				<content:encoded><![CDATA[<p><strong style="color: #232323;">Below are the video and transcript to the panel discussion “The ObamaCare Battle,” which took place at the David Horowitz Freedom Center’s 20th Anniversary Restoration Weekend. The event was held Nov. 13th-16th at the Breakers Resort in Palm Beach, Florida. </strong></p>

<p><strong>Larry Kawa: </strong>We’re going to be talking today a little bit about executive overreach.  It’s a phenomenon I think that America has become fatigued by.  The one good thing for the President about having so many scandals is each one of his next scandals kind of eclipses the previous scandal, so you can’t even think about it anymore.  The one that we’re here to talk about primarily today – we’ll start off with and then I have a couple other surprise scandals at the end I’ll throw in – is the employer mandate.  It’s one that’s been very near and dear to my heart, and thanks to the tremendous help of Judicial Watch, we’re doing very well at trying to enforce that component of the law, and I’m here today to start off by introducing to you my dear friend who is the president of Judicial Watch who does many, many things, only one of which is the great thing that he is doing to help with my lawsuit, which I will get to later in the program.  I’d like to take a moment to introduce to you Mr. Tom Fitton.  Tom, if you could please come up here.</p>
<p><strong>Tom Fitton:</strong> I thank you very much everybody, and I just have to be careful with talking to people at these meetings because I get as outraged as you do, and that’s what motivates us at Judicial Watch, and I joke, and it’s only half a joke.  I go to the Church of Our Lady of Perpetual Outrage, and the pews are much more full these days, and there is a crisis in Washington.  It’s a crisis of lawlessness that others have already spoken about at this panel, and we could talk about Benghazi.  Judicial Watch has worked doing the work of Washington in getting the truth out on Benghazi, getting the truth out on the IRS scandals and also getting the truth out on Obamacare, and we’ve all seen this Gruber comment where he said that lack of transparency is a huge political advantage.  That’s Gruber’s point, and he got, what, $400,000.00 from the Health and Human Services to help push Obamacare, but that’s the guiding principle of President Obama, so the focus on Gruber is actually a misdirection, and our focus ought to be on President Obama.  He is the king of non-transparency.  He is the king of secrecy, secrecy that would probably have Nixon staring with his mouth agape, “Why didn’t I have his lawyers?”</p>
<p>The President began his presidency with the premise: we’ll be the most transparent administration in history, and when we do this healthcare law, C-Span’s gonna be at the table and anyone promoting the drug companies, that will be on C-Span and all the special interests will be held accountable as a result of the transparency he committed to.  Well, we all know how that turned out, and Judicial Watch had to sue to get information about those meetings at the White House.  Judicial Watch has had to sue to get information about how many people are participating in Obamacare.  Judicial Watch has had to sue to find out about the propaganda efforts behind Obamacare.  Judicial Watch has had to sue to find out about the navigators behind Obamacare.  Judicial Watch has had to sue to find out about the security of the healthcare web site.  Transparency is a bad word with the Obama administration, and so Gruber, he’s a sidebar issue, and we need to focus on the stonewalling and the secrecy of this administration.</p>
<p>Today the administration opened up healthcare.gov for the next enrollment period next year.  Well, the information about the pricing of the insurance policies was released last night to the New York Times.  Guess when the election was, and the New York Times reports that unless you change your healthcare plan, you’re going to get an increase of 20 percent, and that was a data dump to the New York Times on the Friday after this election.  Now, they knew those numbers long before, and they would not release them prior.  When did Obamacare open last year?  October 1<sup>st</sup>.  This year the middle of November.  Guess when the notices were allowed to be sent out by the Obama administration from the states telling people what they needed to do in terms of the next year’s healthcare plan?  Guess what day the letter was approved; November 5<sup>th</sup>, the day after the election.  So, it’s outrageous but you know what?  It puts people in jeopardy.  It means people may be double enrolled.  It may be people don’t have healthcare.  It may be people don’t know what the opportunities are to protect themselves in case of catastrophe as a result of the health insurance that we’re all paying for being made available to them.  So this transparency is more than just about the operations of government, and we want government to operate well.  It’s about protecting people and making sure that the government’s accountable and that we have the ability to govern ourselves.</p>
<p>Now, I say we had to sue, but why did we have to sue?  Where was the media?  Where is Congress?  Frankly, where are honest people in the federal government?  And, we found out why we had to sue, and, by the way, every lawsuit is an indication they’re violating the Freedom of Information Act.  We don’t sue because there’s no case to be had, it’s because they’re not following the law, and we know that the cover up is significant.  We know the number of signups.  How many people do you think signed up the first day of Obamacare?  It’s was a big controversy, right?  No one asked about it.  We did.  We sued.  One person signed up the first day of Obamacare. One person.  Well, there was a little bit of a controversy in the documents we obtained because someone said maybe two people signed up.  I want you to think about if we knew one person signed up the first day of Obamacare back in October of last year as opposed to the summer of this year when we obtained the information, how different the debate would have been.  We were able to get documents showing the PR campaign, the propaganda effort, hundreds of millions of dollars going to Obama-connected PR firms to “do behavioral change.”  We found that money was being pushed out, especially in the seven days before the 2010 election.  Again, where is the oversight by Congress?  We found out information about the security of the Obamacare web site.  Think about that.  The documents we have show that the Obama administration knew before the opening of healthcare.gov last year that it was an unsecure web site.  The details they refused to divulge to Congress, but we got the details from them.  Essentially, any joke of a hacker could upload an Excel spreadsheet or an Excel type of program and just gum up the works.  They weren’t tracking what the security flaws were.  I mean anyone who owns a business, anything related to IT, you’re looking for problems, you basically have to keep a list of what the problems are so you can address them all.  They weren’t even doing that and, in fact, they knew it was insecure, and what were the fix-it dates for them?  Months after the healthcare.gov was opened, months.  So, I can tell you if you’re putting information on healthcare.gov, you’re putting your personal information at risk, and, tying it back to the IRS scandal, guess who collects your information about whether you have health insurance, thanks to the individual mandate.  The IRS, and guess who they click with to make sure everyone’s on the same page; this healthcare.gov web site.  So, this unsecure web site – with the IRS web site and services which are also not terribly secure – my gosh, a hacker’s dream.  So, forget about K-Mart or Target or all those businesses who are being dragged and maybe criminally prosecuted by this administration.  Their criminal neglect of our privacy and their knowing neglect in putting our privacy at risk so they wouldn’t have to deal with the political consequences of admitting that the web site screwed up is really beneath contempt.</p>
<p>But, on top of the lack of transparency we’ve got the law breaking.  Now, the debate is whether we repeal Obamacare.  The public wants Obamacare repealed, but let me tell you what the dirty little secret is.  It has been repealed.  The Obamacare of 2010 is no longer in existence.  Now, it’s been repealed, in part, correctly as a result of legislation passed by Congress, signed into law by the President, but also the President himself has repealed it, taking the role of judge, legislature, and President all at once.  And, as Larry indicated most famously – well, perhaps most famously now – with the pushing back the statutory deadline on the employer mandate, and in the case of Dr. Carlisle, his business.  He was doing the right thing.  He prepped.  He knew this employer mandate was coming down the line.  He spent a good deal of money and a good deal of time that could have otherwise been spent pursing, expanding his business further, which is already tremendously successful, and so Obama says, “The law doesn’t apply to me.  I don’t have to follow the law, and I can just, without any cause, any authority, just ignore it.”  He’s out of all of his money.  He has standing, and we sued to challenge his ability to do that, and in that lawsuit, in highlighting it, we talked about this old U.S. Grant quote saying, “The best way to ensure the repeal of a bad law is to enforce it vigorously,” and President Obama has learned that and that’s why, at least, there’s like 24 changes to the law he’s unilaterally made in absolute violation of the law.</p>
<p>And let me tell you, this lawlessness has ensnared everyone else.  Congress, we have sued the District of Columbia over Congress’s participation in the small business exchange.  The House of Representatives, the small business exchange that DC has, limited to people with 50 employees or under.  You literally have to list – because I know because we’re a District of Columbia business, Judicial Watch, we’re located there – to apply in the exchange you have to list every employee and their birthdate.  Guess how the House of Representatives did it?  They just wrote Congress, birthdate 1994 – maybe there was a political statement there – nothing else.  Guess how many employees the House and the Senate have together; 20,000.  So, we get these forms that a representative of the House and the Senate made attesting under oath that they employee less than 50 people.  So, I want you – just a little activism – ask your member, do you have healthcare under this Obamacare exchange?  Do you know that it was obtained through fraudulent means, and what are you gonna do about it?  Maybe that’s one thing for the Republican Congress to do, heal thyself.  The lawlessness includes the judiciary where you had, frankly, Chief Justice Roberts rewrite Obamacare in order to save it, and the lawlessness extends to us where we’re forced to obey laws that weren’t passed by Congress.  There’s nothing to justify them other than raw power being exercised by the President, but we have to follow them in order to get health insurance.</p>
<p>So, the lawlessness of President Obama isn’t just about President Obama, it ensnares us all, and we’re happy to do the work to kind of bring back our ability to govern ourselves, but talking about Obamacare lawlessness, talking about Obama lawlessness, doesn’t really cover it.  The system is broken down.  Judicial Watch did all this great work that is talked about with Obamacare with the Benghazi and the IRS, and I’m proud of our work and pleased to have done it, but what an outrage that it was this little old group in Judicial Watch that’s asking questions about how many people are enrolled in Obamacare.  Why are we asking the questions?  Why are we suing in court?  This President doesn’t believe he is subject to the law.  We know that from other discussions.  The agencies he runs don’t think they’re accountable to the people, and Congress signs checks with their eyes closed and shows up like a fire department after the house burns down and yells &#8220;fire.&#8221;  Meanwhile, previously, we’re giving gasoline and matches to the 3-year-old in the house and wondering why the house burned down.  Really, when there’s no control like that, that’s not self-government and, in my view, we’ve got the appearances of self-government.  You vote.  There are elections, but if Congress goes back, doesn’t want to conduct any oversight, just gives blank checks to unelected bureaucrats, and if the President doesn’t think he is accountable to the law, if you think that’s self-government, it isn’t.  So, we present a way forward through this independent activity – lawsuits direct at lawsuits@govermentlawlessness, using the law to get transparency and accountability – and that’s the way forward.  We’ve got to get our government back under control.</p>
<p>Talk about policy is almost irrelevant in the meantime and actually dangerous because the criminal class is running Washington.  It’s a racket, and until there’s an honest game going on, we shouldn’t play it, and the way to play it and to make it more honest is to get that accountability back and that ought to be the focus of any new Congress, both honest Democrats and Republicans, and that ought to be the focus of what we’re doing here as a movement and I really appreciate Mr. Horowitz’s approach to what’s going on in Washington.  A) He’s not in Washington and he recognizes the crisis, and if we recognize the crisis this doesn’t mean oh, it’s insurmountable as a result.  It means that at least we know what the problem is so we’re not fooling ourselves with wasted efforts on silly things that don’t impact the fundamentals.</p>
<p>And so when I hear Mitch McConnell, for instance, saying, “Well, we need 60 votes to repeal Obamacare, and it’s not gonna happen.”  Well, why is that?  Where is the can-do attitude?  Maybe it will happen.  Obamacare has been repealed.  Who knows, the Supreme Court may rule later this year that the subsidies are illegally being given to people in certain faiths and it’s eviscerated, and Democrats may say, “Well, what’s there to save, let’s repeal it.”  It’s that sort of proactive leadership.  It’s that we’ve got to get something done, and I tell you, Obamacare is destroying our healthcare system.  People will die because of it.  Our house is burning.  We need to protect the family and the treasures, and Congresses need to understand the importance of that, and if it means making sure the President follows the law through a lawsuit that gets a law that we don’t like implemented, so be it.  And if it means that members of Congress and their staff have to pay more money for Obamacare, so be it, but we’ve got to protect ourselves.</p>
<p>So, these are nonpartisan issues.  Corruption, transparency, there’s a reason President Obama talks about transparency.  I know it’s the big lie of his administration because he appeals to people who support him as well, and I can tell you, having worked with groups on the left, they like transparency too.  They don’t understand that when you have a big government and big money transparency is very hard to achieve, but they like it in theory.  Take it for what it’s worth.  So, there are ways to reach across the aisles that don’t require us to leave our principles at the door, but getting government under control, making sure that the politicians are accountable to the people, making sure that businesses aren’t being – in the case of President Obama’s insurance commissar, Kathleen Sebelius – being shaken down to support Obama’s third-party group Enroll America.  I mean, Sebelius was out there campaigning on government time, violated the Hatch Act; first cabinet official in U.S. history.  Hatch Act prevents you from campaigning as a government official on government time.  She should have been fired.  Obama left her in.</p>
<p>I mean this is a crisis and Judicial Watch, I think, is recognizing it and has a way forward to address it, and I appreciate Dr. Carlisle’s participation with us because without a client we can’t do the lawsuit so it’s just great work, and I have to say, do not let up.  Hold your members to account and don’t let them say, “Well, this is the plan.”  No, they’re individually accountable, and it’s about time the individual members be accountable to you, and this is the story I want to leave you with:  Larry Carlisle is a business man down here in Florida, a successful businessman, and he is not cowed by the fact – he is a business man who is not a politician, not a public policy expert – that he can’t talk to politicians in Washington about what they’re supposed to do and what ideas they need to pursue or to lawyers at Judicial Watch.  I’m not a lawyer, but telling them, “Well, hey this is an idea.  Why don’t we do this?”  It’s that sort of, hey, you’re citizens of this grand republic and you need to participate too and don’t be shy about holding those politicians to account, and my guess is most of you are significant enough in your communities to get members of Congress to return your calls, and you should be pushing these issues.  So, with that, I can talk forever about Obama corruption and the situation in Washington.  I’ll end my remarks, and I encourage you to support Judicial Watch, obviously. We’re 300,000 active supporters, by the way.  You wouldn’t know that, would you, but isn’t that a sign to conservatives looking for a way forward, Republicans, honest Democrats? Wow, this Judicial Watch, all they do is talk about transparency, accountability in government, rule of law, and look at all the support they’re getting.  Is there a lesson there?  I think there is.  Thank you very much.</p>
