		<title>Top Obama Lawyer Brings Anti-Israel Bias to High Court</title>

		<description><![CDATA[Israeli sovereignty over Jerusalem is like Russia's control of Crimea? ]]></description>
				<content:encoded><![CDATA[<p><a href="http://cdn.frontpagemag.com/wp-content/uploads/2014/11/zivotofsky_wide-b042c275eff15a2ea95aaee3c6be1b4f4ae3ae51.jpg"><img class="alignleft  wp-image-244732" src="http://cdn.frontpagemag.com/wp-content/uploads/2014/11/zivotofsky_wide-b042c275eff15a2ea95aaee3c6be1b4f4ae3ae51-440x350.jpg" alt="zivotofsky" width="342" height="272" /></a>The Obama administration’s anti-Israel bias was on full display at the Supreme Court earlier this week. Its chief lawyer, Solicitor General Donald Verrilli, offered an incredibly insulting analogy while arguing a case involving whether a U.S. citizen born in Jerusalem has the right to require, upon request, that the State Department identify “Israel” as the place of birth on his or her passport. In defending the administration’s position that it has the inherent discretion to deny any such request if it believes that granting the request would undermine the president’s foreign policy objectives, Verrilli raised the bogeyman comparison to “issuing passports to people born in the Crimea tomorrow that identified Russia as the country of birth.” Verrilli said that to do so “would contradict the foreign policy position in a way that could be quite deleterious,” leaving the distinct impression that Israel’s relationship to Jerusalem should be analyzed the same way for the purposes of this case.</p>
<p>The case stemmed from an attempt by the parents of a boy born in Jerusalem, who is a U.S. citizen because both of his parents are U.S. citizens, to file an application for a consular report of birth abroad and a United States passport for their son, Menachem Binyamin, listing his place of birth as “Israel.” The parents were exercising a statutory right explicitly granted by Congress in the Foreign Relations Authorization Act, which still remains in effect and requires the State Department to record a Jerusalem-born U.S. citizen’s place of birth as “Israel” if requested to do so by the citizen or his or her legal guardian.</p>
<p>The State Department denied the parents’ request, despite the fact that their son was born in “West&#8221; Jerusalem, which even the Palestinian negotiators are not currently claiming belongs to them. The Palestinians insist that only “East” Jerusalem must become the capital of an independent Palestinian state, but the State Department’s rejection of the passport request thrusts the status of <i>all</i> parts of Jerusalem into the conflict, including the undisputed portion.</p>
<p>Verrilli argued to the Supreme Court that requiring the State Department to identify in a passport, an official government-issued document, Israel as the birthplace of a U.S. citizen, known by the government to have been born in Jerusalem, would impermissibly “interject an issue of recognition policy into the content of passports.” He added that “Congress cannot compel the Executive to issue diplomatic communications that contradict the official position of the United States on a matter of recognition,” in summing up the administration’s position. He also expressed concern about the impact that such implied recognition of Israel’s claims would have on the Palestinians, whom, he noted, declared, “Jerusalem the capital of the Palestinian state.”</p>
<p>Verrilli characterized the Obama administration’s role as “an honest broker who could stand apart from this conflict and help bring it to resolution.” He said that adhering to the Foreign Relations Authorization Act’s passport requirement would undermine this role and “the credibility of the President on this fundamental question of where the United States stands on the status of Jerusalem until the parties work it out.”</p>
<p>In other words, the Obama administration has come before the Supreme Court with self-righteous proclamations about the need to preserve the president’s credibility and even-handedness in his conduct of diplomacy on the Jerusalem issue in order to justify its utter disregard of a law on the books concerning the issuance of passports. True to form, the Obama administration is asserting unbridled executive power. Claiming that Congress cannot interfere with the president’s conduct of foreign diplomacy, the State Department decided to disregard an explicit provision in a congressional statute, which requires the State Department to record a Jerusalem-born U.S. citizen’s place of birth as “Israel” if requested to do so by the citizen or his or her legal guardian. The Foreign Relations Authorization Act’s Jerusalem provision granted no discretion to the executive branch in this regard.  The Act says: “For … a United States citizen born in the city of Jerusalem, the Secretary shall, upon the request of the citizen or the citizen’s legal guardian, record the place of birth as Israel.”</p>
<p>“Shall,” not “may,” is the operative word. Such legal technicalities do not faze the Obama administration, however. Its Solicitor General told the Supreme Court Justices that they “ought to defer to the Executive Branch&#8217;s judgment that the place of birth listing can have significant diplomatic consequences.” Justice Stephen Breyer agreed with this position because, as Justice Breyer so humbly put it, “I&#8217;m a judge. I&#8217;m not a foreign affairs expert.”</p>
<p>Justice Sotomayor, acting as if she were counsel for the Palestinians rather than a Supreme Court Justice, remarked that requiring the State Department to honor a Jerusalem-born U.S. citizen’s request to record his or her place of birth as “Israel” on an official government document would be tantamount to “asking the government to lie.” She reached that bizarre conclusion on the premise that the U.S. government would be identifying Jerusalem with Israel, contrary to the government’s official recognition policy.</p>
