“Deeply problematic”. All the best Tumblr experts question the deeply problematic (and probably ableist and transphobic) decision to follow elementary civil rights protocol.
The DOJ’s position is that no special master is needed because a DOJ run by the political opposition which had previously been caught breaking rules to target Trump can be trusted to review privileged documents.
A special master is an independent party. He or she is not the court of final opinion. We’re talking about someone who’s going to go through the seized materials and determine what is protected by attorney-client and then executive privilege.
The Biden DOJ’s argument that this would undermine national security is ridiculous. Anyone chosen for this role would need high-level clearance.
Furthermore, the Biden DOJ could always appeal whatever the special master recommends be treated as privilege.
What is freaking out the media is that they might lose out on some of the feeding frenzy. This isn’t an investigation, it’s a witch hunt. And the goal is to win by any means.
Secondly, the judge ruled that a special master would take a position on executive privilege. The Biden administration, its DOJ operatives and the Democrat media have been howling that there’s no executive privilege here.
That is what really has them afraid.
