per year, and the loss of 3.5 million jobs over 15 years, while the National Center for Public Policy Research asserts that they will “disproportionately hurt lower income people and minorities.”

The EPA counters that the cost will be “only” $8.8 billion annually in 2030, but “will lead to climate and health benefits worth an estimated $55 billion to $93 billion per year in 2030.” White House Press Secretary Jay Carney dismissed the jobs losses as a “doomsday scenario,” and EPA Administrator Gina McCarthy claimed the nation will need “thousands of American workers in construction, transmission and more to make cleaner power a reality.” President Obama asserted that carbon-dioxide emissions—which humans exhale with every breath–are a national health crisis. “We don’t have to choose between the health of our economy and the health of our children,” Obama said in his weekly address Saturday. “As president and as a parent, I refuse to condemn our children to a planet that’s beyond fixing.”

So who’s right? As always, progressives ignore real world evidence that doesn’t accrue to their agenda. In Spain 2.2 jobs were destroyed for every green job created. In Italy, the capital needed to create one green job could create five in the general economy. In Denmark, the commitment to wind power generated the highest electricity rates in the EU. And in Germany, the green energy job creation myth is currently collapsing, as seven-out-of-ten green jobs will be lost without continuing government subsidies. Oliver Krischer, deputy leader of the Greens in the Bundestag, acknowledged inconvenient reality. “A few years ago the renewable sector was the job miracle in Germany, now nothing is left of all of that,” he conceded.

Nothing is a relative term, and the real agenda here may be a familiar one: the Obama administration’s desire to have government determine the nation’s “winners” and “losers” by executive fiat. “Given the facts, we must consider the possibility that this is not about global warming at all but is instead simply another tax, and a relatively large one, that will be used to underwrite favors for Democratic interest groups while creating corporate subsidies for politically connected businesses — namely, those liberal financiers who have large financial positions in so-called clean-energy technologies and stand to make a hefty profit from government mandates for renewables,” writes the editors of the National Review. “Come for the feel-good greenwashing, stay for the corporate welfare.”

The EPA plan is slated to go into effect in June 2016, following a one-year comment period—and a likely plethora of lawsuits. In the meantime, Americans already beset by the weakest recovery since the Great Depression can anticipate what they will shortly endure as the result of what the Times characterizes as Obama’s “legacy-making global deal.” America’s legacy, which now includes the reality that the middle class may be headed for extinction, is somehow lost in the mix. For progressives, destroying the economy is a small price to pay for “saving the planet.”

EPA Chief Gina McCarthy is really trying to live up to the standards of her lunatic predecessor with her latest rant.

After claiming that Global Warming was holding back millions of African-Americans, she said something even dumber.

“It’s worrisome that our science seems to be under constant assault by a small — but vocal — group of critics,” McCarthy said.

“I bet when those same critics get sick, they run to doctors and hospitals that rely on science from — guess who — Harvard University and the American Cancer Society,” McCarthy continued. “I bet they check air quality forecasts from EPA and the National Weather Service to see if the air is healthy enough for their asthmatic child to play outside that day. I bet they buy dishwashers with Energy Star labels, and take FDA-approved medicine, and eat USDA-approved meats. … People and businesses around the world look to EPA and other federal agencies because our science is reliable, and our scientists are credible.”

These examples don’t show that Global Warming critics, many of whom are scientists, don’t understand science.

They show that Gina McCarthy doesn’t understand science.

If a scientist said, “You must accept my theory, even though it’s completely unrelated to anything involving medicine because I come from Harvard University”, he would be rightly laughed out of every forum there is.

But that’s exactly what Gina McCarthy is claiming. Worse, she’s echoing many anti-science liberals who insist that science isn’t a set of hypothesis that have to be tested and retested against new evidence, but that it’s an undifferentiated mass that you have to accept whole.

That’s not science. That’s a religion.

And that’s what Global Warming and the Warmists who insist that it’s part of some scientific catechism are really about.

Gina McCarthy sites National Weather Service forecasts, but those were completely off this winter because Warmunism led them to expect a warmer winter. This ideological fallacy led to possible lost lives.

The Energy Star sticker or FDA and USDA approval are mandates. McCarthy knows it’s not exactly optional. You can’t buy non-FDA approved medicines. So pretending that it’s some gesture of trust is Elizabeth Warren levels of cynicism.

Finally no looks to the EPA for credible science. Environmentalists and Green Tycoons look to the EPA to shut down businesses, kill jobs and make Al Gore and his cronies even richer.