<p>The more conservative-leaning Justices expressed some skepticism regarding the argument that issuing the passport as requested would interfere with the president’s diplomatic powers to decide whether or not to recognize the sovereign claims of Israel to Jerusalem. Justice Scalia acknowledged that there could be a constitutional issue if the president’s recognition powers were being directly challenged by legislation, but he questioned whether that was the case here.</p>
<p>Justice Alito said that while he understood “the position of the United States that Israel does not exercise full sovereignty over Jerusalem,” he suspected there were certain attributes of sovereignty exercised by Israel such as Israel’s issuance of birth certificates for births within Jerusalem or Israel’s prosecution of crimes committed within Jerusalem which “the United States recognizes that Israel is lawfully exercising.”</p>
<p>Justice Kennedy proposed an idea he thought might alleviate the State Department’s concerns. He suggested that the State Department could simply include a statement with the passports it issues for Jewish American citizens born in Jerusalem that “This passport does not indicate that the government of the United States and the Secretary of State recognize that Israel has sovereign jurisdiction.”</p>
<p>Justices Kagan and Ginsburg expressed concern about the ramifications of appearing to take sides in the dispute between the Palestinians and Israel over Jerusalem’s status.</p>
<p>“I mean, history suggests that everything is a big deal with respect to the status of Jerusalem,” Justice Kagan said, pointing to the recent spate of violence in Jerusalem to support her point. “And right now Jerusalem is a tinderbox,” she added, “because of issues about the status of and access to a particularly holy site there. And so sort of everything matters, doesn&#8217;t it?”</p>
<p>With all due respect to Justice Kagan’s concerns about not setting off a “tinderbox,” what should matter is not to give the Palestinians a veto power over the implementation of a clear congressional statutory directive because of worries about a violent Palestinian reaction.</p>
<p>Justice Ginsburg questioned the fairness of the statute. “What about Palestinians who were born in Jerusalem and want to have Palestine as their place of birth?” she asked. “American born Palestinians cannot do that. And that suggests that Congress had a view, and the view was that Jerusalem was properly part of Israel.”</p>
<p>Horror of horrors that Congress should dare tilt in the direction of the one true democracy in the Middle East that has traditionally been our closest ally in the region!</p>
<p>In any case, President Obama has tipped the scale in precisely the opposite direction. Solicitor General Verrilli’s argument that the president’s ability to serve as an “honest broker” will be at risk if the Court rules against the State Department’s denial of the passport request rings hollow. Obama forfeited that role when he effectively endorsed the division of Jerusalem, based on Obama’s call for Israel to withdraw essentially to the pre-June 1967 lines as the basis for Palestinian-Israeli final status negotiations on the border between the two states. Obama’s map-drawing would mean that so-called “East” Jerusalem would become a part of a new Palestine state, codifying an artificial division that would reinstate the conditions prevailing during Jordan’s illegal occupation of the eastern portion of Jerusalem, including the Old City, between 1948 and 1967.</p>
<p>Prior to the Jordanians’ illegal occupation, Jerusalem was an undivided city. Historically, Jews have been living in Jerusalem continuously for more than three millennia. Jerusalem has never been the capital of any sovereign nation except of the Jewish people.</p>
<p>In more recent times, Jews have constituted the largest single group of inhabitants in Jerusalem since at least the mid-1800s. During the Jordanians’ illegal occupation between 1948 and 1967 of the eastern section, including the Old City, which Jordan annexed and ruled from its capital, Amman, Jewish homes and sacred places were destroyed or defaced. Jews were barred from worshipping at their holiest sites. The Palestinians today want to replicate this division and impose an ethnic and religious cleansing of any Jewish residents.</p>
<p>“In a final resolution, we would not see the presence of a single Israeli — civilian or soldier — on our lands,” Palestinian Authority President Abbas said last year.</p>
<p>When the Obama administration condemns Israel for planning to expand housing for Israeli Jews living in over-crowded Jewish neighborhoods within the portion of Jerusalem that Jordan had illegally occupied until Israel reunified the city, it is not neutral or acting as an “honest broker.” It is embracing the Palestinians’ bogus claims derived from Jordan’s illegal occupation.</p>
<p>Earlier this week, Abbas sent a letter to the family of the Palestinian jihadist killed by Israeli soldiers after he had seriously wounded Rabbi Glick, an American citizen, who was peacefully seeking more access for Jews to pray on the Temple Mount. Abbas called the would-be assassin “a martyr defending the rights of our people and the holy places.&#8221;</p>
<p>The Temple Mount is holy to Jews, as well as to Muslims. It includes but is not limited to the al-Aqsa Mosque. But Muslims, whom have been abusing the administrative responsibilities Israel granted to them in connection with the site,  insist on barring Jews from worshipping anywhere on the Temple Mount site. Defending “the holy places” means, according to Abbas, enforcing such discriminatory exclusion of Jews, whom he previously referred to as “cattle,” by &#8220;all means&#8221; necessary.</p>
