How out of control is Judge Boasberg? So out of control that he’s getting rebuked by the D.C. Court of Appeals. That’s like the Chinese Communist Party telling a tank in Tiananmen Square that it’s going too fast.
But, to recap, Judge Boasberg somehow got himself assigned to a case he had no business being involved in, then began ordering DHS to return illegal alien criminals outside the United States to America, and has tried investigating law enforcement personnel and appointees for contempt of court because they didn’t agree that he not only runs the country, but the entire planet.
Now the D.C. Court of Appeals told him to stop.
In a 2-1 ruling, the DC Circuit Court of Appeals found the Obama-appointed judge overstepped his authority by pursuing possible contempt charges against former Homeland Security Secretary Kristi Noem and other top executive branch officials involved in the deportation of hundreds of Venezuelan migrants to El Salvador last March. Boasberg sought to investigate whether the Trump administration officials willfully violated his emergency court order blocking the deportation flights
This was his ‘oral order’ which had no standing anyway.
Judge Rao further described Boasberg’s contempt investigation as “intrusive” and a “legal dead end,” arguing the judge’s order “said nothing about transferring custody” of the Venezuelan migrants to Salvadoran authorities.
“In our constitutional system of government, criminal liability cannot turn on the unstated intentions (or post hoc assertions) of a district court judge,” Rao wrote.
Judges are not dictators. They cannot employ unlimited authority and expect everyone to jump at their word.
Shocking isn’t it.
We didn’t get rid of one monarchy in ermine to replace it with another one in black robes.
Congress just needs to sack him and be done with it.
The “good behavior” clause on retaining his position applies directly.
I don’t see the Senate reaching the 2/3rds requirement to remove him from office.
Can an appeals court or SCOTUS hold a district judge in contempt and if behavior continues have him jailed?
Boasberg should be removed from the bench. His behavior is tyrannical, and he does not have the necessary integrity to be a judge.
Don’t bother with an impeachment circus, just defund his courtroom and lock the door behind him.
Boasberg highlights a major problem with our legal system: That the Executive Branch is potentially subject to the unanimous consent of all 677 district court judges. This is not in the US Constitution. Perhaps the fix is that judicial authority to overturn the Executive Branch should reside with the Supreme Court and only the Supreme Court only.
Interesting solution. Clarence Thomas has been bringing up whether a judge’s ruling really extends to the whole country and how ridiculous it is.
The other rule that might be invoked is for both congress and the executive branches to be able to sue to protect their branch from the ruling immediately after. Make it a requirement after every ruling for it to be determined whether the Judicial ruling infringes on the other two branches and if it does it immediately nullifies the ruling. Also if it ignores any laws or grabs too much power, say the judge punishes arbitrarily or consistently displays a predjudice.
Is the Executive Branch subject to 677 judges or have we just settled into it? I do not know but President Jackson had the correct answer. “Mr. Marshall has an opinion, let him enforce it.”
That would be the greatest service President Trump could provide for our country during his tenure, Saving us from third rate, politically appointed law students.
It’s a bit more complicated than that. Even the Supreme Court cannot be allowed to stop the President from exercising a power granted to him by the Constitution, which is what these Democrats-in-robes are doing in their attempts to overturn the Presidential election.
A full discussion is impossible here, but the basic problem stems from the refusal of the Democratic Left to accept Constitutional restrictions on their power or any resistance to their various totalitarian schemes – in short, its radicalism.
And yet somehow every single case relating to Trump or any MAGA policy ends up on his desk.

In a two to one majority opinion, an appellate court rebuked the Frankenstein monster– Judge James Boasberg– that “woke” Democ-rats sicced on the Washington D.C.