So you might ask, what branch of science produced Gina McCarthy?

A longtime civil servant, McCarthy held the position of assistant administrator, U.S. EPA from 2009 to 2013. Prior to 2009, she was commissioner, Connecticut Department of Environmental Protection, 2004–2009.

McCarthy graduated from the University of Massachusetts Boston with a Bachelor of Arts in Social Anthropology in 1976. In 1981 she received a joint Master of Science in Environmental Health Engineering and Planning and Policy from Tufts University.

Gina McCarthy’s scientific background is right up there with Oprah’s background is psychology.

Black people are being held back by affordable food and gasoline.

Meet the new EPA chief. Even crazier than the old EPA chief. And the old EPA chief set up a separate identity for herself and gave it awards. And then left with an official very expensive portrait of her urinating into a brook.

But Gina McCarthy is showing promising signs of craziness.

Administrator Gina McCarthy attended an event Thursday at Clark Atlanta University hosted by the Hip Hop Caucus.

Rev. Lennox Yearwood, president and CEO of the Hip Hop Caucus, “argues often that climate change is the ‘lunch counter moment’ for the younger generation.”

It’s more like his 5-star restaurant moment.

The EPA chief encouraged black students, who are “most vulnerable to climate change,” to become “champion climate justice advocates” by supporting some of the FDA rules currently being pushed by environmental activists. McCarthy mentioned “greenhouse gas emission standards for new power plants that the agency released last fall, and the rules for existing plants” that are set to be released on June 1.

“Pollution is holding back millions of African Americans fighting for middle class security.” She continues, “Environmental justice is social justice.” McCarthy also says, “We have a moral obligation to act now.”

Sure. Black people are being held back by affordable food and gasoline. If only a carbon tax were to make these and many other things much more expensive, it would really move black people forward.

We have a moral obligation to make Al Gore richer and millions of Americans poorer. Anything else is racism.

In a stunning admission, Environmental Protection Agency (EPA) Administrator Gina McCarthy revealed to House Science, Space and Technology Committee chairman Lamar Smith (R-TX) that the agency neither possesses, nor can produce, all of the scientific data used to justify the rules and regulations they have imposed on Americans via the Clean Air Act. In short, science has been trumped by the radical environmentalist agenda.

The admission follows the issuance of a subpoena by the full Committee last August. It was engendered by two years of EPA stonewalling, apparently aimed at preventing the raw data cited by EPA as the scientific foundation for those rules and regulations from being independently verified. Two studies, the 1993 Harvard Six Cities Study (HSC) and the American Cancer Society’s (ACS) 1995 Cancer Prevention Study II, had verified that fine airborne particles measuring 2.5 micrograms or less were responsible for killing thousands of Americans every year. They became the baseline by which the EPA regulated particulate emissions from power plants, factories and cars. Airborne particles of that size are equivalent to approximately 1/30th the diameter of a human hair.

Apparently Smith and other Republicans had an inkling of what was going on at the EPA last November. At that time, Rep. David Schweikert (R-AZ) introduced the Secret Science Reform Act aimed at barring the agency from proposing new regulations based on science that was neither transparent nor reproducible. “Public policy should come from public data, not based on the whims of far-left environmental groups,” Schweikert said in a statement. “For far too long, the EPA has approved regulations that have placed a crippling financial burden on economic growth in this country with no public evidence to justify their actions.”

The bill was co-sponored by Smith, as well as fellow House Science Committee members Jim Bridenstine (R-OK) and Randy Neugebauer (R-TX). Smith echoed the concern expressed by Schweikert. “It appears the EPA bends the law and stretches the science to justify its own objectives,” he said. “The EPA must either make the data public, or commit to no longer using secret science to support its regulations.”

At that time, McCarthy was singing a different tune. She defended the EPA’s “high-quality science,” and referenced a report by the Office of Inspector General praising the EPA for its research. In testimony before the Committee, she insisted that science is the “backbone of the EPA’s decision-making.”

By February, the list of co-sponsors for Schweikert’s bill had reached about a dozen, prompting the inevitable pushback from Democrats and their media allies. The “climate denier” label, used by the left to cut off debate regarding whether or not climate change is man-made or a natural occurrence, was dutifully applied to environment subcommittee chairman Schweikert by the Huffington Post and Salon. When running for office in 2008, Schweikert offended the doyens of political correctness. “Understanding what part of climate change is part of a natural cycle and what part has human components is the first step,” he at the time. “Our elected officials must be careful to react to facts and not folklore.”

