“If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.”
18 U.S. Code § 2384 – Seditious conspiracy
The 25th Amendment was passed to protect the chain of succession in the event of medical disability following Eisenhower’s heart attack and JFK’s assassination. It has nothing to do with removing a president for political reasons.
That’s what impeachment is for.
Within a few years, talk of using the 25th Amendment to remove President Trump went from a lefty social media fantasy to a policy that every single House Democrat just voted for.
Along with one Republican.
This isn’t even about the current situation. The Constitution provides a clear remedy for removing a president. There is no provision whatsoever for having cabinet members, a non-existent constitutional body, remove a president. That is not what the 25th Amendment was for either.
Despite that, 222 House Democrats and one Republican, Rep. Kinzinger voted for a seditious resolution calling on officials to remove President Trump.
That’s a seditious conspiracy. A vote for the resolution isn’t just a vote against President Trump. It’s a vote against the Constitution and a vote to have officials override the voters when the Constitution clearly only believes that legislative bodies have the power to remove the president. It’s grotesque, insane, and illegal.
Protesting Congress is not sedition. (Attacking Congress by force is.) President Trump did not call for sedition. The House Democrats just did.