<p><strong>Michael Reagan: </strong>I’m actually here as eye candy.  And today I’m not even worried about Obamacare ‘cause I’m on Medicare, and those of you who are on Medicare with me, you know exactly what I’m talking about.  And so what I, it’s the younger generation has to understand what’s going on.  And, what really kinda, excuse me, ticks me off is, I’d like to see Obamacare rolled back and gotten rid of ‘cause I don’t want my 26-year-old child living in the home anymore.  Does anybody have your 26-year-old child living at home?  Get them the hell out.  You know how I became an empty nester?  I bought another house and moved to it.  My son’s still living in the old house wondering where his parents went.  That’s what you need to do.</p>
<p>But I tell you, up here, because then we all go back, and I would really suggest this, ‘cause we all know the story, but we really have to bring another generation of people in who are going to be paying that 20 percent increase in their care and you really need to sit them in a room, the young generation, and let them listen to a speech my father gave back in 1962 on socialized medicine because he warned us back in 1962 what was gonna happen and, guess what, it happened and we’re all here now with socialized medicine with Obamacare.  My wife earlier this year, it&#8217;s interesting, she had to have rotator cuff surgery and so she went down to have her MRI done and she went for the MRI and they said, well, Mrs. Reagan your insurance, you still haven’t paid the full deductible on your insurance, but the reality of it is that, can you just give us a check for $350.00?  She said why?  She said because we’ll actually make a bigger profit if you give us a check for $350.00 than if we charge your insurance company for the MRI we’re gonna give you.  So my wife wrote a check for 350 bucks, got the MRI and then went and had the shoulder surgery a couple of weeks later and then the outpatient surgery center billed the insurance company $87,000.00 for rotator cuff surgery.  I mean, our system needs help.  I think we all agree to that.  But having socialized medicine is not the answer.</p>
<p>And what I really think about and Tom, maybe you could answer this question, Larry, ‘cause I go out and speak on this, I think that members of Congress, I think the insurance companies, I think the banking industry, I think every major industry in this country, oil and gas, you name it, I think they are scared to death of this administration and what might happen to their industry if in fact they go after the President of the United States of America, and I think we all saw that and see that what happened with the whole IRS scandal.  And they’re absolutely scared to death.  I mean you have an insurance industry today who doesn’t say anything about what’s going on because what do they get?  They got a reinsurance policy.  So they are guaranteed 100 percent of their losses are recovered in the first 2 or 3 years of Obamacare.  They got bought off before they went in the game so when they talk about too big to fail, they’ve now insured them against being too big to fail so we’ll never face that again.  There are so many things that are in fact going on, like one of the best reactions to one of the tweets I sent out &#8212; and by the way, David, are you here, or Michael Finch &#8212; should be #freedomcenter, just to let you know.  One of the biggest reactions I got is one time you were talking about, Tom, about Congress living up to the law that they passed on to us and the tweet that I sent out was “How would you feel if every member of Congress was made to pee in a bottle before and after every vote?”  And if you didn’t pass the pee test, then your vote didn’t count.  I think that’s, I’d like to see that law passed tomorrow.  Because I really think sometimes after they vote, don’t you think, my God would they pass the drug test themselves?  But again, it’s going to take all of us and really staying in touch –</p>
<p><strong>Audience Member: </strong>I know at least one who would fail.</p>
<p><strong>Michael Reagan: </strong>Yeah.  Yeah.  But it’s really upon us to stay on top of our members of the House, members of the Senate, but also be really educating the youth of America as they come out of that 26-year-old and started having to pay the fees and pay the prices here and with their prices going up.  It’s not getting cheaper and the death panels are there.  They’re all there.  We know that now.  Now it’s a matter of getting it out and we can’t just sit back and say, well, wait a minute, the dominant media is not going to cover it.  No, they’re not gonna cover it.  They’re never gonna cover it.  So, it’s up to us to be screaming from the mountain tops and doing something about it and as I said this morning when I was speaking, you can’t just come to these events, listen to Tom, listen to Larry, listen to David, listen to Mike, listen to Michele Bachmann, listen to Ann Coulter, listen to everybody and then go home and say that was a wonderful time, I had the greatest time of my life at the Breakers, and listen to all these great speakers and go home and do nothing.  You’ve gotta go home and do something.  Because if you go home and do nothing, then Obama wins.  If you go home and do nothing, the left wins.  And that’s what they’re counting on is for you to come to this, go home, and do nothing.  And so through your support of the Freedom Center is one thing, but you also have to be vocal at home.  You have to be involved at home.  And you have to be educational at home.  And if you do that, then we will win the day.  If we don’t do that and we just show up for these conferences, we are going to lose the day and let me tell you, the world cannot afford for America to lose.  My God, where are the Canadians gonna go now for healthcare?  So I’ll turn it back to you, Larry.</p>
<p><strong>Larry Kawa: </strong>So many scandals and lies out there.  It’s hard to pick one that’s really your favorite.  So, just last night I get back to my room and I decide it would be interesting to do another FOIA request before I get into mine briefly.  So I said, they say that the Keystone Pipeline, the President didn’t want to agree to it yet because he was waiting for some research, he’s always waiting for something, waiting for some research to come back so I go on the Department of Energy’s FOIA request, like most people probably do at midnight, go into their Carlsbad Division and I look under the Waste Isolation Pilot Program to complete my FOIA request and it says to complete this you need to have RB Media.  It’s a government subcontractor.  So, I said okay, I go to RB Media, go on rbmediasolutions.com, you’re welcome to go on your phones right now, and go on rbmediasolutions.com, a government subcontractor.  So I’ll read to you what it says on their web site, “Notice,” this is their landing page, “We apologize for the downtime over past several weeks.  Our server was attacked by an Islamic group and we are in the process of getting everything back in order.”  It’s hard not to mention fun stuff like that.  This is a government subcontract.  But in any event, getting back on point, back in March 2013 I spent money on legal fees to make sure that my business, which is an orthodontic business in Boca Raton, was compliant with a law that I didn’t agree with, the Obamacare law.  I might not like it, but I have respect for the Constitution, I’m a law-abiding citizen, so I paid some lawyers to make sure that my business is in compliance with the law.  Being that I have more than the required minimum of 50, I am technically a large employer, it affects me and a few more months go by, July 2, 2013 on his first day of an 8-day-long, $100 million trip that the taxpayer paid for to Africa, as he flees his own country, our Commander in Chief, decides he’s gonna tweet.  He tweets that he is going to wave the employer mandate.  Now that’s a head scratcher.</p>
<p>It says in the law that it shall go into effect January 1, 2014.  How does that happen?  Well, the day goes on and there’s a blog post from the Department of the Treasury, later memorialized by IRS Memorandum 2013-45 standing behind him saying we agree with his tweet; even though it says it nowhere in the law, we’re gonna change it to be January 1, 2015.  Now, it doesn’t say may, it says shall.  I’m not good at a lot of things, but English I’m okay with.  Shall go into effect and now suddenly it’s not.  I want to remind you that the purpose of any type of executive action is only one.  It is to better enforce the existing laws.  Let’s just go back to the basics of the Constitution.  Article 1 says that only Congress can make or change a law.  Article 2 says only the President has an affirmative fiduciary duty to enforce the existing laws.  Therefore, there’s nothing you could do by executive action to better enforce a date of January 1, 2014 by making it a year later making it January 1, 2015.  Now, there’s a question that I often see asked in the news, which I still haven’t seen the right answer to.  The question is, if this president hasn’t done anymore executive orders than any other president, he’s done less than 200, so did George W. Bush, how you gonna claim that he’s a tyrant?  Why is he ruling by executive fiat?  Well, here’s the answer, which I’ve learned from Tom and his group, terrific group, I’ve been educated along the way, it’s because there are other types of executive actions other than executive orders.</p>
<p>If you want to see every president’s executive orders, it’s not hard.  Go on Wikipedia.  Put in the two words and they’ll list them for every president.  However, tweets, blog posts, signing statements, and inter-department memorandums are also executive actions that carry with it a very similar authority.  So, contrary to popular belief, the employer mandate was not waived by executive order.  It was waived by executive action.  Now if you, this is really the kicker, if you added up all of the executive actions that this present president has done compared with other presidents, it blows away everything all the other presidents have done combined.  Just like the amount of increase in the national debt this president has done.  In six years he’s accumulated as much debt as 233 years of the United States of all these other presidents, 43 other presidents.  Well, he’s also broken the record with executive actions, not necessarily executive orders, but they have the same force and effect.  He has poked his finger in the eye of the Constitution and I had had enough and that’s when I called up Tom and the rest of the group at Judicial Watch and they graciously agreed to take the case and defend both me and defend the Constitution and you might say, well, why doesn’t Congress do something?  Well, in order to bring a lawsuit, I want you to bear in mind that the judicial branch under Article 3 of the Constitution only resolves actual disputes or controversies.  They do not step into the legislative system and resolve controversies between the executive branch and the legislative branch.  It’s not like two children are coming to their mom, that’s the courts, and saying come on, he said, she said.  It doesn’t work that way.  You have to have standing.</p>
<p>And with due respect to John Boehner who has said that he is going to bring a case on the employer mandate, I wish him the best of luck at trying to show that he has standing, injury.  Injury is only one of three components of standing.  You also have to show that the cause of your injury is an executive overreach and you have to show remedy.  You have to show that the courts can patch the bleeding by intervening.  My injury is the fact that I spent thousands of dollars of my money to make sure that my business was in compliance with a law that I didn’t agree with and all that I ask of the President is to simply do the same thing that I did.  Obey the law.  But I guess I was asking a little bit too much.  He governs by his mood ring.  Every day he looks at it and, well I would say he would look at what color it is, but like everyone would say, I’m a racist; the color of his mood ring, okay.  So then he decides what the law’s gonna be each day.  Well, when he waived the employer mandate on July 2, 2013, the reason that he brought it up was because he said large employers, like myself, need transition relief.  Nobody asked for it.  I didn’t ask for it.  Never even heard the phrase before he made it up; he’s got some good catchy phrases, he’s a wordsmith, but if you want to give transition relief, don’t give it to large employers, give it to the people that really need it, the average working American with calloused hands.  Waive the individual mandate.  I didn’t hear anything about that.</p>
<p>So, he waives the employer mandate and one question I have about the employer mandate is, how can you both love creating jobs, while you want to punish the job creators?  The liberals have the jargon down.  They say eat the rich, the wealthy, let’s punish them.  Nobody ever got a job from a poor man, right?  So, do you think it makes it easier or harder to create jobs, when you put more bricks in the knapsack of success of those who do so?  So, I think that’s really a message that needs to resonate with the left.  I doubt that they want to cover stuff like that, but if they really want to show the truth, that’s one way.  But, in terms of their ability to help get the truth out, let’s just say, I don’t want to say that they lie, but they’re a little bit challenged in that respect.  I think that they should be more willing to get out stuff like what Judicial Watch does, like what Michael Reagan talks about when he goes around the country speaking, and explain stuff like this, and understand why, when you hear the President say, I am going to do everything to make things a better America, and if Congress won’t agree with me, I’m going to go ahead, as a Congress of one, and just march forward and do it alone, like some sort of renegade James-Dean version of Congress.  That’s not how the Constitution was written.  If you want to, oh I love you, too, Mike.  Thank you.  That was very kind of you.  I really appreciate that.  And I can’t marry you.  I’m already married, come on.  Not in this state.  That was a very sweet thing, but in any event, there is a lot of stuff like that that goes on.</p>
<p>And I also want to let you know there’s another interesting thing that you’ll see, and I know I’ve got to be brief.  The Department of Defense was blamed by the President for having no strategy on ISIS.  You may remember that he said that the reason he had no strategy on ISIS is because he was waiting for options and direction from the Department of Defense, and they just never got back to him on it.  So, listen, stuff happens.  You get busy, right?  So I said, you know what?  I’m walking by my Jeep.  I have a bumper sticker on it and it says on the back, what would Reagan do?  There’s a picture of your dad, not you, Michael.  So, I said he would trust, but verify.  So, I sent that on my iPhone and I do a Freedom of Information Act request, requesting for all communications between the Executive Branch and the Department of Defense.  Somebody should ask, what did you say?  There’s a lot of stuff going on with this ISIS thing, you might have heard about.  Normally, these things take about a year, to a year and a half to get back; 8 weeks later I get a response from the Chief of the Pentagon, FOIA Division, and I thought Christmas came early.  I mean, it basically said that we have gone &#8212; and by the way if you want to see it, I have a catchy little web site I have.  Fortunately, the President let it lapse.  It was obamaforpresident.org, from the same great minds &#8212; feel free to go on your iPhones now and check it, if you want &#8212; that had healthcare.gov.  They let his main campaign web site lapse, so I took it and I posted this response, signed by &#8212; oh, this is like the Ginsu.  Don’t answer yet.  I’ve also got votehilary.com and hilaryforpresident.com.  Yes, for real.  Go on it.  You’ll see videos of me.  Okay?  Who says we don’t have social media?  So, I posted this response, signed by the Chief of the Pentagon’s FOIA Division.  So, I call him up.  I say, you know, I thought Christmas came early.  I mean, this basically nails the President to the cross.  It says there is absolutely no communication, at all, between the Department of Defense and the Executive Branch.  I said am I missing something?  This just sounds too good to be true, and Hannity covered this last Thursday, by the way.  I think you’ll hear more about it.  It sounds too good to be true.  Could there be classified documents that are missing?  He says no.  He says we actually took it upon ourselves to expand the scope of your request, something they never do, and we searched for ISIS strategy, ISIL strategy, Iraq strategy and Syria strategy, not only with the Executive Branch, like you asked, but we also searched the entire National Security Council.  I said who’s we?  He says me.  I looked through every one of the emails for Secretary of State John Kerry and his deputy, National Security Advisor Susan Rice and her deputy.  I went through Secretary of Defense Chuck Hagel and his deputy, Robert Work.  There was nothing.  I went through CENCOM Central Command and all of their nine combatant command divisions, nothing at all.  He goes, the only thing that we were more surprised about, than having zero results, is thinking that you are the only one that asked.  So, I said well maybe this time, you got lucky.  So, in closing, I don’t want to jeopardize my friendship with Mike.  I know you guys are on a short runway here.  I’m going to skip Q&amp;A, if that’s okay with Mike, and thank you guys for your time.  Please visit the web site.  You’ll see everything else about what we’re doing.  Enjoy the rest of your day.</p>

