Dems and their media have been shouting about a “constitutional crisis” for two weeks now. If you believe Rep. Jared Huffman, it’s even the worst constitutional crisis since the Civil War.
But the actual constitutional crisis is once again proving to be a judicial coup.
Democrat federal judges have blocked lawful moves by the Trump administration under various technical pretexts with the aim of upending legal presidential authority. We’ve already seen this during Trump’s first term, so it comes as no real surprise, but it’s even more aggressive out of the gate with leftist activists and leftist federal judges moving rapidly to try and block nearly anything that the Trump administration does.
This isn’t just limited to broader national policies, like NIH funding caps, but the management of the federal government, including removing political appointees and reassigning federal employees, offering them buyouts, pausing the appropriations process and ending relationships with contractors.
All of these are under the purview of the executive branch until federal judges decided to step in.
Whatever one conceives of the role of the federal judiciary, it is not wielding executive authority. And that is what federal judges are effectively doing by vetoing a broad range of publicly supported policies on the thinnest of pretexts.
There is no way to make meaningful reforms without challenging judicial review or more properly judicial supremacism, but nonetheless it’s clear that the crisis is approaching sooner than anyone expected.
The judicial coup returns us to the fundamental question of who runs the government: elected or unelected officials, by way of the question of what powers the judiciary has and what powers it does not have.

That’s for sure and it’s long overdue, even though Trump has only been President for 22 days, which is only three weeks. He needs to ignore illegal rulings by crooked judges who are Dirtbagocrat operatives and tell them to try and enforce their orders, then have AG Bondi go after them. If the AG wants to prosecute them, she has the legal authority to do so. The D-Bags will never vote to impeach their corrupt operatives but the AG can have the FBI arrest them and she can prosecute them. She has the authority.
The Constitution grants Congress to establish tribunals and courts inferior to the Superior Court and doesn’t prohibit a President from doing so but I doubt President Trump would ever try, much less accomplish it. It would be great if he were to establish a new court designed to prosecute political criminals with somebody like Mike Davis as the judge. He’s honest, he knows the Constitution forwards and backwards and he’s young, so he could serve for a long time.
But I’m just fantasizing, though. The D-Bags would never go for it. But AG Bondi can go after ANYBODY who breaks American law, and ALL those D-Bag operative judges have. Trump needs to stop wasting America’s time by challenging those scummy criminals through the court system, and go after them directly, but I have no confidence that he will. Too bad. It would end the lawfare immediately.

Well, tweaking the immortal words of Leftist hero Joseph Stalin, “How many divisions does the Judiciary have?” It is way past time that the Spectre of Marbury v. Madison be exorcised. I know Musk is pushing to have these hack-in-black Hawaiian Judges de-frocked and kicked off the bench but it presupposes the political will of the GOP to lead the way to impeach them, and since the GOP sadly is also part of the problem my guess is this is a non-starter sadly.
What Trump should do is merely drawing a line in the and and declare the Judiciary completely out of order in usurping Executive Branch constitutional authority.
Also, at some point down the road, there ultimately will be another Democrat President the likes of which will make Obama look positively Reaganesque and they will either be successful packing the courts with hordes of Ruth Bader-Meinhoffs and other wise Latinas and/or removing Clarence Thomases at will on trumped-up charges. Or otherwise bastardizing Trump’s decision to nullify a rogue Judiciary and ignore legitimate rulings (if they every occur again with a likely non-originialist bench).
I think we are truly at a major tipping point in the life of the Republic, as it is or perhaps as we wished it still was but is for sure no longer.
Trump is trying to restore something that perhaps cannot be restored, not with the ideologies and political sides as they are constituted.

The fate of these executive orders will be decided by judicial review. The standard applied to judicial review is not always the same, and this will likely be addressed by the SCOTUS.
One standard is the “reasonableness” standard requiring evidentiary support. Later, the “rational basis” standard was applied to uphold New Deal economic regulations similar to others that had previously been struck down under the “reasonableness” standard. Rational basis review did not require the evidentiary support or the Reasonableness standard, but was upheld if any “rational basis” could be imagined without evidence – the brainchild of the progressives of that time.

Frustrating beyond what I thought possible. As Scott Jennings said last night , any one of a mere 300 Federal Circuit courts judges cannot be allowed to halt the entire Executive Branch who oversees these agencies or 77 million voters. Having said that, if these delays are short in nature until a judge can hear arguments from both sides , then Trump should play this out in the conventional way. A few weeks at most is survivable. But if, as I suspect, these Federal Judges have other motives, then it may indeed be time for a “Constitutional Crisis.” It seems astounding to me that with all 3 branches of government reasonably pushing in one direction , along with the will of the electorate that change can be thwarted this easily. While I dont look forward to us having to fight this battle , it is quickly appearing inevitable.
I used to think judges were appointed because of their legal knowledge. Now I think they are mostly appointed for political reasons.
