A nation of leftists, not laws.
The University of California regents, saying they support an equitable education for all, unanimously agreed Thursday to find a pathway to enact a bold policy to hire students who lack legal status and work permits.
Bold, that is to say boldly illegal.
The Immigration Reform and Control Act is very clear on the matter.
§ 1324a. Unlawful employment of aliens
(1) In general It is unlawful for a person or other entity— (A) to hire, or to recruit or refer for a fee,
for employment in the United States an alien knowing the alien is an unauthorized alien
Which part of this is confusing?
“A novel theory developed by UCLA law scholars argues that the federal law does not specifically include states — or UC, as a state entity — in its language establishing employer sanctions and therefore does not apply to them.”
Federal law doesn’t include states? Big, if true.
So can everyone start disregarding federal law now? Or just lefties who want to open the border?
“The regents voted to form a working group to examine that legal issue, along with practical considerations about how to roll out a policy that is already igniting controversy.”
Ideally,
1 Enact the policy
2 Knowingly hire illegal aliens
3 Go to jail when Republicans take the White House
Obviously, the plan is to fake a challenge while the Biden DOJ will conspire to throw the case and announce that from now on it’s legal to hire illegal aliens because, well what was the legal rationale for DACA? It’s mean not to?
So what’s the exciting legal theory.
“But scholars at the Center for Immigration Law Policy at the UCLA School of Law last year crafted a new legal analysis arguing that the federal law did not apply to states because it doesn’t mention them. A memo signed by 29 immigration and constitutional scholars argued that before the 1986 law, the U.S. Supreme Court ruled that if Congress wanted to change the balance between federal and state power by regulating an area under traditional state control, it must do so with unmistakably clear language.”
Sure. Now let’s apply that to all legislation that does not specifically mention states.
The legal theory here is that when the law stated that, ” It is unlawful for a person or other entity— (A) to hire, or to recruit or refer for a fee, for employment in the United States”, it didn’t mean the states, just possibly Capitol Hill. Or maybe overseas bases.
But I like how enforcing the law on illegal aliens veers randomly from a purely federal to a purely state matter depending on which interpretations lets leftists flood the country with illegal aliens at any given time.
Anyway, UC’s regents created this nightmare by going woke. Now they should personally expose themselves to full legal sanctions and penalties by openly employing illegal aliens. Going to prison will be a small price to pay for equity.

That’s one thing I learned during my time there. Even the staff have no idea what the rules are. When they want to do something, they just look through them and find some excuse to do what they want to do anyway. And noone stops them.
Or maybe they don’t even check the rules at all.

What does it take to charge them?

A willingness to comply with existing law.

Well its the UC system after all, so not surprising. And the woke students won’t object when they see their work-study jobs disappear because DEI.

I had a F1 visa (foreign student visa), which was obviously a hassle to live under. However is was very easy for everybody to follow the rules.

This is just another example of why America is in a state of decline.