				<content:encoded><![CDATA[<p><a href="http://cdn.frontpagemag.com/wp-content/uploads/2014/12/1207-obama-bush-tax-cuts_full_6001-600x350.jpg"><img class="alignleft  wp-image-246694" src="http://cdn.frontpagemag.com/wp-content/uploads/2014/12/1207-obama-bush-tax-cuts_full_6001-600x350-450x324.jpg" alt="1207-obama-bush-tax-cuts_full_6001-600x350" width="315" height="227" /></a>More proof has emerged that President Obama is using the IRS as a weapon against his perceived enemies as the administration abruptly canceled the release of 2,500 damning documents reportedly showing that the IRS illegally shared taxpayer files with the White House.</p>
<p>The existence of the documents is yet more proof that Obama maintains an extensive enemies&#8217; list and that he treats the IRS as his personal plaything while he closely collaborates with senior IRS officials <a href="http://www.thenewamerican.com/usnews/politics/item/16752-irs-officials-visited-white-house-over-150-times-during-period-of-scandal"><span style="color: #0433ff;">who have practically taken up residence</span></a> with him in the White House. To Obama, the IRS is an instrument of political repression and taxpayer terror. Although it isn&#8217;t exactly breaking news that Obama is doing Machiavellian things with the IRS that the nearly-impeached President Nixon only fantasized about doing, hard documentary evidence of wrongdoing has been slow in coming.</p>
<p>The abortive document dump comes as former IRS mandarin Lois Lerner remains at liberty. Instead of becoming a long-term guest of the Bureau of Prisons, the unrepentant left-wing Democratic activist continues to live a life of luxury in Bethesda, Md., a fancy suburb of Washington, D.C. Despite the severity of her crimes, she doesn&#8217;t even have to wear a monitoring anklet. She hasn&#8217;t even been charged with breaking the law, an oversight that may be corrected by the incoming Republican-dominated Congress.</p>
<p>With Lerner taking the lead, Obama&#8217;s IRS targeted conservative “social welfare” nonprofits seeking tax-exempt status under section 501c4 of the Internal Revenue Code. Evidence establishes that hundreds of groups affiliated with the Tea Party movement were bullied and intimidated from engaging in constitutionally protected political activism. The IRS also subjected conservative groups seeking tax-exempt status to heightened scrutiny, harassment, and extended processing delays that may have hindered their activities during previous election cycles.</p>
<p>But now the Obama administration, which barely acknowledges the historic electoral whooping it received last month, has placed the 2,500 documents that are <a href="http://www.washingtonexaminer.com/feds-balk-at-releasing-docs-showing-irs-sharing-tax-returns-with-white-house/article/2556890"><span style="color: #0433ff;">apparently not related</span></a> to Lerner&#8217;s escapades in limbo as it hides behind privacy laws that are supposed to protect taxpayers, as opposed to corrupt government officials.</p>
<p>The inspector general&#8217;s office for the U.S. Department of the Treasury is making the novel claim that privacy laws prevent the promised document release from taking place.</p>
<p>“All of the 2,043 pages of documents we have determined to be responsive were collected by the Secretary of the Treasury with respect to the determination of possible liability under Title 26 of the United States Code. These pages consist of return information protected by 26 U.S.C. § 6103 and may not be disclosed absent an express statutory exception,” the office indicated in a Dec. 1 letter.</p>
<p>The Treasury Department, which oversees the IRS, apparently hasn&#8217;t yet decided what to do with another 466 documents.</p>
<p>Dan Epstein, executive director of Cause of Action, was highly skeptical. Treasury is  using “sophisticated” lawyering to worm out of producing the documents.</p>
<p>Treasury Secretary Jack Lew acknowledges he is examining “potential liability” that his underlings violated the law by providing taxpayer information to the White House. Treasury is either “stonewalling” Cause of Action, or Lew “is incompetent” for only now getting around to investigating possible lawbreaking on a two-year-old case.</p>
<p>Asked about the case Tuesday, White House Press Secretary Josh Earnest <a href="http://www.foxnews.com/politics/2014/12/03/watchdog-finds-thousands-docs-relating-to-improper-disclosure-taxpayer-data-to/"><span style="color: #0433ff;">claimed</span></a> he didn&#8217;t know about it. He said, apparently with a straight face, that the administration “very closely” follows rules shielding the IRS from political interference.</p>
<p>“I can tell you that, as a rule, that the Obama administration has been very rigorous in following all of the rules and regulations that govern proper communication between Treasury officials and White House officials and the Internal Revenue Service,” Earnest said.</p>
<p>Epstein says Earnest isn&#8217;t telling the truth. “We know for a fact that the IRS broke the law,” he said. “If there is any evidence that the White House requested (unauthorized taxpayer information), then people in the White House are going to be implicated,” he said.</p>
<p>The Treasury Department&#8217;s decision to stonewall just so happens to coincide with publication this week of a four-part series by the <a href="http://www.washingtonexaminer.com/feds-balk-at-releasing-docs-showing-irs-sharing-tax-returns-with-white-house/article/2556890"><span style="color: #0433ff;"><i>Washington Examiner</i></span></a> about the benefits and pitfalls of the federal inspectors-general system. The series details several occasions in which inspector generals &#8220;provided cover for agency managers seeking to avoid more rigorous evaluations.&#8221;</p>
<p>It goes without saying that Obama has been using the IRS improperly since he was sworn in as president. That&#8217;s the Chicago way.</p>
<p>Ask Catherine Engelbrecht, leader of the Houston-based good government group True the Vote. Since getting involved in the fight for ballot box integrity she has been <a href="http://www.frontpagemag.com/2014/matthew-vadum/the-mounting-proof-of-an-irs-cover-up/"><span style="color: #0433ff;">subjected</span></a> to a slew of audits, surprise inspections, and all manner of bureaucratic harassment. Ask supporters of the Manassas, Va.-based Patrick Henry Center for Individual Liberty, whose tax-exempt charitable status was yanked by the IRS because it disseminated criticism of Democrats Hillary Clinton and John Kerry a decade ago.</p>
<p>Ask officials of the National Organization for Marriage (NOM). Obama&#8217;s IRS has admitted it illegally provided the group&#8217;s confidential donor information to its left-wing arch-enemy, the Human Rights Campaign (HRC), which favors same-sex marriage. The IRS later agreed to settle a lawsuit by paying $50,000 in damages to NOM. The release of the tax filing, known as an IRS Form 990 was not the issue as such; in fact federal law requires 990s to be publicly disclosed.</p>
<p>But the IRS claimed one of its employees innocently neglected to redact the names and addresses of NOM’s donors before releasing the group&#8217;s amended 2008 Form 990 to an individual. The law requires groups like NOM to list top donors on Schedule B to the form. The information on Schedule B is supposed to be held in strictest confidence by the IRS. Unauthorized disclosure of confidential tax information is a felony that can lead to a five-year term of imprisonment, but Eric Holder’s Justice Department never got around to filing criminal charges in the case.</p>
<p>The egregious IRS leak allowed the HRC in February 2012 to post online NOM’s 2008 tax return and the names and contact information of NOM’s major donors, including Mitt Romney who became the Republican presidential nominee later that year. Making that normally confidential information public allowed progressive activists to harass and intimidate NOM’s donors, just as they had done in the wake of California’s Proposition 8 that affirmed traditional marriage in 2008. The most prominent victim of leftist venom was former Mozilla CEO Brendan Eich, who was forced out of his post because he dared to donate $1,000 to the “pro” traditional marriage side in the Prop 8 battle.</p>
<p>Left-wing activists call this kind of in-your-face harassment “accountability,” an Orwellian euphemism to be sure. Accountability actions focus on harassing and intimidating political enemies, disrupting their activities, and forcing them to waste resources dealing with activists’ provocations. It is a tactic of radical community organizers, open borders fanatics, and union goons. Taking a cue from Marxist theorist Herbert Marcuse, they want to shut down, humiliate, and silence those who fail to genuflect before their policy agenda.</p>
<p>Obama&#8217;s IRS is all about accountability, but not in the way that normal, patriotic Americans use the term.</p>