<p>Palestinian violence has followed in the wake of Abbas’s incendiary rhetoric. But the Obama administration continues to side with the Palestinian position. When asked to comment last week on Glick’s shooting by a Palestinian jihadist, State Department Spokesperson Jen Psaki deplored the shooting but quickly pivoted to expressing the Obama Administration’s “support” for “the long-standing practices regarding non-Muslim visitors to the site, to Haram al-Sharif / Temple Mount.” Just by referring to the Temple Mount first by its Arabic name – even before its English designation &#8211; and omitting any reference to its Hebrew name Har haBáyit (or Har haMoria), the State Department spokesperson displayed the Obama administration’s pro-Palestinian bias.</p>
<p>In what should have been a prosaic explanation to the Supreme Court of the Obama administration’s position on the relevant law, its Solicitor General exposed the true animus that the Obama administration has towards the Jewish state of Israel. Solicitor General Verrilli’s reference to Russia and Crimea in an oral argument dealing with the issuance of a passport listing Israel as the place of birth for an American citizen born in Jerusalem was a contemptible distraction intended to place Israel in an unfavorable light in front of the highest court of the land.</p>
<p>It is always difficult to ascertain which way the Supreme Court will rule in a controversial case from the comments made by the various Justices during oral argument. However, what could emerge is a narrowly written majority opinion that sidesteps the constitutional question of separation of powers. The State Department can honor the Jerusalem-born American citizen’s request in accordance with the statute, based simply on the uncontested fact that it was Israel which issued the official birth certificate in the first place upon which the issuers of the passport relied for information. As Justice Kennedy, often a swing vote on the Court, suggested, the administrative action of issuing the passport with such birth information can be accompanied by a clear disclaimer statement that issuing the passport in no way is meant to express the U.S. government’s diplomatic recognition of Israel’s sovereign claims to Jerusalem.</p>
<p>Whatever the outcome, Solicitor General Verrilli’s slanderous Russia-Crimea analogy will remain a shameful episode in the annals of Supreme Court oral arguments.</p>

		<title>The Swastika Passport</title>

				<content:encoded><![CDATA[<p><a href="http://cdn.frontpagemag.com/wp-content/uploads/2014/04/Ruth_Tirbauer_1938-12-Klein-r100.jpg"><img class="alignleft  wp-image-224248" alt="Ruth_Tirbauer_1938-12-Klein-r100" src="http://cdn.frontpagemag.com/wp-content/uploads/2014/04/Ruth_Tirbauer_1938-12-Klein-r100.jpg" width="285" height="218" /></a>The story of Yaakov Frommer, his Swastika Passport, and the personal intervention by Winston Churchill is told in the weekly magazine &#8220;<i>Matzav Ruach</i>,&#8221; which is one of the pamphlets distributed in Israel through synagogues on the sabbath.  It is not available online.  I am about to summarize the story in my words, although nothing is original here and I am simply paraphrasing the story as it appears in the pamphlet.</p>
<p><span style="line-height: 1.5em;">In the 1930s the Frommer family lived in Haifa.  The father was Dov Frommer, who &#8211; with his wife &#8211; had made aliyah to Eretz Israel in 1935 from Olkusz, a small town in southern Poland.  He lived with his wife Leah Rosa and their two small sons.</span></p>
<p><span style="line-height: 1.5em;">In 1939, Leah Rosa felt an irresistible yearning to return for a visit to her home town in Poland to see her family there. She decided to take her two sons with her.  She was in the early stages of pregnancy.  They sailed from Mandatory Palestine, that is, the British-ruled colony in Eretz Israel, arriving in Danzig, the German port city on Poland&#8217;s Baltic coast.  It was after the Munich accord, and after the German aggression against Czechoslovakia.   It was also smack in the middle of the days of the Molotov-Ribbentrop pact, when Hitler and Stalin were plotting to conquer and divide Poland between themselves.   Leah Rosa felt safe, since she was traveling on British papers.  As residents of Mandatory Palestine, they were citizens of the British Empire, and Great Britain was not yet at war.</span></p>
<p><span style="line-height: 1.5em;">It was only four days after the mother and children reached Olkusz when the Nazis invaded Poland.  Hours later Britain declared war and the family was marooned in the heart of the territory in which the Holocaust would reach its most horrific dimensions.  There were no ways in or out. </span></p>
<p><span style="line-height: 1.5em;">The father of the family, Dov, began a feverish campaign of letter writing with the British authorities to try to win the release of his family in what was now German-annexed Polish territory, in essence part of the Third Reich.  The months dragged on. Leah Rosa gave birth there to her third son, naming him Yaakov.  But the situation was deteriorating and getting more desperate.  The Jews of Olkusz were ordered to wear yellow stars and move into a part of the town that would serve as a ghetto.</span></p>
<p><span style="line-height: 1.5em;">In 1940 a glimmer of hope appeared on the horizon.  There were numerous civilians from the British Empire that were stranded in the territories conquered by Germany, but there were also German civilians in the British Empire.  In particular, &#8220;Palestine&#8221; held a large population of German &#8220;Templers.&#8221;  These were German Protestant pietists who had migrated to &#8220;Palestine&#8221; in the 19th century and set up several colonies, including in Haifa, Jaffa, and Jerusalem.  In the 1930s many of these became devoted Nazis and, bizarre as it sounds, there were pro-Nazi marches complete with swastikas and Heil Hitlers on the streets of Israeli cities, organized by these Germans. </span></p>