Rep. Mike Honda (D-CA) was similarly offended. “The bill attacks the mainstays of scientific investigation,” he wrote in an email to The Huffington Post. “It would strip away the EPA’s authority to make any rules due to the stringency of the data disclosure requirements. The peer review process is the foundation of science inquiry in our society, and is a trusted evaluation of scientific evidence around the world. This legislation attempts to dictate how the scientific method is employed. The Secret Science Reform Act is an attempt by climate change deniers to stop the EPA from doing its job.”

On March 7, such objections were revealed for the fraudulent nonsense they truly are. In a letter sent to Smith, McCarthy acknowledged that the Committee’s subpoena sought data from aforementioned studies, along with analyses and re-analyses of that data. After conducting a “diligent search” of the data in their own possession, the agency noted that it also conducted a search for additional data from outside sources, using the Shelby Amendment as the vehicle to obtain that information. They further acknowledged that they have not withheld any data relevant to the subpoena.

Then came the admission. “The EPA acknowledges, however, that the data provided are not sufficient in themselves to replicate the analyses in the epidemiological studies, nor would they allow for the one to one mapping of each pollutant and ecological variable to each subject.” Yet in the very next sentence, the agency remained utterly defiant. “For reasons explained in our previous letters on this topic, these acknowledgments do not call into question the EPA’s reliance on these studies for regulatory actions.”

Really? Why not? The scientific method is all about reproducing reliable data that can be independently verified. The EPA and their leftist allies are essentially saying “trust us,” even as they denigrate climate change skeptics for their failure to embrace “settled science.” Such overt hypocrisy would be laughable were it not for the reality that the EPA is moving forward with even more regulations that could place 90 percent of the American public in “non-attainment” areas. They are defined as areas “considered to have air quality worse than the National Ambient Air Quality Standards as defined in the Clean Air Act Amendments of 1970.”

Moreover, there are studies that refute the data on which the EPA relies. “Airborne Fine Particulate Matter and Short-Term Mortality,” looked at virtually the entire state of California from 2007-2010. Its author, Johns Hopkins-trained biostatistician Steve Milloy, who posted its results on his junkscience.com website, revealed the fraud the EPA has been perpetrating for decades. “EPA says that when PM2.5 levels go up, people die every day,” he told CNSNews.com. “But if PM2.5 is killing people, my data would show it, especially in Los Angeles, which has some of the worst air quality in the U.S. Not only was there no relationship there, I found a negative correlation in the LA area….If a significant causal relationship between PM2.5 and mortality existed, that relationship should have been visible in this study. But it was not.”

Milloy’s results were not anomalous. Another study, “Assessing Geographic Heterogeneity and Variable Importance in an Air Pollution Data Set,” authored by S. Stanley Young and Jessie Q. Xia of the National Institute of Statistical Sciences, was equally revealing. It contends that the “association between PM2.5 with mortality, when compared to the associations between other variables and mortality, shows that the importance of PM2.5 is relatively small.” Young and Xia conclude that the “data set does not support the claim that decreasing PM2.5 will increase longevity. If the cost of decreasing PM2.5 is high enough there could well be a net loss in longevity.” (italics mine)

In an equally damning revelation, they refute the level of importance placed on fine particulate matter per se, explaining that insufficient income, cigarette smoking and a lack of education are more influential on longevity. Thus they contend that “policymakers might better focus on improving the economy, reducing cigarette smoking, and encouraging people to pursue education.”

These studies underscore the need for the Secret Science Reform Act, aka, HR4012. It intends to prohibit the EPA from “proposing, finalizing or disseminating regulations based upon scientific information that is not publicly available in a manner sufficient for independent scientific analysis.” It would amend the Section 6 (b) of the Environmental Research, Development and Demonstration Authorization Act of 1978 in the following manner:

“The Administrator shall not propose, finalize, or disseminate a covered action unless all scientific and technical information relied on to support such covered action is (A) specifically identified; and (B) publicly available in a manner that is sufficient for independent analysis and substantial reproduction of research results.”

That such eminently reasonable demands are necessary at all reveals the contemptible levels to which the EPA and the Obama administration will stoop to advance the radical environmentalist agenda. “As it stands now, only EPA-funded researchers do the work and review the work, and nobody gets to see the data,” explained Milloy. “These are very expensive regulations, and the alleged benefits are entirely based on this PM/death relationship.” It is a relationship revealed to be an utter fraud. It’s time for a thorough cleaning of the EPA itself. It has been polluted by a poisonous ideology for far too long.