<p style="color: #232323;">Reverend Al Sharpton is a fixture for New Yorkers, and in the last few years, left-leaning cable news viewers have come to rely on his political and social commentary. Love him or hate him, he has been around forever and his brand has matured since the Tawana Brawley days.  Particularly in the current de Blasio administration, Sharpton has grown quite powerful; so powerful, that, as the New York Post says, he <a href="http://nypost.com/2014/08/02/cop-who-used-deadly-chokehold-should-be-charged-sharpton/">dictates policy to the police commissioner</a>. He is also very close with President Barack Obama, the United States Commander-in-chief.</p>
<p style="color: #232323;">Leaving aside Sharpton’s “colorful”<i> </i>history, how is it possible that powerful elected officials in this nation associate with and take advice from a national leader who does not pay his taxes?  Politicians avoid shady characters, and taxes are a matter of fact issue (which in fact pays the salaries of these folks.)</p>
<p style="color: #232323;">As the uber-liberal New York Times reported today, in records they reviewed it was apparent that Sharpton owes, “more than $4.5 million in current state and federal tax liens against him and his for-profit businesses.”  While Sharpton’s friends de Blasio and Obama have been in power, his tax bills have grown – and the organization which he runs, the National Action Network, has not paid federal payroll taxes.</p>
<p style="color: #232323;">Maybe the IRS has been too busy harassing the Tea Party to look at people on their own side of the political fence.</p>
<p style="color: #232323;">During the 2012 election cycle, <a href="http://www.frontpagemag.com/2012/ronn-torossian/sheldon-adelson-isn%E2%80%99t-to-blame-for-failing-leftist-newspapers/"><span style="color: #1255cc;">billionaire Sheldon Adelson</span></a>, an outspoken Republican donor, said a second Obama term would bring government “vilification of people that were against him [Obama].” In 2013 his words came true when the IRS admitted that conservative organizations were unfairly targeted and audited during the 2012 election.</p>
<p style="color: #232323;"><span style="color: #c0504c;"><a href="http://townhall.com/columnists/jaysekulow/">Jay Sekulow of the American Center for Law and Justice said the IRS&#8217;s activity was </a></span>“McCarthyism” – and, in fact, the Obama Administration targets and harasses conservatives while allowing Obama allies to openly cheat the system.  During the 2012 election billionaire Frank VanderSloot raised up to $5 million for Romney’s campaign.  He was labeled by Obama election propaganda as a “presidential enemy;” and soon after, this American businessman – who had never before had legal issues — was audited by the Labor Department and IRS.</p>
<p style="color: #232323;">In this tale of two cities – or of two countries, where some of us pay taxes, and some do not &#8212; right-wingers have been harassed unfairly by the IRS, while left-wingers who evade taxes are giving counsel and setting policy. Are these American tactics or is Obama learning from Putin?</p>
<p style="color: #232323;">Do Obama and de Blasio ask Sharpton about taxes when he whispers in their ears? Does anyone in their offices even care that he is in violation of American law?</p>

<p style="color: #000000;"><strong>In this weeks Firewall, meet Susan Ravel of the FEC and Lois Lerner of the IRS &#8212; two smiling tyrants weaponizing the government against conservatives and following direct orders from the very top of the Democratic leadership. <p style="color: #000000;">Hi everybody; I’m Bill Whittle and this is the Firewall.</p>
<p style="color: #000000;">Let’s say someone wanted to take away that uniquely American right — the one upon which all of this success and prosperity and happiness and freedom is based: Your First Amendment right to freedom of speech. What would that tyrant look like?</p>
<p style="color: #000000;">This, right? Someone like this. Or this. Or this. Nah. Not here. That’s not how tyranny looks in America:</p>
<p style="color: #000000;">((ANN RAVEL))</p>
<p style="color: #000000;">This smiling, normal-looking woman is Ann Ravel. She heads the FEC — the Federal Elections Commission.  She’s a Democrat in a Democratic administration pursuing the Democratic party’s goal of intimidating, jailing and otherwise harassing their political opponents, who are mean because they don’t like being told what to do, or to think — the way nice people do. So she has been ordered to weaponize the government against unregulated speech — we don’t call it “free speech” any more because that term is archaic and also probably racist.</p>
<p style="color: #000000;">It’s not like she doesn’t want to! As a typical progressive Democrat, Ann Ravel has two overriding psychological needs:</p>
<p style="color: #000000;">First, regulate everything. How on earth with people like Ann Ravel and, for that matter, the President of the United States, ever be able to feel secure when the American people are just running around starting businesses willy-nilly, or irresponsibly making internet videos that don’t conform to the Official Truth, or reading news stories — “news stories!” — on places like Fox or the Drudge Report.</p>
<p style="color: #000000;">No, the idea of something being unregulated — like, say, the internet — is anathema to these control freaks, so the chance to regulate something — anything — is good to go right out of the gate.</p>
<p style="color: #000000;">Even better:  Ann Ravel not only wants to regulate the internet, she wants to target those regulations against conservatives on the internet.</p>
<p style="color: #000000;">You see, apparently, a couple of ads were run, for free, on YouTube. Those ads said mean things against President Obama, and that’s wrong! So now, this smiling, ordinary-looking, soccer-mom-type fascist tyrant is threatening regulate content on Websites like the Drudge Report — weaponizing the government and using it’s coercive power to stifle criticisms of DEMOCRATS. Drudge, you may remember, cut his teeth by exposing the fact that Monica Lewinsky — unlike all of the other liars and bimbos before her — had actual, physical evidence of President Clinton’s philandering, predatory infidelities against unknown, powerless young women. But the Drudge Report said mean things against a Democratic President, and that’s wrong!</p>
<p style="color: #000000;">According to the lights of people like Ann Ravel, this what can happen without regulations and the threat of punishment, and sites like The Drudge Report have no First Amendment protections for a free press because saying mean things about Democratic Presidents is not news. It unregulated opinion. Saying mean things against Republican Presidents — THAT’S NEWS.</p>
<p style="color: #000000;">Ann Ravel says she will also be looking into videos like the one you are watching now, Thought Criminal. Needless to say, I had assumed my license to speak my mind was printed on a piece of parchment, sealed in nitrogen behind bulletproof glass in the National Archives, but that doesn’t cut much ice with fascists like Ann Ravel, or the people that give her her marching orders.</p>
<p style="color: #000000;">Now for those of you who say it cannot happen here, that this is all a tempest in a tea party, let me show you another face of fascist tyranny in America: Lois Lehrner, director of the Exempt Organizations Unit of the U.S. Internal Revenue Service. On May 23rd, 2013 she was placed on administrative leave following allegations that she had used the IRS — in other words, weaponized the government — to target Tea Party groups for genuinely excessive, illegal, immoral and utterly shameless scrutiny, which in one case I happen to have first hand knowledge of. She was cited for Contempt of Congress in 2014, because apparently, all of the email regarding these selective examinations and enforcements disappeared when her hard drive failed. And the legally required back ups failed. And something like one thousand other IRS computers hard drives also failed. Plus THEIR back-ups. Some emails, however, sent just before these unfortunate coincidences indicate her discussing these issues with the Department of Justice, which means it was directed by this guy, which means it was directed by this guy. This same guy, who when asked if there was any evidence of corruption in the IRS, replied “not a smidgeon.” Unregulated laughter is punishable by law, oh, and by the way: prepared to be audited.</p>
<p style="color: #000000;">((BILL OF RIGHTS))</p>
<p style="color: #000000;">None of this means anything to these people: First Amendment Right to free speech; Second Amendment right to self-defense, Fourth Amendment right to be secure in our Persons, Houses, Papers and Effects; the Tenth Amendment admonishment that those powers not specifically granted the Federal Government are reserved to the States, or to the People — it’s all just parchment for them — a bit of decoration, like Washington crossing the Delaware — suitable for framing in a museum that no one visits anymore.</p>
<p style="color: #000000;">It’s certainly not the law, because as we know, the law is what the Chicago political machine says it is.</p>
<p style="color: #000000;">Nice Bill of Rights you got there. Be a shame if something happened to it.</p>