<p>Negotiations began for exchanges of the stranded civilians of the two sides.  The US, still a neutral power, aided the efforts. In particular, a deal was in the offing for an exchange of German Templer civilians, mainly women and children, for civilians from Mandatory Palestine in Poland.</p>
<p><span style="line-height: 1.5em;">There was a snag, however.  While Leah Rosa and her two older sons were citizens of the British Empire, having been born in &#8220;Palestine,&#8221; the youngest child, Yaakov, was not.  He had been born in German-annexed Poland and the Germans were unwilling to acknowledge him as a British national.  He was also not a Polish national, since Poland had ceased to exist.</span></p>
<p><span style="line-height: 1.5em;">The father back in Haifa was conducting frantic correspondence with the authorities in London.  Somewhat incredibly, Winston Churchill himself took a personal interest in the family&#8217;s plight and wrote to the father in his own handwriting.  (A photo of the letter appears in the </span><i style="line-height: 1.5em;">Matzav Ruach</i><span style="line-height: 1.5em;"> pamphlet upon which I am relying.)   Fearing the barbarism that was clearly approaching, relatives in Poland urged Leah Rosa to take the two older boys and escape for freedom, leaving the baby in their care, but the mother would hear nothing of it.</span></p>
<p><span style="line-height: 1.5em;">Eventually a deal was reached under which the baby Yaakov, officially a citizen of German-ruled Poland, would be allowed to leave with the rest of his family.   Relatives in the Olkusz ghetto still felt relatively safe in those days, as the mass exterminations had not yet begun, and suggested to Leah Rosa that perhaps she might be better off staying there with them rather than going off to the backwaters of &#8220;Palestine&#8221; with its many dangers and acts of barbarism about which they had heard.</span></p>
<p><span style="line-height: 1.5em;">It was shortly after Pearl Harbor when the family was allowed to escape as part of the exchange of the stranded populations.  They reached Vienna, and from there took a ship down the Danube to the Bulgarian coast of the Black Sea, and from there reached home.  Baby Yaakov Frommer had been equipped with a special Nazi passport, issued by the Reich authorities in control of Poland.  It featured the Nazi eagle emblem and swastikas.  From its serial number, it was the very first passport issued by the Nazi authorities in Poland.   Yaakov made aliyah on a Nazi passport, complete with swastikas. </span></p>
<p><span style="line-height: 1.5em;">Once reunited in Haifa, the family resumed life as normal.  Yaakov grew up to be an electronics technician.  His oldest brother became a scientist at the Weizmann Institute, specializing in water treatment.  The middle brother became an air force navigator, headed an air force training school, and was captured during the Yom Kippur war when his plane fell in Lebanon.   A fourth younger son was born later and became a well-known psychologist.   The father of the family was one of the founders of the religious neighborhood Kiryat Shmuel near Haifa and was a principal at its religious high school.  Four years ago, Leah Rosa passed away at the age of 98.</span></p>
<p><span style="line-height: 1.5em;">Baby Yaakov, today 74 years old, allowed the magazine to photograph his swastika passport.   </span></p>

<p>New extremists are being created in our prisons, the very institution meant to deter crime. Two stories recently broke about people who converted to Islam in prison that acted in violent compliance with their new ideology. The media, for the most part, dropped the stories, leaving the American people unaware of the growing trend.</p>
<p>The October <a href="http://www.10tv.com/live/content/local/stories/2010/04/16/story-columbus-man-charged-gun-stockpile.html?sid=102">arrest</a> of a man in Ohio named Abdullah Mohammed Muslim, formerly known as Johnnie Clagg, has now come to light. He was pulled over and arrested by a police officer for identity theft in order to get a passport so he could leave the country. Law enforcement searched his house and found a large stockpile of weapons.</p>
<p>The arsenal included the material for five pipe bombs, two AK-47s, smoke canisters, an assault rifle, a ballistic vest and ballistic face mask, a semiautomatic rifle, a flak jacket and over 1,000 rounds of ammunition. Additional facts help to identify the intent behind this collection. The police found a CD containing parts of “The Anarchist Cookbook,” a well-known guide to making explosives, and a CD with photos of the crash site of a small plane in the state. And as CBN’s Erick Stakelback has <a href="http://blogs.cbn.com/stakelbeckonterror/archive/2010/04/21/exclusive-new-details-about-ohio-muslims-arrest.aspx">found out,</a> the purpose behind the attempted passport fraud was so he could flee the U.S. before being sentenced for previous weapons-related charges.</p>
<p>Muslim’s attorney has confirmed that he had spent time on the Pakistani side of the border with Afghanistan, the exact spot that radical Islamic militants have found safe haven, have constructed terrorist camps, and are recruiting Westerners to come for training and deployment. To any rational observer, Muslim would appear to be involved in terrorism, but federal authorities told Ohio’s Channel 10 News when the story broke that there was no connection to terrorism. As a result, the story failed to gain traction in the media outside of the local news and a follow-up report by CBN. At the time of this writing, a Google News search of the suspect’s name only brings up two results.</p>
