State governments refusing to cooperate with federal law enforcement in enforcing immigration law because they reject the idea is an insurrection. And it ought to be treated like one. Whether it’s Gov. Newsom in California or Gov. Evers in Wisconsin, state governors ordering employees to obstruct ICE is a Fort Sumter moment.
The State of Wisconsin guidance to “state employees encountering ICE or other federal agents at their workplace” tells them to ask for their budgets, tell them to sit in a “public area” , not allow them to “enter into a non-public area” and to refuse to cooperate without contacting a lawyer.
Gov. Evers’s directive warns state employees “do not answer questions” and “do not give the agent access to any paper files or computer systems” because “state employees may not grant ICE or another agent access to such data or information.”
This comes after the arrest of Judge Hannah Duggan in Milwaukee for obstructing ICE agents while telling an illegal alien wifebeater to run away and helping him escape. Other Wisconsin judges are threatening to follow suit.
All of this is illegal.
State governors do not get to pick and choose which laws they comply with. Neither do state employees. Obstructing immigration enforcement in order to keep flooding America with illegal aliens is an insurrection and can be put down.

Unfortunately, the Democrats have a lot of lawyers and they are technically correct here. States do not have to cooperate with Federal law enforcement although they cannot actually interfere with an arrest. That is why they do not have to allow ICE agents into non-public spaces or give them access to files and records without a judicial warrant.
The two judges recently (and properly) arrested were different: the Milwaukee judge actually obstructed ICE agents in a public space (her courtroom and the courthouse) and concealed an alien to prevent his arrest, while the New Mexico judge was charged with evidence tampering for destroying the cell phone of an illegal alien. Why he hasn’t been charged, as far as I know, with harboring that illegal alien I don’t know because it is a federal offense to do so.
But that doesn’t excuse the Democrats, whose unwillingness to cooperate in the removal of illegal aliens is disgusting. The remedy against Governor Evers and the sneaky, skirt-the-law Democrats like him is political: they want illegal aliens to invade and destroy this country, and Republicans should be shouting about this every day until the Dems look back longingly to the days their approval rating was as high as 28%. (And of course Trump should continue to arrest all the Democrats who cross the line and blatantly break the laws).

Jeff, I’m on your side here in spirit at least. I don’t know if you can review my comment history on FPM here or not, but if you can and do you will see I have the greatest admiration for Trump, for FPM, and for Daniel, who is correct morally in condemning the Dems for their conduct. Unfortunately, the legal situation is quite different. (You can find many of my legal-oriented comments on Disqus if you’re interested. I’ve had a lot to say about Judges Xinis and Boasberg, for example.)
The Supreme Court has held that the state governments cannot be compelled to enforce federal law. That is why they don’t have to comply with ICE detainers or help ICE agents round up illegal aliens. Now in a better world (one without a political Left), this wouldn’t be a problem because OF COURSE the states would cooperate with Federal law enforcement (as long as it wasn’t trying to confiscate citizens’ guns). But in our Democrat-infested country, the effect is that ICE is on its own in these cancerous Democrat-run states and cities.
Now there are lines the Democrats cannot cross, and their shady lawyers seem to have informed them of this in most cases. That is why that punk mayor of Portland is no longer speaking of openly obstructing federal law enforcement, which remains a crime. But refusing to help is not “Obstructing” under the law as written and it appears to me that Evers’ directive to Wisconsin public officials is technically legal even though morally disgusting.
Harboring an illegal or encouraging him to remain in the country is another crime (see U.S. Code Title 8, I think section 1324). Why Cano hasn’t been charged with that yet I don’t know. Let’s hope it’s because they have a more solid case on the destruction of evidence charge. I honestly do not know if declaring your city/state to be a “sanctuary” qualifies as a violation of this statute. I doubt it’s ever been tested in court because until recently, even Democrats didn’t openly announce their support for aliens to violate Federal law, but it’s certainly despicable behavior.

I am absolutely in favor of arresting all of these GOVERNMENT EMPLOYEES on charges
of sedition and placing them in jail WITHOUT BOND while they are tried for that crime.
The punishment meted out needs to be the most severe that law allows.

Not sure if your comment was directed at me or not, but if you’re a lawyer you should understand the difference between violating federal law and being compelled to aid federal law enforcement. It’s the difference between harboring an illegal alien (a crime) and refusing to honor an ICE detainer request or allow ICE agents into a non-public area if they don’t have a judicial search/arrest warrant. Yes, the Feds can make life miserable for anyone, but do we want to repeat the unethical conduct of the Obama/Biden years?
And please, everyone – don’t shoot the messenger (me) for being the bearer of bad news! I didn’t write the laws or make the Supreme Court’s decisions. The anti-immigration enforcement lawfare campaign against Trump has been an eye-opener for a lot of us, not because it’s a surprise but because in actually reading the law (Title 8 for immigration) and court decisions I have found complexity and disappointment. This isn’t the place for details, but if we’re to rid our country of illegal aliens – I goal I wholeheartedly support – we may need Congressional action to expedite deportation procedures. And where the law allows, I’m all in favor of prosecuting every Democrat who’s getting in the way.
And to repeat: Republicans need to amp up the political pressure on Democrats. President Trump (I love writing that!) is leading the way by putting up posters on the White House lawn of 100 illegal alien criminals who have been recently arrested.