				<content:encoded><![CDATA[<p style="color: #232323;"><a href="http://cdn.frontpagemag.com/wp-content/uploads/2014/09/Eric_Holder.jpg"><img class="alignleft  wp-image-240827" src="http://cdn.frontpagemag.com/wp-content/uploads/2014/09/Eric_Holder-450x330.jpg" alt="Eric_Holder" width="315" height="231" /></a>In a <a href="http://www.scribd.com/doc/239206082/Issa-Letter-to-Eric-Holder-About-Brian-Fallon"><span style="color: #1255cc;">letter</span></a> written to U.S. Attorney General Eric Holder by House Oversight Committee Chairman Darrell Issa (R-CA), Issa reveals there was an attempt to coordinate media spin regarding the IRS investigation between the DOJ and the staff of the Committee&#8217;s Ranking Democrat, Rep. Elijah Cummings (D-MD). How did Issa find out? A DOJ official in the Office of Public Affairs who thought he was calling Cummings’ office, mistakenly phoned Issa&#8217;s office instead.</p>
<p style="color: #232323;">“I write with serious concerns stemming from a telephone call my staff received late on Friday afternoon from the Justice Department’s Office of Public Affairs (OPA) about the Committee’s ongoing investigation into the Internal Revenue Service’s targeting of conservative tax-exempt applicants,” Issa states.</p>
<blockquote>
<p style="color: #232323;">A senior OPA official—under the apparent mistaken belief he had called the staff of Ranking Member Elijah E. Cummings—asked if the Committee would release Committee documents to the media so that the Department could publicly comment on the material. I am extremely troubled by this attempt to improperly coordinate the release of Committee documents with the Minority staff. This effort to preemptively release incomplete and selectively chosen information undermines the Department’s claims that it is responding in good faith.</p>
</blockquote>
<p style="color: #232323;">The senior OPA official to whom Issa refers is Brian Fallon, a former <a href="http://www.breitbart.com/Big-Government/2014/09/09/Letter-Holder-Aide-Accidentally-Calls-Issa-For-Help-Spinning-IRS-Scandal"><span style="color: #1255cc;">senior aide</span></a> to Sen. Chuck Schumer (D-NY). Although his name was not mentioned in the letter, he confirmed that he made the call, which took place last Friday at 5:01 p.m. EST. As Issa indicates, he believes Fallon thought he was talking to members of Rep. Elijah Cummings staff.</p>
<blockquote>
<p style="color: #232323;">(Fallon) then asked the Committee employee if the Committee would agree to release the material to selected reporters and thereby allow the Department an opportunity to publicly comment on it.</p>
</blockquote>
<p style="color: #232323;">The subject of the conversation was attorney Andrew Strelka, who is defending IRS commissioner John Koskinen in litigation initiated by the pro-Israel group Z Street. Prior to his job in the DOJ’s civil trial section, Strelka <a href="http://www.nationalreview.com/article/383336/defending-irs-eliana-johnson"><span style="color: #1255cc;">worked</span></a> for Lois Lerner in the IRS’s Tax Exempt Organizations Division—where Z Street’s alleged mistreatment occurred. Documents indicate Strelka was kept in the loop about the IRS’s targeting practices.</p>
<p style="color: #232323;">The Committee wants to talk to Strelka about this apparent conflict of interest, but the DOJ has refused the request, prompting a Sept. 3 <a href="http://jordan.house.gov/uploadedfiles/2014-09-03_jordan_to_holder-doj_-_andrew_strelka.pdf"><span style="color: #1255cc;">letter</span></a> to Holder from Rep. Jim Jordan (R-OH) accusing the DOJ of “conspiring with Mr. Strelka to prevent the American people from learning the truth.”</p>
<p style="color: #232323;">Issa spokesman Frederick Hill, who took Fallon&#8217;s call on a speaker phone in the presence of two other senior Committee employees, told him that Oversight Committee staffers would have to first examine the material—which is when Fallon apparently realized he was calling the office he was intending to undermine. After “abruptly” placing the call on hold for three minutes, an “audibly shaken” Fallon stated there would be a “change in plans,” with no effort to release the material early. Instead, the Department would “defer to the Chairman.”</p>
<p style="color: #232323;">Fallon then made an effort to cover his tracks, insisting that the reason for the call was to improve relations between the DOJ and Committee Republicans, who should “help one another.” When Fallon was subsequently asked if the material he had offered earlier would still be delivered Friday evening, he “attempted to walk back his earlier statement.”</p>
<p style="color: #232323;">Issa wasn’t buying any of it, noting that while communications are sometimes &#8220;erroneously shared,” he remains “disturbed to receive confirmation through this incident of apparently long-standing collaboration between the Obama Administration and Ranking Member Cummings’ staff to obfuscate and prejudice the Committee’s work through under-the-table communication.” Issa further insists that Fallon’s contention about improving relations with the Committee is “inconsistent” with the comments he made prior to putting the call on hold, and that it “strains credulity” to believe the DOJ would “seek to begin to improve relations via a telephone call between two individuals who had never spoken to each other before 5:01 p.m. on a Friday afternoon…”</p>
<p style="color: #232323;">In closing, Issa requested “a detailed explanation for each of the Department’s <i>ex parte</i> communications with the Minority Members or staff about Committee strategies for blocking and undermining oversight,” as well as &#8220;information about the number of times the Department has communicated with Minority staff to the exclusion of Majority staff.&#8221; Issa wants a DOJ response, “no later than Monday September 15, 2014.&#8221;</p>
<p style="color: #232323;">Those familiar with the stonewalling of the Holder-led DOJ know that such a request will likely be ignored. That reality was driven home once again on Tuesday when Inspector General (IG) Michael Horowitz <a href="http://www.justice.gov/oig/testimony/t140910.pdf"><span style="color: #1255cc;">testified</span></a> before the House Committee on the Judiciary. “The FBI and some other department components &#8230; have refused our requests for various types of documents. As a result, a number of our reviews have been significantly impeded,” he revealed.</p>
<p style="color: #232323;">And while Horowitz said he appreciated the efforts of Holder and Deputy Attorney General James Cole to intervene on behalf of the IG, such intervention is “inconsistent” with the “clear mandate” of the law and “compromises our independence.” Horowitz further noted that absent a resolution of the issue, “our struggles to access information relevant to our reviews in a timely manner continue to cause delays to our work and consume resources.&#8221;</p>
<p style="color: #232323;">That same day, Fallon dismissed Issa’s allegations in an <a href="http://thehill.com/policy/finance/217129-issa-accuses-doj-of-under-the-table-coordination-with-house-democrats"><span style="color: #1255cc;">interview</span></a> with The Hill, claiming there was “nothing out of the ordinary” about his conversation with GOP Oversight Committee members. “There is nothing inappropriate about department staff having conversations with both the majority and minority staff as it prepares responses to formal inquiries,” Fallon said. “That includes conversations between the spokespeople for the department and the committee.”</p>
<p style="color: #232323;">An Oversight Democratic staffer dodged a question about whether Cummings had ever had a conversation with the DOJ as described by Issa, insisting that the Representative and his staff  “make their own independent decisions about when to release information to the public and do not improperly coordinate with any executive branch agency.”</p>
<p style="color: #232323;">That last bit is, quite simply, a lie. Last April <a href="http://oversight.house.gov/wp-content/uploads/2014/04/FN-Combined.pdf"><span style="color: #1255cc;">emails</span></a> released by the Oversight Committee revealed that Cummings and his staff communicated with the &#8220;executive branch agency&#8221; known as the IRS multiple times in 2012 and 2013, with regard to the conservative group True the Vote. The Committee <a href="http://townhall.com/tipsheet/katiepavlich/2014/04/09/new-emaisl-show-lois-lerner-fed-information-about-true-the-vote-to-democrat-elijah-cummings-n182"><span style="color: #1255cc;">documented</span></a> communications between Cummings’ staffers and Lois Lerner—communications Cummings denied during a Subcommittee hearing the previous February. That would be the same Elijah Cummings who, despite being caught in a blatant lie, has labeled the ongoing investigation of the IRS as a “witch hunt,” and a waste of time and money.</p>
<p style="color: #232323;">On the same Friday Fallon made his call, the IRS <a href="http://blogs.wsj.com/washwire/2014/09/05/irs-says-emails-from-five-more-workers-have-been-lost/"><span style="color: #1255cc;">revealed</span></a> that emails from five other IRS workers involved in the investigation had also been lost. One of those workers was a senior aide to Lerner, and like the loss of her emails, the IRS blamed it on computer problems, further insisting there was no indication that any evidence had been deliberately destroyed. “To the contrary, the computer issues identified appear to be the same sorts of issues routinely experienced by employees within the IRS, in other government agencies and in the private sector,” the IRS said. “In addition, each of the five hard drive issues resulting in a probable loss of emails substantially predates the onset of the investigations in 2013.”</p>
<p style="color: #232323;">Thus the scandal with “not even a smidgeon of corruption” <a href="http://www.realclearpolitics.com/video/2014/02/02/obama_on_irs_scandal_not_even_a_smidgen_of_corruption.html"><span style="color: #1255cc;">according</span></a> to President Obama, takes another curious turn. Today the Democratically-controlled Senate is <a href="http://www.politico.com/story/2014/09/report-to-criticize-watchdog-irs-tea-party-probe-110619.html"><span style="color: #1255cc;">expected</span></a> to release a report authored by Sen. Carl Levin (D-MI), Chairman of the Permanent Subcommittee on Investigations. It will reportedly claim the 2013 report by J. Russell George, Treasury IG for Tax Administration concluding that conservative groups were targeted for additional scrutiny, is “unfair.” It will further allege the scandal amounts to nothing more than “mismanagement” by the IRS.</p>
<p style="color: #232323;">It’s going to be an uphill climb for Democrats. In a Fox <a href="http://www.foxnews.com/politics/2014/06/24/fox-news-poll-voters-think-irs-emails-were-deliberately-destroyed/"><span style="color: #1255cc;">poll</span></a> taken in June, a whopping 76 percent of Americans, including 90 percent of Republicans, 74 percent of independents and 63 percent of Democrats said they believed that Lois Lerner’s emails were &#8220;deliberately destroyed&#8221; by the IRS. The gaffe committed by Fallon would be amusing were it not for the reality that it is yet another indication of the endemic corruption that infests the Obama administration, their Democrat colleagues and a willfully somnambulant mainstream media. All of them seemingly prefer to run interference for one of the most powerful agencies in government, than allow the truth, no matter how inconvenient, to come out.</p>

<p>Isn&#8217;t it nice of our overlords to condescend to occasionally follow the laws that are only binding on us, not on them. Good to know that <a href="http://hotair.com/headlines/archives/2014/09/10/whenever-we-can-we-follow-the-law/">Obama&#8217;s IRS is opportunistically lawful.</a> </p>
<p>Just think about it. It could be entirely lawless. Just like their boss.</p>
<p>The IRS Commissioner has admitted that the IRS breaks the law when it wants to. A thorough discussion should follow on when the IRS does not follow the law.</p>
<blockquote><p>“Whenever we can, we follow the law,” IRS Commissioner John Koskinen told the House Ways and Means subcommittee on health on Wednesday.</p>
<p>Rep. Kevin Brady (R-Texas), who leads the subcommittee, immediately expressed his concern with the remarks.</p>
<p>“I encourage you to follow the law in all instances,” Brady said.</p>
<p>Koskinen, who was confirmed as head of IRS last December, has repeatedly faced lawmakers’ ire over the agency’s targeting of conservative groups.</p></blockquote>
<p>Now try telling the IRS that you follow the law whenever you can. This attitude is very revealing. The difference between a free country and a totalitarian state is the universal rule of law. In a tyranny, laws are binding on the subjects, not on the institutions of governments that subjugate them.</p>

<p>Judicial Watch&#8217;s<a href="http://www.judicialwatch.org/press-room/press-releases/judicial-watch-new-irs-documents-show-lerner-need-conservative-group-donor-lists-emails-mention-secret-research-project-top-irs-official/"> latest release of IRS discussions</a> gives us a peek into why so many IRS emails are disappearing.</p>
<blockquote><p>A subsequent IRS email thread on June 27, 2012, revealed that inappropriately obtained donor lists were being used for a “secret research project” and that a top official wanted then-Acting IRS Commissioner Steve Miller to decide how to handle the issue.  The email exchange, with the Subject line “donor names,” included the following:</p>
<p>June 27, 2012: 8:59 AM — David L. Fish, IRS acting director of Exempt Organizations Rulings and Agreements, to Holly Paz:</p>
<p>Joseph Urban [IRS Technical Advisor, Tax Exempt and Government Entities] had actually started a secret research project on whether we could, consistent with 6104, argue that [REDACTED] Joe was quite agitated yesterday when I told him what we were doing. (He was involved when the initial question was raised, but we didn’t continue reading him in). At one point he started saying that this was a decision for Steve Miller–I told him we were already doing it, and that I didn’t know whether Lois had already talked to Nikole [former IRS Chief of Staff to IRS Commissioner Steve Miller] about this. Would not be surprised if he already started working on Lois.</p></blockquote>
<p>So what was the secret project that disappeared into REDACTED?</p>
<p><a href="http://www.law.cornell.edu/uscode/text/26/6104">U.S. Code 6104  refers</a> to &#8220;Publicity of information required from certain exempt organizations and certain trusts&#8221;. That suggests that we&#8217;re on the right track. We don&#8217;t have any details on which section was being referred to but the IRS officials involved were clearly doing something dubious and trying to justify it by referencing a provision of the code involving information from tax exempt groups.</p>
<p>A later exchange suggests that Miller approved it.</p>
<p>There&#8217;s something very troubling when a bureaucracy with so much power over people launches secret research projects using non-profit donor lists.</p>

<blockquote><p>The IRS says it has lost emails from five more workers who are part of congressional investigations into the treatment of conservative groups that applied for tax exempt status.</p>
<p>The tax agency said in June that it could not locate an untold number of emails to and from Lois Lerner, who headed the IRS division that processes applications for tax-exempt status. The revelation set off a new round of investigations and congressional hearings.</p>
<p>On Friday, the IRS said it has also lost emails from five other employees related to the probe, including two agents who worked in a Cincinnati office processing applications for tax-exempt status.</p>
<p>The agency blamed computer crashes for the lost emails. In a statement, the IRS said it found no evidence that anyone deliberately destroyed evidence.</p></blockquote>
<p>It&#8217;s great that the IRS can investigate itself for its own scandal and declare itself innocent.</p>