I’m not sure how this is racist, but once Chris Matthews, Melissa Harris-Perry and the other good people at MSNBC put their brain cell together, they’ll figure out the answer to that.

On August 24, 2011, armed FBI agents in SWAT gear executed a warrant for the seizure of wood at Gibson Guitar facilities. At the time, the raid appeared peculiar because of the excessive forced used over charges of regulatory violations. The premise of the raid was an obscure 100-year-old law known as the Lacey Act. On the basis of this act, the Feds were able to storm the facilities, claiming that Gibson’s had broken foreign (not American) law in its procurement of the wood, even though the government produced no evidence of the crime at the time and no evidence has since emerged that the material was illegally obtained. Juszkiewicz was only told at the time that the Gibson supply chain had a “risk” of including illicit wood.

Notably, one of Gibson’s biggest competitors, C.F. Martin & Co., reportedly uses the same type of wood seized from Gibson’s, but did not face any kind of interference from the federal government. The Examiner reports that Chris Martin IV, CEO of C.F. Martin & Co., is a well-known Democratic fundraiser. The Examiner describes Martin as “a long-time Democratic supporter, with $35,400 in contributions to Democratic candidates and the DNC over the past couple of election cycles.” Furthermore, no other companies known to use the wood in question, such as furniture manufacturers, have reported similar prosecution from the federal government, though the wood is distributed widely throughout the world.

So now Gibson is turning government wood into government guitars.

This week Gibson has announced the “Government Series” of guitars, to celebrate the end of its tussle with the eager enforcers of the U.S. Customs Department.

It’s a series of guitars made, purportedly, with the very same wood that was seized by the United States government, which was later returned at the end of the fiasco.

The body is painted in a custom color the company has named “Government Tan”–suitably drab–a nod to the joyless reality of living under the heavy thumb of stifling bureaucracy.

Wait… government tan. That’s racist! Anyway according to the Gibson Guitars press release…

Fight the Powers that Be with this Powerful Les Paul!

Great Gibson electric guitars have long been a means of fighting the establishment, so when the powers that be confiscated stocks of tonewoods from the Gibson factory in Nashville—only to return them once there was a resolution and the investigation ended—it was an event worth celebrating. Introducing the Government Series II Les Paul, a striking new guitar from Gibson USA for 2014 that suitably marks this infamous time in Gibson’s history.

A distinctive vintage-gloss Government Tan finish, complemented by black-chrome hardware and black plastics and trim, is topped by a pickguard that’s hot-stamped in gold with the Government Series graphic—a bald eagle hoisting a Gibson guitar neck. Each Government Series II Les Paul also includes a genuine piece of Gibson USA history in its solid rosewood fingerboard, which is made from wood returned to Gibson by the US government after the resolution.

Antibacterial soaps used by hospitals are exempt

Give these guys another three years and we may just be down to caves and antelope horns. After launching an assault on donuts, milk and popcorn, the FDA has expanded its war on everything to antibacterial soap.

U.S. regulators on Monday issued a proposed rule that would require makers of antibacterial hand soaps and body washes to demonstrate their products are safe and more effective than soap and water in preventing infection and the spread of bacteria.

“Although consumers generally view these products as effective tools to help prevent the spread of germs, there is currently no evidence that they are any more effective at preventing illness than washing with plain soap and water,” the U.S. Food and Drug Administration said in a statement.

So naturally they ought to be banned.

FDA and EPA Working in Tandem on Triclosan

FDA and the Environmental Protection Agency (EPA) have been closely collaborating on science and regulatory issues related to triclosan. This joint effort will help to ensure government-wide consistency in the regulation of the chemical.

Well you know how once the EPA gets involved in something it’s bound to end well.

“Due to consumers’ extensive exposure to the ingredients in antibacterial soaps, we believe there should be a clearly demonstrated benefit from using antibacterial soap to balance any potential risk,” Janet Woodcock, who directs the FDA Center for Drug Evaluation and Research, says in a statement.

That’s the guilty-until-proven innocent statute. Oh but wait…

One interesting twist to the proposal that Jenny Gold noticed is that antibacterial soaps used by hospitals are exempt from these new requirements. The FDA explains this by noting that health care settings are ones where there’s a higher risk of disease being spread.

