When the Dems and their Leftist activist judges waged a ruthless obstructionist war against anything that the Trump administration did, they turned to the Administrative Procedures Act.
Whatever the Trump administration did, the leftist activists and their allied judges blocked it on the grounds that it was “arbitrary and capricious”.
As the Washington Post noted back in the day, “Two-thirds of the cases accuse the Trump administration of violating the Administrative Procedure Act (APA)”.
“The normal “win rate” for the government in such cases is about 70 percent, according to analysts and studies. But as of mid-January, a database maintained by the Institute for Policy Integrity at the New York University School of Law shows Trump’s win rate at about 6 percent.”

Stephen Miller’s America First Legal and Ken Paxton in Texas are doing a victory lap after the Supreme Court blocked a stay on Biden’s overturning of the Remain in Mexico policy for illegal aliens which had been blocked by a Trump judge on the grounds that it was… arbitrary and capricious.
Lefties are having a hissy fit. Vox’s hissy fit is all there in the headline. “The Supreme Court’s stunning, radical immigration decision, explained.”
The explanation is really simple.
When you turn to APA to sabotage an administration’s decisions, you create a dangerous precedent. The Supreme Court blocked President Trump’s overturning of Obama’s illegal DACA amnesty based on APA. Why not overturn Biden’s overturning of Trump’s immigration policy on similar grounds?
The concepts of fair play and consequences never seem to make it through into the leftist brain. Lefties constantly advocate for the most radical means of seizing power and imposing their will, and then whine when they end up on the wrong end of it.