<p>Let me begin by acknowledging that this inspirational title is lifted from a tweet by screen actor James Woods. And now I will explicate his tweet.</p>
<p>Every sentient human being whose brain isn’t stuffed with ideological fairy dust can see that Obama is behind every major scandal of his administration from Benghazi to the I.R.S. disgrace. How can one know this? Because the culprits haven’t been fired. Moreover, if they are serial liars like Susan Rice, they’ve actually been promoted to posts where their loyalty to the criminal-in-chief can do America and its citizens even more damage, if that is possible.</p>
<p>A president faced with a scandal created by underlings behind his back would be naturally furious at their misbehavior, and want heads to roll. This didn’t happen in any of these scandals because their point of origin was the White House itself. Promoting the culprits is a way of keeping them quiet.</p>
<p>And what exactly is the I.R.S. scandal about — to take just one case? It’s a plan unprecedented in modern American politics to push the political system towards a one-party state by using the taxing authority of the government to cripple and destroy the political opposition. The administration’s campaign to promote voter fraud by opposing measures to stop it (and defaming them as “racist” is guided by the same intentions and desire.</p>
<p>And why shouldn’t Obama want to destroy the two-party system since he is also in utter contempt of the Constitutional framework, making law illegally, and defying an impotent Congress to stop him? Of course every radical, like Obama, hates the Constitutional framework because, as Madison explained in Federalist #10, it is designed to thwart “the wicked projects” of the left to redistribute income and destroy the free market.</p>
<p>The same desire to overwhelm and permanently suppress the opposition drives the war that Obama and the Democrats have conducted against America’s borders and therefore American sovereignty. Their plan is too flood the country with illegals of whatever stripe who will be grateful enough for the favor to win them elections and create a permanent majority in their favor. The immediate result of these efforts is that we have no secure southern border, and therefore no border; and therefore we have effectively invited criminals and terrorists to come across and do Americans harm.</p>
<p>Which brings us to the deepest level of Obama’s hell, which is his anti-American foreign policy. When Obama was re-elected in 2012, the very first thought I had was this: A lot of people are going to be dead because of this election. How disastrously right I was. Since their assault on George Bush and their sabotage of the war in Iraq, Obama and the Democrats have forged a power vacuum in Europe and even more dramatically in the Middle East, which nasty characters have predictably entered with ominous implications for the future security of all Americans.</p>
<p>Take one aspect of this epic default: Obama’s lack of response to the slaughter of Christians in Palestine, Egypt and Iraq. Hundreds of thousands of Christians have been slaughtered and driven from their homes in Iraq – over half a million by some counts. This is the oldest Christian community in the world dating back to the time of Christ. What was Obama’s response to this atrocity until a group of Yazvidi along with the Christians were trapped on a mountain side, and politics dictated he had to make some gesture. His response was to do and say nothing. Silence. Even his statement announcing minimal action to save the Yazvidi and the Christians mentioned the Christians once in passing while devoting a paragraph to the obscure Yazvidi.</p>
<p>What this unfeeling and cold response to the slaughter of Christians tells us is that Obama is a pretend Christian just the way he is a pretend American. What he is instead is a world class liar. That is because his real agendas are anti-American, anti-Christian, and anti-Jewish, and obviously and consistently pro America’s third world adversaries to whom he is always apologizing and whom he is always appeasing. Obama lies about his intentions and policies because he couldn’t survive politically if he told the truth.</p>
<p>The socialist plot against individual freedom called Obamacare was sold as a charitable attempt to cover the uninsured (which it doesn’t), to lower health insurance costs (which it doesn’t) and to allow patients to keep their doctor and their plan (which it doesn’t). What it actually does is to take away a major piece of the freedom that Americans once enjoyed – the freedom to choose their plan and their doctor, and not to have the government control their health care or have easy access to all their financial information.</p>
<p>This devious, deceitful, power hungry administration is just as James Woods described it. But it is also a mounting danger for all Americans. Thanks to his global retreat, the terrorists Obama falsely claims are “on the run” are in fact gathering their strength and their weapons of mass destruction until a day will come when they will cross our porous borders and show us what thyears of perfidy not only by Obama but by the whole Democratic Party have wrought.</p>

<p style="color: #323333;">In February, <a href="http://www.frontpagemag.com/2014/ronn-torossian/john-kerrys-blackmail/"><span style="color: #0194d2;">John Kerry tried blackmailing</span></a> and bullying claiming, “[F]or Israel there is an increasing de-legitimization campaign that has been building up. People are very sensitive to it, there is talk of boycott and other kinds of things. Are we all going to be better with all of that?”  Kerry predicted a “high risk” of increased boycotts and a higher likelihood of international isolation for Israel if peace talks broke down.  Precisely what the Obama Administration prescribed for Israel with the travel ban <i>(and ongoing travel warnings) </i>– as the FAA still permits flights into Ukraine, <span style="color: #000000;">Afghanistan, Pakistan, and Yemen.</span></p>
<p style="color: #323333;">As Senator Ted Cruz stated, <span style="color: #000000;">“The facts suggest that President Obama has just used a federal regulatory agency to launch an economic boycott on Israel, in order to try to force our ally to comply with his foreign-policy demands.”  Fitting for his statements in </span>November 2013, when Kerry said that Israel’s “isolation” would be its own fault if a peace deal with the Palestinians falls through. Kerry further warned the Israelis that “the alternative to getting back to the talks is the potential of chaos.”  Now as Israel refuses to give in to a terrorist organization devoted to destroying the nation, we see the Obama Administration banning flights to Israel.  Chaos and isolation. Are Kerry and Obama rejoicing?  <i>Still have Israel’s back Mr. President?</i></p>
<p>Senator Ted Cruz wisely said,</p>
<blockquote><p>[S]ecurity concerns in Israel are hardly breaking news, and given the exceptional challenge Israel faces, Ben Gurion has rightly earned the reputation as one of the safest airports in the world due to the aggressive security measures implemented by the Israeli government. Given that some 2,000 rockets have been fired into Israel over the last six weeks, many of them at Tel Aviv, it seems curious to choose yesterday at noon to announce a flight ban, especially as the Obama Administration had to be aware of the punitive nature of this action.</p></blockquote>
<p>Cruz added,</p>
<blockquote><p>Today we have similar noxious efforts by the Boycott, Divest, Sanction or ‘BDS’ movement, which seeks to punish Israel for the fact that the militant terrorist elements embraced by the Palestinian Authority make any peace deal an intolerable security risk to Israel at this time. But the Obama Administration has refused to robustly denounce this effort to undermine our ally. Instead, Secretary of State John Kerry issued a veiled threat last February when he encouraged boycotts of Israel and said that absent serious Israeli concessions at the negotiating table, Israel’s economic prosperity was &#8220;not sustainable&#8221; and &#8220;illusory.&#8221;</p>
<p>Secretary Kerry unfortunately reprised this theme just this April, when he threatened that Israel risked becoming an &#8220;apartheid state&#8221; if Israel did not submit to his chosen solution to the Israel-Palestinian crisis.</p></blockquote>
<p style="color: #323333;">This Administration has overseen an IRS which unfairly targeted and audited conservative organizations during the 2012 election. <span style="color: #000000;">Billionaire conservative </span>Sheldon Adelson suggested before Obama was re-elected, a second Obama term would bring government “vilification of people that were against him.”  This PR agency owner says it sure seems like it.</p>
<p style="color: #323333;">Targeting Israel seems to be the same – an attack upon those who don’t go along with the Obama way of doing things.</p>
<p style="color: #323333;">Isolating Israel encourages and rewards terror – and harms America and Israel.</p>

<blockquote><p>IRS Deputy Associate Chief Counsel Thomas Kane said in transcribed congressional testimony that more IRS officials experienced computer crashes, bringing the total number of crash victims to “less than 20,” and also said that the agency does not know if the lost emails are still backed up somewhere.</p>
<p>The new round of computer crash victims includes David Fish, who routinely corresponded with Lois Lerner, as well as Lerner subordinate Andy Megosh, Lerner’s technical adviser Justin Lowe, and Cincinnati-based agent Kimberly Kitchens.</p></blockquote>
<p>The IT asset managers? They also crashed.</p>
<blockquote><p>Ordering the destruction of a hard drive and documenting that process would be handled by trained, certified IT asset managers, according to IAITAM. But the group’s records show that at least three IRS IT asset managers were shuffled out of their positions around the time of the May 2013 inspector general’s report that detailed the agency’s targeting practices.</p>
<p>IAITAM said investigators need to “determine if these in-house IT asset managers were removed from the picture as the IRS email investigation heated up.”</p></blockquote>
<p>But don&#8217;t worry, there&#8217;s no conspiracy here. Just routine computer error.</p>
<p>Hard drives crash all the time and statistics show that they are much more likely to crash in the vicinity of subpoenas due to a quantum entanglement between the subpoena, Obama, his subordinates and the molecules of the hard drive.</p>
<p>It&#8217;s just plain science.</p>

<p>Meet the Deep State. It&#8217;s <a href="http://dailycaller.com/2014/07/01/lois-lerner-targeted-chuck-grassley-after-he-blocked-obamas-doj-tax-nominee/?advD=1248,41002">embedded inside a massive remorseless bureaucracy</a> with no conscience or restraint.</p>
<blockquote><p>Ex-Internal Revenue Service official Lois Lerner tried to audit Republican Sen. Chuck Grassley after Grassley blocked President Obama’s nominee to head the Department of Justice (DOJ) tax division, an executive branch insider told The Daily Caller.</p>
<p>Grassley made it more difficult for the IRS and DOJ to work together to target conservative groups by blocking Obama’s political appointee Mary L. Smith from taking over the DOJ Tax Division, which prosecutes criminal cases for the IRS. Grassley held up the nomination in early 2010, just as Lerner and fellow IRS officials were mapping out their targeting strategy. The White House later withdrew Smith’s nomination.</p>
<p>The source confirmed to The Daily Caller that the White House and IRS officials “were very upset at Senator Grassley and Republicans for blocking a vote on Mary Smith’s nomination.”</p>
<p>The IRS relies on the DOJ Tax Division to prosecute both criminal and civil cases, and has entire legal teams devoted to making DOJ referrals. Placing a political appointee as assistant attorney general for the DOJ Tax Division was a top priority for the Obama White House.</p>
<p>Grassley made sure that no Obama political nominee got confirmed for the post, and kept in a “career,” or non-political, DOJ tax head for another two years.</p>
<p>&#8220;The Assistant Attorney General is not the kind of position that you probably would want someone learning on the job,” Grassley said at a Feb. 4, 2010 Senate Judiciary Committee hearing, pointing out Smith’s lack of tax experience.</p></blockquote>
<p>And to prove his point, Lois Lerner decided to go after him. Because the best response to anyone who stops the IRS from engaging in political targeting is&#8230; more political targeting.</p>