“In the U.S. consumer setting, where the target population is composed of generally healthy individuals, the risk of infection and the scope of the spread of infection is relatively low compared to the health care setting, where patients are generally more susceptible to infection and the potential for spread of infection is high,” the agency writes in its preliminary regulation.

This is a bit of a weird justification, given that the agency doesn’t think antibacterial soaps do any better than regular soaps at stopping the spread of bacteria. But, this is where the FDA came down on the issue, and it means soap will now face different regulations depending on where it gets used.

So antibacterial soap is completely ineffective… which is why hospitals will be allowed to keep on using it. Sure.

That comes from the Washington Post which uniquely wandered off the media reservation compared to all the other media outlets which are just parroting the FDA’s talking points and cheerfully telling consumers to stock up while they can, because like incandescent light-bulbs and popcorn, they’ll soon be gone.

“This is a good first step toward getting unsafe triclosan off the market,” said Mae Wu, an attorney for the Natural Resources Defense Council. “FDA is finally taking concerns about triclosan seriously. Washing your hands with soap containing triclosan doesn’t make them cleaner than using regular soap and water and can carry potential health risks.

And you know how much the NRDC cares about hand cleanliness. But no. They’re targeting triclosan for the same reason they’ve targeted dishwashing liquid that actually works. Because they’re fanatical environmentalists. And they enjoy human suffering.

Here’s what this is really about…

Most of these products get washed down the drain, where they enter our waterways and are then transported widely throughout the environment. Triclosan is one of the most frequently detected chemicals in streams across the U.S. and both triclosan and triclocarban are found in high concentrations in sediments and sewage sludge where they can persist for decades.

In the environment, antibacterial compounds could disrupt aquatic ecosystems and pose a potential risk to wildlife. Traces of triclosan have been found in earthworms from agricultural fields and Atlantic dolphins. In the lab, triclosan has been shown to interfere with development of tadpoles into frogs, a process that is dependent on thyroid hormone.

It’s all about the frogs.

Not only is the planet not in immediate danger of exploding because of Global Warming unless John C. Beale saves us from it, but John C. Beale also wasn’t a CIA spy in Pakistan, he never caught a fish that was that big and his girlfriend, whom you’ve never met, does not live in Canada.

But once you tell a lie for a living, it can be hard to stop.

That was the problem faced by John C. Beale, who was paid to be an ecoscammer for the EPA, so he decided to lie about not doing the job that was a lie. And then it all got confusing.

The EPA’s highest-paid employee and a leading expert on climate change deserves to go to prison for at least 30 months for lying to his bosses and saying he was a CIA spy working in Pakistan so he could avoid doing his real job, say federal prosecutors.

Unfortunately Beale’s real job involved lying to the American people. So he was lying to avoid lying. It’s almost moral.

John C. Beale, who pled guilty in September to bilking the government out of nearly $1 million in salary and other benefits over a decade, will be sentenced in a Washington, D.C., federal court on Wednesday. In a newly filed sentencing memo, prosecutors said that his “historic” lies are “offensive” to those who actually do dangerous work for the CIA.

Also his claims about cow flatulence endangering the planet are offensive to cows.

“With the help of his therapist,” wrote attorney John Kern, “Mr. Beale has come to recognize that, beyond the motive of greed, his theft and deception were animated by a highly self-destructive and dysfunctional need to engage in excessively reckless, risky behavior.” Kern also said Beale was driven “to manipulate those around him through the fabrication of grandiose narratives … that are fueled by his insecurities.”

Grandiose narratives? Like pretending that the planet will burn up unless we all bike to work?

Two new reports by the EPA inspector general’s office conclude that top officials at the agency “enabled” Beale by failing to verify any of his phony cover stories about CIA work, and failing to check on hundreds of thousands of dollars paid him in undeserved bonuses and travel expenses — including first-class trips to London where he stayed at five-star hotels and racked up thousands in bills for limos and taxis.

Why would they? They were neck deep in their own lies.

Until he retired in April after learning he was under federal investigation, Beale, an NYU grad with a masters from Princeton, was earning a salary and bonuses of $206,000 a year, making him the highest paid official at the EPA.

Not to mention the CIA and MI6.

Beale perpetrated his fraud largely by failing to show up at the EPA for months at a time, including one 18-month stretch starting in June 2011 when he did “absolutely no work,” as Kern, Beale’s lawyer, acknowledged in his court filing.

