Palin v. New York Times came down to arguing that the paper was sloppy, but not malicious. That may be the best defense that Judge Jed Rakoff, who dismissed the case before the jury had finished its deliberations, can manage.
Why dismiss the case before the jury has even reached a verdict?
The obvious answer is that the judge didn’t trust the jurors to reach the politically correct decision, which they eventually did, but only after Rakoff tainted the jury by dismissing the case.
The overall irony here is that lefties panicked over Palin because they feared ordinary Americans would support her. The level of contempt and insecurity drove the elites into an even greater frenzy of hatred of the kind that has been partly forgotten, but of which the New York Times’ insane smear was only one example.
Rakoff proved equally paranoid about the jury and rushed out his decision.
In both the 2008 election and Palin v. New York Times, the elites got their way, yet they were so insecure that they had to discredit themselves to do it.
The media began the process that completely nuked its credibility with the rise of Obama. Media bias had always been an issue, but from the Obama era onward, the media ceased to function as anything other than an echo chamber and influence operation for the Left.
The judiciary has spent the last 5 years jumping the shark and Rakoff’s awkward move only reinforces the same paranoid power grab by elites that characterized Palin’s national presence.
