One striking anecdote emerges from Special Counsel Robert Hur’s voluminous 300 plus page report on Biden’s misappropriation of classified documents.
In interviews with Biden, the Special Counsel found that the memory of the President of the United States had “significant limitations” and that he didn’t know “when his term ended”, “when his term began” and “did not remember, even within several years, when his son Beau died.”
If there are any two things that a man ought to remember, it’s when his son died and when he ascended to the vice presidency and when he became a private citizen again.
Now a man so far gone that he does not know either one has his finger on the nuclear button.
There have been many defenses of Biden’s state made in the past. We have been told that he misspeaks because he has a problem with stuttering or that he’s prone to making up stories, but neither one explains the sheer scale and persistence of the problem which extends well beyond confusing deceased former German chancellor Helmut Kohl and former chancellor Angela Merkel or former French president François Mitterrand and Emmanuel Macron, the sitting president, as he did this week, which might be understandable if that was all there was to it.
Biden is forgetting things that no normal person in their right state of mind loses track of.
The investigation which began when boxes of classified documents were found including “in a badly damaged box in the garage, near a collapsed dog crate, a dog bed, a Zappos box, an empty bucket, a broken lamp wrapped with duct tape” in Biden’s possession ends on a more troubling note than wilful abuses. Instead the report paints a picture of a politician used to mishandling classified information whose decline is such that he doesn’t know what he’s doing.
Some of the documents at the heart of the case were, the report concludes, possibly taken to be used to compile Biden’s presidential campaign memoir, “Promise Me, Dad” which used his son, Beau Biden’s death, as a springboard.
The Special Counsel reviewed recordings with Mark Zwonitzer, Biden’s ghostwriter on the book, and noted that, “Mr. Biden’s memory also appeared to have significant limitations-both at the time he spoke to Zwonitzer in 2017, as evidenced by their recorded conversations, and today, as evidenced by his recorded interview with our office. Mr. Biden’s recorded conversations with Zwonitzer from 2017 are often painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries.”
This was Biden’s state 7 years ago. What is it like now?
“In his interview with our office, Mr. Biden’s memory was worse. He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 – when did I stop being Vice President?’), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?’). He did not remember, even within several years, when his son Beau died.”
This is not a new problem. In public appearances, Biden claimed that Beau, “lost his life in Iraq” when he had actually died of cancer in Maryland. Then he said it again, “I’m thinking about Iraq because that’s where my son died.” While Biden has a long history of lying and making up stories, based on the Special Counsel’s interview, it would seem as if Biden really doesn’t know.
The report goes on to reject charges because, among other things, “Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory” and it “would be difficult to convince a jury that they should convict him-by then a former president well into his eighties-of a serious felony that requires a mental state of willfulness.”
This is less an exoneration than an exemption on the grounds of senility. And it raises constitutional questions beyond Biden appropriating classified documents for his memoir.
If Joe Biden lacks the mens rea to be convicted of a crime, how can he have the intent or the state of mind to give orders that must be followed? Can a man who no longer knows when he was in office as vice president be qualified for the presidency? And can a man who has lost track of some of the most important dates in his life be able to make life and death decisions?
The impossible paradox is that Biden lacks the state of intent to be charged with a crime, but has enough intent to be able to run the entire country. And that obviously does not work.
It’s been difficult to pin down in the past whether Biden is lying or making a gaffe. This is after all the politician who claimed to have come out of the black church, to have marched for civil rights, and, among many other crazy lies, “I used to drive an 18-wheeler, man.” It can be hard to tell whether a politician is a shameless liar or senile, but there is now an unbiased legal observer telling us that Biden really does not know, does not remember and cannot be held responsible.
Unlike the calls to bring in the 25th Amendment against Trump, this is a legitimate scenario, but no one in the Biden administration is likely to invoke the 25th because, apart from Kamala, they would all lose their jobs, and they would rather try to prop Biden up than to protect the country.
Some would say that in an election year, Biden’s fate is in the hands of the voters. The Founding Fathers did not introduce any such qualification test or removal protocol even though across the ocean, King George III, their original nemesis was losing his mental faculties.
In 1811, the British Parliament imposed its own version of the 25th Amendment through the Regency Act, sidelining George in favor of the Prince of Wales. While these events postdated the Constitutional Convention, the Founders were certainly aware of the possibility as there had been plenty of cases of madness among the inbred crowned heads of Europe, but they did not act likely because they knew that, as a counter-example, heads of state had been removed on false charges of madness and they wanted to avoid the possibility of a coup taking place.
Even the much later 25th Amendment had been more about streamlining the process of succession in the event of a presidential death than removing an unfit president. Congress had plenty of earlier opportunities to address presidential incapacity such as when President James Garfield had spent months slowly dying of medical malpractice after his assassination or after President Woodrow Wilson’s stroke which saw his wife running the country, but did nothing.
But one reason for the 25th Amendment was that there was a vast increase in presidential powers and in the instantaneous consequential decisions that may need to be made at any moment between the Constitutional Convention, the Garfield assassination, Wilson’s stroke and the JFK assassination. Having an incapacitated president was not the end of the world in 1881 or 1919, but by 1967, the president was the man who could destroy the world with a word.
And that is where we are now.
Joe Biden is being tasked with making major decisions while being mentally unfit. This is no longer a political smear or a late night comedian’s joke, it’s the observed reality in a Special Counsel’s report. The president is senile and a constitutional crisis is upon us.

