I’m starting to miss the days when liberal activist judges had some familiarity with the law and some notion that their powers had a tenuous connection to constitutional checks and balances.
Even in the mad competition between Obama and Biden judges to simply declare themselves rulers of the land, Judge Indira Talwani, an Obama appointee, is in her own league, having not only overriden President Trump, but also Congress, declaring that it couldn’t block Medicaid payments to Planned Parenthood despite the existence of a bill that did just that.
Why not?
The abortion provider claimed that Congress had violated the Constitution “by retaliating against them in violation of the First Amendment”. Since apparently the First Amendment covers the right to kill babies.
Tawlani took up the argument that the Big Beautiful Bill “burdens the exercise of Planned Parenthood Federation and its Members’ First Amendment right of association” by not giving them money to kill children and that she has to urgently intervene since “restricting Members’ ability to provide healthcare services threatens an increase in unintended pregnancies” and thus some babies may survive.
All of this has as much connection to the Constitution, never mind the values of the framers, as a hallucinating crackhead pounding on the door of the Burger King while imagining it’s a spaceship. There is nothing legal or American about any of this. It’s simply evil distilled into a lawless arrogance so completely ignorant that it’s almost comical if it weren’t also so horrifying.

This is the best they can come up with? Violation of freedom of speech to block abortion? What about the baby’s First Amendment rights that will never be heard?
Does it matter what a lower court rules when the SCOTUS has set a ruling precedent?

Its called a hail mary far reaching BS ruling trying to find anything to apply asan excuse to stop this funding cut. And wow is this one a real stretch.
MURDER IS MURDER! WE HAVE BEEN USING TAX DOLLARS TO MURDER OUR CHILDREN AND SELL THEIR ORGANS ETC., ALL THE WHILE LETTING THESE CRIMINALS OPERATE WITH IMPUNITY WITH A LUST TO KILL.
WE SHOULD BE ASHAMED OF OURSELVES. JUST BECAUSE YOU DON’T WANT A CHILD DOES NOT MEAN THAT A BABY IS EXPENDABLE. SOME LOVING PARENTS WOULD LOVE TO HAVE A CHILD TO LOVE AND RAISE. KARMA IS A CRUEL TASK MASTER AND WE WILL ALL PAY THE PRICE FOR TURNING A BLIND EYE TO EVIL. (EVIL IS LIVE SPELLED BACKWARD AND THE OPPOSITE OF LIFE, ) THESE PEOPLE ARE PURE EVIL PLAN AND SIMPLE.
This ruling is an unconstitutional decision and should not be accepted as preventing the President from withholding these funds as directed by Congress. Also, this judge has shown such a disregard for the law that she should be impeached and removed from the bench.
When and where did a member of the judicial branch of government get the authority to override the Constitutional prerogative of the legislative branch of government?
I’m thoroughly familiar with US Constitution and article 1, section 1 and section 8 are crystal clear on the prerogatives of congress.
Article 3 pertains to the legislative branch of government and no where does it authorizes a member of the legislative branch to usurp the Constitutional authority of the legislative branch.
That judge should rightfully be impeached. for exceeding his Constitutional authority. That would mean republicans would have to grow a pair.
Unfortunately, that’s never going to happen. RINOs and neocons don’t have balls and wouldn’t know what to do with them if they did.
The Supreme Court and lower Federal Courts have held laws passed and signed by the President since the beginning of the nation. Take a course in Constitution Law to find out
While there are exceptions to every rule, you simply don’t hate federal judges enough. Any lawyer worth his salt could make a whole lot more money in private practice, so…why would anyone want to be a federal judge? Easy.
Most of them are wildly incompetent, and are on a power trip. They simply would not make it in the real world. Sort of a social revenge.