But America&#8217;s upcoming birthday on the Fourth of July is a time when the gift most needed is an urgent warning about the dangers of losing the things that have made this country America — and have long made &#8220;America&#8221; a ringing word of freedom, not only in this country but to people around the world.</p>
<p>All is not lost. But all could be lost — especially if too many of us take freedom for granted and focus our attention on other things, like electronic gadgets and the antics of celebrities, while ignoring such dangers as nuclear weapons in the hands of suicidal fanatics, with a track record of savagery, whom we are too squeamish to call anything stronger than &#8220;militants.&#8221;</p>
<p>Nor are all the dangers abroad. Within our own country there are all too many signs of people blithely ready to sacrifice the interests or freedom of Americans for the sake of symbolism or passing fashions.</p>
<p>When a former Speaker of the House of Representatives announces that she is going down to our border to greet and welcome masses of people crossing that border illegally, you know that something is fundamentally wrong.</p>
<p>No one knows, or apparently cares, what diseases these floods of illegals are bringing into the country, including diseases that have been largely stamped out in the United States, and which American doctors have seldom seen enough to know how to spot them or treat them.</p>
<p>No one knows, or apparently cares, how many of these &#8220;children&#8221; include teenage criminal gangs to whom murder is no big deal. Worst of all, no one knows, or apparently cares, that the elected representatives of the American people were cut out of the loop when it came to making these decisions.</p>
<p>All that matters to people like Nancy Pelosi is the symbolism of welcoming the oppressed, especially if they represent more votes for Democrats, who will shower the taxpayers&#8217; money on them.</p>
<p>As if to make clear the elite&#8217;s contempt for ordinary Americans&#8217; intelligence, President Obama tells us that the people crossing the border &#8220;love&#8221; America.</p>
<p>How could he possibly know that, any more than he could know how to &#8220;invest&#8221; the taxpayers&#8217; money in &#8220;the industries of the future,&#8221; which have in fact gone bankrupt?</p>
<p>What is involved are not just bad policy choices. What is involved are policies imposed unilaterally by the president, in defiance of Congress&#8217; authority to legislate and in contempt of the Constitution&#8217;s separation of powers — on which all our freedoms ultimately depend.</p>
<p>The people who wrote the Constitution of the United States understood what dangers there are to the freedom of the people — and that freedom can be quietly eroded by degrees, rather than taken all at once.</p>
<p>Too many people today seem oblivious to such dangers. So what if the government used the muscle of the Internal Revenue Service to keep groups opposed to the Obama administration tied up in red tape or litigation in an election year? Enough games like that can make our elections meaningless.</p>
<p>This arrogant abuse of power does not end with the federal government. In Massachusetts, teenager Justina Pelletier was taken from her parents&#8217; custody and held virtually incommunicado for over a year, because her parents preferred to continue to have her treated as the physicians at a medical facility associated with Tufts University had treated her, even though shrinks at Children&#8217;s Hospital in Boston said her problems were in her head, and took her off some of her medications.</p>
<p>This difference of opinion as to the best medical treatment for Justina Pelletier was enough to get a judge to side with headstrong bureaucrats and override her parents&#8217; rights. So a girl who was ice skating before ended up in a wheelchair under the &#8220;care&#8221; of shrinks.</p>
<p>Fortunately, enough media attention, especially by former governor Mike Huckabee on Fox News Channel, finally got this child freed. Perhaps we can hope that all is not lost — yet. But if this case is a symbol of Americans fighting back, it is also a symbol of why it is desperately important to fight back.</p>
<p>That spirit is the best birthday present for America.</p>

<p>Every time Congress issues a subpoena, <a href="http://www.foxnews.com/politics/2014/06/25/more-missing-emails-crashed-hard-drives-this-time-at-epa/">hard drives begin crashing in the bureaucratic </a>deep state of the liberal regulators.</p>
<blockquote><p>The Internal Revenue Service isn’t the only government agency dealing with missing emails or faulty hard drives.</p>
<p>Environmental Protection Agency administrator Gina McCarthy on Wednesday cited a similar cyber snafu during a House Oversight Committee hearing.</p>
<p>Lawmakers at the hearing wanted McCarthy to address lost emails from a hard-drive crash at the agency that wiped out some emails from former employee Philip North to his bosses at the EPA over the controversial Alaska mine project.</p>
<p>Complicating matters, North has gone off the proverbial grid, making it difficult for lawmakers to issue a subpoena for him to testify.</p>
<p>When he was still reachable, North was asked multiple times to come in and talk to lawmakers about the project. He offered up a list of complications that prevented him from meeting with the government, including a pre-planned, one-year boat ride around the world with his school-aged children.</p>
<p>Rep. Kerry Bentivolio, R-Mich., asked McCarthy if she knew where North was.</p>
<p>“No sir, I don’t know that,” she responded.</p>
<p>Bentivolio pressed McCarthy about claims North’s hard drive crashed, making some of his emails unavailable.</p>
<p>McCarthy said the EPA has submitted all the documents it has been able to find and will “continue the search.”</p></blockquote>
<p>Isn&#8217;t it funny how this happens. North just &#8220;vanishes&#8221; and his hard drive crashes. That means if Republicans subpoena enough of the Federal government, it will just vanish in a mass of hard drive crashes.</p>

				<content:encoded><![CDATA[<p><a href="http://cdn.frontpagemag.com/wp-content/uploads/2014/06/QANDA-master675.jpg"><img class="alignleft  wp-image-234887" src="http://cdn.frontpagemag.com/wp-content/uploads/2014/06/QANDA-master675-450x300.jpg" alt="QANDA-master675" width="264" height="176" /></a>More proof the Obama administration is covering up the political persecution it inflicted on its conservative political enemies through the Internal Revenue Service emerged yesterday as a federal official accused the White House of breaking the law by hiding emails.</p>
<p>Whenever the records, including emails, of federal agencies are destroyed &#8212; whether intentional or inadvertent &#8212; the law requires that the National Archives be notified. But that did not happen when the computer hard drives of a former IRS official and six of her IRS subordinates allegedly crashed in 2011, destroying records of emails now at the heart of a congressional corruption probe.</p>
<p>&#8220;They did not follow the law,&#8221; Archivist of the United States David Ferriero <a href="http://www.foxnews.com/politics/2014/06/24/house-panel-drags-white-house-attorney-to-testify-on-missing-irs-emails/">said</a> of the IRS during testimony before the House Oversight and Government Reform Committee.</p>
<p>It has also been <a href="http://news.investors.com/ibd-editorials/062314-705857-irs-cancelled-sonasoft-email-backup-contract.htm#ixzz35d1sLhS0">revealed</a> that the IRS suspiciously backed out of a circa 2005 contract with an email storage contractor named Sonasoft mere weeks after Lerner reported losing personal files and before other IRS officials allegedly experienced hard drive crashes as the Tea Party-targeting investigations got underway.</p>
<p>As <i>Investor&#8217;s Business Daily</i> explains,</p>
<blockquote><p>Timing is everything, the saying goes, and sometimes the timing of events is also very curious, as in the case of the lost emails of Lerner and at least six other officials at the very same time the IRS canceled its contract to back up and preserve those emails as required by federal law.</p>
<p>Lerner&#8217;s computer supposedly crashed in June 2011, an alleged event the IRS concealed from the American public and congressional investigators for two years.</p>
<p>This event, which cannot be verified because her hard drive has since been destroyed and recycled, occurred just 10 days after House Ways and Means Committee Chairman Rep. Dave Camp first wrote a letter asking if the IRS was engaging in targeting of nonprofit groups.</p></blockquote>
<p>Sonasoft runs ads stating the company provides &#8220;Email Archiving Done Right&#8221; and &#8220;Point-Click Recovery.&#8221; In a 2009 tweet it bragged: &#8220;The IRS uses Sonasoft to back up their servers, why wouldn&#8217;t you choose them to protect your servers?&#8221;</p>
<p>Why not &#8212; indeed.</p>
<p>Under hyper-partisan, left-wing Democrat Lois Lerner, the tax-exempt organizations branch <a href="http://www.breitbart.com/Big-Government/2014/02/06/True-the-Vote-Founder-on-IRS-I-Was-Targeted-Because-of-My-Political-Beliefs">singled out</a> for harassment the heroic Catherine Engelbrecht, leader of the Houston-based good government group True the Vote. Earlier this year the IRS <a href="http://www.frontpagemag.com/2014/matthew-vadum/hillary-the-left-wing-money-machine-and-a-new-irs-crackdown/">revoked</a> the charitable status of Manassas, Va.-based Patrick Henry Center for Individual Liberty, because it disseminated criticism of Democrats Hillary Clinton and John Kerry a decade ago. In recent years the federal agency also subjected conservative groups seeking tax-exempt status to heightened scrutiny, harassment, and extended processing delays that may have hindered their activities during the previous election cycle.</p>
<p>It is the latest outrage from the Obama administration which has been on a vindictive rampage in recent years, using the feared tax collection agency to vex and annoy its political enemies, especially those associated with the Tea Party movement.</p>
<p>Republicans say the White House has been less than helpful in efforts to investigate the IRS scandal. &#8220;They haven&#8217;t done a damn thing to get to the truth of what happened,&#8221; House Speaker John Boehner (R-Ohio) said yesterday.</p>
<p>The hearing yesterday followed a previous hearing the night before at which lawmakers unloaded on the increasingly arrogant IRS Commissioner John Koskinen, questioning him aggressively. The normally mild-mannered Rep. Paul Ryan (R-Wisc.) excoriated Koskinen for his bad attitude in testifying before the congressional panel. On Friday Koskinen set the stage for conflict. He angered lawmakers when he told them at that hearing that the IRS had nothing to apologize for in the missing Lerner emails scandal.</p>
<p>Oversight Committee Chairman Darrell Issa (R-Calif.) told Koskinen a Monday hearing: &#8220;We have a problem with you and you have a problem with credibility.&#8221;</p>
<p>At a hearing yesterday, Koskinen told Issa that he had honored his vow to the panel to give it all of Lerner&#8217;s emails, adding it is impossible to recover the emails lost in 2011.</p>
<p>&#8220;If you have a magical way for me to do that, I&#8217;d be happy to hear about it,&#8221; a sarcastic Koskinen told Issa.</p>
<p>&#8220;I&#8217;ve lost my patience with you,&#8221; Issa shot back.</p>
<p>Yesterday&#8217;s hearing came as the IRS <a href="http://dailysignal.com/2014/06/24/irs-admits-wrongdoing-pay-50000-leaking-marriage-groups-tax-return/">admitted</a> it illegally provided the confidential tax return of the National Organization for Marriage to that group&#8217;s left-wing arch-enemy, the Human Rights Campaign, which favors same-sex marriage. The IRS has agreed to pay $50,000 in damages to NOM. Unauthorized disclosure of confidential tax information is a felony that can lead to a five-year term of imprisonment, but Eric Holder&#8217;s Justice Department never got around to filing criminal charges in the case.</p>
<p>“We’re delighted that the IRS has now been held accountable for the illegal disclosure of our list of major donors from our tax return,&#8221; said NOM Chairman John D. Eastman. “We urge other groups that have suffered similar problems with the IRS to keep pressing until they, too, are fully vindicated.&#8221;</p>
<p>The egregious IRS leak allowed the HRC in February 2012 to post online NOM’s 2008 tax return and the names and contact information of NOM&#8217;s major donors, including Mitt Romney who became the Republican presidential nominee later that year. Making that normally confidential information public allowed progressive activists to harass and intimidate NOM&#8217;s donors, just as they had done in the wake of California&#8217;s Proposition 8 that affirmed traditional marriage in 2008. The most prominent victim of leftist venom was former Mozilla CEO <a href="http://www.frontpagemag.com/2014/ben-shapiro/the-rise-of-american-totalitarianism/">Brendan Eich</a>, who was forced out of his post because he dared to donate $1,000 to the &#8220;pro&#8221; traditional marriage side in the Prop 8 battle.</p>
<p>Left-wing activists call this kind of in-your-face harassment “accountability,” an Orwellian euphemism to be sure. Accountability actions focus on harassing and intimidating political enemies, disrupting their activities, and forcing them to waste resources dealing with activists’ provocations. It is a tactic of radical community organizers, open borders fanatics, and union goons. Taking a cue from <a href="http://www.discoverthenetworks.org/individualProfile.asp?indid=1608">Herbert Marcuse</a>, they want to shut down, humiliate, and silence those who fail to genuflect before their policy agenda.</p>
<p>Even worse, it is fair to say that under President Obama, the IRS has become a <i>de facto</i> branch of the Democratic National Committee, launching partisan attacks on those who stand in the way of the Left&#8217;s agenda.</p>