Considering that the EPA’s idea of work is manufacturing frauds and storming guitar factories with guns drawn… that was a good thing.

At one point he claimed to be urgently needed in Pakistan because the Taliban was torturing his CIA replacement, according to Sullivan.

And everyone at the EPA believed him, because they had lied so much that they lost the ability to tell apart lies from the truth.

He also claimed to be suffering from malaria that he got while serving in Vietnam. According to his lawyer’s filing, he didn’t have malaria and never served in Vietnam. He told the story to EPA officials so he could get special handicap parking at a garage near EPA headquarters.

So Beale could have also been the Democratic nominee for President in 2004.

Kern, Beale’s lawyer, declined to comment to NBC News. But in his court filing, he asks Judge Ellen Huvelle, who is due to sentence Beale Wednesday, to balance Beale’s misdeeds against years of admirable work for the government. These include helping to rewrite the Clean Air Act in 1990, heading up EPA delegations to United Nations conferences on climate change in 2000 and 2001, and helping to negotiate agreements to reduce carbon emissions with China, India and other nations.

As the death toll for Government Shutdown Apocalypse 2013 continues to grow, it appears that the EPA’s plans to make it even more expensive for Americans to drive a car were “shut down” by the government shutdown.

The U.S. Environmental Protection Agency will take one of the biggest hits of any federal agency if the government shuts down this week, operating with under 7 percent of its employees, according to guidance issued by the agency.

Just think of how much less the EPA will be able to do with only 7 percent of its employees. That EPA SWAT Team may have to sit out the week. Someone else will have to send $700,000 to Thailand’s pig farmers. And someone else will have to hike fuel prices.

Among those furloughed would be most workers at the Office of Air and Radiation, which is in charge of writing and implementing most of the EPA’s major air pollution rules. The clock would also stop, for now, on the EPA’s eagerly-awaited proposal on renewable fuel volume standards for 2014.

Who exactly is eagerly awaiting this proposal? Drivers who can’t wait to pay a buck more for gas.

Gas prices will increase about $1 per gallon by 2015 and take a $550 billion bite out of Americans’ take-home pay when the Environmental Protection Agency’s (EPA) Renewable Fuel Standard (RFS) increases the ethanol mandate past the 10 percent “blend wall.”

Sadly the evil government shutdown may delay the environmentalist push for Electric Poverty in America

“People are not going to be able to be working on these rules at home,” said Dina Kruger, an environmental regulation consultant and former climate change director at the EPA, who worked at the agency when the government shut down in 1996.

Sure.

EPA employees won’t write arbitrary rules that steal money out of the pockets of hardworking Americans unless the Americans pay them first.

“Permitting does not qualify (as essential), so people should expect delays in permit processing and other licensing and approval processes,” said Scott Fulton, former EPA general counsel until January this year and an attorney at Beveridge and Diamond.

“This is a decidedly bad thing for the country. Everybody pays, including the regulated community.”

Gulag employees furloughed. Gulag prisoners waiting for meals hit hardest. There is a solution though. Free the prisoners.

EPA Chief Lisa Jackson has moved on to teaching Apple how to be a green fruit by using solar energy to fry escaping child workers in China, but Apple may want to reconsider hiring a woman who seems to be a few apples short of a tree.

We learned earlier that not only did Lisa Jackson create the alias of Richard Windsor, but she communicated with people as Windsor while pretending to be her own assistant.

And apparently Windsor was a very talented employee and scored all sorts of awards and commendations.

“Richard Windsor” may have only been an alias for former Environmental Protection Agency administrator Lisa Jackson, but that didn’t stop him from being awarded numerous certificates for ethics and records management.

The EPA awarded certificates naming Jackson/Windsor a “scholar of ethical behavior.” Jackson, under her secret alias, was also awarded certificates for completing training modules on email records management.

Nothing says “scholar of ethical behavior” like running a major Federal agency under a dual identity.

“Fire trucks across the country are breaking down at record rates because of this filter system that EPA forces them to use,” the association said.

Red is the new Green. Or maybe Green is the new Red. The patient in question doesn’t sound like much of a loss, but it could have been anyone. And the bigger story is that the madness of Obama Inc. has gotten us to the point where emergency vehicles shut down automatically to reduce emissions.

DC Fire and EMS officials are explaining why an ambulance had to stop, in the middle of the transport of a suspect who was shot by police.

