Mahmoud Khalil, the former Columbia U student, was a leading figure in the campus riot movement that celebrated the Hamas attacks of Oct 7, endorsed terrorism, called for ‘Death to America’ and was “fighting for the total eradication of Western civilization.”
The foreign national was busted by ICE and prepped for deportation for his activities. Democrats and the media, from Sen. Schumer to the Jewish Democratic Council of America, rallied to Khalil’s defense.
They demanded ‘due process’. They just got it and neither they nor Khalil are very happy.
A judge in former Columbia University activist Mahmoud Khalil’s case ruled against him Friday, finding he is eligible for deportation while giving his legal team a little less than two weeks to respond.
Jamee Comans, an immigration judge in Louisiana, found the government’s case is “facially reasonable.” She gave his team until April 23 to file its response.
The government had “established by clear and convincing evidence that he is removable,” Comans said, The Associated Press reported.
“I would like to quote what you said last time that there’s nothing that’s more important to this court than due process rights and fundamental fairness,” Khalil said at the end of the hearing. “Clearly what we witnessed today, neither of these principles were present today or in this whole process.”
That and “the total eradication of Western civilization.”
Khalil’s OJ level team of lawyers is trying to take the case to a friendly federal judge in New Jersey, but the Supreme Court just ruled that habeas cases have to be heard in the ‘district of confinement’ which is not New Jersey.
Meanwhile, this is what leftists are fighting for.
On Wednesday, the administration submitted a memo to the court from Secretary of State Marco Rubio, in which he cited Khalil’s “past, current, or expected beliefs, statements, or associations” as the basis for his deportation and argued that allowing him to remain in the U.S. would foster a “hostile environment for Jewish students in the United States.”

“Mahmoud Khalil hates the United States and what we stand for—so his removal should come as welcome news. It is a privilege to be granted a visa or green card to live and study in the United States of America. When you advocate for violence, glorify and support terrorists that relish the killing of Americans, and harass Jews, that privilege should be revoked, and you should not be in this country,” DHS Secretary Kristi Noem tweeted.
“Being a guest in our country is a privilege not a right. If you promote terrorism and antisemitism – there will be consequences,” National Security Advisor Mike Waltz tweeted.
The White House one was simpler.

Rubio is doing better than I expected.
I think the same thing. I didn’t used to have a high opinion of him but he’s come into his role very well. He’s a good speaker and he represents the administration ably. He speaks up at public meetings and represents America like a man.
I hear it’s wonderful in Gaza this time of year he can enjoy it with his Hamas buddies.

We are awash in a sea of “due process.” The never ending hearings and appeals and re-hearings and appeals and remands and more hearings and more appeals will assure this creature’s continuing presence in the U.S., in what should be a simple case for his removal, until he is eligible for Social Security which, when the Dems get back into power, they will make sure he receives.
Congress must enact a statute whereby any alien, legal or illegal, who violates our laws forfeits any right to remain within the US, including the right to due process and adjudicating the issue within our borders. They can await trial from their home country and pay their lawyer at their own expense.
Congress should legislate strict liability, no mental state and no right to jury trial for any alien. The sole question submitted to the court is “Does the court find defendant violated the law?” If yes, then permanent ban on return without judicial discretion.
The world’s 8 billion people are not all potential Americans capable of living under our laws honed by many centuries of our unique experiences and values forged by living together. These values are anglo-protestant and assume mutual trust, arms-length commercial transactions, etc. Most of the world (like India) assumes corrupt and deceptive commercial and inter-personal dealings.

Little Khalil and his team of lib lawyers are judge shopping in exactly the same way the Norm Eisens of the lawfare world were trying to get the “case against Trump” in front of idiots like Judge Merchan and Jack Smith.