<p>Then a giant dog stuck its head through the window and ate all the servers.</p>
<p>You expect this kind of thing from Enron. You don&#8217;t expect it from the IRS. But <a href="http://dailycaller.com/2014/06/22/irs-cancelled-contract-with-email-storage-firm-weeks-after-lerners-computer-crash/#ixzz35O1z1FFw">as it turns out, there isn&#8217;t much difference</a>.</p>
<blockquote><p>The Internal Revenue Service (IRS) cancelled its longtime relationship with an email-storage contractor just weeks after ex-IRS official Lois Lerner’s computer crashed and shortly before other IRS officials’ computers allegedly crashed.</p>
<p>Lois Lerner’s computer allegedly crashed in June 2011, just ten days after House Ways and Means Committee chairman Rep. Dave Camp first wrote a letter asking if the IRS was engaging in targeting of nonprofit groups. Two months later, Sonasoft’s contract ended and the IRS gave its email-archiving contractor the boot.</p>
<p>IRS official and frequent White House visitor Nikole Flax allegedly suffered her own computer crash in December 2011, three months after the IRS ended its relationship with Sonasoft.</p>
<p>Sonasoft was providing “automatic data processing” services for the IRS throughout the January 2009 to April 2011 period in which Lerner sent her missing emails.</p>
<p>But Sonasoft’s six-year business relationship with the IRS came to an abrupt end at the close of fiscal year 2011, as congressional investigators began looking into the IRS conservative targeting scandal and IRS employees’ computers started crashing left and right.</p></blockquote>
<p>There should have been hard copies of the emails, <a href="http://dailycaller.com/2014/06/17/irs-was-required-by-law-to-print-out-lois-lerners-emails/">but then the paper crashed</a>.</p>
<blockquote><p>The Internal Revenue Service is required by federal law to keep records of all agency emails and to print out hard copies of the emails to make sure they get saved in the event of a computer glitch.</p>
<p>The IRS’s own definition of the Federal Records Act makes clear that emails must be saved and documented, according to an instructional page for employees on the IRS website.</p></blockquote>
<p>That&#8217;s where the giant dog came in. At least the IRS has learned how to thoroughly destroy records. Finally one arm of the government can do something right. Unfortunately it&#8217;s the wrong thing.</p>

<p>It is the latest outrage from the Obama administration which has been on a vindictive rampage in recent years, using the feared tax collection agency to vex and persecute its political enemies, especially those associated with the Tea Party movement.</p>
<p>Under hyper-partisan, left-wing Democrat Lois Lerner, the tax-exempt organizations branch <a href="http://www.breitbart.com/Big-Government/2014/02/06/True-the-Vote-Founder-on-IRS-I-Was-Targeted-Because-of-My-Political-Beliefs">singled out</a> for harassment the heroic Catherine Engelbrecht, leader of the Houston-based good government group True the Vote. Earlier this year the IRS <a href="http://www.frontpagemag.com/2014/matthew-vadum/hillary-the-left-wing-money-machine-and-a-new-irs-crackdown/">revoked</a> the charitable status of Manassas, Va.-based Patrick Henry Center for Individual Liberty, a conservative nonprofit group, because it disseminated old statements critical of Democrats Hillary Clinton and John Kerry a decade ago.</p>
<p>Although President Obama claimed earlier this year that there has not been even &#8220;a smidgen of corruption&#8221; at the IRS under his watch, it is clear that &#8220;the dog ate my homework,&#8221; is becoming the excuse of choice for his lawless administration.</p>
<p>But in March the House Oversight and Government Reform Committee <a href="http://www.frontpagemag.com/2014/matthew-vadum/lois-lerners-lies-and-cover-up-revealed/">published</a> an in-depth report detailing IRS targeting of right-of-center 501c4 nonprofit advocacy groups during the 2010 and 2012 election cycles. (The full report is available in PDF form at <a href="http://oversight.house.gov/wp-content/uploads/2014/03/Lerner-Report1.pdf">the committee&#8217;s website</a>.) Congressional investigators determined that Lerner orchestrated an unprecedented crackdown on Tea Party and conservative groups and then attempted to scapegoat those nonprofits, blaming them for the harsh treatment they received at her instigation.</p>
<p>As political pressure builds on Capitol Hill, it can finally be revealed that a mysterious, politically progressive electromagnetic pulse may have hit the hard drives of Lerner and six of her IRS underlings. Obama officials now claim the emails of all seven government employees to outside organizations and agencies including the White House have been consigned to oblivion.</p>
<p>As a result of this devastating &#8220;attack&#8221; the IRS is suddenly claiming it no longer possesses tens of thousands of emails from Lerner and her subordinates, a year after congressional investigators demanded the likely incriminating electronic communications. For the first time IRS officials say that Lerner&#8217;s computer &#8220;crashed&#8221; in 2011 at the same time the tax-collection Leviathan was devising rules calculated to hurt nonprofit groups with words such as &#8220;Tea Party&#8221; or &#8220;Patriots&#8221; in their names.</p>
<p>The IRS, as Carl M. Cannon <a href="http://www.realclearpolitics.com/articles/2014/06/19/the_lois_lerner_emails_nothing_digital_ever_dies.html#ixzz3591eQiux">writes</a> at RealClearPolitics,</p>
<blockquote><p>also lacked a centralized archive, it says now, and employed an archaic practice of re-using the tapes backing up its system every six months &#8212; thereby erasing the material already there. Who knew the IRS was so frugal? In a similar vein, IRS employees had absurdly low limits for how many emails they could store. And the agency apparently allowed IRS employees to decide for themselves which emails constituted an official record, which they are required by law to retain.</p></blockquote>
<p>It beggars belief that so many emails could vanish into the ether, somehow evading the multiple-redundant backups and system safeguards that are supposed to be in place.</p>
<p>“The Obama administration’s claim that the IRS has ‘lost’ two years of Lois Lerner’s emails is implausible to anyone who understands how email systems work,” according to John Hinderaker, a Claremont Institute fellow. “The Obama administration is lying, and lying in a remarkably transparent way.”</p>
<p>“Nothing digital ever dies,” so the emails must still exist somewhere in cyberspace, Cannon opines. They must be retained on offsite email servers, in files kept by other IRS officials, and in the email accounts and servers of recipients employed by other organizations or agencies.</p>
<p>&#8220;This is almost certainly true if they were sent to White House officials,&#8221; he writes. &#8220;It should be true, anyway: the President[ial] Records Act requires their preservation.&#8221;</p>
<p>Meanwhile, as the chattering classes argue over whether the disappearance of so many IRS emails is even technologically possible or about who should go to prison, the fact remains that President Obama is ultimately responsible for the politically motivated assault on conservative nonprofits, whether he knew of the IRS misdeeds or not.</p>
<p>Democrats correctly view Tea Party groups, that is, right-wing populist groups, as an existential threat to the Left. These nonprofits tend to be Republican-leaning organizations and they have been successful so far in derailing, or at least slowing, parts of President Obama’s ongoing transmogrification of America.</p>
<p>Democrats don’t want any conservative nonprofits to enjoy tax-exempt status. Such nonprofits are all working against the Left, standing in the way and preventing America from becoming a leftist utopia. Using the IRS to hurt right-of-center groups is fair game, according to left-wingers.</p>
<p>The media is onboard with Democrats. The evening newscasts of the big three broadcasts last night all <a href="http://www.mrc.org/biasalerts/lois-lerners-hard-drive-destroyed-big-three-evening-newscasts-ignore">deemed</a> the seven-way IRS computer crash unworthy of coverage &#8220;even as they had time for Harrison Ford&#8217;s broken leg (NBC), a new technology for police car chases (ABC), and comedian Tracy Morgan&#8217;s car accident (CBS).&#8221;</p>
<p>Just another day in Obama&#8217;s America.</p>

<blockquote><p>Congressional investigators say the Internal Revenue Service has lost more emails connected to the tea party investigation.</p>
<p>The IRS said last Friday it had lost an untold number of emails when Lois Lerner&#8217;s computer crashed in 2011. Lerner used to head the division that handles applications for tax-exempt status.</p>
<p>On Tuesday, two key lawmakers said the IRS has also lost emails from additional officials whose computers crashed.</p>
<p>House Ways &amp; Means Committee Chairman Dave Camp (R-Mich.) said one of those employees is Nikole Flax, who was chief of staff to then-Deputy IRS Commissioner Steve Miller. Miller was fired from the IRS after the targeting scandal broke, and Republicans have been seeking Flax’s emails as a way to uncover more evidence about the scandal.</p>
<p>Camp and Rep. Charles Boustany (R-La.), who chairs the oversight subcommittee, said the lost emails now make it appear that the IRS was lying when it said it would work with Republicans to find pertinent information about the targeting scandal.</p>
<p>“It looks like the American people were lied to and the IRS tried to cover-up the fact it conveniently lost key documents in this investigation,” they said. “The White House promised full cooperation, the Commissioner promised full access to Lois Lerner emails and now the Agency claims it cannot produce those materials and they’ve known for months they couldn’t do this.”</p>
<p>The two Republicans said Flax appeared to be a “frequent visitor” to the White House, which raises other questions.</p></blockquote>
<p>Just wait till the crashes spread to Obama and Hillary.</p>

<p>Perry Mason? Columbo? Sherlock Holmes? Can <a href="http://www.washingtontimes.com/news/2014/jun/13/irs-says-it-lost-key-lerner-emails/">anyone unravel the mystery of what happened to these</a> emails.</p>
<blockquote><p>Ms. Lerner ran the division that gave unwarranted scrutiny into tea party groups’ applications for tax-exempt status. The House has since voted to hold her in contempt of Congress for refusing to testify under oath.</p>
<p>The IRS has told Congress that it has lost some of former employee Lois G. Lerner’s emails, including some covering communications with Democrats in Congress and with other parts of the government, the House’s top tax-law writer said Friday.</p>
<p>The agency blamed a computer crash for the mishap.</p></blockquote>
<p>Too bad Nixon didn&#8217;t record on a computer. He could have blamed a CP/M crash for it.</p>
<blockquote><p>Rep. Dave Camp, chairman of the Ways and Means Committee, said he was stunned that it took more than a year into the investigation for the IRS to inform Congress that it didn’t have those emails.</p></blockquote>
<p>I&#8217;m stunned that it took the IRS a year to find and delete the emails and then come up with that excuse. It needs better cover up and tech experts.</p>
<p>Any teenager could have deleted the emails and come up with that excuse in an hour.</p>
<blockquote><p>“The fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to congressional inquiries,” Mr. Camp said. “There needs to be an immediate investigation and forensic audit by Department of Justice as well as the Inspector General.”</p></blockquote>
<p>I&#8217;m sure Holder will get right on that. After he investigates Fast and Furious and Benghazi. Or maybe he&#8217;ll just deliver another speech complaining about racism and demanding tranny bathrooms.</p>
<p>My money is on the tranny bathrooms.</p>
<blockquote><p>In emails that were turned over to Congress, Ms. Lerner describes some of the files lost in the 2011 hard drive crash as “irreplaceable.”</p></blockquote>
<p>I certainly hope not. A good look at those servers and hard drives might show that they are entirely replaceable.</p>
<blockquote><p>Mr. Camp said the emails lost were “critical years” from the beginning of the targeting of conservative groups.</p></blockquote>
<p>Wasn&#8217;t that convenient of the computer? It must have been a liberal PC.</p>
<blockquote><p>According to the agency, employees such as Ms. Lerner have some of their “active” emails stored on the IRS centralized network. The rest they can save in their email archive on their hard drive, but those are lost if the hard drive crashes.</p></blockquote>
<p>Or if someone takes a magnet to them, then set the drive on fire, pours vinegar on it and dumps it for trash pickup<a href="http://dailycaller.com/2014/04/14/lois-lerner-sits-in-her-lavish-house-on-2-4-million-property-as-she-awaits-possible-contempt-charge/"> outside their $2.4 million government mansion</a> in Bethesda.</p>