Surely it isn’t their job to anticipate what the accused’s lawyer might say in court? Isn’t it their function to determine whether a crime has taken place, and if so, to lay charges against the perpetrator?
Also: Could this not just be a ploy by the same corrupt machine, so that “the other side” demands Old Yeller is put down, and they don’t have to do it themselves? Because they want Old Yeller out, and someone else in place before the election? In short – this is a ploy so that other people will do their dirty work for them?
Also: Is there any legislation stating that anyone over a certain age cannot be held accountable for their actions? If so, what is the age? Because Trump isn’t that far off – does this age lie between that of Trump but before that of Biden? If so – all Trump needs to do is hang on until that legal age-line passes and the same DOJ that let Old Yeller off will have to let DT off as well.
What a laughing stock America is right now. All around the world, people are laughing at them. Not just for having this joke as Pres but for their inability to do anything about it.

Biden cannot be charged at the present time because he’s the sitting President. The basic reason why his puppet masters don’t want an official finding (short of an indictment) that he broke the law is because it doesn’t suit their purpose, which is maintaining power at all costs, and they don’t want to risk his possible defeat by Trump in November. Thus the point here is, as you surmised, to remove him as presumptive nominee, but whether they plan to do this by first removing him from office is not clear.
If they go that route, they would require the cooperation of Harris and Congressional Republicans and would then have to either run with Harris or else double-cross her at the nominating convention. The only other path I can see is to use Hur’s report as the basis to rig the convention without having to deal with an Acting President Harris. Whom they would substitute for Harris is not yet clear – I’m sure you’ve seen the speculations regarding Michelle Obama and others.
As for Trump, they have no intention of allowing him to escape their vicious persecution. In his report, Hur went to great pains to attempt to distinguish between his case and Biden’s, rather unconvincingly. To answer your question, no, there is no set age beyond which a defendant in a federal prosecution is considered incompetent to stand trial, and Trump will not attempt to raise any such defense.

