It’s inevitable that as conservative judges minimize their authority lefty judges maximize it.
As the Left tosses aside the Constitution and checks and balances, not to mention the minor matter of the rule of law, we end up with the rule of officials asserting their absolute power because of the moral authority of their politics. The moral arc of the universe bends towards tyranny, after all.
And social justice.
Two ways of saying the same thing.
California is the capital of the new judicial ruling class where lefty judges assert absolute power over everything. One of the more disgusting examples is Clinton federal judge, David Carter, who has been issuing decrees about the crazed junkie vagrant population that lefties call the homeless or more recently, the unhoused.
U.S. District Judge David Carter, who is overseeing the case, called parties to a hearing in a Skid Row parking lot last month and said that if politicians can’t provide solutions, he wants to explore what powers the court has to order and oversee remedies.
Invoking the 1950s civil rights case Brown vs. Board of Education, Carter said there is strong precedence of the federal courts acting “after a long period of inaction by local government officials.”
…. a strong precedence in Latin America?
Judges in America are not members of military coups who act after declaring a “long period of inaction”. They deal with legal cases brought to them.
But Judge David Carter is special. He just commands things. Like King Canute commanding the sea.
All homeless people living on Los Angeles’ Skid Row must be offered housing by October 18, a federal judge ordered Tuesday.
The proper response to that is President Andrew Jackson’s response to the Supreme Court. Judge David Carter has issued his verdict. He should now carry it out.
Preferably at his own expense.
It should be a snap. His house has got to be able to hold at least 30,000 crazed junkie vagrants. That gets him halfway there.
According to the brief, city and county officials must offer and provide shelter to Skid Row’s general population within 180 days, on or before October 18, 2021. Unaccompanied women and children must be offered housing within 90 days.
This is not a judicial ruling. It’s King George III issuing a command that has nothing to do with reality or the law. This isn’t a first for King Carter, but it’s particularly detached from reality because he’s ordering the impossible with no plan to actually carry it out.
Calling it an “unprecedented pace,” Mayor Garcetti said Tuesday he would not comment on the order before fully understanding how the judge envisions the timeline successfully happening.
Judge Carter has declared himself the Mayor of LA. Garcetti should cede his office to HRH and let him figure this out. I’m sure he’d be as terrible at it as Garcetti.
“All of the rhetoric, promises, plans, and budgeting cannot obscure the shameful reality of this crisis –that year after year, there are more homeless Angelenos, and year after year, more homeless Angelenos die on the streets,” Carter said.
They’re dying on the street and they’re on the street because they’re on drugs, or mentally ill, and most often both.
Perhaps Judge Carter should issue a ruling ordering them to get off drugs and take their medication. It’ll work as well as his current ruling which is a bunch of unintentionally hilarious revisionist history and critical race theory nonsense.
Conway said he was struck by Carter’s grand prose in the court filing, which quoted Abraham Lincoln and traced the history of homelessness back from slavery through decades of redlining, containment, eminent domain, exclusionary zoning and gentrification.
That explains all the white homeless junkies I see.
Judge Carter might want to consider Lincoln’s views on judges before quoting him. Lincoln was not a fan of judges who considered themselves kings.