<p>On April 14, a prison convert named James Larry <a href="http://articles.chicagotribune.com/2010-04-14/news/ct-met-chicago-multiple-shooting-20100414_1_baby-son-suspect-life-support">slaughtered</a> his family in Chicago. His brother says that in the days prior to the attack, he was acting differently, carrying around a Koran and saying it called for killing. The sister of his wife said he had begun talking about “going to Allah” and was fighting with his wife because she refused to wear a hijab. An apparent act of mass honor killing followed.</p>
<p>Larry shot and murdered his family. His pregnant wife, 7-year old son named Jihad, and two of his nieces, including one who was pregnant, were killed. His mother and nephew suffered severe injuries and went to the hospital. His 12-year old niece escaped as Larry shot at her as she fled. She managed to run into a gas station and have a worker call her mom. When the police arrived, Larry said he was bringing his family to Allah and said, “I wish I had more bullets. I wish I had more bullets.” His attorney <a href="http://www.suntimes.com/news/24-7/2168676,CST-NWS-shooting17.article">says</a> he is mentally ill and “suffering greatly” over his actions.</p>
<p>This just continues the pattern of the media failing to bring proper emphasis to worthy reports and the government steering the country into complacency by automatically downplaying suggestions that nearly any incident is connected to terrorism or radical Islam.</p>
<p>Last September, another American who converted to Islam while in prison named Michael C. Finton, who also went by the name of Talib Islam, was <a href="http://www.nytimes.com/2009/09/28/us/28springfield.html?_r=1">arrested</a> in Illinois. He was a fan of Anwar al-Awlaki and traveled to Saudi Arabia in April 2008 using $1,375 sent to him from someone inside that country. Upon his return, he told an undercover FBI agent that he desired to go to the Hamas-controlled Gaza Strip to fight Israel, but he also wanted to attack the United States. The FBI gave him fake explosives which he loaded into his truck so he could destroy the Paul Findley Federal Building in Springfield. After he tried to detonate the bombs with his cell phone and nothing happened, he found himself in handcuffs and in federal custody.</p>
<p>This is just an accounting of some recent incidents involving prison converts that didn’t receive the attention they are due. The Senate Foreign Relations Committee <a href="http://articles.latimes.com/2010/jan/20/world/la-fg-prisoners-terror20-2010jan20">says</a> that up to 36 American-Muslims who have served time in prison have recently gone to Yemen, claiming they are learning Arabic. Al-Qaeda has a vibrant branch there that may have recruited some of these so-called students. U.S. forces are trying to stop the next generation of terrorists from being bred overseas, but plenty are being born among Westerners who converted to Islam while serving time or shortly thereafter.</p>

<p>The complaints leveled against Israel by European countries and Australia, regarding the alleged misuse of passports by the Mossad in the assassination of Mahmoud al-Mabhouh, ring hollow and smack of blatant hypocrisy.  Whoever did kill Mahmoud al-Mabhouh—whether it was the Israeli Mossad or someone else—clearly did have their agents use stolen or forged passports.  Big deal.</p>
<p>Every good intelligence agency uses stolen and forged passports.  The British have been especially adept at this means of spycraft.  No country that uses fake passports in their intelligence operations has the moral authority to complain about the alleged misuse of passports in this case.  The only ones that have a legitimate grievance are those individuals whose passports may have been misused without their knowledge.</p>
<p>I guess it’s the job of foreign ministries to complain publicly when other nations do what they themselves do secretly.  Hypocrisy is, after all, the homage that vice pays to virtue.  I’m reminded of the famous scene in Casablanca, when officer Renault declares, “I’m shocked, shocked to find that gambling is going on in here!” A croupier then approaches Renault, and hands him a roll of currency: “Your winnings, sir.”</p>
<p>The hypocrisy in this case seems even more blatant than usual.  Is it because Israel is the alleged offender, and the world has gotten accustomed to singling out Israel for double standard condemnation?</p>
<p>Shortly after the terrorist attacks in Bali, which killed a large number of Australian tourists, I had the opportunity to meet with the Australian Prime Minister.  I was writing a book at the time on preemption, and I asked him whether he would have authorized a preemptive attack on the terrorist who killed Australian citizens, if such an attack would have saved their lives.  His response was that Australia would have done <span style="text-decoration: underline;">anything</span> it could, to prevent these terrorist attacks.  Anything, I guess, except misusing passports!  Is there anybody who believes that Australia would not have used forged or stolen passports to prevent the Bali massacres?  If Great   Britain could have stopped the London subway attack by misusing passports, would M6 have allowed the terrorism to go forward in the name of preserving passport integrity?  Of course not.  The same is true of Spain with regard to the Madrid bombing and to every other country in the world that seeks to prevent terrorism.  Well, if the Mossad did in fact kill al-Mabhouh, they too did it to prevent the killing of their innocent civilians.</p>