If Reason, Facts, Logic, and Truth mattered to them–which clearly they don’t, at all–they would recognize, and admit (at least among one another) that there are just two, mutually exclusive, Choices:
(1) Either Biden goes to prison for his many well-documented, thoroughly proved, and utterly undeniably serious crimes; or
(2) He is adjudicated “a clear and present danger to himself and others”–i.e. to the United States–ruled “Not guilty by reason of Insanity,” and involuntarily committed, for life, to a secure Alzheimer’s Ward (the kind with keypad locks on every door, and 24/7 “care” and restraint).
Those are the only possibilities.
His “age” isn’t, by itself, the Issue–Donald Trump is just a few years younger, but is always clear-headed, fully coherent and has a totally sharp mind and perfect faculties.
And in stark contrast to Biden, President Trump has never hidden or fled from journalists (nor ever had any Handler yanking him away from them)–often standing, impromptu, for more than an hour responding directly and candidly (without notes!) to their hostile, sneering, “gotcha!” questions when they’d ambush him as he walked across the lawn to Marine One.
No; it’s not Biden’s age that’s worrisome; it’s his lifelong corruption, and his obviously accelerating senile insanity, that make him unfit, and that are a direct, lethal threat to our survival as a constitutional republic.

Daniel’s conclusion, that a crisis is upon is, is certainly correct, but there are two points that require further consideration: (1) in his report, SC Hur took pains to attempt to distinguish Biden’s possession of sensitive materials from Trump’s in order to justify the latter’s persecution by the Democrats’ DOJ. Although unconvincing to anyone armed with the facts of both cases, which are too complicated to get into here, this does prove that Hur is doing the Democrats’ business and is in no way, shape or form an “independent” counsel – if anyone had any doubts about that.
(2) More seriously, it also means the powers behind Biden have apparently decided to abandon him and go with another candidate in the fall, because they would not have allowed Hur to make this report otherwise. No doubt this is due to Biden’s refusal to step down voluntarily, and many writers have speculated that this would happen, but now we know for sure – Biden is out. What these sinister people intend to do once Biden is gone is now a critical question.
And more: how does our side, misrepresented as it is by the Republican Party, respond? Do Congressional Republicans go along with Democrats to get the necessary 2/3 vote in both Houses to remove Biden if, as is likely, he disputes the findings of his own cabinet officers and Kamala Harris that he is unfit (which is equally likely since they are also taking orders from above)?
If Republicans side with Biden to keep him in office, they will look like hypocritical opportunists; if they vote along with the Democrats, Harris becomes Acting President and the Dems will nominate (without consulting their voters, of course) the candidate they think most likely to defeat Trump in the fall. Smarter people than the Republican “leadership” would find this a nasty dilemma indeed.

Your point about Harris’ own incompetency is one I forgot to raise in my post, and it’s important. Either the Puppet Masters have got some scheme to shunt her aside once Biden has been removed from office (with her help!) or else the plan is not to invoke the 25th Amendment at all but rather to allow that senile excrescence to serve out his term while replacing him through behind-the-scenes machinations at the Democrat Convention. I suppose we’ll know which when we see whether Harris and the cabinet attempt to invoke the 25th or not.

I don’t think the 25th is even a consideration. The puppet master plans to rid themselves of Biden will/have been made behind the scenes. Those standing in the way will be afforded offers they can’t refuse. This is hardball at its worst. What the public will be allowed to see is not what’s really going on. Biden’s announcement to step down will be made with a gun pointed at his head.

Just FYI: the reason Biden’s current mental state is relevant because, as a general rule, the courts will not allow a prosecution to proceed where a defendant is so demented he cannot meaningfully participate in his own defense. In other words, it’s not enough that a demented man would of course have counsel to defend him; he must be able to, for example, make decisions when counsel presents him with alternative strategies for his defense.
And as much as Biden deserves to be imprisoned, I believe (1`) that he is too demented to stand trial, and (2) that it’s more important right now to drive a spear through the heart of the Democrat Party than to fit creepy old Biden for an orange jumpsuit.

The Biden administration has been in a constitutional crisis ever since the President betrayed his vows to protect and defend the country from both domestic and foreign enemies via his open borders policy. Yet this man who would have his driver’s license legally revoked, can still be the President with the authority over America’s military and nuclear weapons?