The ambulance the suspect in stopped short of the hospital, where he later died. Fire officials say it wasn’t because of an attempt to let a suspected cop shooter die in their care, but because a new piece of equipment on their truck meant to reduce diesel emissions forced the ambulance to shut down.

The device which is mandated by the EPA to be on all newer model diesel vehicles is designed to burn of diesel toxins. It does it either automatically or manually. If neither of those happens during a common cycle known as a “re-generating cycle” warning lights will go off and eventually force the vehicle to lose power and shut off.

Critics of this EPA mandate say there should be exemptions for emergency vehicles so this won’t happen.

However, Deputy Chief Donnelly says their challenge is to work within the federal agencies restrictions. Donnelly added, “We’re not in a position to fight the EPA regulations and we’re not even going to try.”

Fighting environmental Green Fascism is becoming an emergency situation.

Over a 20-month period, the San Diego fire department reported more than 500 regeneration-related issues, Firefighter Nation reported in 2011. And the Southeastern Association of Fire Chiefs in 2011 wrote to the EPA outlining the problem and lobbying for an exemption.

“Fire trucks across the country are breaking down at record rates because of this filter system that EPA forces them to use,” the association said.

In many cases, engines running at high levels for long periods of time can generate enough heat to cleanse the filters and avoid a drop or failure in engine performance. But for urban departments, which often perform short runs, the vehicles are required to undergo what’s called “manual regeneration,” in which the vehicle must be parked and the engine run at a high level for an extended period of time in order to generate the heat necessary to burn the soot from the filter.

Just wait till passenger planes shut down in midair and plummet into the ocean in order to save the planet.

The Environmental Protection Agency, as everyone knows, is the only thing keeping a rapacious mankind from chopping down all the trees, polluting all the rivers and coughing up carbon all over the sky.

To commemorate its commitment to fighting for the waterfalls, the stinkbugs and the nitrogen, the EPA commissioned this $40,000 portrait of insane outgoing EPA Chief Lisa Jackson, who spent much of her term breaking the law and conducting business as Richard Windsor using a secret email account.

This portrait of Lisa Jackson captures much of what the EPA does. It puts large wooden doors around waterfalls, so no one can get at them and pollute them, and then stands in front of them letting the pure energy of the falls soak into their bodies to energize them with its natural goodness.

Or, possibly, Lisa Jackson was actually the embodiment of a nature spirit, who, when she was forced to quit after a fake email scandal, became transformed into a waterfall, and is now flowing somewhere in Virginia.

Either that or she has a major bladder control problem.

New emails released show that Jackson used her fake "Richard Windsor" account to communicate with top liberal groups without them being aware of who she really was.

The Lisa Jackson/Richard Windsor story is getting progressively weirder as new emails released show that Jackson used her fake “Richard Windsor” account to communicate with top liberal groups without them being aware of who she really was.

It’s hard to see why Jackson would want to do that unless she was engaged in activities so illegal that she didn’t trust them or any real life assistant to handle. The current email releases don’t show anything that bad, but we haven’t seen all of it. And the only two possible conclusions is that either Lisa Jackson really had something to hide or she was insane.

I’m going to assume that Lisa Jackson wasn’t crazy.

One June 19, 2009 from the Windsor account shows Jackson corresponded with Michelle Depass of the left-leaning Ford Foundation. Depass told Jackson that soon-to-be “EPA Deputy Assistant Administrator Shalini Vajjhala was going to work at the White House Council on Environmental Quality while also on payroll at the environmental group Resources for the Future,” according to Vitter.

The emails also seem to indicate that the environmentalists on the email threads believed that Richard Windsor and Lisa Jackson were two different people, when in fact the Windsor account belonged to Jackson.

The emails also show that Michael Martin, CEO of the environmental PR company Effect Partners, thought he was corresponding with Lisa Jackson’s assistant when emailing the Windsor account after he could not reach Jackson using her personal email address.

A March 4, 2010 email from Martin to the Windsor account reads, “Hi Richard, Thanks for your help in getting this information to Lisa this last week….If you are still there, could you please call me at [redacted],”

Jackson replied through the alias account, “Michael, Robert Goulding will call you tomorrow.” To which Martin responded, “Thanks Richard!”

So far we’ve got the usual conflicts of interest and the EPA coordinating with the Green Lobby. It’s scandalous, but also commonplace. The EPA stopped being an honest broker a while back and became an arm of environmental groups looking to shut down most industries.