<p>The Israelis are always accused by their enemies, and sometimes even by their friends, of taking “disproportionate” action to stop terrorists.  But what could be more proportionate than a carefully planned and specifically targeted attack on an admitted terrorist who boasted of being an active combatant?  Whoops! I guess I forgot about those darn passports. That must be the disproportionate action complained about.  Saving innocent lives, on the one hand—misusing passports on the other.  I guess the right moral resolution, according to some foreign ministries, is to let innocent victims die—at least as long as its only Israeli victims.</p>
<p>It’s interesting, and disturbing, that more criticism is being directed against Israel for allegedly using stolen passports than for allegedly killing a terrorist.  That’s because no western country wants to appear to be sympathetic to a terrorist.  The “victims” of passport fraud are innocent civilians, but the injury they have suffered pales in comparison to the injuries—deaths—prevented by the well-deserved death of Mahmoud al-Mabhouh.</p>
<p>If the deaths of a small number of innocent civilians is deemed “proportional” to the killing of a terrorist combatant, than surely the discomfort of a small number of innocent victims of passport fraud is proportional.</p>
<p>The high dudgeon expressed by foreign ministries over stolen passports is worse than hypocritical.  It undercuts the war against terrorism.</p>
<p>There ought to be concern, among western democracies, about how easy it is to use forged or stolen passports.  Dubai should be conducting an investigation, but the focus should be on how simple it was for those carrying these phony passports to get into their country.  The misuse of passports is, after all, a primary tool used by terrorists to smuggle themselves into western countries, from which they can engage in worldwide terrorism.  There are thousands of forged and fraudulent British passports circulating around the world today.  Many are in the hands of terrorists.  That should be the focus of any investigation, not the occasional and controlled misuse of passports by western intelligence agencies to combat terrorism.</p>
<p>Whoever snuck into Dubai using fake passports may have done that country a service in warning them to tighten up their passport procedures.  Next time it may be a terrorist who tries to enter the country.  Wait!  Isn’t that exactly what happened when al-Mabhouh walked through security using a real passport with his real name?  I guess in Dubai you don’t have to use a fake passport if you’re a terrorist, but you do if you’re trying to stop terrorists—at least if the terrorism is directed only against Israel.  I guess Dubai is less concerned about letting terrorists into their country with real passports than in letting those who would stop terrorism into their country with fake passports.  It’s a topsy-turvy world out there.</p>

				<content:encoded><![CDATA[<p>Dubai&amp;apos;s police chief said Monday an 11-member hit squad with European passports was responsible for killing a Hamas commander in his hotel room last month, but he did not directly implicate Israel as the Islamic militant group has. The Gulf emirate released photos, names, nationalities and passport numbers of all 11 suspects.</p>
<p>The details given by Lt. Gen. Dhahi Khalfan Tamim are the most comprehensive accusations by Dubai authorities since the body of Mahmoud al-Mabhouh was found Jan. 20 in his luxury hotel room near Dubai&amp;apos;s international airport.</p>
<p>Tamim said it was possible that &#8220;leaders of certain countries gave orders to their intelligence agents to kill&#8221; al-Mabhouh, one of the founders of Hamas&amp;apos; military wing. But he did not name any countries.</p>
<p>Hamas has accused Israel and vowed revenge.</p>
<p>Tamim sketched out a highly organized operation in the hours before the killing, clearly done with advance knowledge of the victim&amp;apos;s movements, and said the killers spent less than a day in the country. He said forensic tests indicate al-Mabhouh died of suffocation, but lab analyses are still under way to pinpoint possible other factors in his death.</p>
<p>He showed a news conference surveillance video of the alleged assassination team arriving on separate flights to Dubai the day before al-Mabhouh was found dead. The members of the alleged hit-squad checked into separate hotels.</p>
<p>They paid for all expenses in cash and used different mobile phone cards to avoid traces, he added.</p>
<p>At least two suspected members of the team watched al-Mabhouh check in to his hotel and later booked a room across from the Hamas commander, Tamim said.</p>
<p>He added that there was &#8220;serious penetration into al-Mabhouh&amp;apos;s security prior to his arrival&#8221; in Dubai, but that it appeared al-Mabhouh was traveling alone.</p>
<p>&#8220;Hamas did not tell us who he was. He was walking around alone,&#8221; said Tamim. &#8220;If he was such an important leader, why didn&amp;apos;t he have people escorting him?&#8221;</p>

<p>[1] Umar Farouk Abdulmutallab is on a terrorist watch list and banned from the U.K. His father has warned U.S. authorities about him. He has no passport, checks no luggage and pays for a one-way ticket in cash. He is allowed to board Northwest Airlines Flight 253.</p>
<p>[2] Homeland Security Secretary Janet Napolitano goes on TV after the Christmas day terror attempt and announces that “the system worked” and that “everything happened that should have.”</p>
<p>[3] The next day, the Secretary goes back on TV to explain her words were taken “out of context” and admits that the &#8220;system did not work in this instance.&#8221;</p>
<p>[4] Napolitano is not fired.</p>
<p>[5] After staying silent for three days while playing golf in Hawaii , Obama makes his first statement: He declares, despite all evidence to the contrary, that the al-Qaeda trained Abdulmutallab is “an isolated extremist.” The President refers to him as a “suspect.”</p>
