Outrage at President Trump and Secretary of War Hegseth’s pursuit of drug dealers operating in international waters has met with outrage and furious mumblings about international law from the usual suspects.
Last week, in my article, ‘Andrew Jackson’s Precedent for Trump’s Strikes on Drug Traffickers’, I demonstrated that there was plenty of precedent in American history for taking out pirates and other enemies classified as ‘pirates’ (including slavers back in the 19th century) in international waters. And, contrary to what America Last libertarians argue, did not require a ‘declaration of war’.
Now let’s turn to the ‘international law’ question. Obviously no conservative believes that international law applies to America. And we should assert that clearly.
But pursuing and taking out drug dealers is legal under international law for much the same reasons. As usual this goes back to the legal concept of piracy. Under admiralty law and later the law of the sea which was codified in ‘international law’, pirates were ‘Hostis humani generis’ or enemies of mankind. Much like Islamic terrorists today or slavers back then and thus could be pursued, fired on or killed at will by anyone.
By the 1980s, the United States had basically claimed jurisdiction over drug smugglers in international waters who were planning to traffic drugs into the United States. Some of this was done under the fig leaf of agreements and some shaky legislation, but the bottom line is that we’ve spent the last two generations intercepting ships in international waters if we believed that they were drug dealers. And we’ve threatened those ships with the use of armed force if they did not comply.
We’re just extending those same protocols more directly and beyond our more proximate waters against ‘enemies of humanity’.

Nobody likes drug runners, I just do not like the executive writing a law that goes against the constitution. Trump has admitted they did not know the name of the so called drug runners, so either their intelligence was not perfect or they are just lying.

No smuggling is not piracy, no drug runners are not terrorist, no Venezuelan smuggling is not an existential crisis, we have all lived safely our entire lives without threat from it as long as you are not a drug user.
There is no such thing as a “narco” terrorist, terrorism definitions require intimidation or violence to coerce a government which the cartels are not doing no matter how scary and dangerous drugs are or how violent the cartels are mostly against their competition and law enforcement.

I don't agree with all of Pauls' stances on issues, but recognize they are much more principled than those who claim to support less intrusive government but then give Republicans a pass when they support more government.

Daniel Greenfield has made that point about the US, that there are those who wish to discourage us into despondency and that we should shut down that discouragement. I think that point should be extended as much as possible to other Western countries. It should also be extended to e.g. NYC, and even if this Mamdani dungbag wins the election. The first job of government at any level is to protect the safety of citizens. Interdicting lethal substances bound for our land while in international waters is 100% consistent with that job. Using air assets to exterminate the substances and the purveyors thereof is just common sense. Whether other nations have opinions on this matter bears not at all on the responsibility of our federal government to protect American citizens by these means. Mr. Greenfield is correct.

Show me in the Constitution that. You can’t. People have to go to precedent, which is not law, and the further they go in precedent, the more lawless they become, ie. what we see going on right now. Remember, Congress has all authority to declare war and to call up military and militia in service of the US. THEN, AND ONLY THEN, does the president BECOME commander in chief (See Article II of the Constitution. The president does not call up the military. He responds to the calls off Congress, which have been silent in this matter. He’s a lawbreaker no matter how well intentioned, just like those who came before him.