What is strange is that Lisa Jackson ran this entire scam in her own head, constructing an alias assistant and using that alias to communicate with the Ford Foundation and other groups because she apparently couldn’t trust a real assistant.

However, the emails released by Vitter also show that Jackson used the account to correspond with former White House regulatory czar Cass Sunstein, who called the Richard Windsor account Jackson’s “special email.”

A December 12, 2009 email from Sunstein to the Windsor account said, “Hi Lisa — chance for lunch one of these days? At the White House? Maybe next Thurs or Fri? and let me know if/how I can be helpful with anything these days? – Cass (PS I have your special email from my friend Lisa H. – hope that’s ok!)”

So Cass was in the know, and being moderately creepy about it. Figures.

King Canute may have ordered the tide to halt and King Xerxes may have ordered his men to whip the waters of the Dardanelles strait for bringing up a storm, but Only King Hussein and Lord O’Malley would contemplate taxing the rain.

If you thought they ran out of ways to tax us you badly misjudged our lawmakers’ creativity. Get ready for their newest invention, the rain tax.

In 2010 the Obama administration’s Environmental Protection Agency ordered Maryland to reduce stormwater runoff into the Chesapeake Bay so that nitrogen levels fall 22 percent and phosphorus falls 15 percent from current amounts. The price tag: $14.8 billion.

And where do we get the $14.8 billion? By taxing so-called “impervious surfaces,” anything that prevents rain water from seeping into the earth (roofs, driveways, patios, sidewalks, etc.) thereby causing stormwater run off. In other words, a rain tax.

Taxing impervious surfaces is a brilliant environmentalist gimmick for penalizing structures. If you pave your driveway, then you’re obstructing the rain and you have to be penalized for it.

The EPA ordered Maryland to raise the money (an unfunded mandate), Maryland ordered its 10 largest counties to raise the money (another unfunded mandate) and, now, each of those counties is putting a local rain tax in place by July 1.

Well, you ask, “How on earth can the government know how much impervious surface I own?” Answer: It’s not on earth, it’s in the sky. Thanks to satellite imagery and geographic information systems, Big Brother can measure your roof and driveway.

Isn’t it great how we got rid of that creepy Bush Administration and its surveillance state that was wasting its time fighting terrorists instead of measuring roofs from space to determine how much money the rain-obstructing criminals have to pay?

OK, once the counties raise this money, how is it spent? The state law is kind of squishy. It can be spent to build and maintain stream and wetland restoration projects. And, of course, a lot of it will go to “monitoring, inspection, enforcement, review of stormwater management plans and permit applications and mapping of impervious surfaces.” In other words, hiring more bureaucrats to administer the rain tax program.

It can also be spent on “public education and outreach” (whatever that means) and on “grants to nonprofit organizations” (i.e. to the greenies who pushed the tax through the various levels of government).

So homeowners are being fined for having roofs overhead with the money being used to create jobs for ecoscammers and funnel money to their groups.

Wouldn’t it be better if we just went to a straight up mafia state like Russia. Then we could dispense with the Rain Taxes and call a shakedown what it is.

Here’s how Montgomery County is spending some of its rain tax:

“(The county) holds workshops and training events to help residents understand how various projects work. Projects such as rain gardens, conservation landscaping, rain barrels and cisterns, drywells and tree planting are then offered to be installed on properties that qualify, based on the County’s assessment.”

So, I’m supposed to pay a rain tax so the county can train me how to plant a tree, which they’ll give me if, in its view, I qualify? Have we all gone mad?

We’ve all gone liberal.

Homeowners are going to pay the rain tax three times. Once, on their homes. A second time because commercial leases force tenants pay the landlord’s property taxes, which the tenants will, then, pass on to their customers. And a third time as church members or supporters of nonprofit hospitals, private schools and charities.

You see, state lawmakers exempted government-owned property from the rain tax but imposed it on religions and nonprofits (which own big roofs and parking lots).

Forget North Carolina. We already have a State Church and it’s fining non-state religions in rain tithes to finance its Green Religion.

Best of all Governor Martin “Rain Tax” O’Malley is contemplating a presidential run.

“I need to be spending a lot more energy and time giving serious consideration and preparation to what — if anything — I might have to offer should I decide to run for president in 2016,” O’Malley said during a wide-ranging interview with editors of The Baltimore Sun.

I’m sure there’s a lot that the Rain Taxer could offer. Like a national Rain Tax. And rain redistribution. The possibilities are endless. So is the tyranny.