<p>[6] The “suspect” is charged, lawyered up and given the right to remain silent &#8212; instead of being treated as an enemy combatant, thrown into a dungeon, and interrogated about other plots, al-Qaeda in general and the whereabouts of his al-Qaeda handlers in particular.</p>
<p>[7] The administration fails to use the word “jihad” in dealing with this terror attack by al-Qaeda and to admit that the U.S. is at war with Islamic terrorists who are inspired by certain tenets of Islamic theology.</p>
<p>[8] A policy of profiling is not immediately instituted for airline security.</p>
<p>[9] Obama does not announce his decision to keep Guantanamo open and to stop sending its detainees back to Yemen .</p>
<p>[10] Obama remains in office.</p>

<p>Being a leftist Anti-Zionist means not only never having to say you are sorry, such as when you get your facts all wrong.  It also means that you have an obligation to represent yourself as a victim of harassment.   Armchair martyrdom is as fundamental a part of leftist ideology as anti-Americanism and hatred of Israel.</p>
<p>In his now-famous essay from July, 1976, &#8220;The Intelligent Co-ed&#8217;s Guide to America,&#8221; Thomas Wolfe wrote about how desperately American academics wish to feel persecuted.  A pretense of being persecuted today seems to do wonders both for their ego and for their web traffic.  The entire “Zionist Lobby” is largely an invention by these same people, anxious to show that they are being oppressed by an evil nefarious conspiracy.  You just need to wave your stigmata and denounce the “Neo-Conservatives,” the “Rightwing McCarthyists,” and – of course the Jews.  Whining about being persecuted seems to be the leading participation sport of today’s far Leftists and the radical armchair postureurs.</p>
<p>As <a href="../2009/10/16/collaborators-in-the-campus-war-against-israel-and-the-jews-joel-beinin-%D7%92%E2%82%AC%E2%80%9C-by-steven-plaut/feed/">documented recently on this web site</a>, Joel Beinin, the Israel-hating pro-Hamas sometimes-Maoist professor of Middle East Studies at Stanford University is just such a persecution whiner.  Here is what we wrote:</p>
<blockquote><p>‘“McCarthyism” seems to be Beinin’s third favorite “m” word, after Marxism and Mao, and he applies it liberally to anyone who dares to criticize him. Beinin wrote a 2004 article called “<a href="http://www.censoringthought.org/beinin.html" target="_blank">The New McCarthyism: Policing Thought about the Middle East</a>.” In it, Beinin denounced the <a href="http://www.discoverthenetwork.org/funderProfile.asp?fndid=5176" target="_blank">Ford Foundation</a>’s decision to withdraw funding from any university grantee that finances the promotion of “violence, terrorism, or bigotry or the destruction of any state.” What worried Beinin was that such restrictions could potentially hurt a “Palestinian student group [that] called for the replacement of the state of Israel with a secular, democratic state,” meaning one seeking the extermination of Israel.’</p></blockquote>
<p>Beinin went on to declare that Bay Area Zionists silenced him and prevented him from giving a talk to a school in San Jose.  The San Francisco Chronicle checked and reported that no one at all from the local Jewish Community had even spoken with anyone at that school.</p>
<p>Well, the good professor is back.  Over the Thanksgiving weekend he widely circulated the following epistle, which we reprint for you here in full, spelling errors and all:</p>

<blockquote><p>I arrived in Israel at about 15:00 on Wednesday, 25 November afternoon to visit my mother, brother, and sister who are Israeli (and US) citizens resident in Israel since 1973.  My mother has been ill, and this visit was prompted primarily for that reason. I have visited Israel dozens of times before – most recently December 2008 – and resided in the country for extended periods on several different occasions.  Yesterday, for the first time since my first visit to Israel in 1965, I was detained without explanation at Ben-Gurion airport for nearly two hours and ultimately interrogated.  The questioners asked questions that they surely already knew the answers to.  The asked, for example, my profession and my email.  My position as Donald J. McLaughlan Professor of History and Professor of Middle East History at Stanford University and my email are a matter of public record, easily obtainable from the website of Stanford’s Department of History.  The questioners also asked whether I had travelled (sic) to “other countries in the region” which, since they had my passport in their hands for the better part of two hours with all the relevant visa stamps, was also not obscure information.  My luggage was not searched nor was I asked any question remotely related to the security of Israel except whether I had traveled (sic) to Iran (I was there once, for two weeks, in 1970 when Israel had warm relations with the Shah’s regime).</p></blockquote>
<blockquote><p>It therefore appears that this “investigation” had no purpose other than to harass and intimidate me.</p></blockquote>
<blockquote><p>Upon leaving I was told that I would be contacted further by one “Amos” from the Ministry of Defense.  For my convenience, I was given his phone number: 054-*******.</p></blockquote>

<p>The main reports about the horrific suffering by Beinin at the hands of the security personnel at Israel’s airport have been on web sites run by Israel’s own predominantly-Arab Stalinist communist party and on one of its front groups named “The Left Bank.”</p>
<p>Now the above Beinin hysterics about being “intimidated” need a dose of deconstruction.  Beinin routinely travels to countries that happen to be at war with Israel, and has visited Iran, which happens to be officially on record as calling for the annihilation of Israel and its population.  By his own admission, Beinin’s passport is bristling with visas from such countries.  One would expect even the sleepiest airport passport inspector at Tel Aviv’s Ben Gurion airport to sit up and take notice of someone coming into the country with such visas.  Most passport inspectors at Tel Aviv airport, by the way, are teenage girls.  So you can imagine the terror and intimation experienced there by the poor professor.</p>
<p>Now Beinin’s insistence that the airport security staff must have known who he is rings a bit curious.  I did a search of the Hebrew web, and &#8211; sure enough &#8211; there are some internet mentions of him in Hebrew, but almost all of those are on the web sites of communist party and its fronts, which the airport inspectors may not visit on a regular basis.  There <em>are</em> two mentions of Beinin’s getting sued by Los Angeles journalist Rachel Neuwirth for his posting false smears about her.</p>
<p>What about Beinin’s claim that being questioned about his travels in belligerent countries constitutes “harassment” and “intimidation?”   (We have only his word that the questioning took two hours, and no mention at all of his being offered cookies and tea; I have waited in that airport for longer just to get a guitar case out of the belly of a plane!)   Well, an acquaintance of mine named Julia is an Israeli Jew born in Libya, a fact noted on her Israeli passport, and you would not believe the hassle she goes through every time she wants to come to the United States for a visit!  My wife was questioned at length and searched at Tokyo airport after 9-11 because her passport says she was born in the Middle East.</p>
<p>More to the point, Joel Beinin is an anti-Israel hate propagandist, someone who has made a career out of rationalizing anti-Jewish terrorism and endorsing Arab demands for Israel’s annihilation.  Other countries routinely bar hostile propagandists for far less provocation.  Canada <a href="http://www.911blogger.com/node/19654">banned ultra-leftist</a> and Saddam’s agent George Galloway from entering, and also <a href="http://www.cbc.ca/world/story/2007/10/04/peace-activists.html">banned some other radicals</a>.  Canada also banned a controversial rap group from entering.  The US banned Tariq Ramadan due to his terrorist connections.  It has banned others for security reasons, including Cat Stevens, the <a href="http://blog.beliefnet.com/idolchatter/2008/03/british-author-barred-from-ent.html">British author Sebastian Horsley</a>, a <a href="http://www.wired.com/threatlevel/2007/04/canadian_psycho">pro-LSD Canadian psychologist</a>, and <a href="http://www.washingtontimes.com/news/2009/mar/17/israels-national-security-aide-barred-from-us">at least one Israeli</a>.  The UK <a href="http://conservativehome.blogs.com/centreright/2009/02/government-bans.html">banned radio host Michael Savage</a> (along with <a href="http://www.independent.co.uk/news/uk/politics/16-banned-from-britain-named-and-shamed-1679127.html">15 other people</a>) for being insensitive to Moslems, and <a href="http://www.timesonline.co.uk/tol/news/uk/article5709892.ece">tried to ban Dutch politician</a> Geert Wilders.  Egypt has barred Hamas members from entering.  The Ukraine <a href="http://www.encyclopedia.com/doc/1A1-D90K90UG1.html">banned the mayor of Moscow</a> from entering the country because of things he said.</p>
<p>Now as it turns out, Israel almost never prevents anti-Israel propagandists and anti-Semitic hate-mongers from entering the country.  For example, it rather stupidly allows lots of “anarchists” from the “International Solidarity Movement” and similar pro-terror groups to enter the country and then to attack its policemen and soldiers as their attempt to help Palestinian terrorists.  The only two anti-Israel propagandists of note who have been barred from entering Israel in recent years were: 1.  Norman Finkelstein, a Neo-Nazi who was fired by DePaul University and who was barred from entering Israel due to his intimate ties with the Hezb’Allah, and 2. Richard Falk, the anti-Semitic retired professor from Princeton who was barred from entering Israel as head of an anti-Israel UN propaganda “commission.”  (When Falk arrived earlier as a private person to give university lectures, he was admitted.)</p>
<p>Anti-Israel fanatics, like Noam Chomsky and the Swedish journalist who recently invented a medieval blood libel about Jews stealing the body parts of Palestinians, have been admitted to Israel freely, although they never would be if <em>I</em> had anything to say about it.  Even Stephen Walt and John Mearsheimer, whose nasty diatribe, <em>The Israel Lobby and US Foreign Policy</em>, has become the Koran for Israel-bashers and Jew-haters around the world, were welcomed in Israel for a speaking tour.</p>
<p>It goes without saying that Beinin has never expressed any criticism of the fact that Israelis are prohibited altogether from entering Iran and most Arab countries.  Some of those countries prohibit entry to Jews from anywhere.  In Saudi Arabia you will get expelled and beaten to a pulp if you have a Hanukka Menorah or a Christmas tree.</p>
<p>Of course the greatest irony in all of this is that Beinin <em>was not banned</em> from Israel at all, in spite of being a fanatical pro-terror anti-Israel propagandist.   He was simply interviewed by an alert young passport inspector, suspicious of all those visas in Beinin’s passport from countries seeking Israel’s annihilation.  For Beinin, however, the incident was a priceless opportunity to wave his stigmata and show the world what a persecuted martyr and victim he is.  His questioning in the airport proves he is being intimidated and harassed by them damned Zionists!</p>
